R. 3723</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action><action-date date="20131212">December 12, 2013</action-date><action-desc><sponsor name-id="C001075">Mr. Cassidy</sponsor> (for himself, <cosponsor name-id="G000558">Mr. Guthrie</cosponsor>, and <cosponsor name-id="D000604">Mr. Dent</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name>, and in addition to the Committee on <committee-name committee-id="HVR00">Veterans’ Affairs</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Public Health Service Act to revise and extend the program for viral hepatitis surveillance, education, and testing in order to prevent deaths from chronic liver disease and liver cancer, and for other purposes.</official-title></form><legis-body id="H57F44811FF494D5B94BC9D55FE55923D" style="OLC"><section id="HD7DD87EFA4A1474A9456C7F77DC2462F" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Viral Hepatitis Testing Act of 2013</short-title></quote>.</text></section><section id="HAC981BAB10CA435A865A36CC8F6A2564" section-type="subsequent-section"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds the following:</text><paragraph id="HBD493B33E1744D768DAA6DF3E57DDE26"><enum>(1)</enum><text>Approximately 5,300,000 Americans are chronically infected with the hepatitis B virus (referred to in this section as <quote>HBV</quote>), the hepatitis C virus (referred to in this section as <quote>HCV</quote>), or both.</text></paragraph><paragraph id="H6E286C07D5AF4328A383A82C95A25440"><enum>(2)</enum><text>In the United States, chronic HBV and HCV are among the most common causes of liver cancer, one of the most lethal and fastest growing cancers in the United States. Chronic HBV and HCV are among the most common causes of chronic liver disease, liver cirrhosis, and the most common indication for liver transplantation. More than 15,000 deaths per year in the United States can be attributed to chronic HBV and HCV. Chronic HCV is also a leading cause of death in Americans living with HIV/AIDS. Many of those living with HIV/AIDS are coinfected with chronic HBV, HCV, or both.</text></paragraph><paragraph id="HA0586EE4031E41B0B00FD879EC7898A6"><enum>(3)</enum><text>According to the Centers for Disease Control and Prevention (referred to in this section as the <term>CDC</term>), approximately 2 percent of the population of the United States is living with chronic HBV, HCV, or both. The CDC has recognized HCV as the Nation’s most common chronic bloodborne virus infection.</text></paragraph><paragraph id="HD41CBA26C20344B4A086F9AE6E1B58BB"><enum>(4)</enum><text>HBV is easily transmitted and is 100 times more infectious than HIV. According to the CDC, HBV is transmitted through contact with infectious blood, semen, or other body fluids. HCV is transmitted by contact with infectious blood, particularly through percutaneous exposures (i.e. puncture through the skin).</text></paragraph><paragraph id="H8027485B697F45AFBBC3D83704F640D8"><enum>(5)</enum><text>The CDC conservatively estimates that in 2011 approximately 16,600 Americans were newly infected with HCV and more than 18,800 Americans were newly infected with HBV. These estimates could be much higher due to many reasons, including lack of screening education and awareness, and perceived marginalization of the populations at risk.</text></paragraph><paragraph id="H4CF4A3846831421E8467DAB36A8D02BE"><enum>(6)</enum><text>In 2012 CDC released new guidelines recommending every person born from 1945 through 1965 receive a one-time HCV test. Among the estimated 102 million (1.6 million chronically HCV-infected) eligible for screening, birth-cohort screening leads to 74,000 fewer cases of decompensated cirrhosis, 46,000 fewer cases of hepatocellular carcinoma, 15,000 fewer liver transplants and 120,000 fewer HCV-related deaths versus risk-based screening.</text></paragraph><paragraph id="HD0D4291B6A0847A38253FE1E23A9D457"><enum>(7)</enum><text>In 2013, the United States Preventative Task Force (USPSTF) issued a Grade B rating for screening for hepatitis C virus (HCV) infection in persons at high risk for infection and adults born between 1945 and 1965. In 2009, the USPSTF issued a Grade A for screening pregnant women for the hepatitis B virus (HBV) during their first prenatal visit.