Terms

Section 101 of the Workforce Investment Act of 1998 (29 U.S.C. 2801) is amended by adding at the end the following:

(54)

Career pathway

The term career pathway means a system of educational and social services connecting education, training, and support services, including adult basic skills, English language instruction, General Educational Development test preparation, and noncredit and for-credit industry-recognized credential and degree programs, to enable youth and adults to advance over time to successively higher levels of education and employment in a given industry, industry sector, or occupational cluster, that—(A)aligns adult education, postsecondary education, and occupational skills training to create a pathway to attaining a recognized postsecondary credential that will qualify an individual for career advancement in projected employment opportunities identified in the State plan under section 112(b)(4)(A);(B)includes advising and career navigation to support the development of individual education and career plans; and(C)leads to a secondary school diploma or its recognized equivalent (for individuals who have not completed secondary school) or to a recognized postsecondary credential.(55)

Integrated education and training

The term integrated education and training means education that, at the same time, combines adult education services and occupational skills training for a specific occupation or occupational cluster leading to a recognized postsecondary credential.(56)

Recognized postsecondary credential

The term recognized postsecondary credential means a postsecondary degree from an institution of higher education described in section 101 of the Higher Education Act of 1965 (20 U.S.C. 1001), a credential for completion of a registered apprenticeship program, or another industry-recognized credential (such as an industry certificate, or a license in an in-demand industry), if the recipient of the grant or contract involved determines that the program leading to the credential is of high quality.(57)

Registered apprenticeship program

The term registered apprenticeship program means an industry occupational skills training program at the postsecondary level that combines technical and theoretical training through structured on-the-job learning with related instruction (in classrooms or through distance learning) while an individual is employed, working under the direction of qualified personnel or a mentor, and earning incremental wage increases aligned to enhanced job proficiency, resulting in the acquisition of a nationally recognized and portable certificate, under a plan approved by the Office of Apprenticeship or a State agency recognized by the Department of Labor.(58)

Sequential education and training

The term sequential education and training means adult education services that may occur prior to occupational skills training or postsecondary education and are appropriate for adults who need services offered, one after another, in a progressive fashion.(59)

Workplace skills

The term workplace skills means the combination of basic skills, critical thinking skills, and self management skills with competency in utilizing resources, using information, working with others, understanding systems, and working with technology, and other skills necessary for success in the workplace.

Purpose

(a)

Subtitle header

The subtitle header for subtitle B of title I of the Workforce Investment Act of 1998 (29 U.S.C. 2811 et seq.) is amended to read as follows:

(b)

Purpose

Section 106 of the Workforce Investment Act of 1998 (29 U.S.C. 2811) is amended by striking workforce investment systems and inserting adult education and workforce investment systems.

103.

State workforce investment boards

Section 111 of the Workforce Investment Act of 1998 (29 U.S.C. 2821) is amended—(1)in subsection (b)(1)(C)(vi)(I), by inserting (particularly the lead State agency officials with responsibility for the programs and activities that are described in section 121(b)(1)(B)(iii)) after 121(b); and(2)in subsection (d)(2), by striking workforce investment system and inserting adult education and workforce investment system.

104.

State plan

Section 112 of the Workforce Investment Act of 1998 (29 U.S.C. 2822) is amended—(1)in subsection (a)—(A)by striking workforce investment system and inserting adult education and workforce investment system; and(B)by inserting and aligns with the State plan described in section 224 before the period at the end;(2)in subsection (b)—(A)in paragraphs (2) and (3), by striking workforce investment system and inserting adult education and workforce investment system;(B)in paragraph (4)—(i)in subparagraph (B), by inserting academic levels and before job skills;(ii)in subparagraph (C), by striking and after the semicolon;(iii)in subparagraph (D), by striking State; and inserting State, including education, training, and registered apprenticeship programs and their relationship to the employment opportunities, academic levels, skills, and economic development needs described in this paragraph; and; and(iv)by adding at the end the following:

(E)the integrated education and training and sequential education and training activities that will be integrated and aligned with workforce investment activities and services under this title, and the State’s efforts to promote greater integration and alignment of adult education and workforce investment activities and services under this title;

(C)in paragraph (8)—(i)in subparagraph (A)(x), by striking and after the semicolon;(ii)in subparagraph (B), by striking the semicolon and inserting , including processes for data collection and reporting regarding performance on the core indicators described in section 212; and; and(iii)by adding at the end the following:

(C)a description of any integrated data systems used to track performance outcomes over time for the participants in the programs and activities described in subparagraph (A);

(19)a strategy for coordinating services, including guidance, counseling, mentoring, and other supports, to populations in need of such services, through public and private partnerships, and for creating transition strategies with such elements as dual enrollment, curricular articulation, and high intensity instruction; and(20)an assurance that every region, as designated by the State under section 116(c), in the State has at least 1 adult education program that offers more than 1 option for earning a credential with value in the local market to students who do not yet have a secondary school diploma or its recognized equivalent and who are unlikely to earn such a diploma or equivalent in the short-term, which option may include earning the credential through a partnership that includes a community college or occupational skills training provider and may include getting that equivalent in the process.

(3)by adding at the end the following:

(e)

Program development period

Notwithstanding any other provision of this section, a State may be eligible to receive an allotment under section 127 or 132, or to receive financial assistance under the Wagner-Peyser Act (29 U.S.C. 49 et seq.), before the State submits a single State plan under this section (as amended under section 104 of the Adult Education and Economic Growth Act of 2013) if the State is in a 1-year program development period.

105.

Local workforce investment boards

Section 117 of the Workforce Investment Act of 1998 (29 U.S.C. 2832) is amended—(1)in subsection (a), by striking workforce investment system each place it appears and inserting adult education and workforce investment system;(2)in subsection (d)(8), by striking workforce investment system and inserting adult education and workforce investment system; and(3)in subsection (h)(2)(A)—(A)in clause (v), by striking and after the semicolon; and(B)by inserting after clause (vi), the following:

(vii)representatives of adult education programs; and

Local plan

Section 118(b)(1) of the Workforce Investment Act of 1998 (29 U.S.C. 2833(b)(1)) is amended—(1)in subparagraph (B), by striking and after the semicolon;(2)in subparagraph (C), by inserting academic levels and before job skills; and(3)by adding at the end the following:

(D)the type and availability of workforce investment activities in the local area, including education, training, and registered apprenticeship programs and their relationship to such business, jobseeker, and worker needs, employment opportunities, and academic levels and job skills, and economic development needs; and(E)the integrated education and training and sequential education and training activities that will be carried out under this title or title II and the integration and alignment of activities described in this subparagraph with workforce investment activities and services under this title.

107.

Use of funds for youth activities

Section 129 of the Workforce Investment Act of 1998 (29 U.S.C. 2854) is amended—(1)in subsection (a)—(A)in paragraph (5), by striking and after the semicolon;(B)in paragraph (6), by striking the period and inserting ; and; and(C)by adding at the end the following:

(7)to provide opportunities for multiple pathways for eligible youth.

; and

(2)in subsection (c)(1)(C)—(A)in clause (iii), by striking and after the semicolon;(B)in clause (iv)(II), by striking the period and inserting a semicolon; and(C)by adding at the end the following:

(v)opportunities for career pathways; and(vi)opportunities for the completion of secondary school, in appropriate cases.

108.

