		  certain payments under the TANF program to Puerto Rico, the Virgin Islands,

		<section id="HE735C8D2EAB446C7A9904099D7A59377" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Territorial TANF Equity Act of
			 2013</short-title></quote>.</text>
		</section><section id="H630FDA3A33D34EE7B5DCC4A8C6F6494E"><enum>2.</enum><header>Elimination of
			 cap on certain payments to Puerto Rico, the Virgin Islands, Guam, and American
			 Samoa</header>
			<subsection id="H643CCE6D80384C78B9E7C1C24C9098FD"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Section 1108 of the
			 Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1308">42 U.S.C. 1308</external-xref>) is amended by striking subsection
			 (a).</text>
			</subsection><subsection id="H4479EE13369C4AF690DECCA25FD96464"><enum>(b)</enum><header>Conforming
			 amendments</header>
				<paragraph id="H47482AF03B234982B86A8CBE058E243C"><enum>(1)</enum><header>Redesignations</header><text>Section
			 1108 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1308">42 U.S.C. 1308</external-xref>) is amended by redesignating subsections (b),
			 (c), (d), (f), and (g) as subsections (a), (b), (c), (d), and (e),
			 respectively.</text>
				</paragraph><paragraph id="H65ECF16C1DE542F9ADCDDEAC74ED0A09"><enum>(2)</enum><header>Additional
			 conforming amendments</header><text>Section 1108 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1308">42 U.S.C. 1308</external-xref>)
			 is amended—</text>
					<subparagraph id="HA182F2FF19B245559C837FD25CE6B829"><enum>(A)</enum><text>in subsection (b),
			 as redesignated by paragraph (1)—</text>
						<clause id="H22050F67FEFE4DC8AA1835C093219650"><enum>(i)</enum><text>by
			 striking paragraphs (2), (4), and (5); and</text>
						</clause><clause id="H5A7AA553ED2B48CE842C41F8B2D2FB3E"><enum>(ii)</enum><text>redesignating
			 paragraph (3) as paragraph (2);</text>
						</clause></subparagraph><subparagraph id="HB3F3FF06E9CB44BA813EBA47CFD12A1E"><enum>(B)</enum><text display-inline="yes-display-inline">in subsection (c), as redesignated by
			 paragraph (1), by striking <quote>subsection (b)</quote> and inserting
			 <quote>subsection (a)</quote>;</text>
					</subparagraph><subparagraph id="H290976A1043149408C29B6E2CBFA8153"><enum>(C)</enum><text display-inline="yes-display-inline">in subsection (d), as redesignated by
			 paragraph (1), by striking <quote>subsection (g)</quote> and inserting
			 <quote>subsection (e)</quote>; and</text>
					</subparagraph><subparagraph id="H82CF62F593094A68A920FAE2B697B8FC"><enum>(D)</enum><text display-inline="yes-display-inline">in subsection (e), as redesignated by

					</subparagraph></paragraph></subsection></section><section id="HE3CEBE1C5B9E4AAB90F608F8854EA3FC"><enum>3.</enum><header>Supplemental
			 grants to Puerto Rico, the Virgin Islands, Guam, and American
			 Samoa</header><text display-inline="no-display-inline">Section 1108(a) of the
			 Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1308">42 U.S.C. 1308(a)</external-xref>), as redesignated by section 2(b)(1) of
			 this Act, is amended to read as follows:</text>
			<quoted-block display-inline="no-display-inline" id="H32652C771965441F887B1B583BC86E22" style="OLC">
				<subsection id="H7CFCF636F47044069B27BE35B70EF30F"><enum>(a)</enum><header>Entitlement to
				supplemental grants</header>
					<paragraph id="H024D4CE0D7864A66B1492468942203EE"><enum>(1)</enum><header>In
				general</header><text>Each territory shall be entitled to receive from the
				Secretary for each fiscal year a supplemental grant in an amount equal
				to—</text>
						<subparagraph id="HFE665F26C26E415EB48764070F76FE4D"><enum>(A)</enum><text>in the case of
				Puerto Rico, the Virgin Islands, and Guam, 10 percent of the family assistance
				grant payable to the territory for the fiscal year; and</text>
						</subparagraph><subparagraph id="H54EF476EB4B14247AF78DBCBC211C8AC"><enum>(B)</enum><text>in the case of