</text></paragraph><paragraph id="HE920B571A7AC416CAF58905F96EE5C0D"><enum>(8)</enum><text>There were 35 outbreaks (19 of HBV, 16 of HCV) reported to CDC for investigation from 2008–2012 related to healthcare acquired infection of HBV and HCV, 33 of which occurred in non-hospital settings. There were more than 99,975 patients potentially exposed to one of the viruses.</text></paragraph><paragraph id="H247C2AC9812943C5A654AEBEEA43870D"><enum>(9)</enum><text>Chronic HBV and chronic HCV usually do not cause symptoms early in the course of the disease, but after many years of a clinically <term>silent</term> phase, CDC estimates show more than 33 percent of infected individuals will develop cirrhosis, end-stage liver disease, or liver cancer. Since most individuals with chronic HBV, HCV, or both are unaware of their infection, they do not know to take precautions to prevent the spread of their infection and can unknowingly exacerbate their own disease progression.</text></paragraph><paragraph id="HA2C65098CDD04538881E9AD05C150E89"><enum>(10)</enum><text>HBV and HCV disproportionately affect certain populations in the United States. Although representing about 6 percent of the population, Asian and Pacific Islanders account for over half of up to 1,400,000 domestic chronic HBV cases. Baby boomers (those born between 1945 and 1965) account for more than 75 percent of domestic chronic HCV cases. In addition, African-Americans, Latinos (Latinas), and American Indian/Native Alaskans are among the groups which have disproportionately high rates of HBV infections, HCV infections, or both in the United States.</text></paragraph><paragraph id="H6EBB2957003A457B9F02C82B218DB3A2"><enum>(11)</enum><text>For both chronic HBV and chronic HCV, behavioral changes can slow disease progression if a diagnosis is made early. Early diagnosis, which is determined through simple diagnostic tests, can also reduce the risk of transmission and disease progression through education and vaccination of household members and other susceptible persons at risk.</text></paragraph><paragraph id="H4291423D4B0D41C09B37AAC88ACBDB06"><enum>(12)</enum><text>Advancements have led to the development of improved diagnostic tests for viral hepatitis. These tests, including rapid, point of care testing and others in development, can facilitate testing, notification of results and post-test counseling, and referral to care at the time of the testing visit. In particular, these tests are also advantageous because they can be used simultaneously with HIV rapid testing for persons at risk for both HCV and HIV infections.</text></paragraph><paragraph id="H37CE6D8129304A5EAB8889C6432B6356"><enum>(13)</enum><text>For those chronically infected with HBV or HCV, regular monitoring can lead to the early detection of liver cancer at a stage where a cure is still possible. Liver cancer is the second deadliest cancer in the United States; however, liver cancer has received little funding for research, prevention, or treatment.</text></paragraph><paragraph id="H5E4D18C8032D4B2680D05D055844A7F1"><enum>(14)</enum><text>Treatment for chronic HCV can eradicate the disease in approximately 75 percent of those currently treated. The treatment of chronic HBV can effectively suppress viral replication in the overwhelming majority (over 80 percent) of those treated, thereby reducing the risk of transmission and progression to liver scarring or liver cancer, even though a complete cure is much less common than for HCV.</text></paragraph><paragraph id="HE731EB91D3974557BE1A54F4AB0AB4E7"><enum>(15)</enum><text>To combat the viral hepatitis epidemic in the United States, in May 2011, the Department of Health and Human Services released, Combating the Silent Epidemic of Viral Hepatitis: Action Plan for the Prevention, Care &amp; Treatment of Viral Hepatitis. The Institute of Medicine of the National Academies produced a 2010 report on the Federal response to HBV and HCV titled: Hepatitis and Liver Cancer: A National Strategy for Prevention and Control of Hepatitis B and C. The recommendations and guidelines provide a framework for HBV and HCV prevention, education, control, research, and medical management programs.