R. 3691</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action><action-date date="20131210">December 10, 2013</action-date><action-desc><sponsor name-id="K000380">Mr. Kildee</sponsor> introduced the following bill; which was referred to the <committee-name committee-id="HAS00">Committee on Armed Services</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend title 10, United States Code, to require additional disclosures when lending to military members and their dependents, and for other purposes.</official-title></form><legis-body id="H240B803175294F2CB89B88175DE1616B" style="OLC"><section id="H546BAC1C059748B0892102F4C0BEB2CC" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Transparency in Military Lending Act of 2013</short-title></quote>.</text></section><section id="H67E12C7D1B36408087D6CC33610A8B80"><enum>2.</enum><header>Transparency in lending to military members and their dependents</header><subsection id="H33B945EA5578410D900B7CE29B029531"><enum>(a)</enum><header>Transparency and disclosures</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/10/987">Section 987(c)</external-xref> of title 10, United States Code, is amended by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="H1F18EC27680740A6B8B4BE29766047B2" style="OLC"><paragraph id="H031F681302A0427CA0454F2D01415D6F"><enum>(3)</enum><header>Additional disclosures</header><subparagraph id="H723B57DF66EE42A6A2EEF37DED385F88"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">With respect to any extension of consumer credit described under paragraph (1), a creditor shall provide to the member or dependent each of the following pieces of information, orally and in writing, and the creditor may not issue the credit unless the member or dependent signs a separate acknowledgment next to each piece of information acknowledging that the member or dependent has read each such piece:</text><clause id="H9F6FF357697A4065BBAFA24F9E879405"><enum>(i)</enum><text display-inline="yes-display-inline">A statement that the Department of Defense and each service branch, offers a variety of financial counseling services.</text></clause><clause id="H7930F94C73A94A2D8FAE90C63C4FDBB3"><enum>(ii)</enum><text display-inline="yes-display-inline">A statement that other, lower interest rate loans, including potentially 0 percent interest loans, may be available through other financial institutions and military relief societies.</text></clause><clause id="H6ECE23AB7BE64C8A90AC3B2475C8BB65"><enum>(iii)</enum><text>Contact information for the nearest Department of Defense financial counseling office.</text></clause><clause id="HB20422CD934E4037B4FE6F25223EC102"><enum>(iv)</enum><text>The actual cost of the extension of credit, prepared as an amortization table showing what the cost to the member or dependent will be if paid off at different points over time.</text></clause></subparagraph><subparagraph id="HB5B65452819D4B9EB9ACC3038F72909F"><enum>(B)</enum><header>Format of disclosures</header><text>The disclosures required under this paragraph shall be made on a single sheet of paper and be in a bold, 14-point font.</text></subparagraph><subparagraph id="H884AFF20C8E54BF2893AB0CE69334425"><enum>(C)</enum><header>List of financial counseling offices</header><text>The Secretary of Defense shall prepare a list of Department of Defense financial counseling offices, and make sure the list is available to creditors and the public.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H7B3EABDFC1DB434F98ACD8635329F62F"><enum>(b)</enum><header>Transparency for payday loans and vehicle loans</header><text>Solely for purposes of the disclosures required under <external-xref legal-doc="usc" parsable-cite="usc/10/987">section 987(c)(3)</external-xref> of title 10, United States Code, the Secretary of Defense shall apply the definitions of <quote>payday loans</quote> and <quote>vehicle title loans</quote> under <external-xref legal-doc="regulation" parsable-cite="cfr/32/232.3">section 232.3</external-xref> of title 32, Code of Federal Regulations, as providing that the terms of such loans are 10 years or less.</text></subsection></section></legis-body></bill>
