R. 3713</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action><action-date date="20131212">December 12, 2013</action-date><action-desc><sponsor name-id="J000294">Mr. Jeffries</sponsor> (for himself and <cosponsor name-id="P000592">Mr. Poe of Texas</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Trademark Act of 1946 to provide for the registration of marks consisting of a flag, coat of arms, or other official insignia of the United States or of any State or local government, and for other purposes.</official-title></form><legis-body id="H234B0506602442B8BD9F7D93884DEBB2" style="OLC"><section id="H4AF0AE589B774C058AE764BB1AC16DA0" section-type="section-one"><enum>1.</enum><header>Registration of certain marks of the United States and State and local governments</header><text display-inline="no-display-inline">Section 2(b) of the Act entitled <quote>An Act to provide for the registration and protection of trademarks used in commerce, to carry out the provisions of certain international conventions, and for other purposes</quote>, approved July 6, 1946 (commonly referred to as the <quote>Trademark Act of 1946</quote>; <external-xref legal-doc="usc" parsable-cite="usc/15/1052">15 U.S.C. 1052(b)</external-xref>) is amended by inserting after <quote>simulation thereof</quote> the following: <quote>, except that this subsection shall not prevent the United States, or any State, municipality, county, political subdivision, or other governmental authority in the United States, from obtaining registration under this Act of any mark that consists of or comprises its own flag, coat of arms, or other official insignia</quote>.</text></section></legis-body></bill>
