R. 3669</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action><action-date date="20131205">December 5, 2013</action-date><action-desc><sponsor name-id="M001171">Mr. Maffei</sponsor> introduced the following bill; which was referred to the <committee-name committee-id="HJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend title 18, United States Code, to provide for increased supervision of persons required to wear an electronic monitoring device as a condition of release from prison, to criminalize disabling such an electronic monitoring device, to establish the Office of the Inspector General for Probation and Pretrial Services, and for other purposes.</official-title></form><legis-body id="H3D6B1CC6C28443F4A64343E47977A647" style="OLC"><section id="H1F3EFD29B73145C2B768A76C0BECEC0E" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Federal Probation System Reform Act</short-title></quote>.</text></section><section id="H12F2012C090A4EA9A9C5BC0A43619D5D"><enum>2.</enum><header>Supervision of a person assigned an electronic monitoring device as a condition of release; Penalty for disabling an electronic monitoring device</header><subsection id="H172C08C50F124A92914CD8C0FAEB36BF"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Part II of title 18, United States Code, is amended by inserting after chapter 237 the following new chapter:</text><quoted-block display-inline="no-display-inline" id="HA08BCD9CD650481F8F21602FBEB2E72A" style="USC"><chapter id="H2CCAF1F110874837912FAFBF3C36D565"><enum>239</enum><header>Electronic Monitoring Devices</header><toc regeneration="no-regeneration"><toc-entry level="section">Sec.</toc-entry><toc-entry level="section">3801. Supervision of a person assigned an electronic monitoring device as a condition of release.</toc-entry><toc-entry level="section">3802. Penalty for disabling an electronic monitoring device. </toc-entry></toc><section id="H8295B7D8FCA341EEB296144DF2E931C5"><enum>3801.</enum><header>Supervision of a person assigned an electronic monitoring device as a condition of release</header><subsection id="H39E677D5DC4E459DA9A0062E3F640EB4"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">In the case of a person who was convicted of a Federal offense who has been sentenced to probation pursuant to subchapter B of chapter 227, placed on probation pursuant to the provisions of chapter 403, or placed on supervised release pursuant to section 3583, or a person accused of such an offense who has been released pending trial, sentence, or appeal pursuant to chapter 207, who is required to wear an electronic monitoring device as a condition of such probation or release, the Director of the Administrative Office of the United States Courts shall ensure that an appropriate probation officer or pretrial services officer supervises the person by doing the following:</text><paragraph id="H01BD83A6B5DA4ED791328E96BC76E55A"><enum>(1)</enum><text display-inline="yes-display-inline">Conducting a daily review of any data produced by the electronic monitoring device worn by the person.</text></paragraph><paragraph id="H70C85085FA0741E8BA656FF1E873C9E0"><enum>(2)</enum><text display-inline="yes-display-inline">In the case of an alert produced by an electronic monitoring system that the Director determines requires an investigation, conducting an investigation immediately following the alert, including—</text><subparagraph id="HA9197B7165DC41AEB537DE9E1F80ABCD"><enum>(A)</enum><text>contacting the person;</text></subparagraph><subparagraph id="H7C76F7DFF6454B46A5B89AE7344039D3"><enum>(B)</enum><text>inspecting the electronic monitoring device; and</text></subparagraph><subparagraph id="HB115F921317544CC816DF44BCA9623AB"><enum>(C)</enum><text>documenting the alert and the response taken.</text></subparagraph></paragraph></subsection><subsection id="H5EB407DB28D947A88A793A12F3EE5A88"><enum>(b)</enum><header>Uniform Standards</header><text>Not later than 60 days after the date of the enactment of this section, the Director of the Administrative Office of the United States Courts shall issue uniform standards in order to implement subsection (a).</text></subsection></section><section id="H0C0AFAC4C7EE4EA985528F6BB511AD28"><enum>3802.