<section commented="no" id="H3C2E2BE8C33A4D3FB0C58015F8C0F30B" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Oil Pollution Research and Development Program Reauthorization Act of 2013</short-title></quote>.</text></section> 
<section id="HDE5CC58709CE4B3FAB83761C94FC8E43"><enum>2.</enum><header>Federal Oil Pollution Research Committee</header> 
<subsection id="HDFF6373E88A24C04A127D3B86839FB20"><enum>(a)</enum><header>Purposes</header><text display-inline="yes-display-inline">Section 7001(a)(2) of the Oil Pollution Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/33/2761">33 U.S.C. 2761(a)(2)</external-xref>) is amended by striking <quote>State</quote> and inserting <quote>State and tribal</quote>.</text></subsection> 
<subsection id="H78DF097D2CBF4F0C889D52F525BA3A5C"><enum>(b)</enum><header>Membership</header><text display-inline="yes-display-inline">Section 7001(a)(3) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/33/2761">33 U.S.C. 2761(a)(3)</external-xref>) is amended to read as follows:</text>

<subparagraph id="HE75FA8C962154FF380F406DE9DBDA9B6"><enum>(A)</enum><header>Members</header><text>The Interagency Committee shall consist of representatives from the following:</text> 
<clause id="H71F0D287CDF8415F843208418888B64E"><enum>(i)</enum><text>The Coast Guard.</text></clause> 
<clause id="H976A62675515499E8CB27C4B49F1D466"><enum>(ii)</enum><text>The Department of Commerce, including the National Oceanic and Atmospheric Administration.</text></clause>

<subparagraph id="HF92D57887C8549F78CE89BDBE2E9738D"><enum>(B)</enum><header>Collaborating agencies</header><text display-inline="yes-display-inline">The Interagency Committee shall collaborate with the following:</text>

<clause id="H1342B8DB06BB48C4BE07D98A2A2A6F3A"><enum>(iv)</enum><text>The Department of Defense, including the Army Corps of Engineers and the Navy.</text></clause>

<subsection id="HB6CE862212894195A136143429ED162B"><enum>(c)</enum><header>Role of the Chair</header><text>Section 7001(a)(4) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/33/2761">33 U.S.C. 2761(a)(4)</external-xref>) is amended to read as follows:</text>

<paragraph id="HC4DCF44ABA084FE2AB6E543C7634B92F"><enum>(4)</enum><header>Chair</header> 
<subparagraph id="HA251AEA45FB344CB9B93429D82F46735"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">A representative of the Coast Guard shall serve as Chair.</text></subparagraph> 
<subparagraph id="H668841DFE02B4419A88D9B79F5836B9B"><enum>(B)</enum><header>Role of Chair</header><text>The primary role of the Chair shall be to ensure that—</text> 
<clause id="H3D5EC8767BD34D67BCD2D743D9241F2D"><enum>(i)</enum><text>the activities of the Interagency Committee and the agencies listed in paragraph (3)(B) are coordinated;</text></clause> 
<clause id="HF4E0C254EEEF471B9AE654B4478350BB"><enum>(ii)</enum><text>the implementation plans required under subsection (b)(1) are completed and submitted;</text></clause> 
<clause id="HF3B3C1098D914662A38700AF424264E3"><enum>(iii)</enum><text>the annual reports required under subsection (e) are completed and submitted;</text></clause> 
<clause id="H8890286646D34B5296548B99B920A5DA"><enum>(iv)</enum><text display-inline="yes-display-inline">the Interagency Committee meets in accordance with the requirements of paragraph (5); and</text></clause> 
<clause id="HE0B8E8486497418699A27A8F5D48DAC3"><enum>(v)</enum><text display-inline="yes-display-inline">the Oil Pollution Research Advisory Committee under subsection (f) is established and utilized.</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H188C3AB75A494DA5BA9624A7A74D78D1"><enum>(d)</enum><header>Activities</header><text>Section 7001(a) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/33/2761">33 U.S.C. 2761(a)</external-xref>) is amended by adding at the end the following:</text>

<paragraph id="H17C55E6B375C4734A0A8A1F293AAFC77"><enum>(5)</enum><header>Activities</header> 
<subparagraph id="H1F7127905F6544658631E9F6CAC971F4"><enum>(A)</enum><header>Ongoing, coordinated efforts</header><text>The Interagency Committee shall ensure that the research, development, and demonstration efforts authorized by this section are coordinated and conducted on an ongoing basis.</text></subparagraph> 
<subparagraph id="HD415C1C06C7D4C7A97D013DF980D4BD3"><enum>(B)</enum><header>Meetings</header> 
<clause id="H1E934A52CAC24840B18E09E3547C8414"><enum>(i)</enum><header>In general</header><text display-inline="yes-display-inline">The Interagency Committee shall meet, or otherwise communicate, as appropriate, to—</text> 
<subclause id="HBD8FB046790041C79A0FFD0C51FBD1C9"><enum>(I)</enum><text>plan program-related activities; and</text></subclause> 
<subclause id="H244D516CE4FE4B8EB158B0C071F4BA18"><enum>(II)</enum><text>determine whether the program is resulting in the development of new or improved methods and technologies to prevent, detect, respond to, contain, and mitigate oil discharge.</text></subclause></clause> 
<clause id="H21241B8479D449BDB309A0B9E65B796D"><enum>(ii)</enum><header>Frequency</header><text>In no event shall the Interagency Committee meet less than once per year.</text></clause></subparagraph> 
<subparagraph id="H63A9DDB2F3ED46CCA9B168E4D938A165"><enum>(C)</enum><header>Information exchange</header><text display-inline="yes-display-inline">The Interagency Committee, acting through the Administrator of the National Oceanic and Atmospheric Administration, shall develop a national information clearinghouse on oil discharge that—</text> 
