R. 3644</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action><action-date date="20131203">December 3, 2013</action-date><action-desc><sponsor name-id="K000220">Mr. Kingston</sponsor> introduced the following bill; which was referred to the <committee-name committee-id="HGO00">Committee on Oversight and Government Reform</committee-name>, and in addition to the Committees on the <committee-name committee-id="HBU00">Budget</committee-name> and <committee-name committee-id="HAP00">Appropriations</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title>To rescind funds provided to certain Federal agencies if the improper payment rate for certain agency-administered programs has increased from the previous year, and for other purposes.</official-title></form><legis-body id="H986427851A864F2E81D2042D358BCDCA" style="OLC"><section commented="no" id="H9CE78B746B6B41CF974702056F8419C5" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Eliminate Preventable Waste Act</short-title></quote>.</text></section><section id="HF48ADFDA38FC425CB72FEE94A21E5949"><enum>2.</enum><header>Reports on improper payments</header><subsection commented="no" id="HD7663ABF6BAE4573BD13A038B9FF292B"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Notwithstanding the requirements of section 2(a)(2) of the Improper Payments Information Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/31/3321">31 U.S.C. 3321</external-xref> note), not later than 90 days after the end of fiscal year 2014 and each fiscal year thereafter, the following agency heads shall perform the review required under section 2(a)(1) of such Act for the following programs, respectively:</text><paragraph commented="no" id="H4FAD92B4978E42759D3D0F18AA3EE761"><enum>(1)</enum><text display-inline="yes-display-inline">Commissioner of the Social Security Administration—</text><subparagraph commented="no" id="HE3383E98488749B0973B118562E4C427"><enum>(A)</enum><text>the Supplemental Security Income program under title XVI of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1381">42 U.S.C. 1381 et seq.</external-xref>); and</text></subparagraph><subparagraph commented="no" id="H7D373F7C2C2746CCA29C5DDED627CB1E"><enum>(B)</enum><text>the Old Age, Survivors, and Disability Insurance program under title XVI of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1381">42 U.S.C. 1381 et seq.</external-xref>).</text></subparagraph></paragraph><paragraph commented="no" id="H0B23987779EA4FB89148007E0B8AF43F"><enum>(2)</enum><text display-inline="yes-display-inline">Secretary of Agriculture—</text><subparagraph commented="no" id="H40A2CC3E279746F19E27DC5A5F9B8E82"><enum>(A)</enum><text>the school lunch program under the Richard B. Russell National School Lunch Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1751">42 U.S.C. 1751 et seq.</external-xref>); and</text></subparagraph><subparagraph commented="no" id="H96DEEDF653294EEFB6D9C9CBF867B00E"><enum>(B)</enum><text>the school breakfast program under section 4 of the Child Nutrition Act of 1966 (<external-xref legal-doc="usc" parsable-cite="usc/42/1773">42 U.S.C. 1773</external-xref>).</text></subparagraph></paragraph><paragraph commented="no" id="H0CB56A0138FC4139BF225B7E7818B297"><enum>(3)</enum><text>Secretary of Labor; State unemployment compensation programs approved by the Secretary of Labor under <external-xref legal-doc="usc" parsable-cite="usc/26/3304">section 3304</external-xref> of the Internal Revenue Code of 1986.</text></paragraph><paragraph commented="no" id="HBD598B90FE984509A0AA21702FE073AE"><enum>(4)</enum><text display-inline="yes-display-inline">Secretary of Health and Human Services—</text><subparagraph commented="no" id="H5EA0A42E6C4F47B882FACBAB4B8FE2C7"><enum>(A)</enum><text>Medicare fee-for-service (parts A and B of title XVIII of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1381">42 U.S.C. 1381 et seq.</external-xref>));</text></subparagraph><subparagraph commented="no" id="HD348414CE62C46BF929EDAA75F8F0167"><enum>(B)</enum><text>Medicaid (title XIX of such Act), Medicare Advantage (part C of title XVIII of such Act);</text></subparagraph><subparagraph commented="no" id="HF5955F4DBD354B4CB32159D55437DF11"><enum>(C)</enum><text>Medicare prescription drug benefit (part D of title XVIII of such Act); and</text></subparagraph><subparagraph commented="no" id="id5960E99A1CED480E87B0F21CC29C4022"><enum>(D)</enum><text>the Child Care and Development Fund (section 5082 of subchapter C of <external-xref legal-doc="public-law" parsable-cite="pl/101/508">Public Law 101–508</external-xref>).