</enum><header>Penalty for disabling an electronic monitoring device</header><subsection id="HBCF2A81F7D004A258F91B6E47834255B"><enum>(a)</enum><header>Offense</header><text display-inline="yes-display-inline">Whoever—</text><paragraph id="H2A22DD9694A54809A3D93674C619D0D5"><enum>(1)</enum><text display-inline="yes-display-inline">intentionally disables an electronic monitoring device that was assigned to a person as a condition of probation pursuant to subchapter B of chapter 227 or chapter 403, supervised release pursuant to section 3583, or release pending trial, sentence, or appeal pursuant to chapter 207; or</text></paragraph><paragraph id="H47DA9536050A4296BA1EF9412FC937AB"><enum>(2)</enum><text display-inline="yes-display-inline">having been assigned an electronic monitoring device as a condition of probation pursuant to subchapter B of chapter 227 or chapter 403, supervised release pursuant to section 3583, or release pending trial, sentence, or appeal pursuant to chapter 207, intentionally allows another person to disable such device;</text></paragraph><continuation-text continuation-text-level="subsection">shall be punished as provided in subsection (b).</continuation-text></subsection><subsection id="HDD05BF6E6757438C89F575AA9859A2FB"><enum>(b)</enum><header>Punishment</header><text>The punishment for an offense under subsection (a) is—</text><paragraph id="HCD3A7B61677C40A0B4719BBE46B58A2E"><enum>(1)</enum><text>if the person to whom the electronic monitoring device was assigned commits a Federal, State, or local offense in addition to violating subsection (a) upon the disabling of such device, a fine under this title or imprisonment for not more than 4 years; or</text></paragraph><paragraph id="HBC317D0D965647B9A9C9D74820C426A6"><enum>(2)</enum><text>if the person to whom the electronic monitoring device was assigned does not commit a Federal, State or local crime in addition to violating subsection (a) upon the disabling of such device, a fine under this title or imprisonment for not more than 1 year.</text></paragraph></subsection></section></chapter><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HF735A9F1B5A1488C860DA5BA93CA8758"><enum>(b)</enum><header>Clerical amendment</header><text>The table of chapters for part II of title 18, United States Code, is amended by inserting after the item relating to chapter 237 the following:</text><quoted-block display-inline="no-display-inline" id="H85FC2EC6AA1C43099B6E5A37DA0708F5" style="OLC"><toc regeneration="no-regeneration"><multi-column-toc-entry level="chapter"><toc-enum>239.</toc-enum><level-header level="chapter">Electronic Monitoring Devices</level-header><target>3801</target></multi-column-toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="HCC1DD808EC6D4C719C24FBD1897439C9"><enum>3.</enum><header>Inspector General for Probation and Pretrial Services</header><subsection id="HF3E978FF2F684BCD983333329E1E4739"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Chapter 207 of part II of title 18, United States Code, is amended—</text><paragraph id="H8523D505DE7F493F98EB047DF05DC3FB"><enum>(1)</enum><text>by redesignating sections 3155 and 3156 as sections 3156 and 3157, respectively;</text></paragraph><paragraph id="H975FA8B53EAA4D8BB673F951FF6D5CB3"><enum>(2)</enum><text display-inline="yes-display-inline">after section 3154, by inserting the following:</text><quoted-block display-inline="no-display-inline" id="H59276A80B59B461EACC844D398208E89" style="USC"><section id="HF1650B64FEC74060AD615D469F3B998D"><enum>3155.</enum><header>Inspector General for Probation and Pretrial Services</header><subsection id="H330A3A2935554F02B4BB654D67528955"><enum>(a)</enum><header>Establishment</header><text display-inline="yes-display-inline">There is established within pretrial services (commonly referred to as the United States Probation and Pretrial Services System) the Office of the Inspector General for Probation and Pretrial Services (referred to in this section as the <quote>Office</quote>).