<clause id="H4D384F242583496DA785F0C3A24CDD01"><enum>(i)</enum><text>includes scientific information and research on preparedness, response, and restoration; and</text></clause> 
<clause id="HC29AE9B602344BA295C6036C22440DCB"><enum>(ii)</enum><text>serves as a single electronic access and input point for Federal agencies, emergency responders, the research community, and other interested parties for such information.</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section> 
<section id="H4EA8E84417F746E1AE98084BEF737907"><enum>3.</enum><header>Oil pollution research and technology plan</header> 
<subsection commented="no" id="HAD68F1E1245B46DEBF3B57461DE73B35"><enum>(a)</enum><header>Implementation Plan</header><text>Section 7001(b)(1) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/33/2761">33 U.S.C. 2761(b)(1)</external-xref>) is amended—</text> 
<paragraph id="H9A2BA938202040FA93D7A592AA66D4BD"><enum>(1)</enum><text>by striking <quote>180 days after the date of enactment of this Act</quote> and inserting <quote>180 days after the date of enactment of the <short-title>Oil Pollution Research and Development Program Reauthorization Act of 2013</short-title> and periodically thereafter, as appropriate, but not less than once every 5 years</quote>;</text></paragraph> 
<paragraph id="HD59718A972AB47CC8E3FAE6561997A60"><enum>(2)</enum><text display-inline="yes-display-inline">by striking subparagraph (A) and inserting the following:</text> 
<quoted-block display-inline="no-display-inline" id="H253A166A817A4C259AEADB024EB8641C" style="OLC"> 
<subparagraph id="H1AC5DF7B0E674ECE9E8FF0144E4E2C23"><enum>(A)</enum><text display-inline="yes-display-inline">identify the roles and responsibilities of each member agency of the Interagency Committee under subsection (a)(3)(A) and each of the collaborating agencies under subsection (a)(3)(B);</text></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></paragraph> 
<paragraph id="H78CAD1E128034AAFAD5849BDC8FD6FC3"><enum>(3)</enum><text display-inline="yes-display-inline">in subparagraph (B) by inserting <quote>containment,</quote> after <quote>response,</quote>;</text></paragraph> 
<paragraph id="H033F8CEFB14A43E594A9A4F58B84DB7F"><enum>(4)</enum><text display-inline="yes-display-inline">in subparagraph (D) by inserting <quote>containment,</quote> after <quote>response,</quote>;</text></paragraph> 
<paragraph id="HC4272303B38547C89EACE4940A177F0E"><enum>(5)</enum><text display-inline="yes-display-inline">by striking <quote>and</quote> at the end of subparagraph (E);</text></paragraph> 
<paragraph id="H155228329101457597C8F44C727B5510"><enum>(6)</enum><text display-inline="yes-display-inline">in subparagraph (F)—</text> 
<subparagraph id="H6C1312886EAD48589A082B87878AD75C"><enum>(A)</enum><text display-inline="yes-display-inline">by striking <quote>the States</quote> through <quote>research needs</quote> and inserting <quote>State and tribal governments, regional oil pollution research needs, including natural seeps and pollution resulting from importing oil from overseas,</quote>; and</text></subparagraph> 
<subparagraph id="HF004203517CD4E58AB3109F76C4B3DDA"><enum>(B)</enum><text>by striking the period at the end and inserting a semicolon; and</text></subparagraph></paragraph> 
<paragraph id="HCD7F521C3E5549A18C4913F4A6AE4CB7"><enum>(7)</enum><text display-inline="yes-display-inline">by adding at the end the following new subparagraphs:</text> 
<quoted-block display-inline="no-display-inline" id="HBC167F7A74FB415F851B7D59F4B1ED71" style="OLC"> 
<subparagraph id="HA7CACB5528CE4B1EB52D5C5DE3906142"><enum>(G)</enum><text display-inline="yes-display-inline">identify the information needed to conduct risk assessment and risk analysis research to effectively prevent oil discharges, including information on human factors and decisionmaking, and to protect the environment; and</text></subparagraph> 
<subparagraph id="H30F36F66FC8445B892B0AC680258031E"><enum>(H)</enum><text display-inline="yes-display-inline">identify a methodology that—</text> 
<clause id="H012922859509418A8CB46382B6866A09"><enum>(i)</enum><text display-inline="yes-display-inline">provides for the solicitation, evaluation, preapproval, funding, and utilization of technologies and research projects developed by the public and private sector in advance of future oil discharges; and</text></clause> 
<clause id="H1A74F55FF4424EB4ADF8ACC79EF030DB"><enum>(ii)</enum><text>where appropriate, ensures that such technologies are readily available for rapid testing and potential deployment and that research projects can be implemented during an incident response.</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="H7F15A98B83FB4F62832CBD568D81C782"><enum>(b)</enum><header>Advice and guidance</header><text>Section 7001(b)(2) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/33/2761">33 U.S.C. 2761(b)(2)</external-xref>) is amended to read as follows:</text> 
<quoted-block display-inline="no-display-inline" id="H18A573EE5C974DF4B59A4E6AE46ABA99" style="OLC"> 
<paragraph id="H9E97BF1266FF46CFAE0ACDCC3E262FE1"><enum>(2)</enum><header>Advice and guidance</header> 
<subparagraph id="H87A6121ABCBC4256BB6B57DE85F1FFC1"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The Chair shall solicit advice and guidance in the development of the research plan under paragraph (1) from—</text> 
