concerned</action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Outer Continental Shelf Lands Act to authorize the Secretary of the Interior to establish an Ocean Energy Safety Institute, to promote the use of best available and safest offshore drilling technologies, and for other purposes.</official-title></form><legis-body id="H2EBB6675D9F34AC79A59AEBBFE690D6E" style="OLC"><section id="H09C5B140214948B1801DF30F5757599D" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Ocean Energy Safety and Technology Improvement Act of 2013</short-title></quote>.</text></section><section id="H33893D5641AB4E3584CF7612383AEF0E"><enum>2.</enum><header>Priority in permitting for new safety-enhancing technologies</header><subsection id="HFD45F04EEB1042A28000295B9E4B7D23"><enum>(a)</enum><header>Exploration plans and permits</header><text>Section 11 of the Outer Continental Shelf Lands Act (<external-xref legal-doc="usc" parsable-cite="usc/43/1340">43 U.S.C. 1340</external-xref>) is amended by adding at the end the following:</text><quoted-block id="HA34E08684A544C08B4DBF5509F32F640" style="OLC"><subsection id="HADAFF577F89849FF8F2F801D2A81F1FA"><enum>(g)</enum><text display-inline="yes-display-inline">In considering exploration plans and applications for permits and other authorizations required under this section, the Secretary may give priority to reviewing and processing plans and applications that use, develop, or demonstrate new safety-enhancing technologies.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H646B55D0A639430C888F20A542D23EDD"><enum>(b)</enum><header>Development and production plans and permits</header><text>Section 25 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/43/1351">43 U.S.C. 1351</external-xref>) is amended by adding at the end the following:</text><quoted-block id="H287CD73A668045AD80C3A8D30F4432F9" style="OLC"><subsection id="HC633762AE35E451896B919BD54E24246"><enum>(m)</enum><text display-inline="yes-display-inline">In considering exploration plans and applications for permits and other authorizations required under this section, the Secretary may give priority to reviewing and processing plans and applications that use, develop, or demonstrate new safety-enhancing technologies.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="H3B3101E6257443F2A4E3F57D579E33D1"><enum>3.</enum><header>Establishment of a small business program</header><text display-inline="no-display-inline">The Outer Continental Shelf Lands Act (<external-xref legal-doc="usc" parsable-cite="usc/43/1331">43 U.S.C. 1331 et seq.</external-xref>) is amended by adding at the end the following:</text><quoted-block id="H8267582B0F844A18BEE37D019B51BE95" style="OLC"><section id="H967E6EEBD6B84CD1949F16C629451358"><enum>31.</enum><header>Establishment of small business program</header><subsection id="HD1B0F97E3FA3487E9A727F09349F5D86"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary shall establish a small business innovation research program or small business technology transfer program, or both, in accordance with this section to broaden participation by smaller industry participants in the development of safer technologies for offshore oil and gas exploration and development.</text></subsection><subsection id="H36E0B172792F42F6AD9C8217FAB9A151"><enum>(b)</enum><header>Definitions</header><text>In this section each of the terms <quote>small business innovation research program</quote> and <quote>small business technology transfer program</quote> has the meaning given such term in section 9(e) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/638">15 U.S.C. 638(e)</external-xref>), as in effect on the date of the enactment of the <short-title>Ocean Energy Safety and Technology Improvement Act of 2013</short-title>.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="H150964DB5D154A35A84A4151277FFED7"><enum>4.</enum><header>Ocean Energy Safety Institute</header><subsection id="HA7622E448C2144C197D331C4150C03B6"><enum>(a)</enum><header>In general</header><text>The Outer Continental Shelf Lands Act (<external-xref legal-doc="usc" parsable-cite="usc/43/1331">43 U.S.C. 1331 et seq.</external-xref>) is further amended by adding at the end the following:</text><quoted-block id="H32BC1B6812DC4573807F0DF52AF3F723" style="OLC"><section id="HE864442815844B3DA90468B4F1460BAE"><enum>32.</enum><header>Ocean energy safety institute</header><subsection id="H06DF6F8804424797999B62C843A0A30A"><enum>(a)</enum><header>Establishment</header><paragraph id="HA1523C2F01CC47D3B7CAF783BDB75019"><enum>(1)</enum><header>In general</header><text>The Secretary shall establish an independent Ocean Energy Safety Institute (in this section referred to as the <quote>Institute</quote>) to enhance safe and responsible operations across the offshore oil and gas industry.</text></paragraph><paragraph id="H1D6C2CEB917949EDB3710DCA4B50F8A2"><enum>(2)</enum><header>Form</header><text>The Secretary may establish the Institute as—</text><subparagraph id="HDD5A3CBE583D4CF6AF41AB496977CB85"><enum>(A)</enum><text>a federally funded research and development center through an agreement in accordance with Federal Acquisition Regulation 35.017–1; or</text></subparagraph><subparagraph id="HD4BBB52E523D4DA1BA548378EA8962E9"><enum>(B)</enum><text>a university-affiliated research center managed by an institution of higher education.