which was referred to the <committee-name committee-id="HBA00">Committee on Financial Services</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To establish a pilot program to authorize the Secretary of Housing and Urban Development to make grants to nonprofit organizations to rehabilitate and modify homes of disabled and low-income veterans.</official-title></form><legis-body id="H13C53D9228C84F0C92EBDDF1728B89CA" style="OLC"><section id="H55688369041D4659B8D899B3F0BFED54" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Housing Assistance for Veterans Act of 2013</short-title></quote> or the <quote><short-title>HAVEN Act</short-title></quote>.</text></section><section id="H54C610EF6DF6443EAC51E7E06E33CE6A" section-type="subsequent-section"><enum>2.</enum><header>Pilot program to rehabilitate and modify homes of disabled and low-income veterans</header><subsection id="H72028429C7EF4AEAB38C004846870784"><enum>(a)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section:</text><paragraph id="H918D87D847CC4BFAB55FC36C9E0BC690"><enum>(1)</enum><header>Disabled</header><text>The term <term>disabled</term> means an individual with a disability, as defined by <external-xref legal-doc="usc" parsable-cite="usc/42/12102">section 12102</external-xref> of title 42, United States Code.</text></paragraph><paragraph id="H37480A5A469F4B6EAACF2C76B13F66FE"><enum>(2)</enum><header>Eligible veteran</header><text display-inline="yes-display-inline">The term <term>eligible veteran</term> means a disabled or low-income veteran.</text></paragraph><paragraph id="H2716654EB8C24B62A5097174B5F64E87"><enum>(3)</enum><header>Energy efficient features or equipment</header><text>The term <term>energy efficient features or equipment</term> means features of, or equipment in, a primary residence that help reduce the amount of electricity used to heat, cool, or ventilate such residence, including insulation, weatherstripping, air sealing, heating system repairs, duct sealing, or other measures.</text></paragraph><paragraph id="HBA88A860ACD546F59F1B2C30A959E8E3"><enum>(4)</enum><header>Low-income veteran</header><text display-inline="yes-display-inline">The term <term>low-income veteran</term> means a veteran whose income does not exceed 80 percent of the median income for an area, as determined by the Secretary.</text></paragraph><paragraph id="H732D5FC126FA4ED08237272BDE0729CD"><enum>(5)</enum><header>Nonprofit organization</header><text display-inline="yes-display-inline">The term <term>nonprofit organization</term> means an organization that is—</text><subparagraph id="H088735F26E354384999CD72C57FD64C0"><enum>(A)</enum><text>described in section 501(c)(3) or 501(c)(19) of the Internal Revenue Code of 1986; and</text></subparagraph><subparagraph id="HD83F0D659CD74473BEF994BB419A20E3"><enum>(B)</enum><text>exempt from tax under section 501(a) of such Code.</text></subparagraph></paragraph><paragraph id="H1CA1C929BB3B4765952B713337D35248"><enum>(6)</enum><header>Primary residence</header><subparagraph id="HA67296AE41294DDAB6E6C8CC9015416E"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The term <term>primary residence</term> means a single family house, a duplex, or a unit within a multiple-dwelling structure that is the principal dwelling of an eligible veteran and is owned by such veteran or a family member of such veteran.</text></subparagraph><subparagraph id="HEE3B88A7AE684D599C5CC7E4C7360288"><enum>(B)</enum><header>Family member defined</header><text>For purposes of this paragraph, the term <term>family member</term> includes—</text><clause id="H2ED74246ABD24CA880F247A37B1DD877"><enum>(i)</enum><text>a spouse, child, grandchild, parent, or sibling;</text></clause><clause id="H9F8E4B88E1334BBBA2CFBD0EBA137E94"><enum>(ii)</enum><text>a spouse of such a child, grandchild, parent, or sibling; or</text></clause><clause id="HF00DD65AF2744B838FDFB9004A9787BC"><enum>(iii)</enum><text>any individual related by blood or affinity whose close association with a veteran is the equivalent of a family relationship.</text></clause></subparagraph></paragraph><paragraph id="H05BB656DBFD2417482BACCE12F383587"><enum>(7)</enum><header>Qualified organization</header><text display-inline="yes-display-inline">The term <term>qualified organization</term> means a nonprofit organization that provides nationwide or statewide programs that primarily serve veterans or low-income individuals.</text></paragraph><paragraph id="HC39A460D0CAB455B8184EC0D74E02D0F"><enum>(8)</enum><header>Secretary</header><text display-inline="yes-display-inline">The term <term>Secretary</term> means the Secretary of Housing and Urban Development.