and</text></paragraph><paragraph id="H9BFBE8C78D574171A2DDDCEBD264DD10"><enum>(3)</enum><text>by inserting after clause (vi) the following:</text><quoted-block id="H1AB8720B22D4406EB340F4D644D9D5D3" style="OLC"><clause id="H48C601CC40CB43E09DC9BDA67C22D887" indent="up2"><enum>(vii)</enum><text>any sport fishing equipment (as such term is defined in subsection (a) of <external-xref legal-doc="usc" parsable-cite="usc/26/4162">section 4162</external-xref> of the Internal Revenue Code of 1986) the sale of which is subject to the tax imposed by section 4161(a) of such Code (determined without regard to any exemptions from such tax as provided by section 4162 or 4221 or any other provision of such Code), and sport fishing equipment components.</text></clause><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section></title><title id="H643838AE929D4CBC880A3DAC160091F8"><enum>II</enum><header>Target Practice and Marksmanship Training Support Act </header><section commented="no" display-inline="no-display-inline" id="H27C49BE2A581441994731A2C924604C1" section-type="subsequent-section"><enum>201.</enum><header display-inline="yes-display-inline">Short title</header><text display-inline="no-display-inline">This title may be cited as the <quote><short-title>Target Practice and Marksmanship Training Support Act</short-title></quote>.</text></section><section commented="no" display-inline="no-display-inline" id="H3FEEB334DDAB4E7080174B3D766A3B8E" section-type="subsequent-section"><enum>202.</enum><header display-inline="yes-display-inline">Findings; purpose</header><subsection commented="no" display-inline="no-display-inline" id="HB0A51DE4491546DD80E726D1347E4668"><enum>(a)</enum><header display-inline="yes-display-inline">Findings</header><text display-inline="yes-display-inline">Congress finds that—</text><paragraph commented="no" display-inline="no-display-inline" id="H57F1BBD8081C45E881425F89E6B5B0C4"><enum>(1)</enum><text display-inline="yes-display-inline">the use of firearms and archery equipment for target practice and marksmanship training activities on Federal land is allowed, except to the extent specific portions of that land have been closed to those activities;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H701344510F9D4946AC87EDC3A23A0F4C"><enum>(2)</enum><text display-inline="yes-display-inline">in recent years preceding the date of enactment of this Act, portions of Federal land have been closed to target practice and marksmanship training for many reasons;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HB4D1EC5281704A05889AA556A9A66B04"><enum>(3)</enum><text display-inline="yes-display-inline">the availability of public target ranges on non-Federal land has been declining for a variety of reasons, including continued population growth and development near former ranges;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H50DAC625157647368EE05B07586A4E42"><enum>(4)</enum><text display-inline="yes-display-inline">providing opportunities for target practice and marksmanship training at public target ranges on Federal and non-Federal land can help—</text><subparagraph commented="no" display-inline="no-display-inline" id="HD9FE0DD26AC2413AAD23A2317C457E09"><enum>(A)</enum><text display-inline="yes-display-inline">to promote enjoyment of shooting, recreational, and hunting activities; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H3B2036AC831F47D49C96D537BBF9430C"><enum>(B)</enum><text display-inline="yes-display-inline">to ensure safe and convenient locations for those activities;</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H47E4AD9A22374A2C90283F5673D0A041"><enum>(5)</enum><text display-inline="yes-display-inline">Federal law in effect on the date of enactment of this Act, including the Pittman-Robertson Wildlife Restoration Act (<external-xref legal-doc="usc" parsable-cite="usc/16/669">16 U.S.C. 669 et seq.</external-xref>), provides Federal support for construction and expansion of public target ranges by making available to States amounts that may be used for construction, operation, and maintenance of public target ranges; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HFCC76CB6D2BD4E208077AC1F75B3363A"><enum>(6)</enum><text display-inline="yes-display-inline">it is in the public interest to provide increased Federal support to facilitate the construction or expansion of public target ranges.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H34B211BA57E74AD386D35E09BAE4E540"><enum>(b)</enum><header display-inline="yes-display-inline">Purpose</header><text display-inline="yes-display-inline">The purpose of this title is to facilitate the construction and expansion of public target ranges, including ranges on Federal land managed by the Forest Service and the Bureau of Land Management.</text></subsection></section><section commented="no" display-inline="no-display-inline" id="H1984CD1CBD684970B12016F266C85D56" section-type="subsequent-section"><enum>203.</enum><header display-inline="yes-display-inline">Definition of public target range</header><text display-inline="no-display-inline">In this title, the term <term>public target range</term> means a specific location that—</text><paragraph commented="no" display-inline="no-display-inline" id="HFFDFF32D983D47D79A75B8C97B213D0C"><enum>(1)</enum><text display-inline="yes-display-inline">is identified by a governmental agency for recreational shooting;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HC4B01150D028489E8BB1D50D488E898E"><enum>(2)</enum><text display-inline="yes-display-inline">is open to the public;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H43740217A8ED4CDEAC70B11A273F3E75"><enum>(3)</enum><text display-inline="yes-display-inline">may be supervised; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H463A3DB656E541079A593377F7278B2A"><enum>(4)</enum><text display-inline="yes-display-inline">may accommodate archery or rifle, pistol, or shotgun shooting.</text></paragraph></section><section commented="no" display-inline="no-display-inline" id="HA869004A8835437990C850FE459AB9FA" section-type="subsequent-section"><enum>204.</enum><header display-inline="yes-display-inline">Amendments to Pittman-Robertson Wildlife Restoration Act</header><subsection commented="no" display-inline="no-display-inline" id="H1A8E813788A04BF081107027193C6CF1"><enum>(a)</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="yes-display-inline">Section 2 of the Pittman-Robertson Wildlife Restoration Act (<external-xref legal-doc="usc" parsable-cite="usc/16/669a">16 U.S.C. 669a</external-xref>) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="H05ADC1A721E1475EBE6FFF7E2D6DB6B5"><enum>(1)</enum><text display-inline="yes-display-inline">by redesignating paragraphs (2) through (8) as paragraphs (3) through (9), respectively; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H24E181E77B3A4D88A5F57F9A45E0E442"><enum>(2)</enum><text display-inline="yes-display-inline">by inserting after paragraph (1) the following:</text><quoted-block display-inline="no-display-inline" id="H3A29A73DA8534CB8A2F795C3B4BE1023" style="OLC"><paragraph commented="no" display-inline="no-display-inline" id="HE0D4D69989F247789006C94EB6A5195B"><enum>(2)</enum><text display-inline="yes-display-inline">the term <term>public target range</term> means a specific location that—</text><subparagraph commented="no" display-inline="no-display-inline" id="H765346FA507F469280BE92A6C0037866"><enum>(A)</enum><text display-inline="yes-display-inline">is identified by a governmental agency for recreational shooting;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H304C10D9C78B477CA86758C0D5FAE6F9"><enum>(B)</enum><text display-inline="yes-display-inline">is open to the public;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H2665BE2454224D6D864405B853170C58"><enum>(C)</enum><text display-inline="yes-display-inline">may be supervised; and</after-quoted-block></quoted-block></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H5ADC4DD651584AF4B5889805D5627BC9"><enum>(5)</enum><text display-inline="yes-display-inline">by inserting after paragraph (1) (as designated by paragraph (1) of this subsection) the following:</text><quoted-block display-inline="no-display-inline" id="HFB2EC2753CE94007859928D3024F8041" style="OLC"><paragraph commented="no" display-inline="no-display-inline" id="HD7C134A789924AD7A3BB6AD8BA3EA82E"><enum>(2)</enum><header display-inline="yes-display-inline">Exception</header><text display-inline="yes-display-inline">Notwithstanding the limitation described in paragraph (1), a State may pay up to 90 percent of the cost of acquiring land for, expanding, or constructing a public target range.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H7DB41737EFEE45CE82992A72AE774F5C"><enum>(c)</enum><header display-inline="yes-display-inline">Firearm and bow hunter education and safety program grants</header><text display-inline="yes-display-inline">Section 10 of the Pittman-Robertson Wildlife Restoration Act (<external-xref legal-doc="usc" parsable-cite="usc/16/669h-1">16 U.S.C. 669h–1</external-xref>) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="H754E377B8D124F01B60EAD14304E965C"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (a), by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="H952038B8964E4B0D86EF0FFA41E80659" style="OLC"><paragraph commented="no" display-inline="no-display-inline" id="H6A670F11F6DE406E885754B25622E7C9"><enum>(3)</enum><header display-inline="yes-display-inline">Allocation of additional amounts</header><text display-inline="yes-display-inline">Of the amount apportioned to a State for any fiscal year under section 4(b), the State may elect to allocate not more than 10 percent, to be combined with the amount apportioned to the State under paragraph (1) for that fiscal year, for acquiring land for, expanding, or constructing a public target range.