which was referred to the <committee-name committee-id="HGO00">Committee on Oversight and Government Reform</committee-name>, and in addition to the Committee on the <committee-name committee-id="HJU00">Judiciary</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title>To impose penalties for the unauthorized disclosure of personal tax information by Federal employees.</official-title></form><legis-body id="HF4B3BB40D46E46E287A264149BB1D9E3" style="OLC"><section id="HFB9F776C69204890B20C6C5AEF467A51" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Personal Tax Information Protection Act</short-title></quote>.</text></section><section id="HB253D26120D94B1DA766F9D2BA994BBC"><enum>2.</enum><header>Unauthorized disclosure of personally identifiable covered information</header><subsection id="HA3A5CF4E2B0343AA8D8B624799937400"><enum>(a)</enum><header>Liability for Certain Acts</header><paragraph id="H6EDF1FED85D944FB8DC6AB47EA80CCC8"><enum>(1)</enum><header>In general</header><text>It shall be unlawful for any officer or employee of the United States—</text><subparagraph id="H59B01B702F6C4D67B530707B73C25FB8"><enum>(A)</enum><text>willfully to make an unauthorized disclosure of personally identifiable covered information; or</text></subparagraph><subparagraph id="H7728058130F846B6B233AC89637B22F6"><enum>(B)</enum><text>to conspire to commit a violation of subparagraph (A).</text></subparagraph></paragraph><paragraph id="HA0F2D1DBE0524D32A2346C9A599FDEE7"><enum>(2)</enum><header>Penalty</header><subparagraph id="H200B30A320014144ACD62C52B565A554"><enum>(A)</enum><header>In general</header><text>Any violation of paragraph (1) shall be subject to a penalty of not more than the greatest of—</text><clause id="H2FC90A9D3C484EF7B4E1B69E38BD201B"><enum>(i)</enum><text>the penalty specified in the law setting forth the offense which covers a violation of paragraph (1), or</text></clause><clause id="H3C04DF8662984D6697BB08B4A38B7B63"><enum>(ii)</enum><text>the penalty set forth in subparagraph (B).</text></clause></subparagraph><subparagraph id="HAA9293E4DAA145EFA6176E3695827458"><enum>(B)</enum><header>Uniform penalty</header><text>The penalty set forth in this subparagraph is a felony punishable upon conviction by—</text><clause id="H20FD9B209C2F4455A2B18D177DEEAED4"><enum>(i)</enum><text display-inline="yes-display-inline">a fine in any amount not exceeding $100,000 for each such violation and imprisonment of not more than 7 years,</text></clause><clause id="H62BE564F57834DD798F1467D345F5D4D"><enum>(ii)</enum><text>the costs of prosecution, and</text></clause><clause id="H885471D234C940EEA230F955F698E76C"><enum>(iii)</enum><text>dismissal from office or discharge from employment.</text></clause></subparagraph><subparagraph id="H993AD32E64FE4C15BD5584FD727E9D66"><enum>(C)</enum><header>Forfeiture of annuities and retired pay</header><text display-inline="yes-display-inline">A violation of paragraph (1) shall be treated as an offense to which sections <external-xref legal-doc="usc" parsable-cite="usc/5/8312">8312</external-xref> and <external-xref legal-doc="usc" parsable-cite="usc/5/8432">8432(g)(5)</external-xref> of title 5, United States Code, apply.</text></subparagraph></paragraph></subsection><subsection id="HCD13116F52FB4016A696FA0A37E8393C"><enum>(b)</enum><header>Definitions</header><text display-inline="yes-display-inline">For purposes of this section—</text><paragraph id="HFC8773BC3E0A43FBAE84993EDB56ECAF"><enum>(1)</enum><header>Officer of the United States</header><text>The term <term>officer of the United States</term> means an officer appointed pursuant to <external-xref legal-doc="usc" parsable-cite="usc/5/2104">section 2104(a)(1)(C)</external-xref> of title 5, United States Code.</text></paragraph><paragraph id="H8A367DE89F8247F3B0DDD14AC5987417"><enum>(2)</enum><header>Employee of the United States</header><text>The term <term>employee of the United States</term> means an employee, as defined by <external-xref legal-doc="usc" parsable-cite="usc/5/2105">section 2105</external-xref> of title 5, United States Code.</text></paragraph><paragraph id="H917DDE2063484EAEB859CC292C468D41"><enum>(3)</enum><header>Personally identifiable covered information</header><text display-inline="yes-display-inline">The term <term>personally identifiable covered information</term> means return, return information, and taxpayer return information (as such terms are defined in <external-xref legal-doc="usc" parsable-cite="usc/26/6103">section 6103(b)</external-xref> of the Internal Revenue Code of 1986) unless such return, return information, and taxpayer return information is authorized to be disclosed under a provision of law.</text></paragraph></subsection></section><section id="H99896CB715D74F7DBB2862A00262F90F"><enum>3.</enum><header>Private right of action</header><subsection id="HDBADEF43BAD445C99B44EE2536B18EBD"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Any person who violates section 2 of this Act or who willfully aids, abets, counsels, induces, or procures the commission of a violation of section 2 of this Act shall be liable to the person whose personally identifiable covered information was disclosed in violation of section 2 of this Act—</text><paragraph id="H25110304477A41E9A3258DCD317A275B"><enum>(1)</enum><text>in the amount of $100,000 for each such violation, and</text></paragraph><paragraph id="H3201EA250824437CB891B65D8FE8C71E"><enum>(2)</enum><text>for costs of prosecution and attorney fees.</text></paragraph></subsection><subsection id="HFBC8F573E666463BACD47AE6004C13BD"><enum>(b)</enum><header>Jurisdiction; statute of limitations; venue; process</header><text display-inline="yes-display-inline">The United States district courts shall have exclusive jurisdiction of actions brought under this section. Any such action shall be brought not later than two years after the date the cause of action arises. Any action brought under subsection (a) of this section may be brought in any judicial district wherein the defendant is found, resides, or transacts business, or in the judicial district wherein any act or transaction constituting the violation occurs. Process in such action may be served in any judicial district of which the defendant is an inhabitant or wherever the defendant may be found.</text></subsection></section></legis-body></bill>