Use of funds for employment and training activities

Section 134 of the Workforce Investment Act of 1998 (29 U.S.C. 2864) is amended—(1)in subsections (a)(3)(A)(vii) and (c)(2)(B)(ii)(II), by striking workforce investment system and inserting adult education and workforce investment system; and(2)in subsection (d)—(A)in paragraph (3)(A)(i)(I), by striking and are unable to obtain employment through core services provided under paragraph (2); and(B)in paragraph (4)—(i)in subparagraph (A)(i), by striking and who are unable to obtain or retain employment through such services;(ii)in subparagraph (D)—(I)in clause (viii), by striking and after the semicolon;(II)in clause (ix), by striking the period and inserting a semicolon; and(III)by adding at the end the following:

(x)integrated education and training; and(xi)career pathway services.

(iii)in subparagraph (G)—(I)in clause (i), by striking clause (ii) and inserting clause (ii) or subparagraph (H); and(II)in clause (ii)—(aa)in subclause (II), by striking or after the semicolon;(bb)in subclause (III), by striking the period and inserting ; or; and(cc)by adding at the end the following:

Authorization of contracts to institutions of higher education

The local board may award a contract to an institution of higher education or other eligible provider of training services, including an adult education provider eligible under section 122, if the local board determines that provision of services through the contract would facilitate the training of multiple individuals in in-demand occupations.

109.

Performance accountability system

Section 136 of the Workforce Investment Act of 1998 (29 U.S.C. 2871) is amended—(1)in subsection (b)(2)(A)—(A)in clause (i)—(i)in the matter preceding subclause (I), by striking and (for participants who are eligible youth age 19 through 21) for youth activities authorized under section 129;(ii)in subclause (III), by striking and at the end;(iii)in subclause (IV), by striking , or by participants who are eligible youth age 19 through 21 who enter postsecondary education, advanced training, or unsubsidized employment. and inserting ; and; and(iv)by adding at the end the following:

(V)performance on the core indicators described in section 212, as appropriate.

; and

(B)in clause (ii)—(i)in the matter preceding subclause (I), by striking (for participants who are eligible youth age 14 through 18);(ii)in subclause (I), by striking and, as appropriate, work readiness or occupational skills and inserting , workplace skills, or occupational skills, as appropriate;(iii)in subclause (II), by striking and after the semicolon;(iv)in subclause (III), by striking the period and inserting ; and; and(v)by adding at the end the following:

110.

National programs

Section 171 of the Workforce Investment Act of 1998 (29 U.S.C. 2916) is amended—(1)in subsection (b)(1)—(A)in subparagraph (G), by striking and after the semicolon;(B)in subparagraph (H), by striking the period and inserting a semicolon; and(C)by adding at the end the following:

(I)projects that assist low-skill and limited English proficient workers to acquire basic, English, work readiness, and applied technical or occupational skills through integrated education and training and sequential education and training programs to successfully transition to postsecondary education, workforce development, and employment in career pathways; and(J)projects that test effective ways to develop comprehensive career pathway learning approaches that—(i)fully align adult education with—(I)secondary education, postsecondary education, workforce development programs including registered apprenticeship programs, and supportive service activities; and(II)regional economic development strategies to meet the skill needs of existing and emerging regional employers as well as the needs of low-skilled adults; and(ii)are designed to help adults, especially those who are low-skilled, to advance through progressive levels of education and training as quickly as possible and gain education and workplace skills of demonstrated value to the labor market at each level.

(2)in subparagraphs (D)(iii)(I) and (E)(ii)(III) of subsection (e)(2), by striking workforce investment system and inserting adult education and workforce investment system.

Administration

(a)