</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H10B046D1349340C2BDA51C367E8CB419"><enum>(2)</enum><text display-inline="yes-display-inline">by striking subsection (b) and inserting the following:</text><quoted-block display-inline="no-display-inline" id="H19846D136DA640B18C7F0C97F8F37870" style="OLC"><subsection commented="no" display-inline="no-display-inline" id="HC239AF2433D04786BAB3B38311A0DCA9"><enum>(b)</enum><header display-inline="yes-display-inline">Cost sharing</header><paragraph commented="no" display-inline="no-display-inline" id="HC4A108C03E8B4EEF89A3C1538E3D994B"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Except as provided in paragraph (2), the Federal share of the cost of any activity carried out using a grant under this section shall not exceed 75 percent of the total cost of the activity.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H5383A5EA3E2143569F89A5E8007A1CC9"><enum>(2)</enum><header display-inline="yes-display-inline">Public target range construction or expansion</header><text display-inline="yes-display-inline">The Federal share of the cost of acquiring land for, expanding, or constructing a public target range in a State on Federal or non-Federal land pursuant to this section or section 8(b) shall not exceed 90 percent of the cost of the activity.</text></paragraph></subsection><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H1209C373474546AC8069EF7A603A6468"><enum>(3)</enum><text display-inline="yes-display-inline">in subsection (c)(1)—</text><subparagraph commented="no" display-inline="no-display-inline" id="H2480B8EA657F4DD1843C3EA8CF8DFE3F"><enum>(A)</enum><text display-inline="yes-display-inline">by striking <quote>Amounts made</quote> and inserting the following:</text><quoted-block display-inline="no-display-inline" id="H97276C7B18B3412E8F09697818197C84" style="OLC"><subparagraph commented="no" display-inline="no-display-inline" id="HACD83D2F01354B4BB2B9764163675415"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Except as provided in subparagraph (B), amounts made</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H6F79A0EFA1BA4D7DBFD7092E63064F87"><enum>(B)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="HF0B22E67E7164B58BA3B174622FE493B" style="OLC"><subparagraph commented="no" display-inline="no-display-inline" id="H9E24A94E632841B999C29C6257CD7C4C"><enum>(B)</enum><header display-inline="yes-display-inline">Exception</header><text display-inline="yes-display-inline">Amounts provided for acquiring land for, constructing, or expanding a public target range shall remain available for expenditure and obligation during the 5-fiscal-year period beginning on October 1 of the first fiscal year for which the amounts are made available.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="HA74DE989E02C4ED99BE5019A8515B24B" section-type="subsequent-section"><enum>205.</enum><header display-inline="yes-display-inline">Limits on liability</header><subsection commented="no" display-inline="no-display-inline" id="HB0843670FE0042F9A5DA8EDFD888F05C"><enum>(a)</enum><header display-inline="yes-display-inline">Discretionary function</header><text display-inline="yes-display-inline">For purposes of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/28/171">chapter 171</external-xref> of title 28, United States Code (commonly referred to as the <quote>Federal Tort Claims Act</quote>), any action by an agent or employee of the United States to manage or allow the use of Federal land for purposes of target practice or marksmanship training by a member of the public shall be considered to be the exercise or performance of a discretionary function.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="H64EA6D335FE347D18748CF721787C2CB"><enum>(b)</enum><header display-inline="yes-display-inline">Civil action or claims</header><text display-inline="yes-display-inline">Except to the extent provided in <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/28/171">chapter 171</external-xref> of title 28, United States Code, the United States shall not be subject to any civil action or claim for money damages for any injury to or loss of property, personal injury, or death caused by an activity occurring at a public target range that is—</text><paragraph commented="no" display-inline="no-display-inline" id="H4CF66DDCDB284BD2B3D998648F9BAAB8"><enum>(1)</enum><text display-inline="yes-display-inline">funded in whole or in part by the Federal Government pursuant to the Pittman-Robertson Wildlife Restoration Act (<external-xref legal-doc="usc" parsable-cite="usc/16/669">16 U.S.C. 669 et seq.</external-xref>); or</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HAF29F12CFC384ED28DA2E80DFADAB60E"><enum>(2)</enum><text display-inline="yes-display-inline">located on Federal land.</text></paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="H487D756717C8461A8623D84DCEEE19DD" section-type="subsequent-section"><enum>206.</enum><header display-inline="yes-display-inline">Sense of Congress regarding cooperation</header><text display-inline="no-display-inline">It is the sense of Congress that, consistent with applicable laws and regulations, the Chief of the Forest Service and the Director of the Bureau of Land Management should cooperate with State and local authorities and other entities to carry out waste removal and other activities on any Federal land used as a public target range to encourage continued use of that land for target practice or marksmanship training.</text></section></title><title id="H2DE081B1799640959F2162CDD7CD836C"><enum>III</enum><header>Public Lands Filming </header><section id="H1ED98CFF75D3406A9A9BA1ADEB5AEFA0" section-type="subsequent-section"><enum>301.</enum><header>Purpose</header><text display-inline="no-display-inline">The purpose of this title is to provide commercial film crews of 5 persons or fewer access to film in areas designated for public use during public hours on Federal lands and waterways.</text></section><section id="HC9D47EC2DD2B46C3948062E5EC5A6495"><enum>302.</enum><header>Annual permit and fee for film crews of 5 persons or fewer</header><subsection id="HA371A1D8157F4D3AA7BD93C184FBD038"><enum>(a)</enum><header>In General</header><text display-inline="yes-display-inline">Section (1)(a) of <external-xref legal-doc="public-law" parsable-cite="pl/106/206">Public Law 106–206</external-xref> (<external-xref legal-doc="usc" parsable-cite="usc/16/460l-6d">16 U.S.C. 460l–6d</external-xref>) is amended by—</text><paragraph id="H35F666A3B7054ADB87171237312A507B"><enum>(1)</enum><text display-inline="yes-display-inline">redesignating paragraphs (1), (2), and (3) as subparagraphs (A), (B), and (C), respectively;</text></paragraph><paragraph id="H874ED3108686452E849C65BC743444DC"><enum>(2)</enum><text display-inline="yes-display-inline">striking <quote>The Secretary of the Interior</quote> and inserting <quote>(1) <header-in-text level="paragraph" style="OLC">In General</header-in-text>.—Except as provided by paragraph (3), the Secretary of the Interior</quote>;</text></paragraph><paragraph id="H505DA5C3ECD04E4097E7CE60E9A84E9A"><enum>(3)</enum><text>inserting <quote>(2) <header-in-text level="paragraph" style="OLC">Other considerations</header-in-text>.—</quote> before <quote>The Secretary may include other factors</quote>; and</text></paragraph><paragraph id="H0ED6F20B12234AB6919632518A1C32DE"><enum>(4)</enum><text display-inline="yes-display-inline">adding at the end the following new paragraph:</text><quoted-block display-inline="no-display-inline" id="HC298DFA860C94897A6A9A76BC14F5F73" style="OLC"><paragraph id="H40218AF6DE6B407FB621CC63A5DC28C9"><enum>(3)</enum><header>Special rules for film crews of 5 persons or fewer</header><subparagraph id="HA48A3A0A798B44F091E6CAFFF772AB6A"><enum>(A)</enum><text>For any film crew of 5 persons or fewer, the Secretary shall require a permit and assess an annual fee of $200 for commercial filming activities or similar projects on Federal lands and waterways administered by the Secretary. The permit shall be valid for commercial filming activities or similar projects that occur in areas designated for public use during public hours on all Federal lands waterways administered by the Secretary for a 12-month period beginning on the date of issuance of the permit.</text></subparagraph><subparagraph id="H399226D21A6F4F458A8FF3EF8C070C2B"><enum>(B)</enum><text>For persons holding a permit described in this paragraph, the Secretary shall not assess, during the effective period of the permit, any additional fee for commercial filming activities and similar projects that occur in areas designated for public use during public hours on Federal lands and waterways administered by the Secretary.</text></subparagraph><subparagraph id="H2365AB28D59242CB8ADCDC3FB0448FD3"><enum>(C)</enum><text>In this paragraph, the term <term>film crew</term> includes all persons present on Federal land under the Secretary’s jurisdiction who are associated with the production of a certain film.