R. 3676</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action><action-date date="20131209">December 9, 2013</action-date><action-desc><sponsor name-id="S001154">Mr. Shuster</sponsor> introduced the following bill; which was referred to the <committee-name committee-id="HPW00">Committee on Transportation and Infrastructure</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To establish a prohibition on certain cell phone voice communications during passenger flights, and for other purposes.</official-title></form><legis-body id="H0055509D2F484A6EBAB64C09C170D575" style="OLC"><section id="H06C1044553D445A2BA7632FD7036E620" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Prohibiting In-Flight Voice Communications on Mobile Wireless Devices Act of 2013</short-title></quote>.</text></section><section id="HFFDEA1E790D24C4884D90BED665FE07E"><enum>2.</enum><header>Prohibition on certain cell phone voice communications</header><subsection id="HFFDFAE0CDEFA413DB55386A8D208603D"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Subchapter I of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/49/417">chapter 417</external-xref> of title 49, United States Code, is amended by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="HAB42FE99F0F6490BA5101C39CBA06670" style="USC"><section id="HB30A3511E8C3405487959B0117F879FA"><enum>41725.</enum><header>Prohibition on certain cell phone voice communications</header><subsection id="H34B50D99CF6740E8BE119500E18B23BC"><enum>(a)</enum><header>Prohibition</header><text display-inline="yes-display-inline">The Secretary of Transportation shall issue regulations—</text><paragraph id="HA0B04D3DCB2340BAA1E90BA0212DC91C"><enum>(1)</enum><text>to prohibit an individual on an aircraft from engaging in voice communications using a mobile communications device during a flight of that aircraft in scheduled passenger interstate or intrastate air transportation; and</text></paragraph><paragraph id="H20D5685AC8D24AA5999AD0BD8ACB9003"><enum>(2)</enum><text>that exempt from the prohibition described in paragraph (1) any—</text><subparagraph id="H1BB996A273194F21A8A7C483C999386C"><enum>(A)</enum><text display-inline="yes-display-inline">member of the flight crew on duty on an aircraft;</text></subparagraph><subparagraph id="H5474A70E68B445BF80BC9633F4F06A25"><enum>(B)</enum><text>flight attendant on duty on an aircraft; and</text></subparagraph><subparagraph id="H70DBA46510B64DECA107BBDC442C9BE3"><enum>(C)</enum><text>Federal law enforcement officer acting in an official capacity.</text></subparagraph></paragraph></subsection><subsection id="HFB6BE902B16A44079C3785E22E68E90A"><enum>(b)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section, the following definitions apply:</text><paragraph id="H70477CC6B49744A9A356E31C045AC430"><enum>(1)</enum><header>Flight</header><text>The term <term>flight</term> means, with respect to an aircraft, the period beginning when the aircraft takes off and ending when the aircraft lands.</text></paragraph><paragraph id="HF279AA3D46474890B8E9CE3BA3835649"><enum>(2)</enum><header>Mobile communications device</header><subparagraph id="HB5EF29B92FDB4F86BCB91B55C7B7215F"><enum>(A)</enum><header>In general</header><text>The term <term>mobile communications device</term> means any portable wireless telecommunications equipment utilized for the transmission or reception of voice data.</text></subparagraph><subparagraph id="HDE5BFD432AFE470D9CB28A4AB6D4FEB2"><enum>(B)</enum><header>Limitation</header><text>The term <term>mobile communications device</term> does not include a phone installed on an aircraft.</text></subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H2A6335131FBB45CEB4C588E835EEA01F"><enum>(b)</enum><header>Clerical amendment</header><text>The analysis for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/49/417">chapter 417</external-xref> of title 49, United States Code, is amended by inserting after the item relating to <external-xref legal-doc="usc" parsable-cite="usc/49/41724">section 41724</external-xref> the following:</text><quoted-block display-inline="no-display-inline" id="H25092E7E30804083BEEF704B72706DBD" style="USC"><toc regeneration="no-regeneration"><toc-entry level="section">41725.
