<official-title>To direct the Secretary of Agriculture, in consultation with Indian tribes, to make grants, competitive grants, and special research grants to, and enter into cooperative agreements and other contracting instruments with, eligible entities to conduct research and education and training programs to protect and preserve Native American seeds, and for other purposes.</official-title>

<section id="H7EE94742F8CA42D7B942EBD3823F58AE" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Native American Seeds Protection Act of 2013</short-title></quote>. </text></section> 
<section id="H6C8E4C1CFFE84FD6A8CAF3F6C05DC814"><enum>2.</enum><header>Research grants for purposes of protection and preservation of Native American seeds</header> 
<subsection id="H695B9B7F3CCA48A09D2AAD40EEA7C188"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Subtitle C of the National Agricultural Research, Extension, and Teaching Policy Act of 1977 (<external-xref legal-doc="usc" parsable-cite="usc/7/3151">7 U.S.C. 3151 et seq.</external-xref>) is amended by adding at the end the following new section:</text> 
<quoted-block style="OLC" id="H722BF62CE3CF420BAE95830BBFFA4702" display-inline="no-display-inline"> 
<section id="H89FA37FC8A404CC09682AE0E3945AA7C"><enum>1419C.</enum><header>Research grants for purposes of protection and preservation of Native American seeds</header> 
<subsection id="H38B8E1CE9B154944B51E110B044D96BE"><enum>(a)</enum><header>Authority</header><text display-inline="yes-display-inline">Consistent with this section, the Secretary may make grants, competitive grants, and special research grants to, and enter into cooperative agreements and other contracting instruments with, eligible entities to conduct research and education and training programs that are objective, operationally independent, and external to the Federal Government and that concern the purity of Native American seeds (as defined by the Secretary, in consultation with Indian tribes).</text></subsection> 
<subsection id="H5B6FDB3D6F9C4B6FA462429EEBF46C63"><enum>(b)</enum><header>Cooperation required</header><text display-inline="yes-display-inline">Grant applications submitted by an eligible entity under this section shall certify that the research to be conducted will be performed under a cooperative agreement with at least one other qualified research entity.</text></subsection> 
<subsection id="H1470B579AF7A4422929645D2622815FB"><enum>(c)</enum><header>Activities</header><text display-inline="yes-display-inline">Under this section, funding may be provided to conduct—</text> 
<paragraph id="HBE872CE8C660433EB14A5179D6F25597"><enum>(1)</enum><text display-inline="yes-display-inline">research to assess the direct and indirect impacts of—</text> 
<subparagraph id="H78D57DD2B40B452F95CEA023CFAB64BD"><enum>(A)</enum><text display-inline="yes-display-inline">public law and policies on traditional ways of life and cultural practices relating to the harvesting and cultivating of Native American seeds; and</text></subparagraph> 
<subparagraph id="HCF4D5E9BA4EF4FBAB791446F8324DF91"><enum>(B)</enum><text display-inline="yes-display-inline">contaminants that compromise the integrity and purity of Native American seeds; and</text></subparagraph></paragraph> 
<paragraph id="H144BFD9D2793487595EEEA82E8E2D726"><enum>(2)</enum><text display-inline="yes-display-inline">education and training programs on—</text> 
<subparagraph id="H56DE766DAB7B42CBB43CDF8619A13E5A"><enum>(A)</enum><text>the methods necessary to conduct the research described in paragraph (1); and</text></subparagraph> 
<subparagraph id="H2A48E15E12354C5EB6073AF2333CF228"><enum>(B)</enum><text>the best methods to continuously test, monitor, and otherwise protect the purity of Native American seeds.</text></subparagraph></paragraph></subsection> 
<subsection id="HD9FBC9777F3442CF8A48F48F7E08E3A0"><enum>(d)</enum><header>Report</header><text display-inline="yes-display-inline">Beginning not later than one year after the date of the enactment of this section, and each year thereafter, the Secretary shall submit to the Committee on Agriculture of the House of Representatives and the Committee on Agriculture, Nutrition, and Forestry of the Senate a report that contains—</text> 