</text></paragraph><paragraph id="H24D59EC639C64A5DA3B0CBC9713A9368"><enum>(9)</enum><header>Veteran</header><text display-inline="yes-display-inline">The term <term>veteran</term> has the meaning given the term in <external-xref legal-doc="usc" parsable-cite="usc/38/101">section 101</external-xref> of title 38, United States Code.</text></paragraph><paragraph id="H62C41B8B6C95455DA162597CCC8303E7"><enum>(10)</enum><header>Veterans service organization</header><text>The term <term>veterans service organization</term> means any organization recognized by the Secretary of Veterans Affairs for the representation of veterans under <external-xref legal-doc="usc" parsable-cite="usc/38/5902">section 5902</external-xref> of title 38, United States Code.</text></paragraph></subsection><subsection id="H8A9DB59EA53D487494D298E936471F98"><enum>(b)</enum><header>Establishment of a pilot program</header><paragraph id="HF55BECD85E4541EDA108D7A8DB22E964"><enum>(1)</enum><header>Grant</header><subparagraph id="H845F79C9602940C39CD18A2D468C3570"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary shall establish a pilot program to award grants to qualified organizations to rehabilitate and modify the primary residence of eligible veterans.</text></subparagraph><subparagraph id="H9EDFF388BE644679AFBFF6E6DB7716AE"><enum>(B)</enum><header>Coordination</header><text>The Secretary shall work in conjunction with the Secretary of Veterans Affairs to establish and oversee the pilot program and to ensure that such program meets the needs of eligible veterans.</text></subparagraph><subparagraph id="H4E002BFA7F1E4B0FAB57F74C2F4F54AD"><enum>(C)</enum><header>Maximum grant</header><text>A grant award under the pilot program to any one qualified organization shall not exceed $1,000,000 in any one fiscal year, and such an award shall remain available until expended by such organization.</text></subparagraph></paragraph><paragraph id="HEC42F8E0F6DE4A61BD3FB44917A5E327"><enum>(2)</enum><header>Application</header><subparagraph id="HE5E22B2025D449CFB22F43179302F47A"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Each qualified organization that desires a grant under the pilot program shall submit an application to the Secretary at such time, in such manner, and, in addition to the information required under subparagraph (B), accompanied by such information as the Secretary may reasonably require.</text></subparagraph><subparagraph id="HF4287DAC683543ECBF20A2AF5A234C68"><enum>(B)</enum><header>Contents</header><text display-inline="yes-display-inline">Each application submitted under subparagraph (A) shall include—</text><clause id="H8FA5EA61603F440E9A72D7D589E181DB"><enum>(i)</enum><text>a plan of action detailing outreach initiatives;</text></clause><clause id="HDDE7DB52025242D7985389B7FC690FE0"><enum>(ii)</enum><text>the approximate number of veterans the qualified organization intends to serve using grant funds;</text></clause><clause id="HD949571D2CC947B1897910B26C7990ED"><enum>(iii)</enum><text>a description of the type of work that will be conducted, such as interior home modifications, energy efficiency improvements, and other similar categories of work; and</text></clause><clause id="H19543DE3E1974E6BA49DD5A764533632"><enum>(iv)</enum><text>a plan for working with the Department of Veterans Affairs and veterans service organizations to identify veterans who are not eligible for programs under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/38/21">chapter 21</external-xref> of title 38, United States Code, and meet their needs.</text></clause></subparagraph><subparagraph id="HC6A884F76CF34BBEAD5368EE1A962BF9"><enum>(C)</enum><header>Preferences</header><text display-inline="yes-display-inline">In awarding grants under the pilot program, the Secretary shall give preference to a qualified organization—</text><clause id="H147DF19585594CF4881A71CC4A19C3A5"><enum>(i)</enum><text>with experience in providing housing rehabilitation and modification services for disabled veterans; or</text></clause><clause id="H04969608D0314FAC824557541AAFD331"><enum>(ii)</enum><text display-inline="yes-display-inline">that proposes to provide housing rehabilitation and modification services for eligible veterans who live in rural, including tribal, areas (the Secretary, through regulations, shall define the term <term>rural areas</term>).</text></clause></subparagraph></paragraph><paragraph id="HCC6F60C1EF154039A92DE18D00085BE7"><enum>(3)</enum><header>Criteria</header><text display-inline="yes-display-inline">In order to receive a grant award under the pilot program, a qualified organization shall meet the following criteria:</text><subparagraph id="H54AAC96420414186952DD32618EE5D2D"><enum>(A)</enum><text>Demonstrate expertise in providing housing rehabilitation and modification services for disabled or low-income individuals for the purpose of making the homes of such individuals accessible, functional, and safe for such individuals.