<official-title display="yes">To amend the Elementary and Secondary Education Act of 1965 to direct local educational agencies to release secondary school student information to military recruiters if the student’s parent provides written consent for the release, and for other purposes.</official-title>

<section display-inline="no-display-inline" id="H23A43A2A132048B6B68A56C9B450FC3C" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Student Privacy Protection Act of 2009</short-title></quote>.</text> </section>
<section id="HCCA96A72355D46CF86DF6327855B1621"><enum>2.</enum><header>Access by military recruiters to secondary school student information</header> 
<subsection id="H93B277D010B642438335462C82AFAFE3"><enum>(a)</enum><header>Amendments</header><text>Section 9528 of the <act-name parsable-cite="ESEA">Elementary and Secondary Education Act of 1965</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/20/7908">20 U.S.C. 7908</external-xref>) is amended—</text> 
<paragraph id="H0C0AC08E4CCB4044A65A2531622AE3E0"><enum>(1)</enum><text>by redesignating subsections (a) through (d) as subsections (b) through (e), respectively;</text> </paragraph>
<paragraph id="H09AF8ACC9191442C9B973A5FCF177D94"><enum>(2)</enum><text>by inserting before subsection (b) (as so redesignated) the following:</text>

<subsection id="H3C79ACDD5D1E43AF86493E21F7DF70E8"><enum>(a)</enum><header>Military Recruiters</header> 
<paragraph id="H7FCC6492C6F2425C9E0855ADC8B3F354"><enum>(1)</enum><header>Access to student recruiting information</header><text>Notwithstanding <external-xref legal-doc="usc" parsable-cite="usc/10/503">section 503(c)</external-xref> of title 10, United States Code, each local educational agency receiving assistance under this Act shall provide, on a request made by military recruiters, access to the name, address, and telephone listing of each secondary student served by the agency if the parent of the student involved has provided written consent to the agency for the release of such information to military recruiters.</text> </paragraph>
<paragraph id="HC7CFAABF959D4F599B9E188F0A86A7C6"><enum>(2)</enum><header>Notice; opportunity to consent</header><text>A local educational agency receiving assistance under this Act shall—</text> 
<subparagraph id="H691A431CD39D4F159977403FC99E29E1"><enum>(A)</enum><text>notify the parent of each secondary school student served by the agency of the option to consent to the release of the student’s name, address, and telephone listing to military recruiters; and</text> </subparagraph>
<subparagraph id="H9120DF8795764DDE8F758743B3F94ECF"><enum>(B)</enum><text>give the parent an opportunity to provide such consent in writing.</text> </subparagraph></paragraph></subsection><after-quoted-block>;</after-quoted-block></quoted-block> </paragraph>
<paragraph id="HB6383D543ABA41A1B39391E6D4F267DE"><enum>(3)</enum><text>in subsection (b) (as so redesignated)—</text> 
<subparagraph id="H80519A8274F44011AFFAB48E9BE6EF88"><enum>(A)</enum><text>by striking <quote><header-in-text level="subsection">Policy</header-in-text>.—</quote> and inserting <quote><header-in-text level="subsection">Institutions of Higher Education</header-in-text>.—</quote>; and</text> </subparagraph>
<subparagraph id="H17BD05E39DD84F17AAE917BD58BCE6C3"><enum>(B)</enum><text>in paragraph (1), by striking <quote>military recruiters or</quote>; and</text> </subparagraph></paragraph>
<paragraph id="H95F9D05CF6154ED185C617A81CD232A1"><enum>(4)</enum><text>by transferring paragraph (3) of subsection (b) (as so redesignated) from the end of such subsection to the end of subsection (a) (as added by paragraph (2)).</text> </paragraph></subsection>
<subsection id="H5B035C88803C4D0D85016EB1F00893B4"><enum>(b)</enum><header>Application</header><text>The amendments made by this Act apply only with respect to school years beginning after the date of the enactment of this Act.</text> </subsection></section>