				American Samoa, $100,000.</text>
						</subparagraph></paragraph><paragraph commented="no" id="H22242C5FF712441284E31DC9589D40CC"><enum>(2)</enum><header>Appropriation</header><text>Out
				of any money in the Treasury of the United States not otherwise appropriated,
				there are appropriated for fiscal year 2013 such sums as are necessary for
				grants under this
				subsection.</text>
					</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="HB983489A822F45B49028D93E6E09E19C"><enum>4.</enum><header>Eligibility of
			 Puerto Rico, the Virgin Islands, Guam, and American Samoa for the TANF
			 contingency fund</header>
			<subsection id="H1F95EF212A7A47E9A57A5A3184E6DDE8"><enum>(a)</enum><header>Definition of
			 State</header><text display-inline="yes-display-inline">Section 403(b)(7) of
			 the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/603">42 U.S.C. 603(b)(7)</external-xref>) is amended by striking <quote>and
			 the District of Columbia</quote> and inserting <quote>, the District of
			 Columbia, Puerto Rico, the Virgin Islands, Guam, and American
			 Samoa.</quote>.</text>
			</subsection><subsection id="HC58487D083594BC79CD9D088B2340A56"><enum>(b)</enum><header>Alternative
			 eligibility criteria for territories</header><text>Section 403(b)(5) of such
			 Act (<external-xref legal-doc="usc" parsable-cite="usc/42/603">42 U.S.C. 603(b)(5)</external-xref>) is amended—</text>
				<paragraph id="H32C66DBBF5C64B3C854CD0AB7A1F7A2D"><enum>(1)</enum><text>in subparagraph
			 (A)(ii), by striking <quote>or</quote> at the end;</text>
				</paragraph><paragraph id="H583190A9DC1F4EC58122B0116FA54A03"><enum>(2)</enum><text>in subparagraph
			 (B)(ii), by striking the period at the end and inserting <quote>; or</quote>;
			 and</text>
				</paragraph><paragraph id="H7B66B1C8DA9A436195C4167DB8BF3089"><enum>(3)</enum><text>by adding at the
			 end the following:</text>
					<quoted-block display-inline="no-display-inline" id="H81EE644D152141E0B4B2A77517F20DBF" style="OLC">
						<subparagraph id="HFC6FFA4B8CB0404EB80584031EEB322C"><enum>(C)</enum><text display-inline="yes-display-inline">in the case of Puerto Rico, the Virgin
				Islands, Guam, and American Samoa, the State satisfies alternative eligibility
				criteria established by the Secretary in consultation with the Governor of the
				State, to be submitted to the Congress not later than 1 year after the date of
				the enactment of this
				subparagraph.</text>
						</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection></section><section id="HBB9320CB2603450AA101D26ECBF75401"><enum>5.</enum><header>Eligibility of
			 Puerto Rico, the Virgin Islands, Guam, and American Samoa for child care
			 entitlement funds</header>
			<subsection id="H28845C2F70D341BBA911CD5E6C131EAF"><enum>(a)</enum><header>Definition of
			 State</header><text display-inline="yes-display-inline">Section 418(d) of the
			 Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/618">42 U.S.C. 618(d)</external-xref>) is amended by striking <quote>and the
			 District of Columbia</quote> and inserting <quote>, the District of Columbia,
			 Puerto Rico, the Virgin Islands, Guam, and American Samoa.</quote>.</text>
			</subsection><subsection id="HD008E586187B42C4877E8BBCA6F1CEE9"><enum>(b)</enum><header>Amount of
			 payment</header>
				<paragraph id="HCED8390683E24063906B64C55A926B7B"><enum>(1)</enum><header>General
			 entitlement</header><text>Section 418(a)(1) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/618">42 U.S.C. 618(a)(1)</external-xref>)
			 is amended by striking <quote>equal to the greater of—</quote> and all that
			 follows and inserting the following:</text>
					<quoted-block display-inline="yes-display-inline" id="H6B596F21ECE841FA8D840BE394D69F87" style="OLC">
						<text>equal