Requirements and restrictions

amended to read as follows:</text><quoted-block display-inline="no-display-inline" id="H43219C81C81E4637B9D32FF3E83D1C56" style="OLC"><subsection id="H716F869CFA8540E992A79492E0AC4B0F"><enum>(a)</enum><header>Activities</header><paragraph id="H62C3A2FB128344D68567B6A8DC79C2C3"><enum>(1)</enum><header>Required activities</header><text>Each eligible agency shall use funds made available under section 222(a)(2) for the following adult education and literacy activities and workplace skills activities:</text><subparagraph id="HC79DDDDC7E054619BCEE2078E6EFB606"><enum>(A)</enum><text>The establishment or operation of professional development programs to improve the quality of instruction provided pursuant to local activities required under section 231(b).</text></subparagraph><subparagraph id="HB05017BBFE0D4794A6759DD57482672C"><enum>(B)</enum><text>The provision of technical assistance to eligible providers of adult education and literacy activities and workplace skills activities to enable them to fulfill the purpose of this title, as described in section 202.</text></subparagraph><subparagraph id="H4E778559B4BF4F479B6E127E4F2D1454"><enum>(C)</enum><text>The monitoring and evaluation of adult education and literacy activities and related activities to determine what works and broadly disseminate information about models and best practices and tools within the State.</text></subparagraph><subparagraph id="H4D88A278AE7343E6A86D09EC4B02C321"><enum>(D)</enum><text>The provision of technology assistance, including staff training, to eligible providers of adult education and literacy activities and workplace skills activities to enable the eligible providers to improve the quality of such activities.</text></subparagraph><subparagraph id="H25CFB9DE14EF4E70ABF3FE4BFCF604C3"><enum>(E)</enum><text>Coordination with the workforce investment systems supported under title I.</text></subparagraph></paragraph><paragraph id="H1C79F48901764E84844E32AAA510393E"><enum>(2)</enum><header>Permissible activities</header><text>Each eligible agency may use funds made available under section 222(a)(2) for one or more of the following adult education and literacy activities and workplace skills activities:</text><subparagraph id="H33DAA8F1C2914B25B9A8DBCAF1574CD2"><enum>(A)</enum><text>Support for State or regional networks of literacy resource centers.</text></subparagraph><subparagraph id="H41C806DD1729459CB9C366F4C3A50A5D"><enum>(B)</enum><text>Incentives for program coordination and integration, and performance awards.</text></subparagraph><subparagraph id="H4A69CB0CEDE14C44AC23D37C33F05386"><enum>(C)</enum><text>Developing and disseminating curricula for postsecondary and job training readiness, including curricula for using technology for distance learning and for instructional and teacher training purposes.</text></subparagraph><subparagraph id="H7DD44415805543178F973099DCE0CA4C"><enum>(D)</enum><text>Coordination with existing support services, such as transportation, child care, and other assistance designed to increase rates of enrollment in, and successful completion of, adult education and literacy activities and workplace skills activities, to adults enrolled in such adult education and literacy activities and workplace skills activities.</text></subparagraph><subparagraph id="HF736DD7A5CBB4C80A0F69C66CE9660D6"><enum>(E)</enum><text>Developing innovative content and models for integrated education and training and sequential education and training programs.</text></subparagraph><subparagraph id="H8CE269409C844ACCBF0BF777749949E8"><enum>(F)</enum><text>Developing innovative content and models to foster the transition to and success in postsecondary education and career pathways.</text></subparagraph><subparagraph id="H6CCD0004A8314051883C38AC347EAE61"><enum>(G)</enum><text>Linkages with postsecondary educational institutions.</text></subparagraph><subparagraph id="H2CA623CEBE1B43F6A84EC7AE16693BDF"><enum>(H)</enum><text>Linkages with community-based organizations.</text></subparagraph><subparagraph id="H1893E791A94C4E3DA0665CB13B21238B"><enum>(I)</enum><text>Support for recruitment and outreach for instructors, students, and employers.</text></subparagraph><subparagraph id="HCC582D81688548FC8808ACE2EB1F532F"><enum>(J)</enum><text>Linkages with public libraries.</text></subparagraph><subparagraph id="H8CC777DC230E4CA5A4921205DBE60B0F"><enum>(K)</enum><text>Other id="H8E5AC1E32BF7449094567D263AA672A4"><enum>208.</enum><header>State plan</header><text display-inline="no-display-inline">Section 224 of the Adult Education and Family Literacy Act (<external-xref legal-doc="usc" parsable-cite="usc/20/9224">20 U.S.C. 9224</external-xref>) is amended—</text><paragraph id="HC6F83FA9AF0B44C88A062F14F1BC5D22"><enum>(1)</enum><text>in subsection (a)—</text><subparagraph id="H28446F406F44403DBEFC0E55C6205F99"><enum>(A)</enum><text>by redesignating paragraph (2) as paragraph (4); and</text></subparagraph><subparagraph id="H4AD83F5086E54600ACEB7269A2F3017E"><enum>(B)</enum><text>by inserting after paragraph (1) the following:</text><quoted-block display-inline="no-display-inline" id="H778662019E0B4D2B8318E5D2E14F8E9E" style="OLC"><paragraph id="H0A897FBC35254287A21E7B361BA44D6D"><enum>(2)</enum><header>Program development period</header><text>Notwithstanding any other provision of this section, an eligible agency may be eligible to receive a grant under this title before submission of a 5-year State plan under this section if the eligible agency is in a 1-year program development period.</text></paragraph><paragraph id="HA06220E201A6460D9FDE002FBD2E5D84"><enum>(3)</enum><header>Stakeholder involvement</header><text>The 5-year State plan shall be comprehensive in nature and developed and monitored by a planning group of all stakeholders in the State’s adult education and workforce development system. The stakeholders shall include—</text><subparagraph id="H5386FF56C06F406EB0A170CD60A2DC12"><enum>(A)</enum><text>the State agencies responsible for—</text><clause id="H49F27B424F8548A791FED2DA0FD77DA3"><enum>(i)</enum><text>the State’s programs under this title and title I;</text></clause><clause id="H193D715D9EEC472F8E971A82E7792229"><enum>(ii)</enum><text>the State program funded under part A of title IV of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/601">42 U.S.C. 601 et seq.</external-xref>);</text></clause><clause id="H9E81F3A672004404A9F38F9CB59F71F5"><enum>(iii)</enum><text>overseeing community colleges;</text></clause><clause id="H11BF57FE2ECA48A6A15354059CF7CFA2"><enum>(iv)</enum><text>elementary and secondary education;</text></clause><clause id="HDF31734E02394BF08DBD89678FB11909"><enum>(v)</enum><text>corrections;</text></clause><clause id="HA64E66B3C178471092E0B3B4A1438947"><enum>(vi)</enum><text>economic development;</text></clause><clause id="HA6880C745D104E1AAA06DC2834EFC5B1"><enum>(vii)</enum><text>family literacy; and</text></clause><clause id="H647041E967C54139B70157F9A0807E06"><enum>(viii)</enum><text>special services to immigrants; and</text></clause></subparagraph><subparagraph id="HE506480FFCB34600BCF281291E4DE02F"><enum>(B)</enum><text>representatives of business and labor.</text></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="H05AD622DAF22498D8ACCD30B939061FE"><enum>(2)</enum><text>in subsection (b)—</text><subparagraph id="H77D5E4931F994715B999F23C33A3E06D"><enum>(A)</enum><text>by striking paragraph (10) and inserting the following:</text><quoted-block display-inline="no-display-inline" id="H315C9710268B48F3845321EE4D70C179" style="OLC"><paragraph id="H9738981C1CD240AAA8833632432B8ED5"><enum>(10)</enum><text>a description and strategy of how the eligible agency will develop program strategies and coordinate services, including guidance, counseling, mentoring, and other supports through public and private partnerships and creating transition strategies with such elements as dual enrollment, curricular articulation, and high intensity instruction, for populations that include, at a minimum—</text><subparagraph id="H618309511D0E4AA1866EDD76EA117780"><enum>(A)</enum><text>low-income students;</text></subparagraph><subparagraph id="HEE0C546B80CB4CE38ED1CEB9E0AF86CB"><enum>(B)</enum><text>individuals with disabilities;</text></subparagraph><subparagraph id="H85F72B563E764BB6AE1320A17842810B"><enum>(C)</enum><text>single parents and displaced homemakers; and</text></subparagraph><subparagraph id="HCA2B0E9868B247EBB231B2E294DE8B83"><enum>(D)</enum><text>individuals with multiple barriers to educational enhancement, including individuals with limited English