</text></subsection><subsection id="H6E24FF8F4B254E91A581478E607AAB21"><enum>(b)</enum><header>Appointment, term, and removal of Inspector General</header><paragraph id="H523AE8BE4402499DBFD55E4999D6A102"><enum>(1)</enum><header>Appointment</header><text display-inline="yes-display-inline">The head of the Office shall be the Inspector General, who shall be appointed by the Chief Justice of the United States after consultation with the majority and minority leaders of the Senate and the Speaker and minority leader of the House of Representatives.</text></paragraph><paragraph id="HEBE0A9F2B6664395BBBC962F9F23AE82"><enum>(2)</enum><header>Term</header><text display-inline="yes-display-inline">The Inspector General shall serve for a term of four years and may be reappointed by the Chief Justice of the United States for any number of additional terms.</text></paragraph><paragraph id="H99ECFFBDD02F481D99B0875B755A42F7"><enum>(3)</enum><header>Removal</header><text>The Inspector General may be removed from office by the Chief Justice of the United States. The Chief Justice shall communicate the reasons for any such removal to both Houses of Congress.</text></paragraph></subsection><subsection id="H4F8ED804B5624989A1BC6FFD2AA9803D"><enum>(c)</enum><header>Duties</header><text>With respect to probation and pretrial services, the Office shall—</text><paragraph id="HE0A88389562F48DDA7AADD68BB533E55"><enum>(1)</enum><text>conduct investigations of alleged misconduct;</text></paragraph><paragraph id="H0FFEA951F5EE4263842095DFCFD36598"><enum>(2)</enum><text>conduct and supervise audits and investigations;</text></paragraph><paragraph id="H355D28A103514F798AB5DDC4769EB0E4"><enum>(3)</enum><text>prevent and detect waste, fraud, and abuse; and</text></paragraph><paragraph id="HAEC1AF5BA2E0496CA35FA60ED959C9B0"><enum>(4)</enum><text>recommend changes in laws or regulations governing probation and pretrial services.</text></paragraph></subsection><subsection id="H977F80CCFCBA475296B4993049165F52"><enum>(d)</enum><header>Powers</header><paragraph id="H9ABEF9F2C2E84A598EE7A8ECAF55CD8C"><enum>(1)</enum><header>In general</header><text>In carrying out the duties of the Office, the Inspector General shall have the power—</text><subparagraph display-inline="no-display-inline" id="H80473BC78A504A7BAE5EB1E038D84A13"><enum>(A)</enum><text>to make investigations and reports;</text></subparagraph><subparagraph id="H0DFB0F9757B04793A32D351158BD3038"><enum>(B)</enum><text>to obtain information or assistance from any Federal, State, or local governmental agency, or other entity, or unit thereof, including all information kept in the normal course of business by probation and pretrial services in any judicial district;</text></subparagraph><subparagraph id="H4A576D65DF3C45C6B6AA2BD841AF64CD"><enum>(C)</enum><text>to require, by subpoena or otherwise, the attendance and testimony of such witnesses, and the production of such books, records, correspondence memoranda, papers, and documents; which subpoena, in the case of contumacy or refusal to obey, shall be enforceable by civil action;</text></subparagraph><subparagraph id="H3C7AA626FE804AABB1C889ECC48A5360"><enum>(D)</enum><text>to administer to or take from any person an oath, affirmation, or affidavit;</text></subparagraph><subparagraph id="HE48FF47FE5F3473BA2BB0A7DB578F9FF"><enum>(E)</enum><text>to employ such officers and employees, subject to the provisions of title 5, governing appointments in the competitive service, and the provisions of chapter 51 and subchapter III of chapter 53 of such title relating to classification and General Schedule pay rates;</text></subparagraph><subparagraph id="H9B80BD4A050F4A88BFF00AC0830218C7"><enum>(F)</enum><text>to obtain services authorized by <external-xref legal-doc="usc" parsable-cite="usc/5/3109">section 3109</external-xref> of title 5 at daily rates not to exceed the equivalent rate prescribed for grade GS–18 of the General Schedule by <external-xref legal-doc="usc" parsable-cite="usc/5/5332">section 5332</external-xref> of title 5; and—</text></subparagraph><subparagraph id="HB1DC6EE95241458D941BAE712FA866CF"><enum>(G)</enum><text>to the extent and in such amounts as may be provided in advance by appropriations Acts, to enter into contracts and other arrangements for audits, studies, analyses, and other services with public agencies and with private persons, and to make such payments as may be necessary to carry out the duties of the Office.