R. 3722</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action><action-date date="20131212">December 12, 2013</action-date><action-desc><sponsor name-id="L000111">Mr. Latham</sponsor> (for himself and <cosponsor name-id="R000588">Mr. Richmond</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name>, and in addition to the Committee on the <committee-name committee-id="HJU00">Judiciary</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title>To provide protections for certain sports medicine professionals who provide certain medical services in a secondary State.</official-title></form><legis-body id="H69164CF80E3541A989B32CD54079051E" style="OLC"><section id="HCF18E1096E4C494B8543530FC1D0507E" section-type="section-one"><enum>1.</enum><header>Protections for covered sports medicine professionals</header><subsection id="H167A35010344456D944A20FDF556F3F7"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">If a covered sports medicine professional provides covered medical services to an athlete, an athletic team, or a staff member of an athlete or athletic team in a secondary State, such services shall be deemed to have been provided in the primary State for the following purposes:</text><paragraph id="H25436F53F6934B2488EFCC326051DE02"><enum>(1)</enum><text display-inline="yes-display-inline">Determining the medical professional liability insurance of that professional.</text></paragraph><paragraph id="H2940D6F2966F4105ADDE4B4E92BD119A"><enum>(2)</enum><text>Determining the civil and criminal malpractice liability of that professional.</text></paragraph></subsection></section><section id="H5C08D5177CBB42B1BE163819A5B28AE1"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act the following definitions apply:</text><paragraph id="HFF89CCC3D57A4980A6EF3FE6737502FD"><enum>(1)</enum><header>Athlete</header><text display-inline="yes-display-inline">The term <term>athlete</term> means an individual —</text><subparagraph id="H71D4C9CC5649407F8D96D5FEE10CD16A"><enum>(A)</enum><text>competing in a sporting event sponsored or sanctioned by a national governing body; or</text></subparagraph><subparagraph id="HEBA1A0378A4745709EE30B46FFFF6DE0"><enum>(B)</enum><text display-inline="yes-display-inline">for whom an institution of higher education provides a covered sports medicine professional.</text></subparagraph></paragraph><paragraph id="H64249C46F7FD41C8857373CEFB92D023"><enum>(2)</enum><header>Athletic team</header><text display-inline="yes-display-inline">The term <term>athletic team</term> means a sports team—</text><subparagraph id="HCB976D26CA804FABA627A9046D18BDBA"><enum>(A)</enum><text>composed of individuals who are paid to participate on the team;</text></subparagraph><subparagraph id="H9C23E3A4ADD84E35A24D74E607A579E2"><enum>(B)</enum><text>composed of individuals who are competing in a sporting event sponsored or sanctioned by a national governing body; or</text></subparagraph><subparagraph id="HDB21DC6EF24E4FF1AA254C13E273805B"><enum>(C)</enum><text>for which an institution of higher education provides a covered sports medicine professional.</text></subparagraph></paragraph><paragraph id="H6BFA8C2F85454DD3B297A98EF47E7B6D"><enum>(3)</enum><header>Covered medical services</header><text>The term <term>covered medical services</term> means general medical care, emergency medical care, or athletic training services. Such term does not include care provided by a covered sports medicine professional—</text><subparagraph id="H906D74651B324824822A4984E4AD8262"><enum>(A)</enum><text>at a health care facility; or</text></subparagraph><subparagraph id="HBC32D46CE46641DDAE824807873DA965"><enum>(B)</enum><text>while a health care provider legally authorized to practice in the secondary State is transporting the injured individual to a health care facility.</text></subparagraph></paragraph><paragraph id="HB8462A908DB9454F9E0F240FDD7EDA4A"><enum>(4)</enum><header> Covered sports medicine professional</header><text display-inline="yes-display-inline">The term <term>covered sports medicine professional</term> means a physician or athletic trainer who—</text><subparagraph display-inline="no-display-inline" id="H49CC5A5430B949E3967428EB72EE670A"><enum>(A)</enum><text display-inline="yes-display-inline">is legally authorized to practice in the primary State;</text></subparagraph><subparagraph id="H7B8BC5ED0E944C639D37AAC475CAB2CB"><enum>(B)</enum><text>provides covered medical services, pursuant to a written agreement with an athletic team, national governing body, or institution of higher education, to an individual who is a member or staff of the athletic team; and</text></subparagraph><subparagraph id="H68FE1F12DF7B4CD4AFEB70F62FC2C462"><enum>(C)</enum><text display-inline="yes-display-inline">prior to providing the covered medical services described in subparagraph (B), has disclosed the nature and extent of such services to the entity that provides the physician or athletic trainer with medical professional liability insurance in the primary State.</text></subparagraph></paragraph><paragraph id="HAA63142BEB0747C1B625C7C364278388"><enum>(5)</enum><header>Health care facility</header><text display-inline="yes-display-inline">The term <term>health care facility</term> means a facility in which medical care, diagnosis, or treatment is provided on an inpatient or outpatient basis. Such term does not include facilities at an arena or stadium or temporary facilities existing for events where athletic teams are competing.</text></paragraph><paragraph id="H4F9F0A89C0444A2E86928F3CD9CDD407"><enum>(6)</enum><header>Institution of higher education</header><text display-inline="yes-display-inline">The term <term>institution of higher education</term> has the meaning given such term in section 101 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1001">20 U.S.C. 1001</external-xref>).</text></paragraph><paragraph id="H18033FB62094474380997D9736F383B8"><enum>(7)</enum><header>National governing body</header><text display-inline="yes-display-inline">The term <term>national governing body</term> has the meaning given such term in <external-xref legal-doc="usc" parsable-cite="usc/36/220501">section 220501</external-xref> of title 36, United States Code.</text></paragraph><paragraph id="HB8A38C28BA0B487DBFC9768FDF94A0D2"><enum>(8)</enum><header>Primary State</header><text display-inline="yes-display-inline">The term <term>primary State</term> means the State in which the covered sports medicine professional is legally authorized to practice.</text></paragraph><paragraph id="H76656D83A4964240AD3844E84CD24F8E"><enum>(9)</enum><header>Secondary State</header><text display-inline="yes-display-inline">The term <term>secondary State</term> means any State in which the covered sports medicine professional is not legally authorized to practice.</text></paragraph><paragraph id="HD6B722E37B1148EABB3E2FE7FE851558"><enum>(10)</enum><header>State</header><text>The term <term>State</term> means each of the several States, the District of Columbia, and each commonwealth, territory, or possession of the United States.</text></paragraph></section></legis-body></bill>