proficiency;</text></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph><subparagraph id="H6929119D3D9640529E01F2DBCBA33472"><enum>(B)</enum><text display-inline="yes-display-inline">in paragraph (11), by striking <quote>and</quote> after the semicolon;</text></subparagraph><subparagraph id="HB521602D170E476183EDA77B5EAA4AF6"><enum>(C)</enum><text>in paragraph (12), by striking the period at the end and inserting a semicolon; and</text></subparagraph><subparagraph id="H281C1EE6CA06426DBB663E27D5A45504"><enum>(D)</enum><text>by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="H5D728466110A4137B6B5B6C0F7BDD8A7" style="OLC"><paragraph id="H89ECF4A711FE43E79FB5D50050F1BBA6"><enum>(13)</enum><text>a description of the knowledge and skills necessary for acceptance in postsecondary education and training;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H94228C19C9C1443EBEA111A914838644"><enum>(14)</enum><text display-inline="yes-display-inline">an assurance that every local program area, as defined by the eligible agency, served by the eligible agency has at least 1 adult education program that offers more than 1 option for earning a credential with value in the local employment market to students who do not yet have a secondary school diploma or its recognized equivalent and who are unlikely to earn such diploma or equivalent in the short term, which option may include earning the credential through a partnership that includes a community college or job training provider and may include earning the recognized equivalent of a secondary school degree in the process;</text></paragraph><paragraph id="HB23B372336274927BCAA9ADD3579BFB5"><enum>(15)</enum><text>a description of any certification or other requirements for instructors in eligible adult education, literacy, and workplace skills program providers in the State;</text></paragraph><paragraph id="H85D535CDD583482F8E2D44A1914711B9"><enum>(16)</enum><text>a description of the professional development needs of adult education, literacy, and workplace skills providers in the State;</text></paragraph><paragraph id="HE4805C9207D34938852D66E46F4F14C3"><enum>(17)</enum><text>a description of how the State will—</text><subparagraph id="H369BC0F6E3BD479686369102E0D6C7E1"><enum>(A)</enum><text>use technology to improve the quality of adult education, literacy, and workplace skills services; and</text></subparagraph><subparagraph id="H8A3ADD0E1EE24E5CA8566F6B9C360EB0"><enum>(B)</enum><text>expand access to such services for workers and students;</text></subparagraph></paragraph><paragraph id="H983CC86E0B4F4084B24447170DF2C520"><enum>(18)</enum><text>a description of how the State will carry out programs described in section 244, if the State is receiving a grant under such section;</text></paragraph><paragraph id="H3703B208526E43289377958442C4F103"><enum>(19)</enum><text>a description of the data system that the State will use to track over time student outcomes on the performance measures described in section 212;</text></paragraph><paragraph id="HE29666145A404F9A997C7388B891D311"><enum>(20)</enum><text>a description of the State’s program to invest in the skills of workers, including plans for involving business as an active partner in the effort; and</text></paragraph><paragraph id="H7A8CB8809F0B44099D08539CDF13A337"><enum>(21)</enum><text>a description of how the adult education programs will be integrated with occupational skills programs and aligned with postsecondary education, career, and technical education, workforce development programs, and other Federal funds available under title I and other relevant Federal programs.</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="H36B169CEF43A49A4A35988581714FB2A"><enum>(3)</enum><text>by striking subsection (e) and inserting the following:</text><quoted-block display-inline="no-display-inline" id="HE2113EA760B2473EB20DAA6FEB826EB2" style="OLC"><subsection id="HAD03EF793A1E4240918467279B46B3F5"><enum>(e)</enum><header>Peer review and plan approval</header><text display-inline="yes-display-inline">The Secretary shall—</text><paragraph id="H0D015AE7B72A4CAF950954E88A2A6A28"><enum>(1)</enum><text>establish a peer-review process to assist in the review and approval of State plans;</text></paragraph><paragraph id="H8B614AEABD0A47878C33C300BD5CA841"><enum>(2)</enum><text>in consultation with the National Center for Adult Education, Literacy, and Workplace Skills, appoint individuals, representing the range of stakeholders, to the peer-review process, including—</text><subparagraph id="H99F8CEDC5B8E458DB39F283068D1F677"><enum>(A)</enum><text>representatives of adult learners, adult education, literacy, and workplace skills providers, eligible agencies, State educational agencies, institutions of higher education, and representatives of State boards or local boards; and</text></subparagraph><subparagraph id="HC1B5EF0E7DF848448FB77A1F5E039F16"><enum>(B)</enum><text>experts in the fields of adult education, literacy, and workplace skills;</text></subparagraph></paragraph><paragraph display-inline="no-display-inline" id="H76254068F1544DDC835C8C7944E4C345"><enum>(3)</enum><text display-inline="yes-display-inline">approve a State plan not later than 120 days after receiving the plan, unless the Secretary makes a written determination, not later than 30 days after receiving the plan, that the plan does not meet the requirements of this section or is inconsistent with specific provisions of this subtitle; and</text></paragraph><paragraph id="HD80372C38BDE4B6B9AEB281D09D3C89F"><enum>(4)</enum><text display-inline="yes-display-inline">not finally disapprove of a State plan before offering the eligible agency the opportunity, prior to the expiration of the 30-day period beginning on the date on which the eligible agency received the written determination described in paragraph (3), to revise the plan, and providing technical assistance in order to assist the eligible agency in meeting the requirements of this subtitle.</text></paragraph></subsection><after-quoted-block>; and</text></subparagraph><subparagraph id="HD062F5C11F22450AB0BF3A97E63AC7C7"><enum>(E)</enum><text>providing effective practices for corrections education;</text></subparagraph></paragraph><paragraph id="H49E06A954060498EA65C4C1E733941F1"><enum>(4)</enum><text>collect and disseminate information on methods of advancing education and literacy that show great promise for adults eligible for services under this title;</text></paragraph><paragraph id="H6E48547B7A5F45BFAF3EBE80C9E752B2"><enum>(5)</enum><text>provide policy and technical assistance to Federal, State, and local organizations for the improvement of adult education, literacy, and workplace skills services; and</text></paragraph><paragraph id="H687A7C3A735E4D10A901D3B671F91A9F"><enum>(6)</enum><text>not later than 4 years after the date of enactment of the Adult Education and Economic Growth Act of 2013, conduct an evaluation and submit a report to the Interagency Group, the Committee on Health, Education, Labor, and Pensions of the Senate, and the Committee on Education and the Workforce of the House of Representatives, on the effectiveness of programs funded under this title in achieving the purpose described in section 202, which evaluation and report shall include—</text><subparagraph id="HBD6985A5268E40D99AE20D3C24D937C0"><enum>(A)</enum><text>a longitudinal study of outcomes for adult learners served under programs under this title;</text></subparagraph><subparagraph id="HED0B3D91F19440F58B0756E624A4DB14"><enum>(B)</enum><text>an analysis of the adequacy of the performance measures described in section 212; and</text></subparagraph><subparagraph id="H52C19D187C88438F8387740C86E37A37"><enum>(C)</enum><text>recommendations for improved performance measures and on how to improve program effectiveness.