</text></subparagraph><subparagraph id="H47CEBF78E5174778A9AA0D5A5890B448"><enum>(B)</enum><text display-inline="yes-display-inline">Have established outreach initiatives that—</text><clause id="HC976434ADD0440888F09A149FD8CBE3E"><enum>(i)</enum><text>would engage eligible veterans and veterans service organizations in projects utilizing grant funds under the pilot program;</text></clause><clause id="HAF24FD60E86B43B3B193B9D9564F95A5"><enum>(ii)</enum><text>ensure veterans who are disabled receive preference in selection for assistance under this program; and</text></clause><clause id="H3EA4189B45DF4A0C86E9F3E7E23F88B5"><enum>(iii)</enum><text>identify eligible veterans and their families and enlist veterans involved in skilled trades, such as carpentry, roofing, plumbing, or HVAC work.</text></clause></subparagraph><subparagraph id="HAF4FC8E86A084E5C8BF1F05C52B6E04B"><enum>(C)</enum><text display-inline="yes-display-inline">Have an established nationwide or statewide network of affiliates that are—</text><clause id="HCAA67D2A9DF241EC8F56402F41F9BA09"><enum>(i)</enum><text>nonprofit organizations; and</text></clause><clause id="HE76D91F5F1214A3383CF5D529395E776"><enum>(ii)</enum><text>able to provide housing rehabilitation and modification services for eligible veterans.</text></clause></subparagraph><subparagraph id="H09231C86A60A41BCBC1ED95871F5C367"><enum>(D)</enum><text>Have experience in successfully carrying out the accountability and reporting requirements involved in the proper administration of grant funds, including funds provided by private entities or Federal, State, or local government entities.</text></subparagraph></paragraph><paragraph display-inline="no-display-inline" id="H66A4CA77600044ABB5C812AE713B2F83"><enum>(4)</enum><header>Use of funds</header><text display-inline="yes-display-inline">A grant award under the pilot program shall be used—</text><subparagraph id="HCBF24DD136794B0EB0BF7CB419F9273F"><enum>(A)</enum><text>to modify and rehabilitate the primary residence of an eligible veteran, and may include—</text><clause id="H69A2196BD64849738494E8DF65E55306"><enum>(i)</enum><text display-inline="yes-display-inline">installing wheelchair ramps, widening exterior and interior doors, reconfigurating and re-equipping bathrooms (which includes installing new fixtures and grab bars), removing doorway thresholds, installing special lighting, adding additional electrical outlets and electrical service, and installing appropriate floor coverings to—</text><subclause id="H82CD914EC0EB4C65A81CACC6F44D6CE5"><enum>(I)</enum><text>accommodate the functional limitations that result from having a disability; or</text></subclause><subclause id="H1FB73920603047609735726BBB605DAD"><enum>(II)</enum><text display-inline="yes-display-inline">if such residence does not have modifications necessary to reduce the chances that an elderly, but not disabled person, will fall in their home, reduce the risks of such an elderly person from falling;</text></subclause></clause><clause id="HEF8397A05CCC410FA1EC714C3D68B2A9"><enum>(ii)</enum><text>rehabilitating such residence that is in a state of interior or exterior disrepair; and</text></clause><clause id="H811680CD94AF4E65B07EB9BC3D0C61EA"><enum>(iii)</enum><text display-inline="yes-display-inline">installing energy efficient features or equipment if—</text><subclause id="H1863E36288914BBA8A2DCB352626E535"><enum>(I)</enum><text>an eligible veteran’s monthly utility costs for such residence is more than 5 percent of such veteran’s monthly income; and</text></subclause><subclause id="H3EF6426D78F54E8CA5AE18515E236DDF"><enum>(II)</enum><text>an energy audit of such residence indicates that the installation of energy efficient features or equipment will reduce such costs by 10 percent or more; and</text></subclause></clause></subparagraph><subparagraph id="H1A8EEEF03C85490CBC3485C4CE4FCC20"><enum>(B)</enum><text display-inline="yes-display-inline">in connection with modification and rehabilitation services provided under the pilot program, to provide technical, administrative, and training support to an affiliate of a qualified organization receiving a grant under such pilot program.</text></subparagraph></paragraph><paragraph id="H9566AD00CFD246AB9F6E9EF13C8FC276"><enum>(5)</enum><header>Oversight</header><text>The Secretary shall direct the oversight of the grant funds for the pilot program so that such funds are used efficiently until expended to fulfill the purpose of addressing the adaptive housing needs of eligible veterans.