</text></subparagraph><subparagraph id="H5B07CA70E26B44AEA926255468D6CE53"><enum>(D)</enum><text>The Secretary shall not prohibit, as a motorized vehicle or under any other purposes, use of cameras or related equipment used for the purpose of commercial filming activities or similar projects in accordance with this paragraph on Federal lands and waterways administered by the Secretary.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H227EE85DB0414646A94367BE9E729329"><enum>(b)</enum><header>Recovery of Costs</header><text display-inline="yes-display-inline">Section (1)(b) of <external-xref legal-doc="public-law" parsable-cite="pl/106/206">Public Law 106–206</external-xref> (<external-xref legal-doc="usc" parsable-cite="usc/16/460l-6d">16 U.S.C. 460l–6d</external-xref>) is amended by—</text><paragraph id="H816115A1A27E4A8082263EC3965283AD"><enum>(1)</enum><text>striking <quote>collect any costs</quote> and inserting <quote>recover any costs</quote>; and</text></paragraph><paragraph id="HE7AA4A1DAA4140519100161ECFF1C1DA"><enum>(2)</enum><text>striking <quote>similar project</quote> and inserting <quote>similar projects</quote>.</text></paragraph></subsection></section></title><title id="H2A9E0E64BDBB4452A0A3E06BB82706F7"><enum>IV</enum><header>Polar Bear Conservation and Fairness Act </header><section id="H298862F7FD5546C18EA74ACDEB4AC660" section-type="subsequent-section"><enum>401.</enum><header>Short title</header><text display-inline="no-display-inline">This title may be cited as the <quote><short-title>Polar Bear Conservation and Fairness Act of 2013</short-title></quote>.</text></section><section id="H9F2AE4E92C5A4A3DB1CEE4F04522AF7A" section-type="subsequent-section"><enum>402.</enum><header> Permits for importation of polar bear trophies taken in sport hunts in Canada</header><text display-inline="no-display-inline">Section 104(c)(5)(D) of the Marine Mammal Protection Act of 1972 (<external-xref legal-doc="usc" parsable-cite="usc/16/1374">16 U.S.C. 1374(c)(5)(D)</external-xref>) is amended to read as follows:</text><quoted-block display-inline="no-display-inline" id="H65B5491D56EC4F8B84FC28D280EB8867" style="OLC"><subparagraph id="HE48480CF8284498681E7F3D535047EFB" indent="up1"><enum>(D)</enum><clause commented="no" display-inline="yes-display-inline" id="H4760E94C0E2242CBBC154E9E8DBC987E"><enum>(i)</enum><text display-inline="yes-display-inline">The Secretary of the Interior shall, expeditiously after the expiration of the applicable 30-day period under subsection (d)(2), issue a permit for the importation of any polar bear part (other than an internal organ) from a polar bear taken in a sport hunt in Canada to any person—</text><subclause id="H89489DDFA847467599CF8F4CC9D0651C" indent="up1"><enum>(I)</enum><text display-inline="yes-display-inline">who submits, with the permit application, proof that the polar bear was legally harvested by the person before February 18, 1997; or</text></subclause><subclause id="H774DBEED226D46B490E84995840C7FAC" indent="up1"><enum>(II)</enum><text display-inline="yes-display-inline">who has submitted, in support of a permit application submitted before May 15, 2008, proof that the polar bear was legally harvested by the person before May 15, 2008, from a polar bear population from which a sport-hunted trophy could be imported before that date in accordance with <external-xref legal-doc="regulation" parsable-cite="cfr/50/18.30">section 18.30(i)</external-xref> of title 50, Code of Federal Regulations.</text></subclause></clause><clause id="HA02D6EB5BDBB423C89756A11A37C709E" indent="up1"><enum>(ii)</enum><text display-inline="yes-display-inline">The Secretary shall issue permits under clause (i)(I) without regard to subparagraphs (A) and (C)(ii) of this paragraph, subsection (d)(3), and sections 101 and 102. Sections 101(a)(3)(B) and 102(b)(3) shall not apply to the importation of any polar bear part authorized by a permit issued under clause (i)(I). This clause shall not apply to polar bear parts that were imported before June 12, 1997.</text></clause><clause id="HD71B420ACDE947E599F1D4B832AC0CAB" indent="up1"><enum>(iii)</enum><text display-inline="yes-display-inline">The Secretary shall issue permits under clause (i)(II) without regard to subparagraph (C)(ii) of this paragraph or subsection (d)(3). Sections 101(a)(3)(B) and 102(b)(3) shall not apply to the importation of any polar bear part authorized by a permit issued under clause (i)(II). This clause shall not apply to polar bear parts that were imported before the date of enactment of the <short-title>Polar Bear Conservation and Fairness Act of 2013</short-title>.</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></section></title><title id="HA7235EF4983C48508CF9ABA454C494D1"><enum>V</enum><header>Permanent Electronic Duck Stamp Act </header><section id="HED29B992CB4E49E3B4FD942FCC19993A" section-type="subsequent-section"><enum>501.</enum><header>Short title</header><text display-inline="no-display-inline">This title may be cited as the <quote><short-title>Permanent Electronic Duck Stamp Act of 2013</short-title></quote>.</text></section><section id="HD97BAC93573F4B52B70F05830516107A"><enum>502.</enum><header>Definitions</header><text display-inline="no-display-inline">In this title:</text><paragraph id="HC58DB4A20A324B64B56CBB4E687828DF"><enum>(1)</enum><header>Actual stamp</header><text display-inline="yes-display-inline">The term <term>actual stamp</term> means a Federal migratory-bird hunting and conservation stamp required under the Act of March 16, 1934 (<external-xref legal-doc="usc" parsable-cite="usc/16/718a">16 U.S.C. 718a et seq.</external-xref>) (popularly known as the <quote>Duck Stamp Act</quote>), that is printed on paper and sold through the means established by the authority of the Secretary immediately before the date of enactment of this Act.</text></paragraph><paragraph id="H7074E27682BD4F9F80F91BC9DB259F07"><enum>(2)</enum><header>Automated licensing system</header><subparagraph id="H43DEDA90811C40448B87BFAE69A50ED0"><enum>(A)</enum><header>In general</header><text>The term <term>automated licensing system</term> means an electronic, computerized licensing system used by a State fish and wildlife agency to issue hunting, fishing, and other associated licenses and products.</text></subparagraph><subparagraph id="H3F2A8FF9C89446EFB5EA4BAD0B66CBD9"><enum>(B)</enum><header>Inclusion</header><text display-inline="yes-display-inline">The term <term>automated licensing system</term> includes a point-of-sale, Internet, telephonic system, or other electronic applications used for a purpose described in subparagraph (A).</text></subparagraph></paragraph><paragraph id="HEBE5198522294C50A56F741A5AD7044D"><enum>(3)</enum><header>Electronic stamp</header><text>The term <term>electronic stamp</term> means an electronic version of an actual stamp that—</text><subparagraph id="H34C85D85B0F04D8F8BE0526386DC54D9"><enum>(A)</enum><text>is a unique identifier for the individual to whom it is issued;</text></subparagraph><subparagraph id="H23CD7D5A1B0148FF8F121ED41B6BD417"><enum>(B)</enum><text display-inline="yes-display-inline">can be printed on paper or produced through an electronic application with the same indicators as the State endorsement provides;</text></subparagraph><subparagraph id="H405CB25D0EDB451A8551768BA4C841A8"><enum>(C)</enum><text>is issued through a State automated licensing system that is authorized, under State law and by the Secretary under this title, to issue electronic stamps;</text></subparagraph><subparagraph id="H1AF7B00EA9544D16AFF277538135B52E"><enum>(D)</enum><text>is compatible with the hunting licensing system of the State that issues the electronic stamp; and</text></subparagraph><subparagraph id="HC1C97A8F4BB74361B42ECC7E1B732660"><enum>(E)</enum><text>is described in the State application approved by the Secretary under section 504(b).</text></subparagraph></paragraph><paragraph id="HA2B5F53F254E4A4CA6050E89A642C445"><enum>(4)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of the Interior.</text></paragraph></section><section id="H0982645C7289403199B2A9DA4833736D"><enum>503.</enum><header>Authority to issue electronic duck stamps</header><subsection id="H790DD01DDB0041989AD0F4E1EAC9CCC5"><enum>(a)</enum><header>In general</header><text>The Secretary may authorize any State to issue electronic stamps in accordance with this title.</text></subsection><subsection id="H9C5F74BE74844F0DB713FFAB0F1A2E1D"><enum>(b)</enum><header>Consultation</header><text>The Secretary shall implement this section in consultation with State management agencies.</text></subsection></section><section id="HE1472C9AD9B149B1B3249DAF4C344DF0"><enum>504.</enum><header>State application</header><subsection id="H07354C2EBF3F4718BB9BAC5E7A8C9F62"><enum>(a)</enum><header>Approval of Application required</header><text display-inline="yes-display-inline">The Secretary may not authorize a State to issue electronic stamps under this title unless the Secretary has received and approved an application submitted by the State in accordance with this section. The Secretary may determine the number of new States per year to participate in the electronic stamp program.