</text></subparagraph></paragraph></subsection><after-quoted-block>; Such activities—</text><paragraph id="H1675120BA5BF40DEA2A0CB52994225E0"><enum>(1)</enum><text display-inline="yes-display-inline">shall include—</text><subparagraph id="HE6F49499BA94474E86E8ADD39CEB86C5"><enum>(A)</enum><text>technical assistance, which may include—</text><clause id="HF50C6470B4F74BD4ABC25A711A9C4A9A"><enum>(i)</enum><text>assistance to eligible providers in developing and using certification systems, performance measures, and data systems for the improvement of adult education and literacy activities and workplace skills activities, including family literacy services, transition to postsecondary education or career pathways, corrections education, and integrated English literacy and civics education programs;</text></clause><clause id="H6CEF495F7D864E4284BCE487B4CDD013"><enum>(ii)</enum><text>assistance related to professional development activities and assistance for the purpose of developing, improving, identifying, and disseminating the most successful methods and techniques for providing adult education and literacy activities and workplace skills activities, including family literacy services, transition to postsecondary education or career pathways, and integrated English literacy and civics education programs, based on scientific evidence where available; or</text></clause><clause id="HA868DE783D2C493CBA901A9C391C8E76"><enum>(iii)</enum><text>assistance in distance learning and promoting and improving the use of technology in the classroom; and</text></clause></subparagraph><subparagraph id="H17CAD5ACB4144061B1E4191BB38AA446"><enum>(B)</enum><text>program evaluation and data collection and reporting; and</text></subparagraph></paragraph><paragraph id="HAEBA41A3BF784742B8364BEAB61D5692"><enum>(2)</enum><text>may include—</text><subparagraph id="HA7D0D3A7DE324ED9A1E67F86C0A8772A"><enum>(A)</enum><text>national demonstration projects for improving adult education, literacy, and workplace skills services, which may include projects that—</text><clause id="H43EF37291CC742D09B20E3FE46452B73"><enum>(i)</enum><text>accelerate learning outcomes for adult learners with the lowest literacy levels;</text></clause><clause id="HA44461C6D8E247C3BADA7547A99D1129"><enum>(ii)</enum><text>promote career pathways;</text></clause><clause id="HF6DB12CE03DE43509CF80BEC21DF1597"><enum>(iii)</enum><text>allow dual enrollment in adult secondary education and credit bearing postsecondary coursework;</text></clause><clause id="HABB3E5EC392B497B817E697AE67F967D"><enum>(iv)</enum><text>provide integrated education and training and sequential education and training services;</text></clause><clause id="H3FD0A2FCAEF64D4E8FF4F41279B15A8B"><enum>(v)</enum><text>build capacity to enhance the intensity of adult education, literacy, and workplace skills services;</text></clause><clause id="H0B36F034203A4AAB89D7B895EF981F3A"><enum>(vi)</enum><text>establish partnerships to improve the quality of and expand adult education, literacy, and workplace skills services to more adults;</text></clause><clause id="H477AFF8462264B62B346111160F03D2E"><enum>(vii)</enum><text>provide professional development opportunities to adult education, literacy, and workplace skills service providers;</text></clause><clause id="HF613070A970E458DAC4C674278355F85"><enum>(viii)</enum><text>develop new curricula and methods of instruction that improve learning outcomes in adult education, literacy, and workplace skills programs;</text></clause><clause id="H30640EAC38B34CB7A700D6350FC15398"><enum>(ix)</enum><text>provide integrated English literacy and civics education program instruction; and</text></clause><clause id="HAEF1F9B641E3464FB2D344DB64DF94F9"><enum>(x)</enum><text>provide corrections education; and</text></clause></subparagraph><subparagraph id="H43198ADCFFFB4CCC8FAF371A90C2F803"><enum>(B)</enum><text>dissemination of the results and best practices identified in the national demonstration projects described in subparagraph (A).</text></subparagraph></paragraph></section><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="H92F89AA54EDF473693DDD617ED63D524"><enum>215.</enum><header>Integrated English literacy and civics education programs</header><subsection id="HFD9FE2DE345449DE930AD53D320BD8B3"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Chapter 4 of subtitle A of the Adult Education and Family Literacy Act (<external-xref legal-doc="usc" parsable-cite="usc/20/9251">20 U.S.C. 9251 et seq.</external-xref>) is amended by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="HEB36E7F1AC974D46A2EBA362F771EA96" style="OLC"><section id="H08314CA62D0C4F31AA51465F45AB0F9A"><enum>244.</enum><header>Integrated English literacy and civics education programs</header><subsection id="H732326C59F534D7780AFFC1761DABBAC"><enum>(a)</enum><header>In general</header><text>From funds reserved under section 211(a)(4) for each fiscal year, the Secretary shall award grants to States, in accordance with the allocations under subsection (b), for integrated English literacy and civics education programs.</text></subsection><subsection id="HB13FB5DC625B4675A9CB14AD800F729F"><enum>(b)</enum><header>Allocations</header><paragraph id="H058C505FDB1B48DAAA0E022A26D3136F"><enum>(1)</enum><header>In general</header><text>Subject to paragraph (2), of the funds described in subsection (a), the Secretary shall allocate—</text><subparagraph id="H92B7D18BE3A146CE86833A821C83C000"><enum>(A)</enum><text>65 percent to States on the basis of a State's need for integrated English and civics education programs, as determined by calculating each State's share of a 10-year average of the data compiled by the Office of Immigration Statistics of the Department of Homeland Security, for immigrants admitted for lawful permanent residence for the 10 most recent years; and</text></subparagraph><subparagraph id="H4FFA03AAC7D74277807D0A8C72668B15"><enum>(B)</enum><text>35 percent to States on the basis of whether the State experienced growth, as measured by the average of the 3 most recent years for which data compiled by the Office of Immigration Statistics of the Department of Homeland Security are available, for immigrants admitted for lawful permanent residence.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HCB14C27D60C6449DB12837E768A740F8"><enum>(2)</enum><header>Minimum</header><text>No State shall receive an allocation under paragraph (1) for a fiscal year in an amount that is less than $60,000.</text></paragraph></subsection></section><after-quoted-block> . </after-quoted-block></quoted-block></subsection><subsection id="H1AAFD160F3A248A39F5B34B4D3496B99"><enum>(b)</enum><header>Table of contents</header><text>The table of contents in section 1(b) of the Workforce Investment Act of 1998 is amended by inserting after the item relating to section 243 the following:</text><quoted-block display-inline="no-display-inline" id="H493B561F5873451BA1BBE85195A48A11" style="OLC"><toc><toc-entry bold="off" level="section">Sec. 244. Integrated English literacy and civics education programs.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><enum>III</enum><header>21st Century Technology and Skills for Adult Learners</header><section commented="no" id="H653145FC538B4DB0A1FE251F20AC0C57"><enum>301.</enum><header>Purposes</header><text display-inline="no-display-inline">The purposes of this title are the following:</text><paragraph commented="no" id="H8EF530B87A3F448BA131A1000E9A1AF8"><enum>(1)</enum><text>To expand access to adult education services and bring about cost efficiencies through increased use of technology and the development of a national web portal.</text></paragraph><paragraph commented="no" id="H9ED796620F084F8B9B3D28E64BDF7D7D"><enum>(2)</enum><text>To provide professional development for providers of adult education, literacy, and workplace skills services so that the providers are able to—</text><subparagraph commented="no" id="H7864940C1CB54D3B86A76429E0CDCE98"><enum>(A)</enum><text>effectively use technology in the delivery of adult education, literacy, and workplace skills services; and</text></subparagraph><subparagraph commented="no" id="HC67C88879F3C423ABE225B9324422029"><enum>(B)</enum><text>improve the quality of instruction and accelerate the—</text><clause commented="no" id="H461B0591F82F42639178B5AFD012A676"><enum>(i)</enum><text>achievement of basic educational skills, English language literacy, and secondary school equivalency or postsecondary education for adult learners; and</text></clause><clause commented="no" id="H7CA923D5BEC34C9284F1F4275A7EC378"><enum>(ii)</enum><text>training readiness for adult learners.</text></clause></subparagraph></paragraph><paragraph commented="no" id="HE3758CB54C8F4FE49F9B88781889B0FF"><enum>(3)</enum><text>To assist States in developing a 21st century delivery system for adult education, literacy, and workplace skills services.</text></paragraph><paragraph commented="no" id="H7AB654944E0E4E378364270913D45F45"><enum>(4)</enum><text>To assist adults in developing digital literacy skills.</text></paragraph></section><section commented="no" id="H4643315007F34BE28B0F54B0815DC295"><enum>302.