<clause id="H231D61DEF37744A1AAEFAF8DBB52CA7B"><enum>(i)</enum><text>the Oil Pollution Research Advisory Committee established under subsection (f);</text></clause> 
<clause id="H585F27E0E6E54B86B166E94D2FCC2382"><enum>(ii)</enum><text>the National Institute of Standards and Technology on issues relating to quality assurance and standards measurements;</text></clause> 
<clause id="HE2A36A4A38504CC0A4AB2D788927FCE8"><enum>(iii)</enum><text>third party standard-setting organizations on issues relating to voluntary consensus standards; and</text></clause> 
<clause id="H935A347B4C1B4FBCB4256E529D112A1B"><enum>(iv)</enum><text>the public in accordance with subparagraph (B).</text></clause></subparagraph> 
<subparagraph id="H8DAA44B7C6D7470F979FD52D03DCDFE5"><enum>(B)</enum><header>Public comment</header><text display-inline="yes-display-inline">Prior to the submission of the research plan to Congress under paragraph (1), the research plan shall be published in the Federal Register and subject to a public comment period of 30 days. The Chair shall review the public comments received and incorporate those comments into the plan, as appropriate.</text></subparagraph></paragraph><after-quoted-block>. </after-quoted-block></quoted-block></subsection> 
<subsection id="H454C2F56321C4431A5FB792CAF5AB873"><enum>(c)</enum><header>Review</header><text>Section 7001(b) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/33/2761">33 U.S.C. 2761(b)</external-xref>) is amended by adding at the end the following:</text> 
<quoted-block display-inline="no-display-inline" id="H59FBD334ADF248ECA03CB884EA976040" style="OLC"> 
<paragraph id="HD7E3F7A35D354710BEA163547BB4DEB8"><enum>(3)</enum><header>Review</header><text display-inline="yes-display-inline">After the submission of each research plan to Congress under paragraph (1), the Chair shall contract with the National Academy of Sciences—</text> 
<subparagraph id="H9BAD333062EC45AE92B68175F98D4F32"><enum>(A)</enum><text>to review the research plan;</text></subparagraph> 
<subparagraph id="H1739522492E64924BF70F727CC15BE86"><enum>(B)</enum><text>to assess the adequacy of the research plan; and</text></subparagraph> 
<subparagraph id="H73879999330241B7AC68A8ED0AF14CB2"><enum>(C)</enum><text>to submit a report to Congress on the conclusions of the assessment.</text></subparagraph></paragraph> 
<paragraph id="H94320B24433641FE9942CC9EADF6A254"><enum>(4)</enum><header>Incorporation of recommendations</header><text>The Chair shall address any recommendations in the review conducted under paragraph (3) and shall incorporate such recommendations into the research plan, as appropriate.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section> 
<section id="H6084F2A3DA9242A0BF860CC13EAB508F"><enum>4.</enum><header>Oil pollution research and development program</header> 
<subsection id="HCFFEB3F6274D48DDB94CD1D1F2C32468"><enum>(a)</enum><header>Establishment</header><text display-inline="yes-display-inline">Section 7001(c)(1) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/33/2761">33 U.S.C. 2761(c)(1)</external-xref>) is amended by striking <quote>research and development, as provided in this subsection</quote> and inserting <quote>research, development, and demonstration, as provided in this subsection and subsection (a)(2)</quote>.</text></subsection> 
<subsection id="HA3088F069B3D46059E7B718A7166FA17"><enum>(b)</enum><header>Innovative oil pollution technology</header><text display-inline="yes-display-inline">Section 7001(c)(2) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/33/2761">33 U.S.C. 2761(c)(2)</external-xref>) is amended—</text> 
<paragraph id="HEDD63D604ADA4B53B1E95A256CF47465"><enum>(1)</enum><text>in the matter before subparagraph (A), by striking <quote>preventing or mitigating</quote> and inserting <quote>preventing, detecting, containing, recovering, or mitigating</quote>;</text></paragraph> 
<paragraph id="H27F9536C09694634B8B57A79110D07DC"><enum>(2)</enum><text>by striking subparagraph (I);</text></paragraph> 
<paragraph id="H95B4A5C252644FA8A3615D44CF927724"><enum>(3)</enum><text>by striking the period at the end of subparagraph (J) and inserting a semicolon; </text></paragraph> 
<paragraph id="H4E9EBBE9ED4D4449A71A1B2004915FDF"><enum>(4)</enum><text>by redesignating subparagraph (J) as subparagraph (I); and</text></paragraph> 
<paragraph id="H18594E4E9C1447D29F77CCAB0997222B"><enum>(5)</enum><text>by adding at the end the following:</text> 
<quoted-block display-inline="no-display-inline" id="HA6BBCAA4A7344B4A90A01D5C635F9CCE" style="OLC"> 
<subparagraph id="H207AE6E6945C462A88B45CA00221225C"><enum>(J)</enum><text display-inline="yes-display-inline">technologies and methods to address oil discharge on land and in inland waters, coastal areas, offshore areas, including deepwater and ultra-deepwater areas, and polar and other icy areas; and</text></subparagraph> 
<subparagraph id="HC08B8B7DA7694F3088EC736E3AC22514"><enum>(K)</enum><text display-inline="yes-display-inline">modeling and simulation capabilities, including tools and technologies, that can be used to facilitate effective recovery and containment of oil discharge during incident response.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="H766EBD66027A4634B32BF09088FA0BD2"><enum>(c)</enum><header>Oil pollution technology evaluation</header><text>Section 7001(c)(3) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/33/2761">33 U.S.C. 2761(c)(3)</external-xref>) is amended to read as follows:</text> 
