which was referred to the <committee-name committee-id="HBA00">Committee on Financial Services</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To instruct the Secretary of the Treasury to use 25 percent of civil fines collected for violations of the Bank Secrecy Act to make grants to community financial institutions to improve compliance with the provisions of that Act, and for other purposes.</official-title></form><legis-body id="H4732794F5EFA4D29BB96E95D6E7C651F" style="OLC"><section id="HD7719D3FEB744BCF9946C842DD4749B3" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Building Community Financial Institutions’ Capacity to Combat Money Laundering Act</short-title></quote>.</text></section><section id="HFFB22C008C34458887823A075AE3E912"><enum>2.</enum><header>BSA compliance improvement grants</header><subsection id="H1A231BEFE546434B8FA731C25C1BA8D8"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Subchapter II of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/31/53">chapter 53</external-xref> of title 31, United States Code, is amended—</text><paragraph id="H5DB1554E20714681B9278FEEF004088D"><enum>(1)</enum><text>in section 5321, by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="H0369DE1A9DCE4F06AEE994584E668265" style="OLC"><subsection id="HF38F67AF72E44CA39DA8E9A9E08D1191"><enum>(f)</enum><header>Civil fines used for compliance improvements</header><paragraph id="HF06DC4FD36BA4784A76C72A17BED3B24"><enum>(1)</enum><header>In general</header><text>For each year, 25 percent of all civil money penalties imposed on domestic financial institutions pursuant to this section shall be deposited into the BSA Compliance Fund established under section 5333.</text></paragraph><paragraph id="HEB9EFA3B1EC540C0815BAA9EDC36CCC1"><enum>(2)</enum><header>Fines under other law for actions that violate this section</header><text display-inline="yes-display-inline">If a domestic financial institution pays a civil fine under any other provision of Federal law with respect to an action for which a civil money penalty is imposed under this section, 25 percent of such civil fine shall be deposited into the BSA Compliance Fund established under section 5333.</text></paragraph></subsection><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="H35A22841D63F4436937B0F1A014DA0B6"><enum>(2)</enum><text>by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="H07FF4788A8EF404B8061CF7BB26F660C" style="USC"><section id="HC18DC8B7174444EF9B936B4DFA51D12A"><enum>5333.</enum><header>Compliance improvement grants</header><subsection id="H138706BF399444F49B5992EC008F8517"><enum>(a)</enum><header>BSA Compliance Fund</header><text display-inline="yes-display-inline">There is established a fund in the Treasury to be known as the <term>BSA Compliance Fund</term> (the <term>Fund</term>), which shall be used to carry out the grant program under this section.</text></subsection><subsection id="H080E8D09EAAF4DA293320780185CE1D7"><enum>(b)</enum><header>Compliance grants</header><paragraph id="H4A3D4ABEE2314204B0B578AAADBAC31E"><enum>(1)</enum><header>In general</header><text>Subject to the availability of funds in the Fund, the Secretary of the Treasury shall make grants to community financial institutions to improve compliance with the requirements of this subchapter.</text></paragraph><paragraph id="H7FA809B3DE0E48A7A880A333A7E38606"><enum>(2)</enum><header>Application</header><text>A community financial institution that wishes to receive a grant under this section shall submit an application to the Secretary, in such form and manner as the Secretary determines appropriate, that contains—</text><subparagraph id="H2FCCD83454094AA89E566CBC26C68B4E"><enum>(A)</enum><text>a compliance improvement plan that details how the grant will be used to improve compliance with the requirements of this subchapter;</text></subparagraph><subparagraph id="HADE0163926E446BEA7974B9C658846E5"><enum>(B)</enum><text>the estimated cost of implementing such plan; and</text></subparagraph><subparagraph id="H4E268D48923B4A81B969A75B38DEE8AA"><enum>(C)</enum><text>such other information as the Secretary determines appropriate.</text></subparagraph></paragraph><paragraph id="H1FFECDD655224F91BE82047DECF6FD2F"><enum>(3)</enum><header>Competitive selection; priority for certain areas</header><text>The Secretary shall select which community financial institutions receive a grant under this section on a competitive basis based on the plans submitted under paragraph (2), and shall give priority to institutions located in counties that have 20 percent or more of residents living below the Federal poverty line.</text></paragraph><paragraph id="H2BC080AE894C45BFB00E692C2873E614"><enum>(4)</enum><header>Amount of grant</header><text>A grant made under this section may not exceed the lesser of—</text><subparagraph id="HA4C399087A2D487FAE67170F77F76B55"><enum>(A)</enum><text>$200,000; or</text></subparagraph><subparagraph id="H8AE5673BFFFA4C608E2F58FB3C379E48"><enum>(B)</enum><text>75 percent of the estimated cost of implementing the proposed compliance improvement plan.</text></subparagraph></paragraph></subsection><subsection id="H17408CF0D4AB44CCA755851447B4640C"><enum>(c)</enum><header>Administrative costs</header><text>Not more than 4 percent of the funds in the Fund may be used to pay for the administrative costs of carrying out this section.</text></subsection><subsection id="H6F0AE2AFC48B48A482BEEC30C93F8EB2"><enum>(d)</enum><header>Community financial institution defined</header><text>For purposes of this section, the term <term>community financial institution</term> means a domestic financial institution with less than $10,000,000,000 in assets.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H21223101E4C1480C9F51BFE4405E586A"><enum>(b)</enum><header>Clerical amendment</header><text>The table of analysis for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/31/53">chapter 53</external-xref> of title 31, United States Code, is amended by inserting after the item relating to <external-xref legal-doc="usc" parsable-cite="usc/31/5332">section 5332</external-xref> the following:</text><quoted-block display-inline="no-display-inline" id="H5D97C658A216437A8914CEDB27C2CD65" style="USC"><toc regeneration="no-regeneration"><toc-entry level="section">5333. Compliance improvement grants.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="H87B68530B8CA4177B94E119E3CAE95A5"><enum>3.</enum><header>Sunset</header><subsection id="H90D0E22609944852A40C93715CDF946A"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Effective October 1, 2018, title 31, United States Code, is amended—</text><paragraph id="H2EA82FB293E14CF39BF1E04546DCC0FE"><enum>(1)</enum><text>in section 5321, by striking subsection (f);</text></paragraph><paragraph id="H08E992AE1FDC4711ADCD901A0D4F8618"><enum>(2)</enum><text>by striking section 5333; and</text></paragraph><paragraph id="HF1A4590A8D9E4C9587B31E6E0256F70E"><enum>(3)</enum><text display-inline="yes-display-inline">in the table of analysis for chapter 53, by striking the item relating to section 5333.</text></paragraph></subsection><subsection id="H375708E4F45145B48D0BDC67BD43255A"><enum>(b)</enum><header>Amounts remaining in BSA Compliance Fund</header><text>Effective October 1, 2018, the Secretary of the Treasury shall deposit any funds in the BSA Compliance Fund into the general fund of the Treasury.</text></subsection></section></legis-body></bill>