</text></paragraph><paragraph id="HA88C195ED48F44739FB18E7DCC5931E5"><enum>(16)</enum><text>The annual health care costs attributable to viral hepatitis in the United States are significant. For HBV, it is estimated to be approximately $2,500,000,000 ($2,000 per infected person). In 2000, the lifetime cost of HBV—before the availability of most current therapies—was approximately $80,000 per chronically infected person, totaling more than $100,000,000,000. For HCV, medical costs for patients are expected to increase from $30,000,000,000 in 2009 to over $85,000,000,000 in 2024. Avoiding these costs by screening and diagnosing individuals earlier—and connecting them to appropriate treatment and care will save lives and critical health care dollars. Currently, without a comprehensive screening, testing and diagnosis program, most patients are diagnosed too late when they need a liver transplant costing at least $314,000 for uncomplicated cases or when they have liver cancer or end stage liver disease which costs between $30,980 to $110,576 per hospital admission. As health care costs continue to grow, it is critical that the Federal Government invests in effective mechanisms to avoid documented cost drivers.</text></paragraph><paragraph id="H1309B47A48CD4846BC70540A6C937103"><enum>(17)</enum><text>According to the Institute of Medicine report in 2010 (described in paragraph (13)), chronic HBV and HCV infections cause substantial morbidity and mortality despite being preventable and treatable. Deficiencies in the implementation of established guidelines for the prevention, diagnosis, and medical management of chronic HBV and HCV infections perpetuate personal and economic burdens. Existing grants are not sufficient to address the scale of the health burden presented by HBV and HCV.</text></paragraph><paragraph id="HB863999712CE434990003B576BCEA134"><enum>(18)</enum><text>The Secretary of Health and Human Services has the discretion to carry out this Act directly and through whichever of the agencies of the Public Health Service the Secretary determines to be appropriate, which may (in the Secretary’s discretion) include the Centers for Disease Control and Prevention, the Health Resources and Services Administration, the Substance Abuse and Mental Health Services Administration, the National Institutes of Health (including the National Institute on Minority Health and Health Disparities), and other agencies of such Service.</text></paragraph><paragraph id="H230182F3F6484477BBB58BA14BA564B4"><enum>(19)</enum><text>For over a decade, the Centers for Disease Control and Prevention’s Viral Hepatitis Prevention Coordinator (VHPC) program has been the only national program dedicated to the prevention and control of the viral hepatitis epidemics administering the duties currently specified by Section 317N of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/247b-15">42 U.S.C. 247b–15</external-xref>) at State and local health departments. VHPCs provide the technical expertise necessary for the management and coordination of activities to prevent viral hepatitis infection and disease with little to no Federal funding for program implementation or development. Further, these coordinators help integrate viral hepatitis prevention services into health care settings and public health programs that serve adults at risk for viral hepatitis.</text></paragraph></section><section id="HC21D842687354D1DA0CC4B261D935072"><enum>3.</enum><header>Revision and extension of hepatitis surveillance, education, and testing program</header><subsection id="H504E0D5CD6B74ED49ADECC4A9381CAE1"><enum>(a)</enum><header>In general</header><text>Section 317N of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/247b-15">42 U.S.C. 247b–15</external-xref>) is amended—</text><paragraph id="HA14280072DA7415EA546BF5A64EDBF9F"><enum>(1)</enum><text>by amending the section heading to read as follows: <quote><header-in-text level="section" style="OLC">Surveillance, education, testing, and linkage to care regarding hepatitis virus</header-in-text></quote>;</text></paragraph><paragraph id="H43CE8779EAF44685B22DF03FDC5FC403"><enum>(2)</enum><text>by redesignating subsections (b) and (c) as subsections (d) and (e), respectively; and</text></paragraph><paragraph id="HAFC8C847545642AF9C2F9CDA05CBCBB3"><enum>(3)</enum><text>by striking subsection (a) and inserting the following:</text><quoted-block id="H85BDE43DF2DD473F9873DE2C73556D59" style="OLC"><subsection id="H87CAA7CE07ED4265813E5FE88D0F8C13"><enum>(a)</enum><header>In general</header><text>The Secretary shall, in accordance with this section, carry out surveillance, education, and testing programs with respect to hepatitis B and hepatitis C virus infections (referred to in this section as <term>HBV</term> and <term>HCV</term>, respectively). The Secretary may carry out such programs directly and through grants to public and nonprofit private entities, including States, political subdivisions of States, territories, Indian tribes, and public-private partnerships.</text></subsection><subsection id="H01E7A51A94D441F7887A3BB2E3E305EB"><enum>(b)</enum><header>National system</header><text>In carrying out subsection (a), the Secretary shall, in consultation with States and other public or nonprofit private entities and public-private partnerships described in subsection (d), establish a national system with respect to HBV and HCV with the following goals:</text><paragraph id="H0BC8FCC572544AB3B215F3E283DFAB7E"><enum>(1)</enum><text>To determine the incidence and prevalence of such infections, including providing for the reporting of acute and chronic cases.</text></paragraph><paragraph id="H6226DD8F2F2F4C108522410947940B16"><enum>(2)</enum><text>With respect to the population of individuals who have such an infection, to carry out testing programs to increase the number of individuals who are aware of their infection to 50 percent by December 31, 2014, and to 75 percent by December 31, 2016.</text></paragraph><paragraph id="HC00BA12A57E1422399B9C9C9D3EB67C2"><enum>(3)</enum><text>To develop and disseminate public information and education programs for the detection and control of such infections.</text></paragraph><paragraph id="HA2CAFA75ED2045FFA9AADEE22514C472"><enum>(4)</enum><text>To improve the education, training, and skills of health professionals in the detection, control, and care and treatment, of such infections.</text></paragraph><paragraph id="H9AC21893355D47C69D08E007E6CBB131"><enum>(5)</enum><text>To provide appropriate referrals for counseling and medical care and treatment of infected individuals and to ensure, to the extent practicable, the provision of appropriate follow-up services.</text></paragraph></subsection><subsection id="H7A47F8AC9C464F7AA5C638E3FC3D68C5"><enum>(c)</enum><header>High-Risk populations; chronic cases</header><paragraph id="H3F7D06A8B76F4A5786E97A62DABC6711"><enum>(1)</enum><header>In general</header><text>The Secretary shall determine the populations that, for purposes of this section, are considered at high-risk for HBV or HCV. The Secretary shall include the following among those considered at high-risk:</text><subparagraph id="H1BA4FD549755420FBAE904F44723CE0D"><enum>(A)</enum><text>For HBV, individuals born in countries in which 2 percent or more of the population has HBV or who are a part of a high-risk category as identified by the Centers for Disease Control and Prevention.</text></subparagraph><subparagraph id="H70AED5D35B2041BCBAC053FECDC8DD1D"><enum>(B)</enum><text>For HCV, individuals born between 1945 and 1965 or who are a part of a high-risk category as identified by the Centers for Disease Control and Prevention.</text></subparagraph><subparagraph id="H249A18C806434A31A47494F3EB9420CE"><enum>(C)</enum><text>Those who have been exposed to the blood of infected individuals or of high-risk individuals or who are family members of such individuals.