</enum><header>Definitions</header><text display-inline="no-display-inline">In this title:</text><paragraph commented="no" id="HA08BA6451CC240849A1FB8C750CD0384"><enum>(1)</enum><header>Adult Education and Family Literacy Act terms</header><text display-inline="yes-display-inline">The terms <term>adult education</term>, <term>eligible agency</term>, <term>eligible provider</term>, <term>literacy</term>, <term>Secretary</term>, <term>State</term>, and <term>workplace skills</term> have the meanings given the terms in section 203 of the Adult Education and Family Literacy Act (<external-xref legal-doc="usc" parsable-cite="usc/20/9202">20 U.S.C. 9202</external-xref>).</text></paragraph><paragraph commented="no" id="HB319456400F54A36B6E4A8CD3E033FC6"><enum>(2)</enum><header>Center</header><text display-inline="yes-display-inline">The term <term>Center</term> means the National Center for Adult Education, Literacy, and Workplace Skills established under section 242 of the Adult Education and Family Literacy Act (<external-xref legal-doc="usc" parsable-cite="usc/20/9252">20 U.S.C. 9252</external-xref>).</text></paragraph><paragraph commented="no" id="H7843145D3B04450A84B032A0C79C8C77"><enum>(3)</enum><header>Distance education</header><text display-inline="yes-display-inline">The term <term>distance education</term> has the meaning given the term in section 103 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1003">20 U.S.C. 1003</external-xref>).</text></paragraph><paragraph commented="no" id="HBAF5C8C89D514FABB2758B69808303AD"><enum>(4)</enum><header>Digital literacy skills</header><text display-inline="yes-display-inline">The term <term>digital literacy skills</term> has the meaning given the term in section 202 of the Museum and Library Services Act (<external-xref legal-doc="usc" parsable-cite="usc/20/9101">20 U.S.C. 9101</external-xref>).</text></paragraph></section><section commented="no" id="H77D95A28441F4B28A60FF2DA1E9D6A1F"><enum>303.</enum><header>Reservation of funds and allotments</header><subsection commented="no" id="HDE3AD046734044E8AAC2A96D711E9240"><enum>(a)</enum><header>Reservation of funds</header><text>From the amounts appropriated under section 307 for a fiscal year, the Secretary shall reserve 3 percent or $7,500,000, whichever amount is less, to carry out section 306.</text></subsection><subsection commented="no" id="HDE713A55E63C4D37B3094D553232B89E"><enum>(b)</enum><header>Allotment of remainder</header><text>From the sums remaining for a fiscal year after making the reservation under subsection (a), the Secretary shall allot—</text><paragraph commented="no" id="H1EBBD39BDF4E4688B8E129CB2EBF2260"><enum>(1)</enum><text>75 percent to carry out section 305;</text></paragraph><paragraph commented="no" id="H7DFC2EC6D0BA48A5A402C18EEBF81B06"><enum>(2)</enum><text>20 percent to carry out section 304; and</text></paragraph><paragraph commented="no" id="H6DE935C19414493FA3741A9DEF0E0330"><enum>(3)</enum><text>5 percent for administrative costs in carrying out section 304.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HF1F031296C2E42E78F3C6DEED8A2F1D0"><enum>(c)</enum><header>Allotments to eligible agencies</header><paragraph commented="no" display-inline="no-display-inline" id="H23502FC91B1449F1BFB92D4C0A72EFE2"><enum>(1)</enum><header>In general</header><text>From the amounts available to carry out section 304 for a fiscal year, the Secretary shall allot to each eligible agency with an approved application an amount that bears the same relationship to such sums as the amount received under section 211(c)(2) of the Adult Education and Family Literacy Act (<external-xref legal-doc="usc" parsable-cite="usc/20/9211">20 U.S.C. 9211(c)(2)</external-xref>) by such eligible agency bears to the amount received under such section for such fiscal year by all eligible agencies.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H2D3686027C834031B190AF82121C5793"><enum>(2)</enum><header>Minimum allotment; ratable reduction</header><text>No eligible agency shall receive an allotment under paragraph (1) for a fiscal year in an amount that is less than $100,000. If the amount appropriated to carry out section 304 for a fiscal year is not sufficient to pay such minimum allotment to all States, the amount of such minimum allotments shall be ratably reduced.</text></paragraph></subsection></section><section commented="no" id="HF75E6C168B16474E849E561A4C02430C"><enum>304.</enum><header>Grants to eligible agencies</header><subsection commented="no" id="H74FD1A11A01942DFB0AD1AE17E3AC55B"><enum>(a)</enum><header>Authorization of grants</header><text>The Secretary shall award grants to eligible agencies from allotments under section 303(b) to enable the eligible agencies to carry out subsection (c) and award subgrants or contracts under section 305.</text></subsection><subsection commented="no" id="H85F86C6B71044B43981B6F6EBD97738E"><enum>(b)</enum><header>Application</header><paragraph commented="no" id="H4F36F37574254520AD4530986226514C"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Each eligible agency that desires to receive a grant under this title shall submit an application to the Secretary at such time, in such manner, and accompanied by such information as the Secretary may require.</text></paragraph><paragraph commented="no" id="H5830019775FF488BA12D167197A3EAC3"><enum>(2)</enum><header>Contents</header><text>An application submitted under paragraph (1) shall contain the following:</text><subparagraph commented="no" id="HEA58BB049B0C4A4CADBAFDD756455FD6"><enum>(A)</enum><text>A description of the eligible agency's technology plan for the adult education system, including measurable goals to be achieved.</text></subparagraph><subparagraph commented="no" id="H499F8E3FCC48430A88BA61DBC4DDFB21"><enum>(B)</enum><text>A description of how the eligible agency will provide technical assistance and support to local programs.</text></subparagraph><subparagraph commented="no" id="HABF9B7F006F845BB8F85D3EE667A86C3"><enum>(C)</enum><text>A description of how the eligible agency will use technology to expand adult education, literacy, and workplace skills services to more adults, including adults in rural areas.</text></subparagraph><subparagraph commented="no" id="H374D7492F50141E383FFF410597D7819"><enum>(D)</enum><text>A description of the long-term goals and strategies for improved outcomes for adult learners.</text></subparagraph><subparagraph commented="no" id="H191019AF20C64C8288ED3BE72D54323F"><enum>(E)</enum><text>A description of the professional development activities to be undertaken in accordance with subsection (c)(2).</text></subparagraph><subparagraph commented="no" id="HE452BBA69E2B4B5CA945F151AF81B89F"><enum>(F)</enum><text>A description of the performance benchmarks to be used to evaluate the activities supported under the grant, and how data will be collected.</text></subparagraph><subparagraph commented="no" id="H86C58DE5210A419C9E55802FD99BB2CF"><enum>(G)</enum><text>A description of how the eligible agency will ensure that grants or contracts to eligible providers are of sufficient size and scope to achieve the purposes of this title.</text></subparagraph></paragraph></subsection><subsection commented="no" id="HC3AD0A2CD0084C6FBA0E4C8D23555E35"><enum>(c)</enum><header>Activities</header><text display-inline="yes-display-inline">An eligible agency that receives a grant under this title shall carry out the following:</text><paragraph id="H9DD2DC778D1C42CFAB4DC8A3F0FA7C3F"><enum>(1)</enum><text>Implementing a statewide technology plan for the adult education system, including—</text><subparagraph id="HA3BD831D389342BF9CE689B1B4282D46"><enum>(A)</enum><text>providing professional development for adult education, literacy, and workplace skills service providers;</text></subparagraph><subparagraph id="HF82540E3E02245CC943304A71BB9E2CD"><enum>(B)</enum><text>providing access to curricula, instruction, and assessment for adult learners and eligible providers;</text></subparagraph><subparagraph id="H70A19980C955488C9C5C9785065D94C2"><enum>(C)</enum><text>supporting the development of curricula and assessment tools for adult education, literacy, and workplace skills service providers; and</text></subparagraph><subparagraph id="H80D87873787748CBB474B040F206BF83"><enum>(D)</enum><text>providing guidance and technical assistance to eligible providers.</text></subparagraph></paragraph><paragraph id="H52569BB63A1A402B8A6E04F22E5E1869"><enum>(2)</enum><text>Supporting innovative pilot projects such as the use of assistive technology to deliver content to adult learners.</text></paragraph></subsection></section><section commented="no" id="H886908945076459789F8231A2174ABF6"><enum>305.