read twice and referred to the <committee-name committee-id="SSAF00">Committee on Agriculture, Nutrition, and Forestry</committee-name></action-desc></action><legis-type>AN ACT</legis-type><official-title display="yes">To provide a temporary extension of the Food, Conservation, and Energy Act of 2008 and amendments made by that Act, as previously extended and amended and with certain additional modifications and exceptions, to suspend permanent price support authorities, and for other purposes.</official-title></form><legis-body id="H5F58D547C09546F3AE911E3ED2571A27" style="OLC"><section id="HE35C6179774A44E1830624CDA69FE0CD" section-type="section-one"><enum>1.</enum><header>Temporary extension of agricultural programs</header><subsection id="HA1BBBED471C94373B754755E1CB0E20A"><enum>(a)</enum><header>Extension</header><text display-inline="yes-display-inline">Except as otherwise provided in this section and notwithstanding any other provision of law, the authorities provided by each provision of the Food, Conservation, and Energy Act of 2008 (<external-xref legal-doc="public-law" parsable-cite="pl/110/246">Public Law 110–246</external-xref>; 122 Stat. 1651) and each amendment made by that Act (and for mandatory programs at such funding levels), as in effect on September 30, 2013, pursuant to the extension and amendments made by section 701 of the American Taxpayer Relief Act of 2012 (<external-xref legal-doc="public-law" parsable-cite="pl/112/240">Public Law 112–240</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/7/8701">7 U.S.C. 8701</external-xref> note), shall continue, and the Secretary of Agriculture shall carry out the authorities, until January 31, 2014, except as provided in subsection (b)(1) of such section 701.</text></subsection><subsection id="HA91284270118480EAE1CBFFBB304F71A"><enum>(b)</enum><header>Suspension of permanent price support authorities</header><text display-inline="yes-display-inline">The provisions of law specified in subsections (a) through (c) of section 1602 of the Food, Conservation, and Energy Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/7/8782">7 U.S.C. 8782</external-xref>) shall be suspended until January 31, 2014.</text></subsection><subsection id="H5A4C256BCC5145E2AD84C3BF8B6D0FEB"><enum>(c)</enum><header>Supplemental agricultural disaster assistance</header><text display-inline="yes-display-inline">Section 531 of the Federal Crop Insurance Act (<external-xref legal-doc="usc" parsable-cite="usc/7/1531">7 U.S.C. 1531</external-xref>), as amended by section 702 of the American Taxpayer Relief Act of 2012 (<external-xref legal-doc="public-law" parsable-cite="pl/112/240">Public Law 112–240</external-xref>), relating to the provision of supplemental agricultural disaster assistance, shall apply through January 31, 2014.</text></subsection><subsection id="H1A659D6910584266A9D665008B244620"><enum>(d)</enum><header>Exceptions</header><paragraph commented="no" id="H002298C722D140DE9F19700B7FB3BE67"><enum>(1)</enum><header>Nutrition</header><text display-inline="yes-display-inline">Subsection (a) does not apply with respect to mandatory funding provided by the program authorized by the provision of law amended by subsection (d)(2) of section 701 of the American Taxpayer Relief Act of 2012 (<external-xref legal-doc="public-law" parsable-cite="pl/112/240">Public Law 112–240</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/7/8701">7 U.S.C. 8701</external-xref> note).</text></paragraph><paragraph id="HDED4DF6A1166434C86B4C1ED2B63D68A"><enum>(2)</enum><header>Conservation</header><text display-inline="yes-display-inline">Subsection (a) does not apply with respect to the programs specified in paragraphs (3)(B), (4), (6), and (7) of section 1241(a) of the Food Security Act of 1985 (<external-xref legal-doc="usc" parsable-cite="usc/16/3841">16 U.S.C. 3841(a)</external-xref>), relating to the conservation stewardship program, farmland protection program, environmental quality incentives program, and wildlife habitat incentives program, for which program authority was extended through fiscal year 2014 by section 716 of <external-xref legal-doc="public-law" parsable-cite="pl/112/55">Public Law 112–55</external-xref> (125 Stat. 582).</text></paragraph><paragraph id="H632FAF10B2B5454788D26B2200F46140"><enum>(3)</enum><header>Trade</header><text display-inline="yes-display-inline">Subsection (a) does not apply with respect to the following provisions of law:</text><subparagraph id="H30FB27E0FE6A498CB75624018BE2DC2F"><enum>(A)</enum><text>Section 3206 of the Food, Conservation, and Energy Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/7/1726c">7 U.S.C. 1726c</external-xref>) relating to the use of Commodity Credit Corporation funds to support local and regional food aid procurement projects.</text></subparagraph><subparagraph id="H1C140DA3016240DF8FD67E36E8451042"><enum>(B)</enum><text display-inline="yes-display-inline">Section 3107(l)(1) of the Farm Security and Rural Investment Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/7/1736o-1">7 U.S.C. 1736o–1(l)(1)</external-xref>) relating to the use of Commodity Credit Corporation funds to carry out the McGovern-Dole International Food for Education and Child Nutrition Program.