</text></subparagraph></paragraph><paragraph id="H6D27E21342B943AF8AED0A1FE3959AF9"><enum>(2)</enum><header>Priority in programs</header><text>In providing for programs under this section, the Secretary shall give priority—</text><subparagraph id="H931926FC9EF444339568D051CD4E88C7"><enum>(A)</enum><text>to early diagnosis of chronic cases of HBV or HCV in high-risk populations under paragraph (1); and</text></subparagraph><subparagraph id="H57DF7E019F5E4C46A242A13C21E8256F"><enum>(B)</enum><text>to education, and referrals for counseling and medical care and treatment, for individuals diagnosed under subparagraph (A) in order to—</text><clause id="HBD30F63084594D14A7F51F41D346BC99"><enum>(i)</enum><text>reduce their risk of dying from end-stage liver disease and liver cancer, and of transmitting the infection to others;</text></clause><clause id="HE26BD819EEEB41B985C58EDC147F8D4D"><enum>(ii)</enum><text>determine the appropriateness for treatment to reduce the risk of progression to cirrhosis and liver cancer;</text></clause><clause id="H9942C204FDF54B0FAB1A5BA5C96660C3"><enum>(iii)</enum><text>receive ongoing medical management, including regular monitoring of liver function and screenings for liver cancer;</text></clause><clause id="HE6A7514EBE15480481A6F6599D056652"><enum>(iv)</enum><text>receive, as appropriate, drug, alcohol abuse, and mental health treatment;</text></clause><clause id="H24EA5065F18943708026CB8D901DAD4E"><enum>(v)</enum><text>in the case of women of childbearing age, receive education on how to prevent HBV perinatal infection, and to alleviate fears associated with pregnancy or raising a family; and</text></clause><clause id="HE9EF7D4524FD44BABE03E016FA59203F"><enum>(vi)</enum><text>receive such other services as the Secretary determines to be appropriate.</text></clause></subparagraph></paragraph><paragraph id="H330E6C269B7542E7A5F4EC36391ABCE6"><enum>(3)</enum><header>Cultural context</header><text>In providing for services pursuant to paragraph (2) for individuals who are diagnosed under subparagraph (A) of such paragraph, the Secretary shall seek to ensure that the services are provided in a culturally and linguistically appropriate manner.</text></paragraph></subsection><subsection id="HDE6CF1D89A0E47D9A80332673CE196C6"><enum>(d)</enum><header>Public-Private partnerships</header><paragraph id="HA5F60EFD102F4614B852E6E175C580FB"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">In carrying out this section, and not later than 60 days after the date of the enactment of the <short-title>Viral Hepatitis Testing Act of 2013</short-title>, the Secretary shall, in consultation with the Assistant Secretary for Health, the Director of the Centers for Disease Control and Prevention, the Health Resources and Services Administration, the Substance Abuse and Mental Health Services Administration, the Office of Minority Health, the Indian Health Service, other relevant agencies, and non-government stakeholder entities, establish and support public-private partnerships that facilitate the surveillance, education, screening, testing, and linkage to care programs authorized by this section.</text></paragraph><paragraph id="H3919E94643AB443AB6106CE8F65AED56"><enum>(2)</enum><header>Duties</header><text>Public-private partnerships established or supported under paragraph (1) shall—</text><subparagraph id="H96BEF82CED434019B531558ED75F79F0"><enum>(A)</enum><text>focus primarily on the surveillance, education, screening, testing, and linkage to care programs authorized by this section;</text></subparagraph><subparagraph id="H6444B5BEC2C14AD18B05C2BB8D361ED3"><enum>(B)</enum><text>generate resources, in addition to the funds made available pursuant to subsection (f), to carry out the surveillance, education, screening, testing, and linkage to care programs authorized in this section by leveraging Federal funding with non-Federal funding and support;</text></subparagraph><subparagraph id="HF591C043FD4441A98F054E07C20D7221"><enum>(C)</enum><text>allow for investments in such programs of financial or in-kind resources by each of the partners involved in the partnership;</text></subparagraph><subparagraph id="HD411AAB3DE2E4CE483CF457ABB46723B"><enum>(D)</enum><text>include corporate and industry entities, academic institutions, public and non-profit organizations, community and faith-based organizations, foundations, and other governmental and non-governmental organizations; and</text></subparagraph><subparagraph id="H281256C3C87549DC91D89406753B641E"><enum>(E)</enum><text>advance the core goals of each of the partners of the partnership as determined by the Secretary in development of the partnership.