which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name>, and in addition to the Committees on <committee-name committee-id="HAS00">Armed Services</committee-name>, <committee-name committee-id="HJU00">the Judiciary</committee-name>, and <committee-name committee-id="HVR00">Veterans’ Affairs</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title>To provide for a prescription drug take-back program for members of the Armed Forces and veterans, and for other purposes.</official-title></form><legis-body id="H62B81C82E85F459696B6C0917AF39A0C" style="OLC"><section id="H9C7711E2290043159B750A3A2AA3F3E5" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Servicemembers and Veterans Prescription Drug Safety Act of 2013</short-title></quote>.</text></section><section id="HC7246F92CD7F470882D2F0AA6246AAC7"><enum>2.</enum><header>Prescription drug take-back program for members of the Armed Forces and their dependents</header><subsection id="H5B28CFCACBD748BAA13102C3D1195118"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph id="HF72E2F1987DB4E62BCBA7C1660544D7D"><enum>(1)</enum><header>Covered beneficiary</header><text>The term <term>covered beneficiary</term> has the meaning given that term in <external-xref legal-doc="usc" parsable-cite="usc/10/1072">section 1072</external-xref> of title 10, United States Code.</text></paragraph><paragraph id="H35272F9AE2844606AD3C9B8E06B06584"><enum>(2)</enum><header>Covered controlled substance</header><text>The term <term>covered controlled substance</term> means a controlled substance that is listed in schedule II, III, IV, or V of section 202(c) of the Controlled Substances Act (<external-xref legal-doc="usc" parsable-cite="usc/21/812">21 U.S.C. 812(c)</external-xref>).</text></paragraph><paragraph id="H4B786F9788C8488E9C57019A8D688CEA"><enum>(3)</enum><header>Dependent</header><text>The term <term>dependent</term> has the meaning given that term in <external-xref legal-doc="usc" parsable-cite="usc/10/1072">section 1072</external-xref> of title 10, United States Code.</text></paragraph><paragraph id="HAFE875C50A7A4B40ACFFB9B0F15948B2"><enum>(4)</enum><header>Eligible person</header><text>The term <term>eligible person</term> means—</text><subparagraph id="H8953E07435844820ADC506DDD574D201"><enum>(A)</enum><text>a member of the Armed Forces;</text></subparagraph><subparagraph id="HA46BC65E553E4EE2ADED24B88121A5A7"><enum>(B)</enum><text>an individual who is receiving or is entitled to receive retired or retainer pay under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/10/71">chapter 71</external-xref> of title 10, United States Code;</text></subparagraph><subparagraph id="HC47A4B0B71214C559BF61BD68F6A94C1"><enum>(C)</enum><text>a dependent of a member of the Armed Forces, if that dependent is a covered beneficiary in receipt of health care services under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/10/55">chapter 55</external-xref> of title 10, United States Code; and</text></subparagraph><subparagraph id="H1DADDBD84D024BF3837687D658FB333B"><enum>(D)</enum><text>any person lawfully entitled to dispose of the property of a person described in subparagraphs (A) through (C) who dies while lawfully in possession of a covered controlled substance for personal use.</text></subparagraph></paragraph><paragraph id="HB155E340478547C286241C1BCADF3C28"><enum>(5)</enum><header>Program</header><text>The term <term>program</term> means the program established under subsection (b)(1).</text></paragraph><paragraph id="HAE9C1E17C3D74A60934E1C85FCD5B831"><enum>(6)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Defense.</text></paragraph></subsection><subsection id="HBAC811CA651A4BA78A33419DE83E525A"><enum>(b)</enum><header>Program required</header><paragraph id="HAAA3B4E86B8640C3BA3A96BA56957838"><enum>(1)</enum><header>In general</header><text>The Secretary and the Attorney General shall jointly carry out a program, which shall, except as provided in paragraph (2), be carried out in accordance with section 302(g) of the Controlled Substances Act (<external-xref legal-doc="usc" parsable-cite="usc/21/822">21 U.S.C. 822(g)</external-xref>), under which an eligible person who has lawfully obtained a covered controlled substance in accordance with such Act may deliver the covered controlled substance to be disposed of at a facility and by a person specified under paragraph (2).</text></paragraph><paragraph id="H0A7988616B61427EA3122EBFB50FFEDA"><enum>(2)</enum><header>Delivery of controlled substances</header><text>Notwithstanding the requirement under section 302(g)(1) of the Controlled Substances Act (<external-xref legal-doc="usc" parsable-cite="usc/21/822">21 U.S.C. 822(g)(1)</external-xref>) that a person receiving a controlled substance be authorized to receive the controlled substance under such Act, the Secretary and the Attorney General shall jointly specify the facilities and persons to which covered controlled substances may be delivered under the program.</text></paragraph></subsection><subsection id="H2303D7EB7ABF46CA9E55BA7001F4771C"><enum>(c)</enum><header>Prevention of abuse</header><text>In implementing the program, the Secretary and the Attorney General shall jointly develop appropriate guidelines and procedures to prevent the diversion, misuse, theft, or loss of controlled substances delivered under the program.</text></subsection><subsection id="H20C02295623043358BE47646E9A705E6"><enum>(d)</enum><header>Administration of program</header><paragraph id="HABA84A1D5EDA420A82E58F7AE03E1920"><enum>(1)</enum><header>Regulations</header><text>Not later than 1 year after the date of enactment of this Act, the Secretary and the Attorney General shall jointly prescribe regulations to carry out the program.</text></paragraph><paragraph id="H4153AE49F2DD4421B47248D9D2667DAF"><enum>(2)</enum><header>Implementation</header><text>Not later than 1 year after the date on which the Secretary and the Attorney General jointly prescribe regulations under paragraph (1), the Secretary shall fully implement the program.</text></paragraph></subsection></section><section id="H947AB6FD0AB44B9D914848151A4B83DB"><enum>3.</enum><header>Prescription drug take-back program for veterans and their dependents</header><subsection id="H1BDFD7EE822041CDACE9CE70C2A83772"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph id="H6CAABA591E2940F1AAD992432FE0FAC7"><enum>(1)</enum><header>Covered controlled substance</header><text>The term <term>covered controlled substance</term> means a controlled substance that is listed in schedule II, III, IV, or V of section 202(c) of the Controlled Substances Act (<external-xref legal-doc="usc" parsable-cite="usc/21/812">21 U.S.C. 812(c)</external-xref>).</text></paragraph><paragraph id="H7994AECA04EE470C972134DE1430D90B"><enum>(2)</enum><header>Eligible person</header><text>The term <term>eligible person</term> means—</text><subparagraph id="H1D1859F81C1D43259A44054044D76C12"><enum>(A)</enum><text>a veteran;</text></subparagraph><subparagraph id="H617EBE2184FF4659B2299EEF7AEFC8E0"><enum>(B)</enum><text>the spouse of a veteran, if the spouse is in receipt of medical services under laws administered by the Secretary;</text></subparagraph><subparagraph id="H3E5BB1EA53C74117AB873A9C87154A7C"><enum>(C)</enum><text>a dependent of a veteran, if the dependent is in receipt of medical services under laws administered by the Secretary;</text></subparagraph><subparagraph commented="no" id="H3DF2DE60B0214B3082D40AE4094123FB"><enum>(D)</enum><text>a person described in section 2(a)(4) who is in receipt of medical services at a facility of the Department of Veterans Affairs;
