which was referred to the <committee-name committee-id="HJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To require the Secretary of Homeland Security to submit to Congress an annual report on immigration policy directives issued by the Department of Homeland Security, to ensure that each such policy directive is subject to the rule making process described in <external-xref legal-doc="usc" parsable-cite="usc/5/553">section 553</external-xref> of title 5, United States Code, and for other purposes.</official-title></form><legis-body id="H19DA8894A47444E8B45C1FB660F396C0" style="OLC"><section id="H5BE0D1FA158448A09A3049B78E0AFBF8" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>DHS Immigration Accountability and Transparency Act of 2013</short-title></quote>.</text></section><section id="HFC25EFE33DC144AAAD13AF95D38DB343"><enum>2.</enum><header>Transparency Requirement for Immigration Policy Directives</header><subsection id="H3369D57326BF426EB985F91D4A0E239B"><enum>(a)</enum><header>Reporting requirement</header><text display-inline="yes-display-inline">The Secretary of Homeland Security shall submit to the Committee on Homeland Security and Governmental Affairs of the Senate and the Committee on Homeland Security of the House of Representatives an annual report on immigration policy directives.</text></subsection><subsection id="HEF83F02E74664DA085E4A6DA86957224"><enum>(b)</enum><header>Matters covered</header><text>The report required by subsection (a) shall include, at a minimum—</text><paragraph id="H4C68D1365D1344D5AE35D8BCBDB1531F"><enum>(1)</enum><text>statistics on the removal of aliens from the United States during the 10-year period preceding the date of submission of the report, including the number of aliens placed in removal proceedings but not removed;</text></paragraph><paragraph id="H8943268504B14146AA4BB61DCD646269"><enum>(2)</enum><text display-inline="yes-display-inline">statistics and a cost-benefit analysis regarding the use of Federal funds to implement each immigration policy directive issued by the Department of Homeland Security during the period beginning on January 20, 2009, and ending on the date of submission of the report;</text></paragraph><paragraph id="HFED551799C044528AFC5AE152D9E6483"><enum>(3)</enum><text>the number of aliens unlawfully present or without lawful status in the United States with an immigration status that was modified or otherwise adjusted as a result of each such policy directive, including an identification of the new status assigned to each such alien;</text></paragraph><paragraph id="H454DF1C7AE1B4021B52313F393AD3677"><enum>(4)</enum><text>the number of aliens unlawfully present or without lawful status in the United States who applied for and were denied relief as a result of each such policy directive, and the percentage of such aliens against whom removal proceedings were initiated;</text></paragraph><paragraph id="H2B18C7B5AFCE42398B0E5F1079C7306F"><enum>(5)</enum><text>for each alien denied relief under paragraph (4) against whom removal proceedings were not initiated, an explanation of why such action was not taken and a listing of the final determination made in such alien’s case, if any;</text></paragraph><paragraph id="H46122F22809543E8A053F94A03B6D616"><enum>(6)</enum><text>the number of cases in the Executive Office for Immigration Review of the Department of Justice that were administratively closed as a result of each such policy directive and an identification of the new status or statuses assigned to the aliens in such cases;</text></paragraph><paragraph id="H2EA57AD468CD4E45B3FF8D70B80A4F89"><enum>(7)</enum><text>statistics on aliens unlawfully present or without lawful status in the United States released from prisons or administrative detention centers since January 20, 2009, including—</text><subparagraph id="H229D52442F9F48A9ACA871BA6CC0E9BF"><enum>(A)</enum><text>the number of such aliens convicted or formally accused of a violent crime; and</text></subparagraph><subparagraph id="HE56096AEA95D44B4B1ACE85637344AE7"><enum>(B)</enum><text>the number of such aliens released in each State; and</text></subparagraph></paragraph><paragraph id="H6FF06379A4D54679AC26104A41B257B1"><enum>(8)</enum><text display-inline="yes-display-inline">detailed information on the methods used to compile and calculate the information described in paragraphs (1), (2), (3), (4), (5), (6), and (7).</text></paragraph></subsection><subsection id="HA69988F5728348A6AEBCAF9AE1BAA1C5"><enum>(c)</enum><header>Public availability</header><text display-inline="yes-display-inline">The report required by subsection (a) shall be made publicly available.</text></subsection><subsection id="H4F11E1D58EC5435189CCDE285B8E0EF9"><enum>(d)</enum><header>Reporting deadline</header><text display-inline="yes-display-inline">The Secretary shall submit the first report required by subsection (a) not later than 90 days after the date of the enactment of this Act.</text></subsection><subsection id="H24DE38AFB80A4567BB509403BCBAF81F"><enum>(e)</enum><header>Removal of aliens from the United States</header><text>In this Act, the term <term>removal of aliens from the United States</term> does not include individuals who are denied admission upon being inspected by an immigration officer at the border of the United States.</text></subsection></section><section id="HE8B8B137EB854B72A31B3BFBB6EA8AA6"><enum>3.</enum><header>Accountability Requirements for Immigration Policy Directives</header><subsection display-inline="no-display-inline" id="HA8D8C52EDEB74EAFA67F43C9133D760C"><enum>(a)</enum><header>Treatment of an Immigration Policy Directive as a Rule</header><text>For purposes of chapters 5, 6, 7, and 8 of title 5, United States Code, an immigration policy directive shall be treated as a rule.</text></subsection><subsection id="HF75DFE272B0A49458858F473BA25A669"><enum>(b)</enum><header>Notice Requirement</header><text display-inline="yes-display-inline">In publishing a general notice of proposed rule making as required under <external-xref legal-doc="usc" parsable-cite="usc/5/553">section 553</external-xref> of title 5, United States Code, for an immigration policy directive, the Secretary of Homeland Security shall include a report that—</text><paragraph id="HFD80EDBCCD764B2280D85A885E78E23B"><enum>(1)</enum><text>describes with reasonable detail the actions the Department of Homeland Security plans to take to implement and enforce the policy directive;</text></paragraph><paragraph id="H6D39C837604E443287CEFE5143503819"><enum>(2)</enum><text>indicates whether the policy directive states a new or changed policy regarding the enforcement of any Federal law, and if so, provides a citation to such law; and</text></paragraph><paragraph id="H41089D9D7F5D485FB69899142B43EDD7"><enum>(3)</enum><text>estimates the number of aliens present in the United States with an immigration status that will be modified as a result of the policy directive and identifies the new status or statuses to be assigned to such aliens.</text></paragraph></subsection></section><section display-inline="no-display-inline" id="HA1DF161609904DA493D60DFF8B332412"><enum>4.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="H9695DAFFAAA74DA28C22388395824E73"><enum>(1)</enum><header>Immigration policy directive</header><text display-inline="yes-display-inline">The term <term>immigration policy directive</term> means any communication that is not a rule, issued by the Department of Homeland Security or any agency or office within the Department, regarding the administration or enforcement of immigration law or policy, including memoranda, statements, and guidance documents.</text></paragraph><paragraph id="H84943E5462AC4CC681FFAC68204F4FE3"><enum>(2)</enum><header>Rule</header><text>The term <term>rule</term> has the meaning provided in <external-xref legal-doc="usc" parsable-cite="usc/5/551">section 551</external-xref> of title 5, United States Code.</text></paragraph></section></legis-body></bill>