</text></paragraph><paragraph id="H98F68BE0CED24A4DBC5D1B8AF0D913F3"><enum>(6)</enum><header>Matching funds</header><subparagraph id="H6C37400FEA7240508658F5A752FDBC06"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">A qualified organization receiving a grant under the pilot program shall contribute towards the housing modification and rehabilitation services provided to eligible veterans an amount equal to not less than 50 percent of the grant award received by such organization.</text></subparagraph><subparagraph id="H9FF809F08293402199DC70B90032B921"><enum>(B)</enum><header>In-kind contributions</header><text display-inline="yes-display-inline">In order to meet the requirement under subparagraph (A), such organization may arrange for in-kind contributions.</text></subparagraph></paragraph><paragraph id="HE4497AAF817B49A6A90E2DEC8F3A685F"><enum>(7)</enum><header>Limitation cost to the veterans</header><text display-inline="yes-display-inline">A qualified organization receiving a grant under the pilot program shall modify or rehabilitate the primary residence of an eligible veteran at no cost to such veteran (including application fees) or at a cost such that such veteran pays no more than 30 percent of his or her income in housing costs during any month.</text></paragraph><paragraph id="HAEFEE836CBBA4E8BBE187B220318F28B"><enum>(8)</enum><header>Reports</header><subparagraph id="HC645778B6B7D412B9C1641174D338A63"><enum>(A)</enum><header>Annual report</header><text display-inline="yes-display-inline">The Secretary shall submit to Congress, on an annual basis, a report that provides, with respect to the year for which such report is written—</text><clause id="HBD5A77F6A5214060A9FDD62445ABD9D4"><enum>(i)</enum><text>the number of eligible veterans provided assistance under the pilot program;</text></clause><clause id="H9E49C79CCFBA4BC1B8E107CB513924D3"><enum>(ii)</enum><text>the socioeconomic characteristics of such veterans, including their gender, age, race, and ethnicity;</text></clause><clause id="HBD5914C4335545268ADE783CC2536B2E"><enum>(iii)</enum><text>the total number, types, and locations of entities contracted under such program to administer the grant funding;</text></clause><clause id="H4CF2F75FF2D14FDEB21F6AB4D7E64AC9"><enum>(iv)</enum><text>the amount of matching funds and in-kind contributions raised with each grant;</text></clause><clause id="H5B0CE561A2CD44A1A0DE341BCF19E895"><enum>(v)</enum><text>a description of the housing rehabilitation and modification services provided, costs saved, and actions taken under such program;</text></clause><clause id="HAADCD92099F74D3FA96847F1E4CFD901"><enum>(vi)</enum><text>a description of the outreach initiatives implemented by the Secretary to educate the general public and eligible entities about such program;</text></clause><clause id="HA3E9174FE1B54F759681EBCBB4FB8DF9"><enum>(vii)</enum><text>a description of the outreach initiatives instituted by grant recipients to engage eligible veterans and veteran service organizations in projects utilizing grant funds under such program;</text></clause><clause id="HAB71171E8957401A91B21E48CB97B380"><enum>(viii)</enum><text>a description of the outreach initiatives instituted by grant recipients to identify eligible veterans and their families; and</text></clause><clause id="H9BD8009BF2B34EADA0DBA65DB1609229"><enum>(ix)</enum><text>any other information that the Secretary considers relevant in assessing such program.</text></clause></subparagraph><subparagraph id="H8396E21F139747FA883FA7319C490B82"><enum>(B)</enum><header>Final report</header><text>Not later than 6 months after the completion of the pilot program, the Secretary shall submit to Congress a report that provides such information that the Secretary considers relevant in assessing the pilot program.</text></subparagraph><subparagraph id="H2B1993F0D7724302A16E05971B554A37"><enum>(C)</enum><header>Inspector General report</header><text>Not later than March 31, 2019, the Inspector General of the Department of Housing and Urban Development shall submit to the Chairmen and Ranking Members of the Committee on Banking, Housing, and Urban Affairs of the Senate and the Committee on Financial Services of the House of Representatives a report containing a review of—</text><clause id="H802D6C08E6984336B75B082CAFFD3B59"><enum>(i)</enum><text>the use of appropriated funds by the Secretary and by grantees under the pilot program; and</text></clause><clause id="H0BFDFC4599E941B082150ED86846F04C"><enum>(ii)</enum><text>oversight and accountability of grantees under the pilot program.</text></clause></subparagraph></paragraph><paragraph id="H9B0C6816DE0944FBA5A0CCC2B585B062"><enum>(9)</enum><header>Authorization of appropriations</header><text display-inline="yes-display-inline">There are authorized to be appropriated for carrying out this section $4,000,000 for each of fiscal years 2015 through 2019.</text></paragraph></subsection></section></legis-body></bill>