<quoted-block display-inline="no-display-inline" id="H7BCF2CFA256544789C54948CB80523F7" style="OLC"> 
<paragraph id="H8FACBBFA205744DA88B65F289D19BAB3"><enum>(3)</enum><header>Oil pollution technology evaluation</header><text display-inline="yes-display-inline">The program established under this subsection shall provide for the evaluation of oil pollution prevention, containment, and mitigation technologies, including—</text> 
<subparagraph commented="no" id="H864D3E2C818743A18768E4415DA360B5"><enum>(A)</enum><text>the evaluation of the performance and effectiveness of such technologies in preventing, detecting, containing, recovering, and mitigating oil discharges;</text></subparagraph> 
<subparagraph id="HEC55165251FA459C8F0889A23A7CACA6"><enum>(B)</enum><text>the evaluation of the environmental effects of the use of such technologies;</text></subparagraph> 
<subparagraph id="H22080E3E15D4427F8BE1D1F912B91899"><enum>(C)</enum><text>the evaluation and testing of technologies developed independently of the research and development program established under this subsection, including technologies developed by small businesses;</text></subparagraph> 
<subparagraph id="H5B69898315B242D4B310DB30FE248AD2"><enum>(D)</enum><text>the establishment, with the advice and guidance of the National Institute of Standards and Technology, of standards and testing protocols traceable to national standards to measure the performance of oil pollution prevention, containment, or mitigation technologies;</text></subparagraph> 
<subparagraph id="H073013CC3BF340DC8DE2DDF1BF68DE80"><enum>(E)</enum><text>an evaluation of the environmental effects and utility of controlled field testing;</text></subparagraph> 
<subparagraph id="HC15B426DE2B24512A2EF5CE4451AFF35"><enum>(F)</enum><text display-inline="yes-display-inline">the use, where appropriate, of controlled field testing to evaluate real-world application of new or improved oil discharge prevention, response, containment, recovery, or mitigation technologies;</text></subparagraph> 
<subparagraph id="H7BE0DED9CEC84F7BBDF6A839BB7E9366"><enum>(G)</enum><text>an evaluation of the effectiveness of oil pollution prevention technologies based on probabilistic risk analyses of the system; and</text></subparagraph> 
<subparagraph id="HDEF631A2CE7D4FC5B5AA17BD7B53107E"><enum>(H)</enum><text display-inline="yes-display-inline">research conducted by the Environmental Protection Agency and other appropriate Federal agencies for the evaluation and testing of technologies that demonstrate—</text> 
<clause id="HA6D82D63B3A742F8BA84D4A9CF24BCBE"><enum>(i)</enum><text>maximum effectiveness, including application and delivery mechanisms; and</text></clause> 
<clause id="H1E2E12DEBAA946C8909CD48DA1D50257"><enum>(ii)</enum><text>minimum effects, including toxicity, to human health and the environment in both the near-term and long-term.</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H768CF6CB6B2843AB9B4FDAB13C5B0260"><enum>(d)</enum><header>Oil pollution effects research</header><text display-inline="yes-display-inline">Section 7001(c)(4) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/33/2761">33 U.S.C. 2761(c)(4)</external-xref>) is amended—</text> 
<paragraph id="H20F1BFC67B3D47AA87665C33478F7C73"><enum>(1)</enum><text>by striking subparagraph (A) and inserting the following:</text> 
<quoted-block display-inline="no-display-inline" id="H90533E0587874B499CF68C6D625D22CC" style="OLC"> 
<subparagraph id="HDCA2F0F5300940D8B796D5B19530130B"><enum>(A)</enum><header>In general</header> 
<clause id="H27E56E2129CE4752A88E7A340B3DC250"><enum>(i)</enum><header>Establishment</header><text display-inline="yes-display-inline">The Interagency Committee, acting through the Administrator of the National Oceanic and Atmospheric Administration, shall establish a research program to monitor and scientifically evaluate the environmental effects, including long-term effects, of oil discharge.</text></clause> 
<clause id="H98FB9A5062A247E5A980228EE69CE4CA"><enum>(ii)</enum><header>Specifications</header><text>Such program shall include the following elements:</text> 
<subclause id="HB633793A5B784957A98F7D481359E722"><enum>(I)</enum><text>Research on and the development of effective tools to detect, measure, observe, analyze, monitor, model, and forecast the presence, transport, fate, and effect of an oil discharge throughout the environment, including tools and models to accurately measure and predict the flow of oil discharged.</text></subclause> 
<subclause id="HD823A34745934E788079E630ADFDF4A3"><enum>(II)</enum><text>The development of methods, including economic methods, to assess and predict damages to natural resources, including air quality, resulting from oil discharges, including in economically disadvantaged communities and areas.</text></subclause> 
<subclause id="H47B5A31FC823458D9439B01A8A011625"><enum>(III)</enum><text>The identification of types of ecologically sensitive areas at particular risk from oil discharges, such as inland waters, coastal areas, offshore areas, including deepwater and ultra-deepwater areas, and polar and other icy areas.</text></subclause> 
<subclause id="H968D5C03477F4AB59B8F465B6871FECB"><enum>(IV)</enum><text>The preparation of scientific monitoring and evaluation plans for the areas identified under subclause (III) to be implemented in the event of major oil discharges in such areas.</text></subclause> 