</enum><header>Subgrants and contracts to eligible providers</header><subsection commented="no" id="H1B40D9F2E40A49A9BF927F0EF42F2FAB"><enum>(a)</enum><header>Authorization of subgrants and contracts</header><text>An eligible agency that receives a grant under this title shall award subgrants or contracts to eligible providers to carry out activities described in this section.</text></subsection><subsection commented="no" id="HD7A7B87826B242F3A65309FC178A67B2"><enum>(b)</enum><header>Eligible provider application</header><text>An eligible provider that desires to receive a subgrant or contract under this section shall submit an application to an eligible agency, which shall include—</text><paragraph commented="no" id="H7D696BF945A348C6B86D866960B6DA25"><enum>(1)</enum><text>a description of how the eligible provider will integrate technology into the eligible provider's delivery of adult education, literacy, and workplace skills services;</text></paragraph><paragraph commented="no" id="H68FBDDD60BC94604833B399FC3149667"><enum>(2)</enum><text>a description of professional development activities to be undertaken; and</text></paragraph><paragraph commented="no" id="H7A2890CAB57A44AD875A1BB566A2C9C4"><enum>(3)</enum><text>a description of plans to regularly replace computers and servers that lack the functional capabilities to process new online applications and services, including video conferencing, video streaming, virtual simulations, and distance education courses.</text></paragraph></subsection><subsection commented="no" id="HBD13617BC7714720A9BE53730EA3AD1B"><enum>(c)</enum><header>Eligible provider activities</header><text display-inline="yes-display-inline">An eligible provider that receives a subgrant or contract under this section shall carry out one or more of the following:</text><paragraph commented="no" id="H4E7B58E62CC94D3DBE148BA228D1CFA5"><enum>(1)</enum><text>Acquiring and effectively implementing technology tools, applications, and other resources in conjunction with enhancing or redesigning adult education, literacy, and workplace skills curricula to increase adult learning outcomes and improve adult digital literacy skills.</text></paragraph><paragraph commented="no" id="HADA6DE1E5EA24E48B006CDAAA3ED1D3A"><enum>(2)</enum><text>Acquiring and effectively implementing technology tools, applications, and other resources to—</text><subparagraph commented="no" id="H9D7C815D3C1A4B9C9C2459C65DC82D02"><enum>(A)</enum><text>conduct on going assessments and use other timely data systems to more effectively identify individual learning needs and guide personalized instruction, learning, and appropriate interventions that address those personalized student learning needs; and</text></subparagraph><subparagraph commented="no" id="H6BEE48F1E7974B40A0FB2E27404514ED"><enum>(B)</enum><text>support individualized learning, including through instructional software and digital content that support the learning needs of each student or through providing access to high-quality courses and instructors, especially in rural areas.</text></subparagraph></paragraph><paragraph commented="no" id="H404112BD21B8415D9AB14D2191B89C2B"><enum>(3)</enum><text>Providing professional development activities for providers of adult education, literacy, and workplace skills services that include—</text><subparagraph commented="no" id="HEE820EAB94E140DA9117EBDFCC309B4D"><enum>(A)</enum><text>training that is on-going, sustainable, timely, and directly related to delivering adult education, literacy, and workplace skills services;</text></subparagraph><subparagraph commented="no" id="H752F3692FB2C4E6F8360A46C10A9A8BB"><enum>(B)</enum><text>training in strategies and pedagogy in the delivery of adult education, literacy, and workplace skills services that involves the use of technology and curriculum redesign as key components of changing teaching and learning and improving outcomes for adult learners;</text></subparagraph><subparagraph commented="no" id="HCB0645E84FBB40F9AFFCAFB6DCBE3C11"><enum>(C)</enum><text>training in the use of technology to ensure that providers of adult education, literacy, and workplace skills services are able to use technology for data analysis to enable individualized instruction and to use technology to improve digital literacy skills for adult learners; and</text></subparagraph><subparagraph commented="no" id="H6C4856B7264D4B2BBD443D62428D9925"><enum>(D)</enum><text>training that includes on-going communication and follow-up with instructors, facilitators, and peers.</text></subparagraph></paragraph><paragraph commented="no" id="H65DF2FC853364DD8BC397A8DC9C4400C"><enum>(4)</enum><text>Acquisition and implementation of technology tools, applications, and other resources to be employed in professional development activities.</text></paragraph></subsection></section><section commented="no" id="H2D2785E352804A419ABB0BEFE05856F3"><enum>306.</enum><header>National Adult Learning and Technology Clearinghouse</header><subsection commented="no" id="H6CFD4EA51B6B470FAEE35D7237E004F6"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Center shall establish and maintain the National Adult Learning and Technology Resource Clearinghouse (referred to in this section as the <term>Clearinghouse</term>).</text></subsection><subsection commented="no" id="HD83EDCEE87F747DAA04014C2081E4F87"><enum>(b)</enum><header>Duties of the Clearinghouse</header><text>The Clearinghouse shall—</text><paragraph commented="no" id="H2D8716D8378D435CA9FF6E2B581374A4"><enum>(1)</enum><text>develop and disseminate frameworks for technology-based learning and professional development materials for adult education, literacy, and workplace skills;</text></paragraph><paragraph commented="no" id="H33FC21FE95C541598A232854B207B022"><enum>(2)</enum><text>develop and disseminate frameworks for performance measures for digital literacy skills;</text></paragraph><paragraph commented="no" id="HD7A72C3D5AF641E79C35551AA80838ED"><enum>(3)</enum><text display-inline="yes-display-inline">provide technical assistance to eligible entities and eligible providers of adult education, literacy, and workplace skills;</text></paragraph><paragraph commented="no" id="H24EE92C2B55F480C8EA7F1B46722607C"><enum>(4)</enum><text>support distance education for professional development for eligible entities and eligible providers of adult education, literacy, and workplace skills services;</text></paragraph><paragraph commented="no" id="H29CB55B9DEED4D0CB772DABFDCFDAAD6"><enum>(5)</enum><text>support the innovative uses of technology, such as the use of assistive technology, to deliver content to adult learners; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H6B26D021DDC140B5A28107FE7DE6A1CF"><enum>(6)</enum><text>be accessible to the public through the website of the Center.</text></paragraph></subsection></section><section commented="no" id="H027EAE5AAB004B378E5302E9D84D6617"><enum>307.</enum><header>Authorization of appropriations</header><text display-inline="no-display-inline">There are authorized to be appropriated to carry out this title, $250,000,000 for fiscal year 2015 and such sums as may be necessary for each succeeding fiscal year.</text></section><enum>IV</enum><header>Research in adult education</header><section id="H443EBD5C04754494BC699FD9950DA282"><enum>401.</enum><header>Research in adult education</header><subsection id="H26E71A4C6E944FC09E892625B127FEAF"><enum>(a)</enum><header>In general</header><text>Subparagraph (A) of section 133(c)(2) of the Education Sciences Reform Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/20/9533">20 U.S.C. 9533(c)(2)(A)</external-xref>) is amended to read as follows:</text><quoted-block display-inline="no-display-inline" id="H6DDD7321372C4DD9AD003C149819E687" style="OLC"><subparagraph id="H1309708D480F42F884B0931C5F8A3CD6"><enum>(A)</enum><text>Adult education, literacy, and workplace skills.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HABD02D8CB06542799D19A884A0BDCFDE"><enum>(b)</enum><header>National research and development center</header><paragraph id="H87540F21687A4A6F954A9F010E3BAA1A"><enum>(1)</enum><header>In general</header><text>The Secretary of Education shall direct the Commissioner for Education Research of the National Center for Education Research established pursuant to section 131 of the Education Sciences Reform Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/20/9531">20 U.S.C. 9531</external-xref>) to establish a national research and development center for adult education, literacy, and workplace skills as described in section 133(c)(2)(A) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/20/9533">20 U.S.C. 9533(c)(2)(A)</external-xref>).