</text></subparagraph></paragraph><paragraph id="H33A657E589D94B97910696E5BAB426D2"><enum>(3)</enum><header>Annual reports</header><text>The Secretary shall provide to the Congress an annual report on the public-private partnerships established under this subsection. Each such report shall include—</text><subparagraph id="H9976D2B7663745B0BB2C9A80B9F35B6B"><enum>(A)</enum><text>the number of public-private partnerships established;</text></subparagraph><subparagraph id="HA65F363622A24AF3B8DA5417835F8271"><enum>(B)</enum><text>specific and quantifiable information on the surveillance, education, screening, testing, and linkage to care activities conducted as well as the outcomes achieved through each of the public-private partnerships;</text></subparagraph><subparagraph id="HB035B03B2DE448B284E2D293AA2EA8CC"><enum>(C)</enum><text>the amount of Federal funding or resources dedicated to the public-private partnerships;</text></subparagraph><subparagraph id="H7A4D21A379BB432E830A90913BD4EEE6"><enum>(D)</enum><text>the amount of non-Federal funding or resources leveraged through the public-private partnerships; and</text></subparagraph><subparagraph id="H756F523A9AB2424F9F385BEDF0CCE84D"><enum>(E)</enum><text>a plan for the following year that outlines future activities.</text></subparagraph></paragraph><paragraph id="H0CBC2292814A4EF4A82648959C75349E"><enum>(4)</enum><header>Limitation</header><text>No more than 25 percent of the funds made available to carry out this section may be used for public-private partnerships established or supported under this subsection.</text></paragraph><paragraph id="H2106FF1D075247F2AC6596016DA22C3C"><enum>(5)</enum><header>Linkage to care</header><text display-inline="yes-display-inline">For purposes of this section, the term <term>linkage to care</term> means, with respect to an individual with a diagnosis of HBV or HCV, the referral of such individual to clinical care for a thorough evaluation of their clinical status to determine the need for treatment, vaccination for HBV, or other therapy.</text></paragraph></subsection><subsection id="H5DD233634AA64FC0ACA733BE0AE9E78B"><enum>(e)</enum><header>Agency for healthcare research and quality HBV and HCV guidelines</header><text display-inline="yes-display-inline">Due to the rapidly evolving standard of care associated with diagnosing and treating viral hepatitis infection, the Director of the Agency for Healthcare Research and Quality shall convene the Preventive Services Task Force under section 915(a) to review its recommendation for screening for HBV and HCV infection every 3 years.</text></subsection><subsection id="HCF31897524E44ADDA6441DD27EEF94B4"><enum>(f)</enum><header>Funding</header><paragraph id="H6DDCAA7E910947ACB252F76F9386E52C"><enum>(1)</enum><header>In general</header><text>In addition to any amounts otherwise authorized by this Act, there are authorized to be appropriated to carry out this section—</text><subparagraph id="H0E0E022E60C04463ADABFCC1AF0C82DB"><enum>(A)</enum><text>$25,000,000 for fiscal year 2014;</text></subparagraph><subparagraph id="H607A594819A7491FB87E542B7D28AF45"><enum>(B)</enum><text>$35,000,000 for fiscal year 2015; and</text></subparagraph><subparagraph id="HDA0C020483C54FCBBCBD0EDCAA4D09F7"><enum>(C)</enum><text>$20,000,000 for fiscal year 2016.</text></subparagraph></paragraph><paragraph id="H7AC1F06948494DD687CF5BEC9D9CFAAF"><enum>(2)</enum><header>Grants</header><text>Of the amounts appropriated pursuant to paragraph (1) for a fiscal year, the Secretary shall reserve not less than 80 percent for making grants under subsection (a).</text></paragraph><paragraph id="H598301F5C367412DB3F3D76C9727334B"><enum>(3)</enum><header>Source of funds</header><text display-inline="yes-display-inline">The funds made available to carry out this section shall be derived exclusively from the funds appropriated or otherwise made available for planning and evaluation under this Act.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H5F7392252BF643A584C815434B24F9FD"><enum>(b)</enum><header>Savings Provision</header><text>The amendments made by this section shall not be construed to require termination of any program or activity carried out by the Secretary of Health and Human Services under section 317N of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/247b-15">42 U.S.C. 247b–15</external-xref>) as in effect on the day before the date of the enactment of this Act.