<subclause id="H51686291CCAE4C6D864CFAC05483258B"><enum>(V)</enum><text>The collection of environmental baseline data in the areas identified under subclause (III) if such data are insufficient.</text></subclause> 
<subclause id="H85C38CF32179430D8B67DAD3A975E627"><enum>(VI)</enum><text display-inline="yes-display-inline">The use of both onshore and offshore air quality monitoring to study the effects of an oil discharge and oil discharge cleanup technologies on air quality and making the results of such monitoring and health and safety warnings readily available to the public, including emergency responders, the research community, local residents, and other interested parties.</text></subclause> 
<subclause id="H2F98B5C2D1514EE59F557050985B98F0"><enum>(VII)</enum><text>Research on technologies, methods, and standards for protecting removal personnel and for volunteers that may participate in incident responses, including training, adequate supervision, protective equipment, maximum exposure limits, and decontamination procedures.</text></subclause></clause></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></paragraph> 
<paragraph id="H75FDE69B3B724E578A340AF77AEA3B52"><enum>(2)</enum><text>in subparagraph (B)—</text> 
<subparagraph id="H5AEE8D983430427B9D949AD0E9D7D1D7"><enum>(A)</enum><text>by striking <quote>(B) The Department of Commerce</quote> and all that follows through <quote>future oil discharges.</quote> and inserting the following:</text> 
<quoted-block display-inline="no-display-inline" id="H2126C85DCC064BD5A64AF6FC0909FABE" style="OLC"> 
<subparagraph id="H737D66B0CD9246269621A6B5DF2E0B46"><enum>(B)</enum><header>Conditions</header><text display-inline="yes-display-inline">The Interagency Committee, acting through the Administrator of the National Oceanic and Atmospheric Administration, shall conduct research activities under subparagraph (A) for areas in which—</text> 
<clause id="H2E21312EE0D8446399CAD83825989985"><enum>(i)</enum><text>the amount of oil discharged exceeds 250,000 gallons; and</text></clause> 
<clause id="HBC2A908B119343C8A681427335EE983F"><enum>(ii)</enum><text>a study of the long-term environmental effects of the discharge would be of significant scientific value, especially for preventing or responding to future oil discharges.</text></clause></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph> 
<subparagraph id="H53E9EAB32A7B4C6AA834051604EDC9C4"><enum>(B)</enum><text>by striking <quote>ATHOS I, and</quote> and inserting <quote>ATHOS I;</quote>; and</text></subparagraph> 
<subparagraph id="HBBF868F41FF040E59E6D974258BC3291"><enum>(C)</enum><text>by striking the period at the end and inserting <quote>; Prince William Sound, where oil was discharged by the EXXON VALDEZ; and the Gulf of Mexico, where oil was discharged by the DEEPWATER HORIZON.</quote>; and</text></subparagraph></paragraph> 
<paragraph id="HBBD3632537A1419BAE7633DF66AD1617"><enum>(3)</enum><text>in subparagraph (C) by striking <quote>Research</quote> and inserting <quote><header-in-text level="subparagraph" style="OLC">Coordination.</header-in-text>—Research</quote>.</text></paragraph></subsection> 
<subsection id="H046A97F6FA1040BEB1E2641997CCCFE4"><enum>(e)</enum><header>Demonstration projects</header><text>Section 7001(c)(6) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/33/2761">33 U.S.C. 2761(c)(6)</external-xref>) is amended—</text> 
<paragraph id="H3865AE9F23954B9B918D37EB1EE84F2C"><enum>(1)</enum><text>by striking the first sentence and inserting the following: <quote>The United States Coast Guard, in conjunction with such agencies as the President may designate, shall conduct a total of 2 port oil pollution minimization demonstration projects, 1 with the Ports of Los Angeles and Long Beach, California, and 1 with a port on the Great Lakes, for the purpose of developing and demonstrating integrated port oil pollution prevention and cleanup systems that utilize the information and implement the improved practices and technologies developed from the research, development, and demonstration program established in this section.</quote>; and</text></paragraph> 
<paragraph id="H8144B9E24A0D40858DD408852E5D2E9D"><enum>(2)</enum><text>in the second sentence by striking <quote>oil spill</quote> and inserting <quote>oil discharge</quote>.</text></paragraph></subsection> 
<subsection id="HAB9C170E2A1D4EECA7786AAB6924DDFC"><enum>(f)</enum><header>Simulated Environmental Testing</header><text display-inline="yes-display-inline">Section 7001(c)(7) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/33/2761">33 U.S.C. 2761(c)(7)</external-xref>) is amended by inserting <quote>Oil pollution technology testing and evaluations shall be given priority over all other activities performed at such Research Center.</quote> after <quote>evaluations.</quote>.</text></subsection> 
<subsection id="HEA5561C034604CF7B0873C9FED787B1B"><enum>(g)</enum><header>Regional research program</header> 
<paragraph id="H500F81E9EC7B4FF990AF2E0438CD505F"><enum>(1)</enum><header>In general</header><text>Section 7001(c)(8) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/33/2761">33 U.S.C. 2761(c)(8)</external-xref>) is amended—</text> 
<subparagraph id="HA3900F9195CD4E25B480AC631DADB803"><enum>(A)</enum><text>in subparagraph (A)—</text> 