</text></subparagraph></paragraph><paragraph id="HFDCF6B36893C44668E18A2BB7370B371"><enum>(2)</enum><header>Limitation</header><text>The Inspector General shall not have the authority to—</text><subparagraph id="H41FE8A5031634AE69D4A9063C3983BF4"><enum>(A)</enum><text>investigate or review any matter that is directly related to the merits of a decision or procedural ruling by any judge or court; or</text></subparagraph><subparagraph id="HF466883B10464B49AD3E8DF9893F56E4"><enum>(B)</enum><text display-inline="yes-display-inline">punish or discipline any pretrial services officer or probation officer.</text></subparagraph></paragraph></subsection><subsection id="HD1767B7C946843E1B5B2CF197B6D1411"><enum>(e)</enum><header>Reports</header><paragraph id="H6F05E240872C4732A6DC6E8EFD7B5A79"><enum>(1)</enum><header>When to be made</header><text display-inline="yes-display-inline">The Inspector General shall—</text><subparagraph id="H7AED737BDA4A4C2889E01AD1C154CCDD"><enum>(A)</enum><text display-inline="yes-display-inline">make an annual report to the Director of the Administrative Office of the United States Courts and to Congress relating to the activities of the Office; and</text></subparagraph><subparagraph id="H5652B2AD7D08496E8249F75B7BDDFD0A"><enum>(B)</enum><text display-inline="yes-display-inline">make prompt reports to the Director and to Congress on matters that may require action by them.</text></subparagraph></paragraph><paragraph id="H973EBFA737CB47C3838E50B8C5639D86"><enum>(2)</enum><header>Sensitive matter</header><text>If a report contains sensitive matter, the Inspector General may so indicate and Congress may receive that report in closed session.</text></paragraph><paragraph id="HC716C3B592734E6FA72B8003EDCFD4E5"><enum>(3)</enum><header>Duty to inform Attorney General</header><text>In carrying out the duties of the Office, the Inspector General shall report expeditiously to the Attorney General whenever the Inspector General has reasonable grounds to believe there has been a violation of Federal criminal law.</text></paragraph></subsection><subsection id="H80D2B34EF9CD41A08DD6F0DD3C310DB9"><enum>(f)</enum><header>Whistleblower protection</header><paragraph id="HA81B43586AA245C597F93BF3C891FD80"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">No officer, employee, agent, contractor, or subcontractor of pretrial services may discharge, demote, threaten, suspend, harass, or in any other manner discriminate against an employee in the terms and conditions of employment because of any lawful act done by the employee to provide information, cause information to be provided, or otherwise assist in an investigation regarding any possible violation of Federal law or regulation, or misconduct, by a pretrial services officer or probation officer, which may assist the Inspector General in the performance of duties under this chapter.</text></paragraph><paragraph id="H9A15528D275F401D996800139C4A49AC"><enum>(2)</enum><header>Civil action</header><text>An employee injured in violation of paragraph (1) may, in a civil action, obtain appropriate relief.</text></paragraph></subsection><subsection id="HEE98C09EB713428F8DEBA2D66C3FFC96"><enum>(g)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated such sums as may be necessary to carry out this section.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H762E80D85AF842D3A6108AAF8E30A7C2"><enum>(b)</enum><header>Clerical amendments</header><text>Chapter 207 of part II of title 18, United States Code, is amended—</text><paragraph id="H2223E68F79B34C05836C1242584D3E65"><enum>(1)</enum><text display-inline="yes-display-inline">in section 3157(b) (as redesignated by this Act) is amended by striking <quote>3152–3155</quote> and inserting <quote>3152–3156</quote>; and</text></paragraph><paragraph id="H06104AE0BCDA4FCDB60DC039E7997290"><enum>(2)</enum><text>in the table of sections, after the item relating to section 3154, by inserting the following:</text><quoted-block display-inline="no-display-inline" id="H26851EA055FB4CC094871886A9D6246E" style="USC"><toc regeneration="no-regeneration"><toc-entry level="section">3155.