</text></subparagraph></paragraph><paragraph commented="no" id="HDAB4990FFD4C4FDF9C9226B6E65E9633"><enum>(5)</enum><text display-inline="yes-display-inline">Secretary of the Treasury; the Earned Income Tax Credit (<external-xref legal-doc="usc" parsable-cite="usc/26/32">section 32</external-xref> of the Internal Revenue Code of 1986).</text></paragraph><paragraph commented="no" id="H7849A97490944C0A90B2BBB110055678"><enum>(6)</enum><text display-inline="yes-display-inline">Secretary of Veterans Affairs—</text><subparagraph commented="no" id="H03965809509E476595E4985E3AA056BE"><enum>(A)</enum><text display-inline="yes-display-inline">payments under section 607 of the Transportation, Treasury, and Independent Agencies Appropriations Act, 2004 (division F of <external-xref legal-doc="public-law" parsable-cite="pl/108/199">Public Law 108–199</external-xref>)<italic></italic>; and</text></subparagraph><subparagraph commented="no" id="HE5D717DE570E487ABBB2FBADB38039F6"><enum>(B)</enum><text>payments to non-Department facilities (as defined in <external-xref legal-doc="usc" parsable-cite="usc/38/1701">section 1701(4)</external-xref> of title 38, United States Code) under the following:</text><clause commented="no" id="H5DF8ADA8DBAB4477B0022235010DC5AF"><enum>(i)</enum><text>section 1703 of such title (relating to hospital care and medical services provided to veterans in non-Department facilities);</text></clause><clause commented="no" id="H4FF16E06A6CD42A4ABA04C951BA5F661"><enum>(ii)</enum><text>section 1725 of such title (relating to reimbursement to veterans for certain emergency treatment in non-Department facilities);</text></clause><clause commented="no" id="HF8AF04E6076046F993C178EA45188AFC"><enum>(iii)</enum><text>section 1728 of such title (relating to reimbursement to veterans for certain treatment in non-Department facilities);</text></clause><clause commented="no" id="HD091166BD27E43188F4DFA6376C6C945"><enum>(iv)</enum><text>section 8111 of such title (relating to the sharing of Department of Veterans Affairs and Department of Defense health-care resources); and</text></clause><clause commented="no" id="HDB50D7E302A442EFBC81A3097B1C0368"><enum>(v)</enum><text>section 8153 of such title (relating to the sharing of health-care resources).</text></clause></subparagraph></paragraph></subsection><subsection id="H01EFCDA3F0C1471CA931E93EEB3C4798"><enum>(b)</enum><header>Budget submission</header><text display-inline="yes-display-inline">Each agency head shall include in the applicable agency annual budget request to the Office of Management and Budget a report on the review required under subsection (a).</text></subsection><subsection id="H0D3171DD44F540CB83E064C745A2C3E8"><enum>(c)</enum><header>Sunset</header><text display-inline="yes-display-inline">If a review under subsection (a) shows that the improper payment rate for any listed program is less than or equal to 0.00034 percent, this section shall no longer apply with respect to such program.</text></subsection></section><section id="H39F0BEC3B6A74D5FBB62C62DAF562042"><enum>3.</enum><header>Amendment with respect to President’s budget submission</header><subsection id="HCD748CDA057F4E919008D6E3EFAFB990"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/31/1105">Section 1105(a)</external-xref> of title 31, United States Code, is amended by—</text><paragraph commented="no" id="H58D4B88CA61C47C99329BFCB14574053"><enum>(1)</enum><text display-inline="yes-display-inline">redesignating paragraph (37) (relating to the list of outdated or duplicative plans and reports) as paragraph (39); and</text></paragraph><paragraph commented="no" id="HA3DCBB1C210840EA8713625058696683"><enum>(2)</enum><text>by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="H16D808D299E04AAC9E2133B7CC1EBFB5" style="USC"><paragraph commented="no" id="H0BCCA66BAB5E41BDB2239330BA7B0BB3"><enum>(40)</enum><text display-inline="yes-display-inline">any report submitted to the Office of Management and Budget pursuant to section 2 of the Eliminate Preventable Waste Act.