<clause id="H1C6B69FCC5D54FB095328727BB54E803"><enum>(i)</enum><text>by striking <quote>program of competitive grants</quote> and inserting <quote>program of peer-reviewed, competitive grants</quote>; and</text></clause> 
<clause id="H87459858510345E48651F13EA4AC4F1F"><enum>(ii)</enum><text>by striking <quote>(1989)</quote> and inserting <quote>(2009)</quote>;</text></clause></subparagraph>

<subparagraph id="H4C003406F5D44625A9F6ADCE95D8EB28" indent="up1"><enum>(H)</enum><text display-inline="yes-display-inline">In carrying out this paragraph, the Interagency Committee shall coordinate the program of peer-reviewed, competitive grants to universities or other research institutions, including Minority Serving Institutions as defined under section 371(a) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1067q">20 U.S.C. 1067q(a)</external-xref>), and provide consideration to such institutions in the recommendations for awarding grants.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph> 
<paragraph id="HB490A72403904789B6615DADA3CBD800"><enum>(2)</enum><header>Funding</header><text display-inline="yes-display-inline">Section 7001(c)(9) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/33/2761">33 U.S.C. 2761(c)(9)</external-xref>) is amended by striking <quote>1991</quote> and all that follows through <quote>shall be available</quote> and inserting <quote>2014, 2015, 2016, 2017, and 2018, there are authorized to be appropriated from amounts in the Fund $12,000,000</quote>.</text></paragraph></subsection></section> 
<section id="HAB4F7A2E8B1A4C8AAE8571499897C99C"><enum>5.</enum><header>International cooperation</header><text display-inline="no-display-inline">Section 7001(d) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/33/2761">33 U.S.C. 2761(d)</external-xref>) is amended to read as follows:</text> 
<quoted-block display-inline="no-display-inline" id="HD5C6F4879ECD4AA7931464226D144309" style="OLC"> 
<subsection id="H3B57896DC7144E6DA472B468DF52683B"><enum>(d)</enum><header>International cooperation</header><text>In accordance with the research plan submitted under subsection (b), the Interagency Committee shall engage in international cooperation by—</text> 
<paragraph id="HE4955C5EC4A14922B0F8B7B703A62D96"><enum>(1)</enum><text>harnessing global expertise through collaborative partnerships with foreign governments and research entities, and domestic and foreign private actors, including nongovernmental organizations and private sector companies; and</text></paragraph> 
<paragraph id="H7AF96415017345308CDD71BC4B020DA5"><enum>(2)</enum><text>leveraging public and private capital, technology, expertise, and services towards innovative models that can be instituted to conduct collaborative oil pollution research, development, and demonstration activities, including controlled field tests of oil discharges and other activities designed to improve oil recovery and cleanup.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section> 
<section id="H56902B4308AA44F09D9738EFB44B6495"><enum>6.</enum><header>Annual reports</header><text display-inline="no-display-inline">Section 7001(e) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/33/2761">33 U.S.C. 2761(e)</external-xref>) is amended to read as follows:</text> 
<quoted-block display-inline="no-display-inline" id="H15DACCF02F7F415994752D0D814AD6A3" style="OLC"> 
<subsection id="H46FAC9AAFF274393933FCC4073D3F3DA"><enum>(e)</enum><header>Annual report</header> 
<paragraph id="HCD399BD68A8643958B3C2A5CBA66B8AD"><enum>(1)</enum><header>In general</header><text>Concurrent with the submission to Congress of the President’s annual budget request in each year after the date of enactment of the <short-title>Oil Pollution Research and Development Program Reauthorization Act of 2013</short-title>, the Chair of the Interagency Committee shall submit to Congress a report describing the—</text> 
<subparagraph id="HA9EA077B55C24D9AA1574CA462E8E677"><enum>(A)</enum><text display-inline="yes-display-inline">activities carried out under this section in the preceding fiscal year, including—</text> 
<clause id="H60951AB3EF6142DBA1FFBFBEDC74A6BE"><enum>(i)</enum><text>a description of major research conducted on oil discharge prevention, detection, containment, recovery, and mitigation techniques in all environments by each agency described in subparagraphs (A) and (B) of subsection (a)(3); and</text></clause> 
<clause id="HC54BB41925B749E08AA507FF05122CEC"><enum>(ii)</enum><text>a summary of—</text> 
<subclause id="H85F256BEBED943CC8441589EDE9911D1"><enum>(I)</enum><text>projects in which the agency contributed funding or other resources;</text></subclause> 
<subclause id="HC8A6361331524B918E8D3060D7D83575"><enum>(II)</enum><text>major projects undertaken by State and tribal governments, and foreign governments; and</text></subclause> 
<subclause id="H256AADD65D0C4660ADCE59D6AD1C23AC"><enum>(III)</enum><text>major projects undertaken by the private sector and educational institutions;</text></subclause></clause></subparagraph> 
<subparagraph id="H0475E3DE54664F2CBDE7D47BE9052CE5"><enum>(B)</enum><text display-inline="yes-display-inline">activities being carried out under this section in the current fiscal year, including a description of major research and development activities on oil discharge prevention, detection, containment, recovery, and mitigation technologies and techniques in all environments that each agency will conduct or contribute to; and</text></subparagraph> 
