R. 3791</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action><action-date date="20131219">December 19, 2013</action-date><action-desc><sponsor name-id="F000043">Mr. Fattah</sponsor> introduced the following bill; which was referred to the <committee-name committee-id="HWM00">Committee on Ways and Means</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Internal Revenue Code of 1986 to provide an above-the-line deduction for health insurance premiums.</official-title></form><legis-body id="H3661FABC91F64B508E20BF6D576A32D5" style="OLC"><section id="H203B4088D85E4663BCECE3C51597B0D7" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Health Premium Parity Act</short-title></quote>.</text></section><section id="H9A52AF07F70A49F8BDCA388B01D94EB0"><enum>2.</enum><header>Deduction for health insurance premiums</header><subsection id="H6D1302CDED6C407EA54E8E0B5834036E"><enum>(a)</enum><header>In general</header><text>Part VII of subchapter B of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/26/1">chapter 1</external-xref> of the Internal Revenue Code of 1986 (relating to additional itemized deductions for individuals) is amended by redesignating section 224 as section 225 and by inserting after section 223 the following new section:</text><quoted-block id="HFD56CFD5E0F34C33A6515CA0759A73AD" style="OLC"><section id="H1D25D5FA54A84C34AEF09588B98E48B4"><enum>224.</enum><header>Health insurance premiums</header><subsection id="H678153D2C1F8461F8E1489774E0D8557"><enum>(a)</enum><header>In general</header><text>In the case of an individual, there shall be allowed as a deduction an amount equal to the amount paid during the taxable year for insurance which constitutes medical care for—</text><paragraph id="H45A63F89E137478FA3EC3F7EA2FFD67B"><enum>(1)</enum><text>the taxpayer,</text></paragraph><paragraph id="HE9A24BACE7194F658677EDCD63E6874E"><enum>(2)</enum><text>the taxpayer’s spouse,</text></paragraph><paragraph id="H6F7E4F565FD846CC8021CFF86FDFC777"><enum>(3)</enum><text>the taxpayer’s dependents, and</text></paragraph><paragraph id="H4EFD54F2F5F94E97B120B0C88C1B0E35"><enum>(4)</enum><text>any child (as defined in section 152(f)(1)) of the taxpayer who as of the end of the taxable year has not attained age 27.</text></paragraph></subsection><subsection id="HABAEEFF51CB3411A80D7240F4CBA6616"><enum>(b)</enum><header>Limitation on other coverage</header><paragraph id="HBD10114CD42F41ACBA9D4393EC96B0B5"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Subsection (a) shall not apply to any taxpayer for any calendar month for which the taxpayer is eligible to participate in any subsidized health plan maintained by any employer of the taxpayer or of the spouse of, or any dependent, or individual described in subsection (a)(4) with respect to, the taxpayer. The preceding sentence shall be applied separately with respect to—</text><subparagraph id="HBE125B96737342C6A7062F56468AC6CF"><enum>(A)</enum><text>plans which include coverage for qualified long-term care services (as defined in section 7702B(c)) or are qualified long-term care insurance contracts (as defined in section 7702B(b)), and</text></subparagraph><subparagraph id="HF9598FA7313345C0AAFB14815F2D252B"><enum>(B)</enum><text>plans which do not include such coverage and are not such contracts.</text></subparagraph></paragraph><paragraph id="HA640739DF5DD44579CCCD37616584F49"><enum>(2)</enum><header>Long-term care premiums</header><text>In the case of a qualified long-term care insurance contract (as defined in section 7702B(b)), only eligible long-term care premiums (as defined in section 213(d)(10)) shall be taken into account under subsection (a).</text></paragraph></subsection><subsection id="H6BCDDCCD65794F0D9D698261D0FB6224"><enum>(c)</enum><header>Coordination with medical deduction, etc</header><text>Any amount paid by a taxpayer for insurance to which subsection (a) applies shall not be taken into account in computing the amount allowable to the taxpayer as a deduction under section 213(a). Any amount taken into account in determining the credit allowed under section 35 or 36B shall not be taken into account for purposes of this section.</text></subsection><subsection id="HF71D8672BB85426EA4EE35E8E7CC9EEA"><enum>(d)</enum><header>Deduction not allowed for self-Employment tax purposes</header><text>The deduction allowable by reason of this section shall not be taken into account in determining an individual’s net earnings from self-employment (within the meaning of section 1402(a)) for purposes of chapter 2.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H95187BEC1DA9484CA523C3AC667BEE37"><enum>(b)</enum><header>Deduction allowed whether or not taxpayer itemizes deductions</header><text>Subsection (a) of section 62 of such Code is amended by inserting before the last sentence the following new paragraph:</text><quoted-block id="H80B9E99688E543ED87E13FF698D0B192" style="OLC"><paragraph id="HD13300E10CC74AE18BF4C779D56D6B6E"><enum>(22)</enum><header>Health insurance premiums</header><text>The deduction allowed by section 224.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H48E5067351AF47A3901D0936F132C521"><enum>(c)</enum><header>Conforming amendments</header><paragraph id="H929A78495E894CD29043990BB00DE3AD"><enum>(1)</enum><text>Section 162 of such Code is amended by striking subsection (l).</text></paragraph><paragraph id="H90C24B0BEB0E43D8AD1B458E42DF1904"><enum>(2)</enum><text>The table of sections for part VII of subchapter B of chapter 1 of such Code is amended by redesignating the item relating to section 224 as an item relating to section 225 and inserting before such item the following new item:</text><quoted-block display-inline="no-display-inline" id="H2C1C12E8FFA14C88B9CD36B3420470E3" style="OLC"><toc container-level="quoted-block-container" idref="HFD56CFD5E0F34C33A6515CA0759A73AD" lowest-bolded-level="division-lowest-bolded" lowest-level="section" quoted-block="no-quoted-block" regeneration="yes-regeneration"><toc-entry idref="H1D25D5FA54A84C34AEF09588B98E48B4" level="section">Sec. 224. Health insurance premiums.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="HAD40EFB3D55F40159528297C0CE08522"><enum>(d)</enum><header>Effective date</header><text>The amendments made by this section shall apply to taxable years beginning after December 31, 2013.</text></subsection></section></legis-body></bill>