<paragraph id="HB6F66C1AF98349CEACAA3C3F83FBB621"><enum>(1)</enum><text>the results of any research conducted under this section;</text></paragraph> 
<paragraph id="HADDC9EF7AABB4F63B045160D2AB34D5E"><enum>(2)</enum><text display-inline="yes-display-inline">the effectiveness of any education and training programs conducted under this section in enabling eligible entities to ensure the purity of Native American seeds; and</text></paragraph> 
<paragraph id="H4923031ABDFF4651B699DD19CACA7A5B"><enum>(3)</enum><text>any recommendations of the Secretary to improve the effectiveness of such education and training programs.</text></paragraph></subsection> 
<subsection id="H838E81522FFB41229809370CE52DF19D"><enum>(e)</enum><header>Definitions</header><text>In this section:</text> 
<paragraph id="HC801ED4299E646F8B1FD084C6373C96D"><enum>(1)</enum><header>Eligible entity</header><text>The term <quote>eligible entity</quote> means—</text> 
<subparagraph id="HED7EB0EE1D4E45AA8FA640DAC6E16C70"><enum>(A)</enum><text>a 1994 Institution (as defined in section 532 of the Equity in Educational Land-Grant Status Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/7/301">7 U.S.C. 301</external-xref> note)); or</text></subparagraph> 
<subparagraph id="H5343DF14E5604B42A70F8166E19C06F6"><enum>(B)</enum><text>an Indian tribe.</text></subparagraph></paragraph> 
<paragraph id="HFFA95440B758499986C58A6B4B425ED8"><enum>(2)</enum><header>Indian tribe</header><text display-inline="yes-display-inline">The term <quote>Indian tribe</quote> has the meaning given such term in section 4 of the Indian Self-Determination and Education Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/25/450b">25 U.S.C. 450b</external-xref>).</text></paragraph> 
<paragraph id="H550F37B0FF78470C8F59D64984AA4DF7"><enum>(3)</enum><header>Qualified research entity</header><text display-inline="yes-display-inline">The term <quote>qualified research entity</quote> means an entity with a demonstrated capacity and infrastructure necessary to carry out agricultural research projects, including—</text> 
<subparagraph id="H56B29BAEC2B6456785E89D8DD6024FFF"><enum>(A)</enum><text>a State agricultural experiment station;</text></subparagraph> 
<subparagraph id="HA7C8C3EFC26540C19A06FE1A7721C2D8"><enum>(B)</enum><text>a college or university (including a 1994 Institution);</text></subparagraph> 
<subparagraph id="HA0C9A4E379E848259D1F401E2C57FAC5"><enum>(C)</enum><text>another research institution or organization;</text></subparagraph> 
<subparagraph id="H486AF35698C1465EAA5428F9C036B4D9"><enum>(D)</enum><text>a private organization;</text></subparagraph> 
<subparagraph id="HC5C9232F21624C38A4B3C0913B7C733E"><enum>(E)</enum><text>a corporation; or</text></subparagraph> 
<subparagraph id="H69A1AB1BFA8A4DBF89956ACB8A2A4895"><enum>(F)</enum><text>an individual.</text></subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H745AC03A8DC544BE8D39056AED97215A"><enum>(b)</enum><header>Regulations</header><text display-inline="yes-display-inline">Not later than 180 days after the date of the enactment of this Act, the Secretary shall issue regulations to carry out section 1419C of the National Agricultural Research, Extension, and Teaching Policy Act of 1977, as added by subsection (a), including regulations to define the term <quote>Native American seed</quote> as specified in subsection (a) of such section 1419C. </text></subsection></section> 
<section id="H60527580B0C745C2815B114544C58A5C"><enum>3.</enum><header>Developing seed storage facilities to preserve and protect Native American seeds</header><text display-inline="no-display-inline">Section 306 (a)(19)(A) of the Consolidated Farm and Rural Development Act (<external-xref legal-doc="usc" parsable-cite="usc/7/1926">7 U.S.C. 1926(a)(19)(A)</external-xref>) is amended by inserting <quote>, including the expansion, construction, and infrastructure costs associated with developing seed storage facilities that are used to protect and preserve Native American seeds (as defined by the Secretary pursuant to section 1419C of the National Agricultural Research, Education, and Teaching Policy Act of 1977)</quote> before the period at the end.</text></section>