<subparagraph id="HAEF6274F567C4EDEA007E34B219FD48A"><enum>(C)</enum><text display-inline="yes-display-inline">activities proposed to be carried out under this section in the subsequent fiscal year, including an analysis of how these activities will further the purposes of the program authorized by this section.</text></subparagraph></paragraph> 
<paragraph id="H9F99090746CA4B769695DD03FEBD3A9C"><enum>(2)</enum><header>Additional requirement</header><text>If the National Academy of Sciences provides recommendations on the research plan under section 7001(b)(3), the Chair shall include, in the first annual report under paragraph (1) of this subsection, a description of those recommendations incorporated into the research plan, and a description of, and explanation for, any recommendations that are not included in such plan.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section> 
<section commented="no" id="HEB8E4836AF3642328DBCF3C16F3FC757"><enum>7.</enum><header>Advisory committee</header><text display-inline="no-display-inline">Section 7001 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/33/2761">33 U.S.C. 2761</external-xref>) is further amended—</text> 
<paragraph id="H9266B10E37F4460DBCA36D3585F7AB39"><enum>(1)</enum><text>by striking subsection (f); and</text></paragraph> 
<paragraph id="HF39CC8823A654B899F85C8F1EF6D6C54"><enum>(2)</enum><text>by inserting after subsection (e) the following:</text>

<paragraph id="H6205FAF607CE45EB9FF2D04262BFE8DF"><enum>(1)</enum><header>Establishment</header><text>Not later than 90 days after the date of enactment of the <short-title>Oil Pollution Research and Development Program Reauthorization Act of 2013</short-title>, the Chair of the Interagency Committee shall establish an advisory committee to be known as the Oil Pollution Research Advisory Committee (in this subsection referred to as the <quote>advisory committee</quote>).</text></paragraph> 
<paragraph id="H957E8326C4BD48A58637FE0D9B4E667C"><enum>(2)</enum><header>Membership</header> 
<subparagraph id="H706490CFCB5D44338F6112FA92D82F0E"><enum>(A)</enum><header>In general</header><text>The advisory committee shall be composed of members appointed by the Chair, in consultation with each member agency described in subsection (a)(3), including—</text> 
<clause id="HC2050450C1114325A7AD6F85B8FDCEA5"><enum>(i)</enum><text>individuals with extensive knowledge and research experience or operational knowledge of prevention, detection, response, containment, and mitigation of oil discharges;</text></clause> 
<clause id="H976BB07D059E4B069B16816D8464D773"><enum>(ii)</enum><text>individuals broadly representative of stakeholders affected by oil discharges; and</text></clause> 
<clause id="HE2E2903B561543DE9073FD1052882518"><enum>(iii)</enum><text>other individuals, as determined by the Chair.</text></clause></subparagraph> 
<subparagraph id="H2D508CF9AA9449648E25D8B0AD36A11E"><enum>(B)</enum><header>Limitations</header><text>The Chair shall—</text> 
<clause id="H56E0516F59B14D0E954F26DC9315206F"><enum>(i)</enum><text>appoint no more than 25 members that shall not include representatives of the Federal Government, but may include representatives from State, tribal, and local governments; and</text></clause> 
<clause id="H4AF66190CFB841929212BF58AAF75A68"><enum>(ii)</enum><text>ensure that no class of individuals described in clause (ii) or (iii) of subparagraph (A) comprises more than <fraction>1/3</fraction> of the membership of the advisory committee.</text></clause></subparagraph> 
<subparagraph id="H9EEEDEB98D774C5C833A37F3677962B8"><enum>(C)</enum><header>Terms of service</header> 
<clause id="H0F39DF8A1D15485FA086C8C0D9FA14ED"><enum>(i)</enum><header>In general</header><text>Members shall be appointed for a 3-year term and may serve for not more than 2 terms, except as provided in clause (iii).</text></clause> 
<clause id="H58096ED6C70C4A7EA61F1D51554B14AC"><enum>(ii)</enum><header>Vacancies</header><text>Vacancy appointments shall be for the remainder of the unexpired term of the vacancy.</text></clause> 
<clause id="HCF39EFD736D044F0A569F6D84AA0BC98"><enum>(iii)</enum><header>Special rule</header><text>If a member is appointed to fill a vacancy and the remainder of the unexpired term is less than 1 year, the member may subsequently be appointed for 2 full terms.</text></clause></subparagraph> 
<subparagraph id="H4BFF97DD49624754A9B3D27B14C44E6B"><enum>(D)</enum><header>Compensation and expenses</header><text>Members of the advisory committee shall not be compensated for service on the advisory committee, but may be allowed travel expenses, including per diem in lieu of subsistence, in accordance with subchapter I of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/57">chapter 57</external-xref> of title 5, United States Code.</text></subparagraph></paragraph> 
<paragraph id="H37DFFB66E4554E008559EC4552C5B4EC"><enum>(3)</enum><header>Duties</header><text>The advisory committee shall review, advise, and comment on Interagency Committee activities, including the following:</text> 
<subparagraph commented="no" id="HD8A44CF74A724E06B8D12502292EA2D2"><enum>(A)</enum><text display-inline="yes-display-inline">Management and functioning of the Interagency Committee.</text></subparagraph> 
