which was referred to the <committee-name committee-id="HPW00">Committee on Transportation and Infrastructure</committee-name>, and in addition to the Committees on <committee-name committee-id="HFA00">Foreign Affairs</committee-name>, <committee-name committee-id="HIF00">Energy and Commerce</committee-name>, and <committee-name committee-id="HII00">Natural Resources</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title>To provide for the expedited approval of the construction, operation, and maintenance of the Keystone XL pipeline, and for other purposes.</official-title></form><legis-body id="H296E19344DDE42A797F841F962A17E78" style="OLC"><section id="H5ED683CF1A824D309F636400F4485ACD" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Approve the Pipeline Now Act</short-title></quote>.</text></section><section display-inline="no-display-inline" id="H61BFFA8B958B4B63B54B47D0C3A40CC3" section-type="subsequent-section"><enum>2.</enum><header> Keystone XL pipeline and environmental impact statement approval</header><subsection id="H2DDE20377998475FB6DC577F07DACCB1"><enum>(a)</enum><header>Requirement</header><text display-inline="yes-display-inline">Not later than 30 days after the date of enactment of this Act, the Secretary of State shall—</text><paragraph id="HDABDB3C20E9742EB9D4D51E678969492"><enum>(1)</enum><text>issue a Presidential permit approving the pipeline described in the application filed on May 4, 2012, by TransCanada Keystone Pipeline, L.P. to the Department of State for the Keystone XL pipeline, as supplemented to include the Nebraska reroute evaluated in the Final Evaluation Report issued by the Nebraska Department of Environmental Quality in January 2013 and approved by the Nebraska governor; and</text></paragraph><paragraph id="HCA32C5BC5F0647E2AB579DD590AF990A"><enum>(2)</enum><text>issue a final environmental impact statement for such pipeline.</text></paragraph></subsection><subsection id="H0990B1CD984E4E398C0B82C6367F1CB1"><enum>(b)</enum><header>Satisfaction of requirements</header><text>The final environmental impact statement described in subsection (a)(2), coupled with the Final Evaluation Report described in subsection (a)(1), shall be considered to satisfy all requirements of the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321 et seq.</external-xref>), of the National Historic Preservation Act (<external-xref legal-doc="usc" parsable-cite="usc/16/470">16 U.S.C. 470 et seq.</external-xref>), and of section 7 of the Endangered Species Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/16/1536">16 U.S.C. 1536</external-xref>).</text></subsection><subsection display-inline="no-display-inline" id="H37A6C506D807442C95A07747773FFBCB"><enum>(c)</enum><header>Consequence of failure To comply</header><paragraph id="H7D02F3FC3E61430E9FA98D05C97A97F0"><enum>(1)</enum><header>General rule</header><text display-inline="yes-display-inline">If either the Presidential permit described in subsection (a)(1) or the environmental impact statement described in subsection (a)(2) remains unissued upon the expiration of 30 days after the date of enactment of this Act, until such permit and environmental impact statement are both issued no Federal funds may be expended to pay more than 75 percent of the salary of any senior official in the Department of State.</text></paragraph><paragraph id="H6C4DB54F2CAC43B3911157CAF3BF7229"><enum>(2)</enum><header>Definition</header><text display-inline="yes-display-inline">In this subsection, the term <term>senior official in the Department of State</term> means the Secretary of State and any Deputy Secretary or Under Secretary at the Department of State.</text></paragraph></subsection></section><section id="HE15F8F5931D340ADBB77B6FECF336D62"><enum>3.</enum><header>Associated permits</header><subsection id="HFFDC8B11A1344E0996A4C9205D7CF697"><enum>(a)</enum><header>Requirement</header><text display-inline="yes-display-inline">Not later than 30 days after the date of enactment of this Act—</text><paragraph id="H7558E6C8FDFC47E99548193BA8F6535B"><enum>(1)</enum><text>the Secretary of the Interior shall issue all permits associated with the pipeline project described in section 2(a) that were applied for before the date of enactment of this Act, including a grant of right-of-way and temporary use permit under section 28 of the Mineral Leasing Act (<external-xref legal-doc="usc" parsable-cite="usc/30/185">30 U.S.C. 185</external-xref>) and the Federal Land Policy and Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1701">43 U.S.C. 1701 et seq.</external-xref>) and any permit required under the Migratory Bird Treaty Act (<external-xref legal-doc="usc" parsable-cite="usc/16/703">16 U.S.C. 703 et seq.</external-xref>); and</text></paragraph><paragraph id="HE0FF897868E241F194D8461A32C2CED3"><enum>(2)</enum><text display-inline="yes-display-inline">the Secretary of the Army shall issue all permits associated with such pipeline project that were applied for before the date of enactment of this Act under section 404 of the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1344">33 U.S.C. 1344</external-xref>).</text></paragraph></subsection><subsection id="H830ACE48CA644CD3A804830371AC338C"><enum>(b)</enum><header>Consequence of failure To comply</header><paragraph id="HB267AC319BAE4916A7B884E3197557DB"><enum>(1)</enum><header>General rule</header><text display-inline="yes-display-inline">If any permit described in subsection (a) remains unissued upon the expiration of 30 days after the date of enactment of this Act, until all such permits are issued no Federal funds may be expended to pay more than 75 percent of the salary of—</text><subparagraph id="H76D71142123642A6AF55DDFB32EA7E98"><enum>(A)</enum><text>in the case of a permit described in subsection (a)(1), any senior official in the Department of the Interior; and</text></subparagraph><subparagraph id="H7AB28BC0F2194514BEB06A7DF8F493AE"><enum>(B)</enum><text display-inline="yes-display-inline">in the case of a permit described in subsection (a)(2), the Secretary of the Army and the Assistant Secretary of the Army for Civil Works.</text></subparagraph></paragraph><paragraph id="H01595432ADF5478F82DEB49142FD95A5"><enum>(2)</enum><header>Definition</header><text display-inline="yes-display-inline">In this subsection, the term <term>senior official in the Department of the Interior</term> means the Secretary of the Interior and any Deputy Secretary or Under Secretary at the Department of the Interior.</text></paragraph></subsection></section></legis-body></bill>