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection commented="no" id="H22F532C99ECF4B0FB3D8A77276504B9D"><enum>(b)</enum><header>Effective date</header><text display-inline="yes-display-inline">The amendments made by this section shall take effect on October 1, 2014.</text></subsection></section><section id="HD34A0AC707774155AE64CCD9E68188B6"><enum>4.</enum><header>Rescission of funds</header><subsection commented="no" id="HA299BCB1120B473299B24290FCA3BE65"><enum>(a)</enum><header>Reduction in error rates</header><text display-inline="yes-display-inline">If any report submitted by an agency head required under section 2, as included in President’s budget under <external-xref legal-doc="usc" parsable-cite="usc/31/1105">section 1105(a)</external-xref> of title 31, United States Code (as amended by section 2 of this Act), does not show, with respect to the relevant program listed in section 2(a), a decrease in the improper payment rate from the fiscal year immediately preceding the fiscal year covered by the report, a rescission under subsection (b) of certain funds made available to the applicable agency shall apply.</text></subsection><subsection id="H29DA2046B8EF456182396EB0BF91C229"><enum>(b)</enum><header>Rescission</header><paragraph commented="no" id="HBAEB06F995934F79B61ECB8D873E08DE"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">On the day that the President submits such a budget, there is rescinded (if necessary) from the following accounts a percentage of such account equal to the percentage of the highest improper payment rate of the program listed in the report submitted by the relevant agency pursuant to section 2 and included in such agency’s budget:</text><subparagraph id="HBBFE154C47DE45729AA2D6047CB01F3D"><enum>(A)</enum><text display-inline="yes-display-inline">Department of Agriculture, <quote>Agricultural Programs—Production, Process, and Marketing—Office of the Secretary</quote>.</text></subparagraph><subparagraph id="HB82EF9C7D5044F6584D4EEA809A308FC"><enum>(B)</enum><text>Department of Health and Human Services, <quote>Department of Health and Human Services—Office of the Secretary</quote>.</text></subparagraph><subparagraph id="HC97271757F934096B6FE331E857F21AF"><enum>(C)</enum><text>Department of Labor, <quote>Department of Labor—Departmental Management—Salaries and Expenses</quote>.</text></subparagraph><subparagraph id="HF7B963D839264FDB84549B9EE9FBA09D"><enum>(D)</enum><text display-inline="yes-display-inline">Department of the Treasury, <quote>Department of the Treasury—Departmental Offices—Salaries and Expenses</quote>.</text></subparagraph><subparagraph id="H86DCEF6BA1B341E0AD014E0D5D114FC3"><enum>(E)</enum><text display-inline="yes-display-inline">Social Security Administration, <quote>Social Security Administration—Limitation on Administrative Expenses</quote>.</text></subparagraph><subparagraph id="H66BFAB2A2460432E9373FEC009B2B345"><enum>(F)</enum><text display-inline="yes-display-inline">Department of Veterans Affairs, <quote>Department of Veterans Affairs—Departmental Administration—General Administration</quote>.</text></subparagraph></paragraph><paragraph id="H42030A5B545940509D9E3D613082E212"><enum>(2)</enum><header>Proportionate application</header><text display-inline="yes-display-inline">Any rescission made under paragraph (1) shall be applied proportionately within each listed account to each program, project, and activity (with programs, projects, and activities as delineated in the appropriation Act or accompanying reports for the applicable fiscal year covering such account).</text></paragraph></subsection><subsection commented="no" id="HF15A72F8F2B84EEAAA3EC8D9D15C1431"><enum>(c)</enum><header>Report to Congress</header><text display-inline="yes-display-inline">For each fiscal year beginning in fiscal year 2015, not later than the date on which President submits a budget under <external-xref legal-doc="usc" parsable-cite="usc/31/1105">section 1105(a)</external-xref> of title 31, United States Code, each agency head listed in section 2(a) shall submit to Congress any report required by section 2 of this Act.</text></subsection><subsection commented="no" id="HFDEC2E806CC34C9FAD30A284BFF344DC"><enum>(d)</enum><header>Effective date</header><text>This section shall take effect on October 1, 2014.</text></subsection></section></legis-body></bill>