</text></subparagraph></paragraph><paragraph id="H9683BC6386DC49BAB842C50A6149B6F4"><enum>(3)</enum><header>Collaboration</header><text>The Secretary shall ensure that the Institute is a collaborative initiative involving government, academia, and scientific experts.</text></paragraph></subsection><subsection id="HEE7E96225EFB4815BB6229850442AC80"><enum>(b)</enum><header>Functions</header><text>The Institute shall—</text><paragraph id="H1ED1CFA980104BF0BA4160A6C5BF9295"><enum>(1)</enum><text display-inline="yes-display-inline">develop a program of research, technical assistance, and education that serves as a center of expertise in oil and gas exploration, development, and production technology;</text></paragraph><paragraph id="H7B2EAB89A1F9437DB9FC8F1525F34801"><enum>(2)</enum><text>provide a forum for dialogue, shared learning, and cooperative research among academia, government, industry, and other nongovernmental organizations, in offshore energy-related technologies and activities that ensure safe and environmentally responsible offshore oil and gas exploration, development, and production operations;</text></paragraph><paragraph id="H5FEC5FFD63A4470490EA4D44DA29F429"><enum>(3)</enum><text>serve as a technical center that captures and preserves knowledge and experience to improve such operations;</text></paragraph><paragraph id="HDD2E51D3AD5446468569AAF803BBB6B0"><enum>(4)</enum><text display-inline="yes-display-inline">provide recommendations and technical assistance to the Secretary related to the determination of best available and safest technology and environmentally sound offshore oil and gas development practices;</text></paragraph><paragraph id="H9AB1BC98FB954DEABAE016B167743B14"><enum>(5)</enum><text>evaluate design, test protocols, and test results on behalf of the Secretary to certify new best available and safest technologies for such operations that have health, safety, or environment ramifications;</text></paragraph><paragraph id="HD5EA1B3B6F6E4B89B46FBC489ABB5E7E"><enum>(6)</enum><text>facilitate training of Federal workers on identification and verification of best available and safest technology, and implementation of operational improvements, in the areas of offshore drilling safety and environmental protection, blowout containment, and oil spill response;</text></paragraph><paragraph id="HD685559E5DEE45EDACB6BA22F2B9B7E7"><enum>(7)</enum><text display-inline="yes-display-inline">develop and maintain a domestic and international equipment failure reporting system and database of critical offshore oil and gas operations equipment failures related to well control;</text></paragraph><paragraph id="H3489BB006E3640A59A3EF9CE14115398"><enum>(8)</enum><text display-inline="yes-display-inline">provide recommendations and technical assistance related to geological and geophysical sciences relevant to understanding the technical challenges of offshore oil and gas operations; and</text></paragraph><paragraph id="H62CD1F35A1C24961BA2B50F874C59839"><enum>(9)</enum><text>provide knowledgeable independent assessments concerning technology maturity, suitability, and cost.</text></paragraph></subsection><subsection id="HDDEFE676147842A3B9F0DAC8603CCD9A"><enum>(c)</enum><header>Funding</header><paragraph id="H3E8C095B08404EF1BD9A43A1D8FAC96F"><enum>(1)</enum><header>Fee</header><text>The Secretary shall issue regulations to establish an annual nonproducing lease fee with respect to areas of the outer Continental Shelf that are subject to a lease under this Act for production of oil or natural gas under which production is not occurring.</text></paragraph><paragraph id="HF58E671288D2498DA90F7AB533821224"><enum>(2)</enum><header>Application</header><text>Such fee shall apply with respect to land that is subject to such a lease that is in effect on the date final regulations are promulgated under this subsection or that is issued thereafter.</text></paragraph><paragraph id="HFC4B47BA004B4A5094CABFFEDFD6EB73"><enum>(3)</enum><header>Amount</header><text>The amount of the fee shall be $1 for each acre of such land from which oil or natural gas is produced for less than 90 days in a calendar year.</text></paragraph><paragraph id="HA56EF7F6D5BF4D20AF591C6A60E688A2"><enum>(4)</enum><header>Assessment and collection</header><text>The Secretary shall assess and collect the fee established under this subsection.</text></paragraph><paragraph id="H48EC1FF79C2840D1BDD80B76FB15DB64"><enum>(5)</enum><header>Use</header><text>Amounts received by the United States as the fee under this subsection may be used by the Secretary for operations of the Institute.</text></paragraph><paragraph id="H8C1A44962C7C45E3BA2428E330836F6F"><enum>(6)</enum><header>Preventing evasion</header><text>The Secretary may include in the regulations provisions to prevent evasion of the fee.</text></paragraph></subsection><subsection id="H117DD7E485254E38AA2527D6BED65F15"><enum>(d)</enum><header>Reporting and meetings</header><text>The Institute shall provide a report to the Secretary on all Institute activities on a quarterly basis, and conduct an in-person meeting with the Secretary or the Secretary’s designees at least once each year.</text></subsection></section><after-quoted-block>. </after-quoted-block></quoted-block></subsection><subsection id="H579B637E4FEC4D08947FA5AA9AE24DD5"><enum>(b)</enum><header>Deadline for fee regulations</header><text>The Secretary of the Interior shall issue regulations establishing the fee under the amendment made by subsection (a) within 180 days after the date of enactment of this Act.</text></subsection></section></legis-body></bill>
