which was referred to the <committee-name committee-id="HED00">Committee on Education and the Workforce</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To clarify the requirements of authorized representatives under the Family Educational Rights and Privacy Act of 1974, and for other purposes.</official-title></form><legis-body id="HA0F830F939254934852641757D9271AA" style="OLC"><section id="H38A35030363A42B89DA975077D978DF9" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Protecting Education Privacy Act</short-title></quote>.</text></section><section id="HE760620CB09F41FCAEAF8629BAB1272F"><enum>2.</enum><header>Amendments to FERPA</header><text display-inline="no-display-inline">Section 444(b) of the General Education Provisions Act (<external-xref legal-doc="usc" parsable-cite="usc/20/1232g">20 U.S.C. 1232g(b)</external-xref>) (commonly known as the <term>Family Educational Rights and Privacy Act of 1974</term>) is amended—</text><paragraph id="HE7D883C2B4244958B86EEBA7E8849C16"><enum>(1)</enum><text>in paragraph (1)(C)(i)(III), by inserting <quote>or local</quote> after <quote>State</quote>;</text></paragraph><paragraph id="H90E43593005B4FB2B8E77F72F49C5D24"><enum>(2)</enum><text>in paragraph (3)—</text><subparagraph id="H4D7FF62225C943F690ADCACCFCCBEF68"><enum>(A)</enum><text>by striking <quote>(A)</quote> and inserting <quote>(i)</quote>;</text></subparagraph><subparagraph id="H0FDDCA96CA7044B396CADD7C65969018"><enum>(B)</enum><text>by striking <quote>(B)</quote> and inserting <quote>(ii)</quote>;</text></subparagraph><subparagraph id="HF0BBDA3D29104E3D8C691D4338FEF4C2"><enum>(C)</enum><text>by striking <quote>(C)</quote> and inserting <quote>(iii)</quote>;</text></subparagraph><subparagraph id="H41569FC415834ADFBE61B07FD81A90F0"><enum>(D)</enum><text>by striking <quote>(3) Nothing</quote> and inserting the following: <quote>(3)(A) Nothing</quote>;</text></subparagraph><subparagraph id="H64F8C5601D3B428FACFF76F7CB7F07C9"><enum>(E)</enum><text>by inserting <quote>or local</quote> after <quote>State</quote>;</text></subparagraph><subparagraph id="H440C0CEAAC3A4E7DBD0025C4FFAA70E9"><enum>(F)</enum><text>by striking <quote>programs:</quote> and inserting <quote>programs.</quote>;</text></subparagraph><subparagraph id="H964AE32FE2F348689673F16E708D3B8D"><enum>(G)</enum><text>by striking <quote><italic>Provided</italic>, That except</quote> and by inserting the following:</text><quoted-block display-inline="no-display-inline" id="H625985CC0B354AFC86C75E37C61424E7" style="OLC"><subparagraph id="H5515D0A32A2F496FB0F9DF32635283CF"><enum>(B)</enum><text display-inline="yes-display-inline">Except</text></subparagraph><after-quoted-block>; </after-quoted-block></quoted-block></subparagraph><subparagraph id="HFB4C6513A1F944DDAD43B14787F02A53"><enum>(H)</enum><text>by striking <quote>such officials</quote> and inserting <quote>the officials described in items (i) through (iii) of subparagraph (A)</quote>; and</text></subparagraph><subparagraph id="HD1FB9C57215B4D11A28FFEC5ECD49BF9"><enum>(I)</enum><text>by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="H19FC6198E2A04101BC17F71FA60BA29E" style="OLC"><subparagraph id="HF5F26E922DBD401BA20A3FEA3BCADEF4"><enum>(C)</enum><clause commented="no" display-inline="yes-display-inline" id="H28BCC28E1DF24353A0C5AE394F8520C5"><enum>(i)</enum><text>For purposes of this section, the term <term>authorized representative</term> means an individual who—</text><subclause id="HE21259B78D2A4ECFB87EC780BAE416A9"><enum>(I)</enum><text>is designated as an authorized representative by an official described in item (i), (ii), or (iii) of subparagraph (A); and</text></subclause><subclause id="H8421AD23FE124C709F004BBE5E9C23A0"><enum>(II)</enum><text>is under the direct control, as a contractor or employee, of such official.</text></subclause></clause><clause id="HFA022F52CBE3418DA062AF42B39E85B7"><enum>(ii)</enum><text display-inline="yes-display-inline">An authorized representative shall not release any educational records or personally identifiable information collected while serving as an authorized representative to any individual, agency, or organization, other than the official under whom the authorized representative is under the direct control.</text></clause></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="H6212CE8183884AE291D177E5810898B5"><enum>(3)</enum><text>by adding at the end the following new paragraph:</text><quoted-block display-inline="no-display-inline" id="H3C679FCE6E33494BA4CCAD438A38900A" style="OLC"><paragraph id="HF7F093E6EA814A43887294BB6384268F"><enum>(8)</enum><text display-inline="yes-display-inline">Nothing in this section may be construed to authorize the educational records or the personally identifiable information of students to be shared, without the written consent of their parents, for the development of commercial products or services.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="H2F474EF7318D49E293850878009247C1"><enum>3.</enum><header>FERPA regulations</header><subsection id="H0BC7BE8AFB394D4BA6B15C0B0FF41D3C"><enum>(a)</enum><header>Repeals</header><text display-inline="yes-display-inline">The definitions of the terms <term>authorized representative</term>, <term>early childhood education program</term>, and <term>education program</term> in <external-xref legal-doc="regulation" parsable-cite="cfr/34/99.3">section 99.3</external-xref> of title 34, Code of Federal Regulations, are repealed and shall have no legal effect.</text></subsection><subsection id="H2156CEC202DC461680CF68C6DE81D281"><enum>(b)</enum><header>Certain regulations prohibited</header><text display-inline="yes-display-inline">The Secretary of Education shall not promulgate or enforce any regulation or rule that defines <term>early childhood education program</term> or <term>education program</term> for any purpose under section 444 of the General Education Provisions Act (<external-xref legal-doc="usc" parsable-cite="usc/20/1232g">20 U.S.C. 1232g</external-xref>) (commonly known as the <term>Family Educational Rights and Privacy Act of 1974</term>) on or after the date of enactment of this Act.</text></subsection></section></legis-body></bill>