			 to—</text><subparagraph id="HEA9059697CF54E4CA6CD87D1EA7A0B94"><enum>(A)</enum><text display-inline="yes-display-inline">in the case of Puerto Rico, the Virgin
				Islands, Guam, and American Samoa, 60 percent of the amount required to be paid
				to the State for fiscal year 2010 under the Child Care and Development Block
				Grant Act of 1990; or</text>
						</subparagraph><subparagraph id="HA97771A5960145EDB8DF99CE34E5A612"><enum>(B)</enum><text>in the case of any
				other State, the greater of—</text>
							<clause id="H908BEB8C29D04BEB80EC5A42E9FAC16F"><enum>(i)</enum><text>the total amount
				required to be paid to the State under section 403 of this Act for fiscal year
				1994 or 1995 (whichever is greater) with respect to expenditures for child care
				under subsections (g) and (i) of section 402 of this Act (as in effect before
				October 1, 1995); or</text>
							</clause><clause id="H0D80B9EDDD3E411BBF989E51E77CEC1E"><enum>(ii)</enum><text>the average of
				the total amounts required to be paid to the State for fiscal years 1992
				through 1994 under the subsections referred to in clause
				(i).</text>
							</clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph><paragraph id="H5897EA85DA58469F8D3B40F545243493"><enum>(2)</enum><header>Allotment of
			 remainder</header><text>Section 418(a)(2)(B) of such Act (42 U.S.C.
			 618(a)(2)(B)) is amended to read as follows:</text>
					<quoted-block id="H5DB8E366F8AB436595F1724AEC193F9E" style="OLC">
						<subparagraph id="HD2BFC281FC7D4D4EAEE842292BBDF519"><enum>(B)</enum><header>Allotments to
				states</header><text>Of the total amount available for payments to States under
				this paragraph, as determined under subparagraph (A)—</text>
							<clause id="H825E03E0FAB6414987F359FFDB2D8241"><enum>(i)</enum><text display-inline="yes-display-inline">an amount equal to 65 percent of the amount
				required to be paid to each of Puerto Rico, the Virgin Islands, Guam, and
				American Samoa for fiscal year 2010 under the Child Care and Development Block
				Grant Act of 1990, shall be allotted to Puerto Rico, the Virgin Islands, Guam,
				and American Samoa, respectively; and</text>
							</clause><clause id="H1F989B7B66424294A73791E8AC8AF6A5"><enum>(ii)</enum><text>the remainder
				shall be allotted among the other States based on the formula used for
				determining the amount of Federal payments to each State under section 403(n)
				of this Act (as in effect before October 1,
				1995).</text>
							</clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection></section><section id="H8C936E359FB1435B93831811977716D0"><enum>6.</enum><header>Increase in
			 Federal matching rate for foster care and adoption assistance in Puerto Rico,
			 the Virgin Islands, Guam, and American Samoa</header><text display-inline="no-display-inline">Section 474(a) of the Social Security Act
			 (<external-xref legal-doc="usc" parsable-cite="usc/42/674">42 U.S.C. 674(a)</external-xref>) is amended in each of paragraphs (1) and (2)—</text>
			<paragraph display-inline="no-display-inline" id="HC80A3A19E4A44C85867B997ECCF49391"><enum>(1)</enum><text>by striking
			 <quote>in the case of a State other than the District of Columbia, or</quote>
			 and inserting <quote>in the case of each of the 50 States,</quote>; and</text>
			</paragraph><paragraph id="HFB997971534E4F8988C39FF1D77D9D49"><enum>(2)</enum><text display-inline="yes-display-inline">by inserting <quote>, or 75 percent, in the
			 case of Puerto Rico, the Virgin Islands, Guam, and American Samoa</quote> after
			 <quote>in the case of the District of Columbia</quote>.</text>
			</paragraph></section><section id="H9EA62131EDEC41A5A91EDF32978F43E6"><enum>7.</enum><header>Effective
			 date</header><text display-inline="no-display-inline">The amendments made by
			 this Act shall take effect on the 1st day of the 1st Federal fiscal year that
			 begins 1 year or more after the date of enactment of this Act.</text>