</text></subsection><subsection id="H7BBD2B7D1BC741D189A8643DE10098DC"><enum>(b)</enum><header>Contents of Application</header><text>The Secretary may not approve a State application unless the application contains—</text><paragraph id="HBC811DDFE7C64EC59E1A7D493DFED536"><enum>(1)</enum><text>a description of the format of the electronic stamp that the State will issue under this title, including identifying features of the licensee that will be specified on the stamp;</text></paragraph><paragraph id="H7CE3A3DF3E4C42BB94B1C23D7AC83B51"><enum>(2)</enum><text>a description of any fee the State will charge for issuance of an electronic stamp;</text></paragraph><paragraph id="H55C6EE5D5EB547BC890C517DD78E5CC8"><enum>(3)</enum><text>a description of the process the State will use to account for and transfer to the Secretary the amounts collected by the State that are required to be transferred to the Secretary under the program;</text></paragraph><paragraph id="H3058A0A753A841018B5AE2C553547484"><enum>(4)</enum><text>the manner by which the State will transmit electronic stamp customer data to the Secretary;</text></paragraph><paragraph id="HFA49D63B7626437C827A0D13F43530FD"><enum>(5)</enum><text>the manner by which actual stamps will be delivered;</text></paragraph><paragraph id="H942FE9123B57447C9BEFD0FCE0C4029C"><enum>(6)</enum><text>the policies and procedures under which the State will issue duplicate electronic stamps; and</text></paragraph><paragraph id="HEE8258CEE82A406B9C36F722ABA361F6"><enum>(7)</enum><text>such other policies, procedures, and information as may be reasonably required by the Secretary.</text></paragraph></subsection><subsection id="HA78F3DB538854BD49FF8A0BA6D3E64CD"><enum>(c)</enum><header>Publication of Deadlines, Eligibility Requirements, and Selection Criteria</header><text>Not later than 30 days before the date on which the Secretary begins accepting applications under this section, the Secretary shall publish—</text><paragraph id="H36386EBB8B374393B10DCA2CF9D9FB51"><enum>(1)</enum><text>deadlines for submission of applications;</text></paragraph><paragraph id="HD74F603D61AF4A35BFADC036EEE02BCB"><enum>(2)</enum><text>eligibility requirements for submitting applications; and</text></paragraph><paragraph id="H520C8F20D3CF4AB9BB95C01AB4F3566D"><enum>(3)</enum><text>criteria for approving applications.</text></paragraph></subsection></section><section id="H1466E091C56545E69A92A35471F9DDF1"><enum>505.</enum><header>State obligations and authorities</header><subsection id="HC51D7F27620E4453B8D0FB484D2A92A3"><enum>(a)</enum><header>Delivery of Actual Stamp</header><text>The Secretary shall require that each individual to whom a State sells an electronic stamp under this title shall receive an actual stamp—</text><paragraph id="H93C8362415964C6799D41AFE0D3AB0A6"><enum>(1)</enum><text>by not later than the date on which the electronic stamp expires under section 506(c); and</text></paragraph><paragraph id="HD38727C79D43402AA71BDB7050F2274F"><enum>(2)</enum><text>in a manner agreed upon by the State and Secretary.</text></paragraph></subsection><subsection id="H78DF91215FF4452780D004280E712DC2"><enum>(b)</enum><header>Collection and transfer of electronic stamp revenue and customer information</header><paragraph id="HBC7EC95CC2314BEBAB2B19B75738F0BF"><enum>(1)</enum><header>Requirement to transmit</header><text>The Secretary shall require each State authorized to issue electronic stamps to collect and submit to the Secretary in accordance with this section—</text><subparagraph id="H07AA714D8FD444A8BA5E5B74298DE69A"><enum>(A)</enum><text>the first name, last name, and complete mailing address of each individual that purchases an electronic stamp from the State;</text></subparagraph><subparagraph id="H32C5973CFE424A3089C1BFC30A8905C7"><enum>(B)</enum><text>the face value amount of each electronic stamp sold by the State; and</text></subparagraph><subparagraph id="H552FA81E3FDE47AAB67A623F4E7C4D31"><enum>(C)</enum><text>the amount of the Federal portion of any fee required by the agreement for each stamp sold.</text></subparagraph></paragraph><paragraph id="H5B39AEE8150E49DA86E32CD6BB91F1F7"><enum>(2)</enum><header>Time of transmittal</header><text display-inline="yes-display-inline">The Secretary shall require the submission under paragraph (1) to be made with respect to sales of electronic stamps by a State according to the written agreement between the Secretary and the State agency.</text></paragraph><paragraph id="H93EE2BF849F74F0EBAA2288E52544366"><enum>(3)</enum><header>Additional fees not affected</header><text>This section shall not apply to the State portion of any fee collected by a State under subsection (c).</text></paragraph></subsection><subsection id="H88A3DEA9C6E0418CBB47A209D435562D"><enum>(c)</enum><header>Electronic Stamp Issuance Fee</header><text>A State authorized to issue electronic stamps may charge a reasonable fee to cover costs incurred by the State and the Department of the Interior in issuing electronic stamps under this title, including costs of delivery of actual stamps.</text></subsection><subsection id="H1F6616D9FEC14A4C9B9808908695471E"><enum>(d)</enum><header>Duplicate Electronic Stamps</header><text>A State authorized to issue electronic stamps may issue a duplicate electronic stamp to replace an electronic stamp issued by the State that is lost or damaged.</text></subsection><subsection id="HC516B385861D48B792629D9FDE2E4CC8"><enum>(e)</enum><header>Limitation on Authority To Require Purchase of State License</header><text>A State may not require that an individual purchase a State hunting license as a condition of issuing an electronic stamp under this title.</text></subsection></section><section id="HC295DF263F1C4C82990014E03E24AE75"><enum>506.</enum><header>Electronic stamp requirements; recognition of electronic stamp</header><subsection id="HBF01FC158AB34CAA9A29F3A905652246"><enum>(a)</enum><header>Stamp Requirements</header><text>The Secretary shall require an electronic stamp issued by a State under this title—</text><paragraph id="H5C74B37557964C88B13EEAC128345CC6"><enum>(1)</enum><text>to have the same format as any other license, validation, or privilege the State issues under the automated licensing system of the State; and</text></paragraph><paragraph id="H6328249EB65C461CBE7C50E84D274E91"><enum>(2)</enum><text>to specify identifying features of the licensee that are adequate to enable Federal, State, and other law enforcement officers to identify the holder.</text></paragraph></subsection><subsection id="HC170C6537E264D6CB6A64E4FA2B0F364"><enum>(b)</enum><header>Recognition of Electronic Stamp</header><text>Any electronic stamp issued by a State under this title shall, during the effective period of the electronic stamp—</text><paragraph id="H12FE5FE393F245FDB6183C66B6AE757F"><enum>(1)</enum><text>bestow upon the licensee the same privileges as are bestowed by an actual stamp;</text></paragraph><paragraph id="H9C85296C508C4DB0B92DDF29FCA55225"><enum>(2)</enum><text>be recognized nationally as a valid Federal migratory bird hunting and conservation stamp; and</text></paragraph><paragraph id="H68CD9538DF544392BE0D4F74B6584040"><enum>(3)</enum><text>authorize the licensee to hunt migratory waterfowl in any other State, in accordance with the laws of the other State governing that hunting.</text></paragraph></subsection><subsection id="H7A8193A5A4EE45648488620E89884C07"><enum>(c)</enum><header>Duration</header><text>An electronic stamp issued by a State shall be valid for a period agreed to by the State and the Secretary, which shall not exceed 45 days.</text></subsection></section><section id="HED00FBBFE1F646B19FACE08D98058CDF"><enum>507.</enum><header>Termination of State participation</header><text display-inline="no-display-inline">The authority of a State to issue electronic stamps under this title may be terminated—</text><paragraph id="H2455A8748602410E90429CC22BAE7AF9"><enum>(1)</enum><text>by the Secretary, if the Secretary—</text><subparagraph id="HEC23512D70554269A383BD91B4812A75"><enum>(A)</enum><text>finds that the State has violated any of the terms of the application of the State approved by the Secretary under section 504; and</text></subparagraph><subparagraph id="HE88B51B37183400EAA80971754AFF3A8"><enum>(B)</enum><text>provides to the State written notice of the termination by not later than the date that is 30 days before the date of termination; or</text></subparagraph></paragraph><paragraph id="H4820C1C947034FB99C4E57E8F792BBDA"><enum>(2)</enum><text>by the State, by providing written notice to the Secretary by not later than the date that is 30 days before the termination date.</text></paragraph></section></title><title id="H0BB0D31BB26E439FAD62315DF747043E"><enum>VI</enum><header>Access to Water Resources Development Projects Act</header><section id="H005DBD7307B24976A68486ABF691B81C" section-type="subsequent-section"><enum>601.</enum><header>Short title</header><text display-inline="no-display-inline">This title may be cited as the <quote><short-title>Recreational Lands Self-Defense Act of 2013</short-title></quote>.</text></section><section id="HE1F5DFC3CCDD418CBD26191F86EC3E86"><enum>602.</enum><header>Protecting Americans from violent crime</header><subsection id="H15BFDEEEC57D4D19B2F092DB11944322"><enum>(a)</enum><header>Findings</header><text>Congress finds the following:</text><paragraph id="HA3DE34AC74624B94AF7E0DD5639F1CCC"><enum>(1)</enum><text>The Second Amendment to the Constitution provides that <quote>the right of the people to keep and bear Arms, shall not be infringed</quote>.