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HED25B360A508420E9A4A15597B242C1F"><enum>(2)</enum><header>Provision for expansion of research</header><text>If, as of the date of the enactment of this Act, the Commissioner for Education Research of the National Center for Education Research has established a center for adult literacy in accordance with section 133(c)(2)(A) of the Education Sciences Reform Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/20/9533">20 U.S.C. 9533(c)(2)(A)</external-xref>), the Commissioner shall expand the topic of research of such center to include adult education and workplace skills, in accordance with the amendment made by subsection (a).</text></paragraph></subsection></section><enum>V</enum><header>Employer incentives</header><section id="H4EC40DEF1DB94C94B65FD0C3DDFAA7F1"><enum>501.</enum><header>Credit for employer educational assistance programs</header><subsection id="H3E3F128FE8944FD390878C78AAAB943C"><enum>(a)</enum><header>In general</header><text>Subpart D of part IV of subchapter A of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/26/1">chapter 1</external-xref> of the Internal Revenue Code of 1986 is amended by adding at the end the following new section:</text><quoted-block act-name="" id="H3F1727D841F14ED285383271168300BD" style="OLC"><section id="H203AE7546BC848718A9D08008E139FCA"><enum>45S.</enum><header>Credit for employer educational assistance programs</header><subsection id="H33694D6761E3413E8DE70663A493B863"><enum>(a)</enum><header>General rule</header><text>For purposes of section 38, in the case of an employer, the employer educational assistance program credit determined under this section for the taxable year is an amount equal to 50 percent of the qualified educational assistance expenses paid or incurred by the taxpayer to or on behalf of any employee of the taxpayer during the taxable year.</text></subsection><subsection id="H94DA8B7D288E409DAED58D6379879308"><enum>(b)</enum><header>Limitations</header><paragraph id="H8A1DB9CBD53F4347A89C3455A12E0843"><enum>(1)</enum><header>Per employee limitation</header><text>The amount of the qualified educational assistance expenses taken into account under subsection (a) with respect to any employee for the taxable year shall not exceed $5,250.</text></paragraph><paragraph id="H44E855CC5E134D1A8DB20B811AB5C296"><enum>(2)</enum><header>Total limitation</header><text>The aggregate amount of the qualified educational assistance expenses taken into account under subsection (a) with respect to all employees of the taxpayer for the taxable year shall not exceed the average of the aggregate qualified educational assistance expenses with respect to all employees of the taxpayer taken into account under subsection (a) in the 3 taxable years preceding such taxable year.</text></paragraph><paragraph commented="no" id="H52093DB3AF624E56B0032C03C20BD86B"><enum>(3)</enum><header>Transition rule</header><subparagraph commented="no" id="HA140DBEC726F4180ABC25EAAD31A7BD3"><enum>(A)</enum><header>In general</header><text>In the case of a taxable year in which qualified educational assistance expenses of the taxpayer have not been taken into account under subsection (a) for each of the 3 taxable years preceding such taxable year, the aggregate amount of the qualified educational assistance expenses taken into account under subsection (a) with respect to all employees of the taxpayer for such taxable year shall not exceed the average of the sum of—</text><clause commented="no" id="H9336C8796C414827B57C6FD370782936"><enum>(i)</enum><text>the aggregate qualified educational assistance expenses with respect to all employees of the taxpayer taken into account under subsection (a) in any of the 3 taxable years preceding such taxable year, plus</text></clause><clause commented="no" id="HE098029BA770447FAC47919083DCD87E"><enum>(ii)</enum><text>the aggregate amount of amounts paid or expenses incurred by the employer, for which an exclusion was allowable to any employee of the employer under section 127, in any of such 3 taxable years in which no expenses were taken into account under subsection (a), plus</text></clause><clause commented="no" id="H888C85775D724105A6B1FA9745E579F1"><enum>(iii)</enum><text>in the case of a taxable year in which expenses have not been taken into account under subsection (a) or section 127 for each of the 3 taxable years preceding such taxable year, an amount equal to—</text><subclause commented="no" id="H7B5437DCACCE406AB425568EF23D1968"><enum>(I)</enum><text>$5,250, multiplied by</text></subclause><subclause commented="no" id="H567FC1E4C8614E6BB2B5302FC72F052C"><enum>(II)</enum><text>the number of employees of the taxpayer with respect to which the taxpayer has qualified educational assistance expenses in such taxable year.</text></subclause></clause></subparagraph></paragraph></subsection><subsection id="H130B49A7E59949668F8BC9660A779DD0"><enum>(c)</enum><header>Qualified educational assistance expenses</header><text>For purposes of this section—</text><paragraph id="HEB63E8DD533C48409E720B696AC5ADBF"><enum>(1)</enum><header>In general</header><text>The term <term>qualified educational assistance expenses</term> means expenses paid for educational assistance pursuant to an educational assistance program (within the meaning of section 127(b)).</text></paragraph><paragraph id="H52909213DBD14CCFA3EF0868B95772A1"><enum>(2)</enum><header>Educational assistance</header><text>The term <term>educational assistance</term> has the meaning given such term by section 127(c)(1), applied without regard to subparagraph (B) thereof, except that such term includes a payment only if such payment is made with respect to an employee enrolled in a program provided at the workplace or outside of the workplace—</text><subparagraph id="H2A9C0CC2E10D48CDBA4B14CA8D534A12"><enum>(A)</enum><text>leading to a sub-baccalaureate degree or career technical certificate awarded by an accredited postsecondary institution; or</text></subparagraph><subparagraph commented="no" id="H17B9D1F28BF34D0F9F436E3D91C535B7"><enum>(B)</enum><text>in basic education or English language training leading to a nationally recognized certificate of proficiency, or in workplace skills leading to an industry-recognized credential described in section 101(56) of the Workforce Investment Act of 1998 that is nationally recognized.</text></subparagraph></paragraph></subsection><subsection id="H074A11EA76494AE3A8C97A05C6D59D9F"><enum>(d)</enum><header>Other definitions and special rules</header><text>Rules similar to the rules of paragraphs (2) through (5) of section 127(c) shall apply for purposes of this section.</text></subsection><subsection id="HABB2B4E6A56A409AA921EE3691C9B2FE"><enum>(e)</enum><header>Denial of double benefit</header><text>No deduction or other credit shall be allowed under this chapter to an employer for any amount taken into account in determining the credit under this section.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H917CF0474C45459D9A80E914C3696E55"><enum>(b)</enum><header>Credit included in general business credit</header><text><external-xref legal-doc="usc" parsable-cite="usc/26/38">Section 38(b)</external-xref> of the Internal Revenue Code of 1986 is amended by striking <quote>plus</quote> at the end of paragraph (35), by striking the period at the end of paragraph (36) and inserting <quote>, plus</quote>, and by adding at the end the following new paragraph:</text><quoted-block act-name="" id="HA154A627642D494A96EADCD5472FF395" style="OLC"><paragraph id="H3610BE86DA16479EB825C260D8F52A49"><enum>(37)</enum><text>the employer educational assistance program credit determined under section 45S(a).</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HBD9CD57BE8944B7ABE4666C6238034DC"><enum>(c)</enum><header>Clerical amendment</header><text>The table of sections for subpart D of part IV of subchapter A of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/26/1">chapter 1</external-xref> of the Internal Revenue Code of 1986 is amended by adding at the end the following new item:</text><quoted-block display-inline="no-display-inline" id="HD5B86E4F21C54F7ABAD6F5C1DF9C373D" style="OLC"><toc><toc-entry bold="off" level="section">Sec. 45S. Credit for employer educational assistance programs.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection commented="no" display-inline="no-display-inline" id="H29A480AF41634921815FA079FC997EE8"><enum>(d)</enum><header>Effective date</header><text>The amendments made by this section shall apply to expenses relating to courses of instruction beginning after December 31, 2013.</text></subsection></section>