</text></subsection></section><section id="H0391FE3D08684060ACF15B58D6FA4A5C"><enum>4.</enum><header>Hepatitis C screening and evaluation of needed care for veterans</header><subsection id="H38BB8183E83D49D8B0086348D4A6446B"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Subchapter II of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/38/17">chapter 17</external-xref> of title 38, United States Code, is amended by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="H8C063FB908F14000AB28E692225E5ED1" style="USC"><section id="H929820C19BBA43ABBDB454AC065CD7C6"><enum>1720H.</enum><header>Hepatitis C screening and evaluation of needed care for veterans</header><subsection id="H445AE805EC9D47E7B3325554813911FD"><enum>(a)</enum><header>In general</header><paragraph commented="no" display-inline="yes-display-inline" id="H7EBD3093554741A985370E70F1C74A48"><enum>(1)</enum><text display-inline="yes-display-inline">The Secretary shall establish and carry out a plan to provide veterans described in paragraph (2) with—</text><subparagraph id="H25AC6310D341479FB955C39733DB8B1C" indent="up1"><enum>(A)</enum><text display-inline="yes-display-inline">a risk assessment for the hepatitis C virus; and</text></subparagraph><subparagraph id="HD15959E9396D4DE5924762BE7BA78054" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">if a veteran is diagnosed with such virus—</text><clause id="H4C6958DA89CB4058BFDB67C934FF4EF1"><enum>(i)</enum><text>a thorough evaluation of the clinical status of the veteran to determine the need for treatment, vaccination, or other therapy; and</text></clause><clause id="H76390221CC0A42E2AF3E3D29C0A0BFA3"><enum>(ii)</enum><text>information with respect to the needs determined under clause (i).</text></clause></subparagraph></paragraph><paragraph id="HA15609EE8EED482AB14033338764435F" indent="up1"><enum>(2)</enum><text>Veterans described in this paragraph are veterans who—</text><subparagraph id="HFC7DB767AA7D455385FED33F7874B247"><enum>(A)</enum><text display-inline="yes-display-inline">are enrolled in the health care system established under section 1705(a) of this title; and</text></subparagraph><subparagraph id="HFBE5471FED6A4275ACA1C875F4D7B798"><enum>(B)</enum><text>were born between 1945 and 1965.</text></subparagraph></paragraph></subsection><subsection id="H627BF6FF577146499B8D130C5CEC0FF2"><enum>(b)</enum><header>Compliance</header><paragraph commented="no" display-inline="yes-display-inline" id="H6866B0671BD542BA8C16524D4F9F8355"><enum>(1)</enum><text>The Secretary shall use the plan established under subsection (a)(1) as a key measure in determining performance under the VA Handbook Performance Management System, or the successor to such handbook, to ensure the compliance of such plan.</text></paragraph><paragraph display-inline="no-display-inline" id="HB848CD330699414A96B02EDCC02E25D3" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">If the Secretary determines that a medical facility of the Department complies with the plan established under subsection (a)(1) at a rate less than 100 percent, the Secretary shall treat the director of such medical facility as <quote>less than fully successful</quote>with respect to the performance appraisal that is used for the basis for determining performance awards under the handbook described in paragraph (1).</text></paragraph></subsection><subsection id="H7658497ADE244B258740362710070BF3"><enum>(c)</enum><header>Annual report</header><text>The Secretary shall submit annually to Congress a report on the compliance of each medical facility of the Department with the plan established under subsection (a)(1).</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H21318761EF784390A05981F813ED9106"><enum>(b)</enum><header>Clerical amendment</header><text>The table of sections at the beginning of such chapter is amended by inserting after the item relating to section 1720G the following new item:</text><quoted-block display-inline="no-display-inline" id="HA095C2C81DB14CE4BCBADEAEAD16A1A2" style="USC"><toc regeneration="no-regeneration"><toc-entry level="section">1720H.