</text></paragraph><paragraph id="HA5A24F987B434B7294B3A4CFBFB1544E"><enum>(2)</enum><text display-inline="yes-display-inline"><external-xref legal-doc="regulation" parsable-cite="cfr/36/327.13">Section 327.13</external-xref> of title 36, Code of Federal Regulations, provides that, except in special circumstances, <quote>possession of loaded firearms, ammunition, loaded projectile firing devices, bows and arrows, crossbows, or other weapons is prohibited</quote> at water resources development projects administered by the Secretary of the Army.</text></paragraph><paragraph id="H8143D448793646ABB55E563EB4E2AEB3"><enum>(3)</enum><text>The regulations described in paragraph (2) prevent individuals complying with Federal and State laws from exercising the second amendment rights of the individuals while at such water resources development projects.</text></paragraph><paragraph id="HC06A35318D5F483CA29F5238D239D747"><enum>(4)</enum><text>The Federal laws should make it clear that the second amendment rights of an individual at a water resources development project should not be infringed.</text></paragraph></subsection><subsection id="H0006986ACE4D40A180EAEC494D6E4C04"><enum>(b)</enum><header>Protecting the right of individuals To bear arms at water resources development projects</header><text>The Secretary of the Army shall not promulgate or enforce any regulation that prohibits an individual from possessing a firearm including an assembled or functional firearm at a water resources development project covered under <external-xref legal-doc="regulation" parsable-cite="cfr/36/327.0">section 327.0</external-xref> of title 36, Code of Federal Regulations (as in effect on the date of enactment of this Act), if—</text><paragraph id="HD11CCD502B744EEDBAC46779BB15C243"><enum>(1)</enum><text>the individual is not otherwise prohibited by law from possessing the firearm; and</text></paragraph><paragraph id="H97D9D8AA7363431F883DD37132A6E0BF"><enum>(2)</enum><text>the possession of the firearm is in compliance with the law of the State in which the water resources development project is located.</text></paragraph></subsection></section></title><title id="H2DE7A50DBDDC4C5C9D8589C938D698A2"><enum>VII</enum><header>Wildlife and Hunting Heritage Conservation Council Advisory Committee </header><section id="H7AEB8ED23E6542449F2938C9D2C3B1BE"><enum>701.</enum><header>Wildlife and Hunting Heritage Conservation Council Advisory Committee</header><text display-inline="no-display-inline">The Fish and Wildlife Coordination Act (<external-xref legal-doc="usc" parsable-cite="usc/16/661">16 U.S.C. 661 et seq.</external-xref>) is amended by adding at the end the following:</text><quoted-block id="H8517D55F8E594E84B0FC87F3FD12FDF2"><section id="HD1B8AF6309874B4B83BEF6B9788D3F29"><enum>10.</enum><header>Wildlife and Hunting Heritage Conservation Council Advisory Committee</header><subsection id="H5307186FC90A4D169B37ABFEE13A77DC"><enum>(a)</enum><header>Establishment</header><text>There is hereby established the Wildlife and Hunting Heritage Conservation Council Advisory Committee (in this section referred to as the <term>Advisory Committee</term>) to advise the Secretaries of the Interior and Agriculture on wildlife and habitat conservation, hunting, and recreational shooting.</text></subsection><subsection id="H5F63E992AC7C42A0A60971065D3AAA9E"><enum>(b)</enum><header>Duties of the advisory committee</header><text>The Advisory Committee shall advise the Secretaries with regard to—</text><paragraph id="HC95BB9E9B53B4DF082FB86097718CD0D"><enum>(1)</enum><text>implementation of Executive Order No. 13443: Facilitation of Hunting Heritage and Wildlife Conservation, which directs Federal agencies <quote>to facilitate the expansion and enhancement of hunting opportunities and the management of game species and their habitat</quote>;</text></paragraph><paragraph id="HC4C526304DBC459581A9EBA3738F35D2"><enum>(2)</enum><text>policies or programs to conserve and restore wetlands, agricultural lands, grasslands, forest, and rangeland habitats;</text></paragraph><paragraph id="H03224C19AEED40F480FB7756B26E906D"><enum>(3)</enum><text>policies or programs to promote opportunities and access to hunting and shooting sports on Federal lands;</text></paragraph><paragraph id="H5AAC0E0DB1F24BD4A103C80F7F8DCDAF"><enum>(4)</enum><text>policies or programs to recruit and retain new hunters and shooters;</text></paragraph><paragraph id="H43BB096A95424D75936D08D22FA65ADC"><enum>(5)</enum><text>policies or programs that increase public awareness of the importance of wildlife conservation and the social and economic benefits of recreational hunting and shooting; and</text></paragraph><paragraph id="HE9C9985F27C048B395CB093032B5ABE7"><enum>(6)</enum><text>policies or programs that encourage coordination among the public, the hunting and shooting sports community, wildlife conservation groups, and States, tribes, and the Federal Government.</text></paragraph></subsection><subsection id="H110B4F7C8C5A45C0A8B8D2A0BB1B8305"><enum>(c)</enum><header>Membership</header><paragraph id="HF9159D82735D443D90153D7947476544"><enum>(1)</enum><header>Appointment</header><subparagraph id="H8C482697B02A4C37BA04199EF25674A1"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The Advisory Committee shall consist of no more than 16 discretionary members and 7 ex officio members.</text></subparagraph><subparagraph id="H21DCFD6F21E24FE1B4ADDB0FACFE520F"><enum>(B)</enum><header>Ex officio members</header><text display-inline="yes-display-inline">The ex officio members are—</text><clause id="H84DF43AB2E9647ACA55282F08CFEFCD6"><enum>(i)</enum><text>the Director of the United States Fish and Wildlife Service or a designated representative of the Director;</text></clause><clause id="HF33262A4B10F4B3EA115D9669DC47F5A"><enum>(ii)</enum><text>the Director of the Bureau of Land Management or a designated representative of the Director;</text></clause><clause id="HE76EE0F210604C42BC69303F3EA72629"><enum>(iii)</enum><text>the Director of the National Park Service or a designated representative of the Director;</text></clause><clause id="H525D60F143E245C69AA5394E69EEBD21"><enum>(iv)</enum><text>the Chief of the Forest Service or a designated representative of the Chief;</text></clause><clause id="H3B3653998FD9496C8DBABAE765E101E4"><enum>(v)</enum><text>the Chief of the Natural Resources Conservation Service or a designated representative of the Chief;</text></clause><clause id="H2F2722D52E0D472BBF89C500B1D7B8CB"><enum>(vi)</enum><text>the Administrator of the Farm Service Agency or a designated representative of the Administrator; and</text></clause><clause id="H6B8DD6C6211E4A0ABEB25B2481E0C313"><enum>(vii)</enum><text>the Executive Director of the Association of Fish and Wildlife Agencies.</text></clause></subparagraph><subparagraph id="HE5CE00558E204DE4A908F813080FACAA"><enum>(C)</enum><header>Discretionary members</header><text>The discretionary members shall be appointed jointly by the Secretaries from at least one of each of the following:</text><clause id="HB513389BC9B74CB98755C1215D2A015C"><enum>(i)</enum><text>State fish and wildlife agencies.</text></clause><clause id="H37B5FA0C09A647FDA0A5611DE675F277"><enum>(ii)</enum><text>Game bird hunting organizations.</text></clause><clause id="H3C764EF36B294817A24F2962487B2AA6"><enum>(iii)</enum><text>Wildlife conservation organizations.</text></clause><clause id="HD999DE0BEEA244309B9AA93E5A933397"><enum>(iv)</enum><text>Big game hunting organizations.</text></clause><clause id="H3A133876D51E42BC820DB0BB6A8D5D4A"><enum>(v)</enum><text>Waterfowl hunting organizations.</text></clause><clause id="HFB7FDA74224B489CA9418E8C099EB924"><enum>(vi)</enum><text>The tourism, outfitter, or guiding industry.</text></clause><clause id="H58C72C7F02DE458498AD4F1636C5532E"><enum>(vii)</enum><text>The firearms or ammunition manufacturing industry.</text></clause><clause id="H6D3E6877537C491A99D0FCFE358A803C"><enum>(viii)</enum><text>The hunting or shooting equipment retail industry.</text></clause><clause id="H55A945BA269549C9A1B4DC524689ED15"><enum>(ix)</enum><text display-inline="yes-display-inline">Hunting and shooting sports outreach and education organizations.</text></clause><clause id="HC488B2FD592B40AA8E0C757A064CDA71"><enum>(x)</enum><text>Tribal resource management organizations.</text></clause><clause id="H02E78B6F59FF45318C78BBCE033CFB78"><enum>(xi)</enum><text>The agriculture industry.</text></clause><clause id="HBEE927C35314473C90394935F6DDC9D1"><enum>(xii)</enum><text>The ranching industry.</text></clause></subparagraph><subparagraph id="H799843CEC0BB4B1295365CBA496B199F"><enum>(D)</enum><header>Eligibility</header><text display-inline="yes-display-inline">Prior to the appointment of the discretionary members, the Secretaries shall determine that all individuals nominated for appointment to the Advisory Committee, and the organization each individual represents, actively support and promote sustainable-use hunting, wildlife conservation, and recreational shooting.</text></subparagraph></paragraph><paragraph id="H0E202C5106C04D9D87F615844F93F061"><enum>(2)</enum><header>Terms</header><subparagraph id="H868DA72CAB6D41C1BDC846B2D3959A68"><enum>(A)</enum><header>In general</header><text>Except as provided in subparagraph (B), members of the Advisory Committee shall be appointed for a term of 4 years. Members shall not be appointed for more than 3 consecutive or nonconsecutive terms.