</text></subparagraph></paragraph><paragraph id="H89EA0E65B5974AA78B5ADF17FA37ECBE"><enum>(4)</enum><header>Survey of foods purchased by school food authorities</header><text display-inline="yes-display-inline">Subsection (a) does not apply with respect to section 4307 of the Food, Conservation, and Energy Act of 2008 (<external-xref legal-doc="public-law" parsable-cite="pl/110/246">Public Law 110–246</external-xref>; 122 Stat. 1893) relating to the use of Commodity Credit Corporation funds for a survey and report regarding foods purchased by school food authorities.</text></paragraph><paragraph display-inline="no-display-inline" id="HE2514EAF62444A7AA1A1B64761919974"><enum>(5)</enum><header>Rural development</header><text display-inline="yes-display-inline">Subsection (a) does not apply with respect to the following provisions of law:</text><subparagraph id="H61BB6372756345FF99BC41B4CD8DCE79"><enum>(A)</enum><text display-inline="yes-display-inline">Section 379E(d)(1) of the Consolidated Farm and Rural Development Act (<external-xref legal-doc="usc" parsable-cite="usc/7/2008s">7 U.S.C. 2008s(d)(1)</external-xref>), relating to funding of the rural microentrepreneur assistance program.</text></subparagraph><subparagraph id="H2F2218A3F1B44A4EB733533826CB7C89"><enum>(B)</enum><text display-inline="yes-display-inline">Section 6029 of the Food, Conservation, and Energy Act of 2008 (<external-xref legal-doc="public-law" parsable-cite="pl/110/246">Public Law 110–246</external-xref>; 122 Stat. 1955) relating to funding of pending rural development loan and grant applications.</text></subparagraph><subparagraph id="HC5646B5A6B4F4DB7ACBD11BC18A033A1"><enum>(C)</enum><text display-inline="yes-display-inline">Section 231(b)(7)(A) of the Agricultural Risk Protection Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/7/1632a">7 U.S.C. 1632a(b)(7)(A)</external-xref>), relating to funding of value-added agricultural market development program grants.</text></subparagraph><subparagraph id="H7E8135D2844443E1A6F9420967D78437"><enum>(D)</enum><text display-inline="yes-display-inline">Section 375(e)(6)(B) of the Consolidated Farm and Rural Development Act (<external-xref legal-doc="usc" parsable-cite="usc/7/2008j">7 U.S.C. 2008j(e)(6)(B)</external-xref>) relating to the use of Commodity Credit Corporation funds for the National Sheep Industry Improvement Center.</text></subparagraph></paragraph><paragraph id="H57B97BBE396641C6B74C0F03A1540474"><enum>(6)</enum><header>Market Loss Assistance for Asparagus Producers</header><text display-inline="yes-display-inline">Subsection (a) does not apply with respect to section 10404(d) of the Food, Conservation, and Energy Act of 2008 (<external-xref legal-doc="public-law" parsable-cite="pl/110/246">Public Law 110–246</external-xref>; 122 Stat. 2112).</text></paragraph><paragraph id="HFFAC90AB0B394988846C6A3616CA056C"><enum>(7)</enum><header>Supplemental agricultural disaster assistance</header><text display-inline="yes-display-inline">Subsection (a) does not apply with respect to section 531 of the Federal Crop Insurance Act (<external-xref legal-doc="usc" parsable-cite="usc/7/1531">7 U.S.C. 1531</external-xref>) and title IX of the Trade Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/19/2497">19 U.S.C. 2497 et seq.</external-xref>) relating to the provision of supplemental agricultural disaster assistance.</text></paragraph><paragraph id="HAC8EA5393B784C46B2C3365ADDD9A5B0"><enum>(8)</enum><header>Pigford claims</header><text display-inline="yes-display-inline">Subsection (a) does not apply with respect to section 14012 of the Food, Conservation, and Energy Act of 2008 (<external-xref legal-doc="public-law" parsable-cite="pl/110/246">Public Law 110–246</external-xref>; 122 Stat. 2209) relating to determination on the merits of Pigford claims.</text></paragraph><paragraph id="H0137096AC87D4FC6BE80777032DC011D"><enum>(9)</enum><header>Heartland, habitat, harvest, and horticulture act of 2008</header><text display-inline="yes-display-inline">Subsection (a) does not apply with respect to title XV of the Food, Conservation, and Energy Act of 2008 (<external-xref legal-doc="public-law" parsable-cite="pl/110/246">Public Law 110–246</external-xref>; 122 Stat. 2246), and amendments made by that title, relating to the provision of supplemental agricultural disaster assistance under title IX of the Trade Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/19/2497">19 U.S.C. 2497 et seq.</external-xref>), certain revenue and tax provisions, and certain trade benefits and other matters.</text></paragraph></subsection><subsection commented="no" id="H96E5AE4F08754E71A93422BDD485E763"><enum>(e)</enum><header>Effective Date</header><text display-inline="yes-display-inline">This section takes effect as of September 30, 2013.</text></subsection></section></legis-body><attestation><attestation-group><attestation-date chamber="House" date="20131212">Passed the House of Representatives December 12, 2013.</attestation-date><attestor display="yes">Karen L.