<subparagraph id="HD871D6AF98A44778ADEC8C98CCC55979"><enum>(B)</enum><text>Collaboration of the Interagency Committee and the agencies listed in subsection (a)(3)(B).</text></subparagraph> 
<subparagraph commented="no" id="H82F1CA922F7243FF8A20FE9F380A868B"><enum>(C)</enum><text>The research and technology development of new or improved response capabilities.</text></subparagraph> 
<subparagraph commented="no" id="H8CA3D091137B46768B28AAA11FE0B4D7"><enum>(D)</enum><text>The use of cost-effective research mechanisms.</text></subparagraph> 
<subparagraph commented="no" id="H9108E22BA6AB4E8AAB8BE1D95C12F6CC"><enum>(E)</enum><text>Research, computation, and modeling needs and other resources needed to develop a comprehensive program of oil pollution research.</text></subparagraph></paragraph> 
<paragraph commented="no" id="HF4E821B6CF704528910C1D2BEEF812AE"><enum>(4)</enum><header>Subcommittees</header><text>The advisory committee may establish subcommittees of its members.</text></paragraph> 
<paragraph id="HC238FBBFF2794C638ED7E0504044B9F0"><enum>(5)</enum><header>Meetings</header><text>The advisory committee shall meet at least once per year and at other times at the call of the chairperson.</text></paragraph> 
<paragraph commented="no" id="H3EF7C7F07A394B07BF1D29723A300D91"><enum>(6)</enum><header>Report</header><text>The advisory committee shall submit biennial reports to the Interagency Committee and Congress on the function, activities, and progress of the Interagency Committee and the programs established under this section.</text></paragraph> 
<paragraph commented="no" id="H3500DB8AB53743DCBD69F2C08FE4BA34"><enum>(7)</enum><header>Expiration</header><text>Section 14 of the Federal Advisory Committee Act (5 U.S.C. App.) shall not apply to the advisory committee.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section>

<subsection id="H78DEACEE92FA42188284106CE43B6BE4"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 7001 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/33/2761">33 U.S.C. 2761</external-xref>) is further amended by adding at the end the following new subsection:</text>

<paragraph id="H30DFC608B55E4B1581FD692EEEA980EA"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">There are authorized to be appropriated from amounts in the Fund not more than $48,000,000 annually to carry out this section, except for subsection (c)(8).</text></paragraph> 
<paragraph id="HDEC1C570303F47CEB726417ED84E8FC2"><enum>(2)</enum><header>Specific allocations</header><text display-inline="yes-display-inline">From the amounts in paragraph (1), there are authorized to be appropriated—</text> 
<subparagraph id="H2F4156E6FD6F47F4AA8B656C59DD9A9B"><enum>(A)</enum><text display-inline="yes-display-inline">$16,000,000 to the Administrator of the National Oceanic and Atmospheric Administration annually to carry out this section; and</text></subparagraph> 
<subparagraph id="HE693FAA2E5B44E38B5363EDCF8A230DA"><enum>(B)</enum><text>$2,000,000 for each of fiscal years 2014, 2015, 2016, and 2017 to carry out the activities in subsection (c)(6).</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="HFEBD6B3C9BBC48CC8F442610CE1ADE09"><enum>(b)</enum><header>Authorization</header><text>Section 1012(a)(5)(C) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/33/2712">33 U.S.C. 2712(a)(5)(C)</external-xref>) is amended to read as follows:</text> 
<quoted-block display-inline="no-display-inline" id="H1422F9B4497748C9BAAC2C1B0EDEA752" style="OLC"> 
<subparagraph id="H33B143270F3E44968CC0DBB9322CFFDB"><enum>(C)</enum><text display-inline="yes-display-inline">notwithstanding <external-xref legal-doc="usc" parsable-cite="usc/26/9509">section 9509(f)</external-xref> of the Internal Revenue Code of 1986, not more than $48,000,000 in each fiscal year shall be available to carry out title VII of this Act; and</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section> 
<section id="H930D0AC8135F4568AEDB989C00990D5A"><enum>9.</enum><header>Access to research during an emergency</header><text display-inline="no-display-inline">Section 7001 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/33/2761">33 U.S.C. 2761</external-xref>) is further amended by adding at the end the following new subsection:</text>

<subsection id="HCAE707DC18C04147B78487A44ABC89C0"><enum>(h)</enum><header>Access to research during an emergency</header><text display-inline="yes-display-inline">Any entity that receives Federal funding for research, the methodologies or results of which may be useful for response activities in the event of an oil discharge incident described in sections 300.300–334 of title 40 of the Code of Federal Regulations, shall, upon request to that entity, make the methodologies or results of such research available to the Interagency Committee and the Federal On-Scene Coordinator (as defined in section 311(a)(21) of the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1321">33 U.S.C. 1321(a)(21)</external-xref>)). Any methodologies or research results made available under this subsection shall be for use only for purposes of the response activities with respect to the oil discharge incident and shall not be available for disclosure under <external-xref legal-doc="usc" parsable-cite="usc/5/552">section 552</external-xref> of title 5, United States Code, or included in information made publicly available pursuant to this Act.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section>