</text></subparagraph><subparagraph id="H8019A876B0DA4BE98C35269A73F2DFE3"><enum>(B)</enum><header>Terms of initial appointees</header><text>As designated by the Secretary at the time of appointment, of the members first appointed—</text><clause id="H8E76D47CE92E4859929CA6ECD8551A11"><enum>(i)</enum><text>6 members shall be appointed for a term of 4 years;</text></clause><clause id="H731900F179CF4AC2B2EC2F283ED641C6"><enum>(ii)</enum><text>5 members shall be appointed for a term of 3 years; and</text></clause><clause id="H2FB85B036AB44448B7B888BAC3077511"><enum>(iii)</enum><text>5 members shall be appointed for a term of 2 years.</text></clause></subparagraph></paragraph><paragraph id="H696C006498DD49148F6963875CD1C840"><enum>(3)</enum><header>Preservation of public advisory status</header><text>No individual may be appointed as a discretionary member of the Advisory Committee while serving as an officer or employee of the Federal Government.</text></paragraph><paragraph id="HEB960F5D4EF3455CAB009D550E593AE8"><enum>(4)</enum><header>Vacancy and removal</header><subparagraph id="H14773F309BB4474C874A214224E6A681"><enum>(A)</enum><header>In general</header><text>Any vacancy on the Advisory Committee shall be filled in the manner in which the original appointment was made.</text></subparagraph><subparagraph id="H87440F287C1541E1AFFE4A13FD508C7E"><enum>(B)</enum><header>Removal</header><text>Advisory Committee members shall serve at the discretion of the Secretaries and may be removed at any time for good cause.</text></subparagraph></paragraph><paragraph id="HE8AC0E4D64FA4D3C87BDCB3E4C54E580"><enum>(5)</enum><header>Continuation of service</header><text>Each appointed member may continue to serve after the expiration of the term of office to which such member was appointed until a successor has been appointed.</text></paragraph><paragraph id="H7FBE19F256714282AD727929CCF9F787"><enum>(6)</enum><header>Chairperson</header><text>The Chairperson of the Advisory Committee shall be appointed for a 3-year term by the Secretaries, jointly, from among the members of the Advisory Committee. An individual may not be appointed as Chairperson for more than 2 consecutive or nonconsecutive terms.</text></paragraph><paragraph id="H492E13614C5D4453A5E0D6F943C4A69B"><enum>(7)</enum><header>Pay and expenses</header><text display-inline="yes-display-inline">Members of the Advisory Committee shall serve without pay for such service, but each member of the Advisory Committee shall be reimbursed for travel and lodging incurred through attending meetings of the Advisory Committee approved subgroup meetings in the same amounts and under the same conditions as Federal employees (in accordance with <external-xref legal-doc="usc" parsable-cite="usc/5/5703">section 5703</external-xref> of title 5, United States Code).</text></paragraph><paragraph id="H02B4C2185BE049A29BB9C679E6B2A651"><enum>(8)</enum><header>Meetings</header><subparagraph id="H75CFBC9129AC4BEA8C5B93D0A46B5749"><enum>(A)</enum><header>In general</header><text>The Advisory Committee shall meet at the call of the Secretaries, the chairperson, or a majority of the members, but not less frequently than twice annually.</text></subparagraph><subparagraph id="H9C96A4E88A734CF0B47A8F41CF49153F"><enum>(B)</enum><header>Open meetings</header><text>Each meeting of the Advisory Committee shall be open to the public.</text></subparagraph><subparagraph id="H1A52E6BE949D4DE09822404C1497E158"><enum>(C)</enum><header>Prior notice of meetings</header><text>Timely notice of each meeting of the Advisory Committee shall be published in the Federal Register and be submitted to trade publications and publications of general circulation.</text></subparagraph><subparagraph id="H031530D3B5FD407DB9759EC868DEEC11"><enum>(D)</enum><header>Subgroups</header><text>The Advisory Committee may establish such workgroups or subgroups as it deems necessary for the purpose of compiling information or conducting research. However, such workgroups may not conduct business without the direction of the Advisory Committee and must report in full to the Advisory Committee.</text></subparagraph></paragraph><paragraph id="HE455D2FBD004429FA4B5B09704CE7EBA"><enum>(9)</enum><header>Quorum</header><text>Nine members of the Advisory Committee shall constitute a quorum.</text></paragraph></subsection><subsection id="HC988C48DDA424BC88452484CE69B0987"><enum>(d)</enum><header>Expenses</header><text>The expenses of the Advisory Committee that the Secretaries determine to be reasonable and appropriate shall be paid by the Secretaries.</text></subsection><subsection id="H93420C6FE09A4F88AF7355F0749A6AF5"><enum>(e)</enum><header>Administrative support, technical services, and advice</header><text>A designated Federal Officer shall be jointly appointed by the Secretaries to provide to the Advisory Committee the administrative support, technical services, and advice that the Secretaries determine to be reasonable and appropriate.</text></subsection><subsection id="H19C96BF169A44D76BFB81EE4332C9B5B"><enum>(f)</enum><header>Annual report</header><paragraph id="H9F15D390FFD64E319B3371CC421BE7E4"><enum>(1)</enum><header>Required</header><text>Not later than September 30 of each year, the Advisory Committee shall submit a report to the Secretaries, the Committee on Natural Resources and the Committee on Agriculture of the House of Representatives, and the Committee on Energy and Natural Resources and the Committee on Agriculture, Nutrition, and Forestry of the Senate. If circumstances arise in which the Advisory Committee cannot meet the September 30 deadline in any year, the Secretaries shall advise the Chairpersons of each such Committee of the reasons for such delay and the date on which the submission of the report is anticipated.</text></paragraph><paragraph id="HA05F03FA0B3C4793BA277CC486057F29"><enum>(2)</enum><header>Contents</header><text>The report required by paragraph (1) shall describe—</text><subparagraph id="H3CE66DB966BF4D0C86CAC111665C4500"><enum>(A)</enum><text>the activities of the Advisory Committee during the preceding year;</text></subparagraph><subparagraph id="H3016092908DA4B90BE627E9ECA246D33"><enum>(B)</enum><text>the reports and recommendations made by the Advisory Committee to the Secretaries during the preceding year; and</text></subparagraph><subparagraph id="H4FE2CD47BC0D47F1B8DBF68327E4E91D"><enum>(C)</enum><text>an accounting of actions taken by the Secretaries as a result of the recommendations.</text></subparagraph></paragraph></subsection><subsection id="H82C2DC9285C64A5EA17F13001764E383"><enum>(g)</enum><header>Federal advisory committee act</header><text>The Advisory Committee shall be exempt from the Federal Advisory Committee Act (5 U.S.C. App.).</text></subsection><subsection id="HB09734C89AAF4E828691BAF0ACB0B0AA"><enum>(h)</enum><header>Abolishment of the existing wildlife and hunting heritage conservation council advisory committee</header><text display-inline="yes-display-inline">Effective on the date of the enactment of this Act, the Wildlife and Hunting Heritage Conservation Council formed in furtherance of section 441 of the Revised Statutes (<external-xref legal-doc="usc" parsable-cite="usc/43/1457">43 U.S.C. 1457</external-xref>), the Fish and Wildlife Act of 1956 (<external-xref legal-doc="usc" parsable-cite="usc/16/742a">16 U.S.C. 742a</external-xref>), and other Acts applicable to specific bureaus of the Department of the Interior is hereby abolished.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section></title><title id="H6570F5E452BD4F2FAE713931C5E85B76"><enum>VIII</enum><header>Recreational Fishing and Hunting Heritage and Opportunities Act</header><section id="H2C61B9CC6EF241898BC90EDE6854C485" section-type="subsequent-section"><enum>801.</enum><header>Short title</header><text display-inline="no-display-inline">This title may be cited as the <quote>Recreational Fishing and Hunting Heritage and Opportunities Act</quote>.</text></section><section id="H22E4F3C221CD4BD19F7B87A1613A1A4C"><enum>802.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds that—</text><paragraph id="H6DFBD30A296A457E98C6AD64A8A5C928"><enum>(1)</enum><text>recreational fishing and hunting are important and traditional activities in which millions of Americans participate;</text></paragraph><paragraph id="HF1DCBD01EC194B18BCA1D5C7FB50B736"><enum>(2)</enum><text>recreational anglers and hunters have been and continue to be among the foremost supporters of sound fish and wildlife management and conservation in the United States;</text></paragraph><paragraph id="HF418A9F184054E2C88C50358CF7B0436"><enum>(3)</enum><text>recreational fishing and hunting are environmentally acceptable and beneficial activities that occur and can be provided on Federal public lands and waters without adverse effects on other uses or users;</text></paragraph><paragraph id="H407FEEBA9B4F46E2BAF68E87E7DCD35A"><enum>(4)</enum><text>recreational anglers, hunters, and sporting organizations provide direct assistance to fish and wildlife managers and enforcement officers of the Federal Government as well as State and local governments by investing volunteer time and effort to fish and wildlife conservation;</text></paragraph><paragraph id="HEA4C5B112D16454D9EBFB5720E4BE3A8"><enum>(5)</enum><text>recreational anglers, hunters, and the associated industries have generated billions of dollars of critical funding for fish and wildlife conservation, research, and management by providing revenues from