which was referred to the <committee-name committee-id="HGO00">Committee on Oversight and Government Reform</committee-name>, and in addition to the Committee on <committee-name committee-id="HIF00">Energy and Commerce</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title>To provide for a reduction in the pay of the Secretary of Health and Human Services until the healthcare.gov Web site is certified as fully functional.</official-title></form><legis-body id="H50C19D2160EF4D7F86416D92332EB755" style="OLC"><section id="H31737568C8E4490B9B73FBC0ED54EF5E" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Government Lacks Insight To Choose Health Act</short-title></quote> or the <quote><short-title>GLITCH Act</short-title></quote>.</text></section><section id="HB2E98B4F1FBA43F6AA90AE8965E3F2F1"><enum>2.</enum><header>Reduction in pay of the Secretary of Health and Human Services until healthcare.gov Web site is fully functional</header><subsection id="HFF7B45E7647C44D09DF21715A081AF91"><enum>(a)</enum><header>Pay reduction</header><paragraph id="HE0045B83C1A04EBBB77FE2C5117CED2F"><enum>(1)</enum><header>In general</header><text>Notwithstanding any other provision of law, the rate of basic pay payable to the Secretary of Health and Human Services shall be equal to—</text><subparagraph id="H0532B4F6B4BE46AE9AF29020AA219D74"><enum>(A)</enum><text display-inline="yes-display-inline">for each month ending during the pay reduction period, the rate that would otherwise apply if this Act had not been enacted, reduced by the applicable percentage; and</text></subparagraph><subparagraph id="HBFEF436BE9054162BD26CA9096114F2E"><enum>(B)</enum><text>for each month ending after the pay reduction period, the rate that would otherwise apply if this Act had not been enacted.</text></subparagraph></paragraph><paragraph id="HFC81F4B9D01341B0906F5460751E4BD0"><enum>(2)</enum><header>Applicable percentage</header><text>For purposes of paragraph (1), the applicable percentage is—</text><subparagraph id="H6882244B198343E1B40076460CE612A8"><enum>(A)</enum><text>for the first month ending during the pay reduction period, 5 percent; and</text></subparagraph><subparagraph id="HDDB6A8B2E47747599CBB5211538B1C23"><enum>(B)</enum><text>for each subsequent month ending during the pay reduction period—</text><clause id="H69348694CF254FF08187A4BC64BE036F"><enum>(i)</enum><text>the applicable percentage for the previous month, plus</text></clause><clause id="H7CBD3763C1FA4B4B9BBB3A4AB2B182B3"><enum>(ii)</enum><text>5 percentage points,</text></clause><continuation-text continuation-text-level="subparagraph">except that in no event shall the applicable percentage for any month exceed 100 percent.</continuation-text></subparagraph></paragraph><paragraph id="HF05BEB55A74A48B9A3A57A95D24F31B4"><enum>(3)</enum><header>Pay reduction period defined</header><text>For purposes of this section, the term <term>pay reduction period</term> means the period which—</text><subparagraph id="H69C2C21308124FC890366F2EA83C6F8C"><enum>(A)</enum><text>begins on the date of the first determination under subsection (b) that the healthcare.gov Web site is not fully functional; and</text></subparagraph><subparagraph id="H678593DEC6B94182B3FA420E8E1651BD"><enum>(B)</enum><text>ends on the date of the determination under subsection (b) that the healthcare.gov Web site is fully functional.</text></subparagraph></paragraph></subsection><subsection id="H0FBC68A565974B49A491CDE1682C4EEA"><enum>(b)</enum><header>Certification required that healthcare.gov Web site is fully functional</header><paragraph id="H20A563B9AF994B22936E6686FB8085B3"><enum>(1)</enum><header>Determinations</header><text display-inline="yes-display-inline">Subject to paragraph (2), not later than the 15th of the first month beginning after the date of the enactment of this Act and of each subsequent month, the Comptroller General of the United States shall determine, in such manner and in accordance with such criteria as specified by the Comptroller General if the healthcare.gov Web site is fully functional and submit to the Congress such determination.</text></paragraph><paragraph id="HD0547297E05F4DCFAFF026E4712CA866"><enum>(2)</enum><header>Certification</header><text>Determinations under paragraph (1) shall cease after the date on which the Comptroller General of the United States certifies to the Congress that the healthcare.gov Web site is fully functional.</text></paragraph></subsection></section></legis-body></bill>