purchases of fishing and hunting licenses, permits, and stamps, as well as excise taxes on fishing, hunting, and shooting equipment that have generated billions of dollars of critical funding for fish and wildlife conservation, research, and management;</text></paragraph><paragraph id="HAB72FB03667B461CB0D8607CE115F0C6"><enum>(6)</enum><text>recreational shooting is also an important and traditional activity in which millions of Americans participate, safe recreational shooting is a valid use of Federal public lands, including the establishment of safe and convenient shooting ranges on such lands, and participation in recreational shooting helps recruit and retain hunters and contributes to wildlife conservation;</text></paragraph><paragraph id="HBF2C0D6CEE124BB58A620C186A3A06DE"><enum>(7)</enum><text>opportunities to recreationally fish, hunt, and shoot are declining, which depresses participation in these traditional activities, and depressed participation adversely impacts fish and wildlife conservation and funding for important conservation efforts; and</text></paragraph><paragraph id="H55014B9A51824F9B9C8C46802074A7FF"><enum>(8)</enum><text>the public interest would be served, and our citizens’ fish and wildlife resources benefitted, by action to ensure that opportunities are facilitated to engage in fishing and hunting on Federal public land as recognized by Executive Order No. 12962, relating to recreational fisheries, and Executive Order No. 13443, relating to facilitation of hunting heritage and wildlife conservation.</text></paragraph></section><section id="H633E713EF4FA46C9974257BA067CDA32"><enum>803.</enum><header>Definitions</header><text display-inline="no-display-inline">In this title:</text><paragraph id="H79B05B0A8E0442A18B0AB1CB82E0130A"><enum>(1)</enum><header>Federal public land</header><text>The term <term>Federal public land</term> means any land or water that is owned and managed by the Bureau of Land Management or the Forest Service.</text></paragraph><paragraph id="HE1C52B19998C4A24AF3B0DE56FA8992D"><enum>(2)</enum><header>Federal public land management officials</header><text>The term <term>Federal public land management officials</term> means—</text><subparagraph id="HFE903252B9F24ACC98CF91D61917A0AF"><enum>(A)</enum><text>the Secretary of the Interior and Director of Bureau of Land Management regarding Bureau of Land Management lands and waters; and</text></subparagraph><subparagraph id="HB756D51238E84534832E868F1F66CC62"><enum>(B)</enum><text>the Secretary of Agriculture and Chief of the Forest Service regarding the National Forest System.</text></subparagraph></paragraph><paragraph id="HCE6D686FA75E4B0CB0C212F90D22ECC3"><enum>(3)</enum><header>Hunting</header><subparagraph id="H9B965A920301426288C99444B87C5D8F"><enum>(A)</enum><header>In general</header><text>Except as provided in subparagraph (B), the term <term>hunting</term> means use of a firearm, bow, or other authorized means in the lawful—</text><clause id="H3FDF0183533E48E7B0C4CDB666F28A23"><enum>(i)</enum><text>pursuit, shooting, capture, collection, trapping, or killing of wildlife;</text></clause><clause id="H34A3F4E5CF8F47E48C205AA388E0333B"><enum>(ii)</enum><text>attempt to pursue, shoot, capture, collect, trap, or kill wildlife; or</text></clause><clause id="H3033FEDF844842CDA6A86E74EF9EED18"><enum>(iii)</enum><text>the training of hunting dogs, including field trials.</text></clause></subparagraph><subparagraph id="H3EC2152FC3904A7A908D07E517FEA859"><enum>(B)</enum><header>Exclusion</header><text>The term <term>hunting</term> does not include the use of skilled volunteers to cull excess animals (as defined by other Federal law).</text></subparagraph></paragraph><paragraph id="HFC39D1FE08B34ADC9A37A8ED9B0E124A"><enum>(4)</enum><header>Recreational fishing</header><text>The term <term>recreational fishing</term> means the lawful—</text><subparagraph id="H4472D804CA07403794A3D059F35492A1"><enum>(A)</enum><text>pursuit, capture, collection, or killing of fish; or</text></subparagraph><subparagraph id="H4B7AF879B9CC48E58DBC30C66ECBCA0C"><enum>(B)</enum><text>attempt to capture, collect, or kill fish.</text></subparagraph></paragraph><paragraph id="H96AAD0DD30594CBC8FE25B1B5CDB118D"><enum>(5)</enum><header>Recreational shooting</header><text>The term <term>recreational shooting</term> means any form of sport, training, competition, or pastime, whether formal or informal, that involves the discharge of a rifle, handgun, or shotgun, or the use of a bow and arrow.</text></paragraph></section><section id="HA42ABCA57C9B4AB4B131BF1E2C4FA58D"><enum>804.</enum><header>Recreational fishing, hunting, and shooting</header><subsection id="H901FC723F32344808E1609F0EA779EC1"><enum>(a)</enum><header>In general</header><text>Subject to valid existing rights and subsection (g), and cooperation with the respective State fish and wildlife agency, Federal public land management officials shall exercise authority under existing law, including provisions regarding land use planning, to facilitate use of and access to Federal public lands, including National Monuments, Wilderness Areas, Wilderness Study Areas, and lands administratively classified as wilderness eligible or suitable and primitive or semi-primitive areas, for fishing, sport hunting, and recreational shooting, except as limited by—</text><paragraph id="H0012B825273C41A69D7AB64313828000"><enum>(1)</enum><text>statutory authority that authorizes action or withholding action for reasons of national security, public safety, or resource conservation;</text></paragraph><paragraph id="H72EAB48BDF25461489420058BEA5883E"><enum>(2)</enum><text>any other Federal statute that specifically precludes recreational fishing, hunting, or shooting on specific Federal public lands, waters, or units thereof; and</text></paragraph><paragraph id="HF9FD3C0EEF524D8FA1B242FB1151A214"><enum>(3)</enum><text>discretionary limitations on recreational fishing, hunting, and shooting determined to be necessary and reasonable as supported by the best scientific evidence and advanced through a transparent public process.</text></paragraph></subsection><subsection id="H74357C3C25A24CC3B875BE45DB2BC9F7"><enum>(b)</enum><header>Management</header><text>Consistent with subsection (a), the head of each Federal public land management agency shall exercise its land management discretion—</text><paragraph id="H59A20E8C93A84A9D8B8006ADAC63A8D4"><enum>(1)</enum><text>in a manner that supports and facilitates recreational fishing, hunting, and shooting opportunities;</text></paragraph><paragraph id="H729C57D16CB14BD49EC7D003DCE68A88"><enum>(2)</enum><text>to the extent authorized under applicable State law; and</text></paragraph><paragraph id="HB5EAD231B65D419E828B823927CD1503"><enum>(3)</enum><text>in accordance with applicable Federal law.</text></paragraph></subsection><subsection id="HBF46262FC8DA4006B4FEFA9D017CE972"><enum>(c)</enum><header>Planning</header><paragraph id="H84FEB961E8F744BDB890EEB005C3234E"><enum>(1)</enum><header>Evaluation of effects on opportunities to engage in recreational fishing, hunting, or shooting</header><text>Federal public land planning documents, including land resources management plans, resource management plans, and comprehensive conservation plans, shall include a specific evaluation of the effects of such plans on opportunities to engage in recreational fishing, hunting, or shooting.</text></paragraph><paragraph id="H831ED2F55ACC4E9CB13201C8C19AB43C"><enum>(2)</enum><header>No major federal action</header><text>No action taken under this title, or under section 4 of the National Wildlife Refuge System Administration Act of 1966 (<external-xref legal-doc="usc" parsable-cite="usc/16/668dd">16 U.S.C. 668dd</external-xref>), either individually or cumulatively with other actions involving Federal public lands or lands managed by the United States Fish and Wildlife Service, shall be considered to be a major Federal action significantly affecting the quality of the human environment, and no additional identification, analysis, or consideration of environmental effects, including cumulative effects, is necessary or required.</text></paragraph><paragraph id="H395B74004FEF4FEEA99571D4B27DEE78"><enum>(3)</enum><header>Other activity not considered</header><text>Federal public land management officials are not required to consider the existence or availability of recreational fishing, hunting, or shooting opportunities on adjacent or nearby public or private lands in the planning for or determination of which Federal public lands are open for these activities or in the setting of levels of use for these activities on Federal public lands, unless the combination or coordination of such opportunities would enhance the recreational fishing, hunting, or shooting opportunities available to the public.</text></paragraph></subsection><subsection id="HC2ECF263973A400CB11667CAFA0DC12D"><enum>(d)</enum><header>Federal public lands</header><paragraph id="H00615945709C4D5CACC269FAD1736BAC"><enum>(1)</enum><header>Lands open</header><text>Lands under the jurisdiction of the Bureau of Land Management and the Forest Service, including Wilderness Areas, Wilderness Study Areas, lands designated as wilderness or administratively classified as wilderness eligible or suitable and primitive or semi-primitive areas and National Monuments, but excluding lands on the Outer Continental Shelf, shall be open to recreational fishing, hunting, and shooting unless the managing Federal agency acts to close lands to such activity. Lands may be subject to closures or restrictions if determined by the head of the agency to be necessary and reasonable and supported by facts and evidence, for purposes including resource conservation, public safety, energy or mineral production, energy generation or transmission infrastructure, water supply facilities, protection of other permittees, protection of private property rights or interest, national security, or compliance with other law.</text></paragraph><paragraph id="HAC4EA6F448D246D98EAF2D9A3F9EFEC2"><enum>(2)</enum><header>Shooting ranges</header><subparagraph id="H0AF5BB318F2F4766B972C9EBDC0DB8F9"><enum>(A)</enum><header>In general</header><text>The head of each Federal agency shall use his or her authorities in a manner consistent with this title and other applicable law, to—</text><clause id="H5FCDA2DA044D4CCC9CC505C005CDFC16"><enum>(i)</enum><text>lease or permit use of lands under the jurisdiction of the agency for shooting ranges; and</text></clause><clause id="H68F8B22630054216B7363F3F0E8F14D9"><enum>(ii)</enum><text>designate specific lands under the jurisdiction of the agency for recreational shooting activities.</text></clause></subparagraph><subparagraph id="H7F2F8B9BA8724D7BA8542635BC2EE1F4"><enum>(B)</enum><header>Limitation on liability</header><text>Any designation under subparagraph (A)(ii) shall not subject the United States to any civil action or claim for monetary damages for injury or loss of property or personal injury or death caused by any activity occurring at or on such designated lands.</text></subparagraph></paragraph></subsection><subsection id="H54D415BC1BB64491B61F1D93F5C78375"><enum>(e)</enum><header>Necessity in wilderness areas and <quote>within and supplemental to</quote> wilderness purposes</header><paragraph id="H6CB4BF2000C849CE92308EB6A4F91E3E"><enum>(1)</enum><header>Minimum requirements for administration</header><text display-inline="yes-display-inline">The provision of opportunities for hunting, fishing and recreational shooting, and the conservation of fish and wildlife to provide sustainable use recreational opportunities on designated Federal wilderness areas shall constitute measures necessary to meet the minimum requirements for the administration of the wilderness area, provided that this determination shall not authorize or facilitate commodity development, use, or extraction, motorized recreational access or use that is not otherwise allowed under the Wilderness Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1131">16 U.S.C. 1131 et seq.</external-xref>), or permanent road construction or maintenance within designated wilderness areas.</text></paragraph><paragraph id="HDF88F1C4691C402EB769B83AF333C545"><enum>(2)</enum><header>Application of Wilderness Act</header><text display-inline="yes-display-inline">Provisions of the Wilderness Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1131">16 U.S.C. 1131 et seq.</external-xref>), stipulating that wilderness purposes are <quote>within and supplemental to</quote> the purposes of the underlying Federal land unit are reaffirmed. When seeking to carry out fish and wildlife conservation programs and projects or provide fish and wildlife dependent recreation opportunities on designated wilderness areas, the head of each Federal agency shall implement these supplemental purposes so as to facilitate, enhance, or both, but not to impede the underlying Federal land purposes when seeking to carry out fish and wildlife conservation programs and projects or provide fish and wildlife dependent recreation opportunities in designated wilderness areas, provided that such implementation shall not authorize or facilitate commodity development, use or extraction, or permanent road construction or use within designated wilderness areas.</text></paragraph></subsection><subsection id="H83657E24B2CC4FEA9B42A302FC960B9B"><enum>(f)</enum><header>Report</header><text>Beginning on the second October 1 after the date of the enactment of this Act and biennially on October 1 thereafter, the head of each Federal agency who has authority to manage Federal public land on which fishing, hunting, or recreational shooting occurs shall submit to the Committee on Natural Resources of the House of Representatives and the Committee on Energy and Natural Resources of the Senate a report that describes—</text><paragraph id="H59B70663C61D4583A2666789D942EE00"><enum>(1)</enum><text>any Federal public land administered by the agency head that was closed to recreational fishing, sport hunting, or shooting at any time during the preceding year; and</text></paragraph><paragraph id="H884EC31D37374AD0BD8DF5289117EE3D"><enum>(2)</enum><text>the reason for the closure.</text></paragraph></subsection><subsection id="HA27BFB38A6C141A2BAD12677F06696E4"><enum>(g)</enum><header>Closures or significant restrictions of 640 or more acres</header><paragraph id="HD81E05754D5249A0B46509E9A0819302"><enum>(1)</enum><header>In general</header><text>Other than closures established or prescribed by land planning actions referred to in subsection (d) or emergency closures described in paragraph (3) of this subsection, a permanent or temporary withdrawal, change of classification, or change of management status of Federal public land that effectively closes or significantly restricts 640 or more contiguous acres of Federal public land to access or use for fishing or hunting or activities related to fishing, hunting, or both, shall take effect only if, before the date of withdrawal or change, the head of the Federal agency that has jurisdiction over the Federal public land—</text><subparagraph id="H849B51AE20A64201AC4463BAAC2DC761"><enum>(A)</enum><text>publishes appropriate notice of the withdrawal or change, respectively;</text></subparagraph><subparagraph id="HCF66331627304EE388F6494BD2682BDA"><enum>(B)</enum><text>demonstrates that coordination has occurred with a State fish and wildlife agency; and</text></subparagraph><subparagraph id="H43593864478D4DFF8E29CCE854411AE3"><enum>(C)</enum><text>submits to the Committee on Natural Resources of the House of Representatives and the Committee on Energy and Natural Resources of the Senate written notice of the withdrawal or change, respectively.</text></subparagraph></paragraph><paragraph id="HF8FF7D9A26654F4E8492092E51A7E5B1"><enum>(2)</enum><header>Aggregate or cumulative effects</header><text>If the aggregate or cumulative effect of separate withdrawals or changes effectively closes or significantly restricts 1,280 or more acres of land or water, such withdrawals and changes shall be treated as a single withdrawal or change for purposes of paragraph (1).</text></paragraph><paragraph id="HCACFB4AEC19A4E2395CE0D4F35756260"><enum>(3)</enum><header>Emergency closures</header><text>Nothing in this title prohibits a Federal land management agency from establishing or implementing emergency closures or restrictions of the smallest practicable area to provide for public safety, resource conservation, national security, or other purposes authorized by law. Such an emergency closure shall terminate after a reasonable period of time unless converted to a permanent closure consistent with this title.</text></paragraph></subsection><subsection id="HB7E39AEFE7074870AE687482F715715E"><enum>(h)</enum><header>National park service units not affected</header><text>Nothing in this title shall affect or modify management or use of units of the National Park System.</text></subsection><subsection id="H1881944BA9F247B3BAA23D14676D044F"><enum>(i)</enum><header>No priority</header><text>Nothing in this title requires a Federal land management agency to give preference to recreational fishing, hunting, or shooting over other uses of Federal public land or over land or water management priorities established by Federal law.</text></subsection><subsection id="H0AD2B78BBC7C41BB87DF3E81E825618D"><enum>(j)</enum><header>Consultation with councils</header><text>In fulfilling the duties set forth in this title, the heads of Federal agencies shall consult with respective advisory councils as established in Executive Order Nos. 12962 and 13443.</text></subsection><subsection id="H1000C3D309B04229AE7F07153E3BE422"><enum>(k)</enum><header>Authority of the States</header><paragraph id="H9E85C4B2C81E49ACA11A1D21288AA1C6"><enum>(1)</enum><header>In general</header><text>Nothing in this title shall be construed as interfering with, diminishing, or conflicting with the authority, jurisdiction, or responsibility of any State to exercise primary management, control, or regulation of fish and wildlife under State law (including regulations) on land or water within the State, including on Federal public land.</text></paragraph><paragraph id="H722557FA33E14E8CAAED237B74457F16"><enum>(2)</enum><header>Federal licenses</header><text>Nothing in this title shall be construed to authorize the head of a Federal agency head to require a license, fee, or permit to fish, hunt, or trap on land or water in a State, including on Federal public land in the States, except that this paragraph shall not affect the Migratory Bird Stamp requirement set forth in the Migratory Bird Hunting and Conservation Stamp Act (<external-xref legal-doc="usc" parsable-cite="usc/16/718">16 U.S.C. 718 et seq.</external-xref>).</text></paragraph></subsection></section></title></legis-body></bill>
