concerned</action-desc></action><legis-type>A BILL</legis-type><official-title>To establish a Water Infrastructure Investment Trust Fund, and for other purposes.</official-title></form><legis-body id="H8EB2106370A94501A737554149C47B24" style="OLC"><section id="H254B9C10F13B464C877118E383C0B6BF" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Water Trust Fund Act of 2013</short-title></quote>.</text></section><section id="HA13F151C38B04B6384238E83D691A22A"><enum>2.</enum><header>Establishment and funding of Water Infrastructure Investment Trust Fund</header><subsection id="HC582BF9430514428AB92CF7C7A2B350C"><enum>(a)</enum><header>Water Infrastructure Investment Trust Fund</header><paragraph id="H52D456F8AE0D48FEA784EB78785AE14F"><enum>(1)</enum><header>In general</header><text>Subchapter A of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/26/98">chapter 98</external-xref> of the Internal Revenue Code of 1986 (relating to establishment of trust funds) is amended by adding at the end the following new section:</text><quoted-block display-inline="no-display-inline" id="H4DE2639491394E34A51AD6E8B5634861" style="OLC"><section id="H24034738B6DD41EA97D416CDE6E836C4"><enum>9512.</enum><header>Water Infrastructure Investment Trust Fund</header><subsection id="HCDA62868355C4619ADC522BF7E1F3465"><enum>(a)</enum><header>Creation of trust fund</header><text>There is established in the Treasury of the United States a trust fund to be known as the <quote>Water Infrastructure Investment Trust Fund</quote>, consisting of such amounts as may be appropriated or credited to such fund as provided in this section or section 9602(b).</text></subsection><subsection id="H76D54554530542359F410D5F07AE047F"><enum>(b)</enum><header>Transfers to trust fund</header><text display-inline="yes-display-inline">There are hereby appropriated to the Water Infrastructure Investment Trust Fund amounts equivalent to the fees received in the Treasury before January 1, 2019, under section 2(b) of the <short-title>Water Infrastructure Investment Act of 2013</short-title>.</text></subsection><subsection id="H8AB9C19ED10F4A06920635C73302F165"><enum>(c)</enum><header>Expenditures</header><text display-inline="yes-display-inline">Except as provided by subsection (d), amounts in the Water Infrastructure Investment Trust Fund shall be available, without further appropriation, as follows:</text><paragraph id="H8FD69E056A58448E9356AE2FFCE6C11B"><enum>(1)</enum><text>85 percent of the amounts shall be available to the Administrator of the Environmental Protection Agency for making capitalization grants under section 601 of the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1377">33 U.S.C. 1377</external-xref>).</text></paragraph><paragraph id="HB8F5AB24B60743D29D11E36105B344E0"><enum>(2)</enum><text display-inline="yes-display-inline">15 percent of the amounts shall be available to the Secretary of the Treasury for carrying out the innovative financing program established under section 3 of the <short-title>Water Infrastructure Investment Act of 2013</short-title>.</text></paragraph></subsection><subsection id="H6EE82538D5434EABBE245880E4CADBD9"><enum>(d)</enum><header>Limitation on expenditures</header><text display-inline="yes-display-inline">Amounts in the Water Infrastructure Investment Trust Fund may not be made available for a fiscal year unless the funds appropriated to the Clean Water State Revolving Fund through annual capitalization grants is not less than the average of the annual amounts provided in capitalization grants under section 601 of the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1381">33 U.S.C. 1381</external-xref>) for the 5-fiscal-year period immediately preceding such fiscal year.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="H33828F898C134335B60DFA2C9C5B6658"><enum>(2)</enum><header>Clerical amendment</header><text>The table of sections for subchapter A of chapter 98 of such Code is amended by adding at the end the following new item:</text><quoted-block display-inline="no-display-inline" id="H93B7DB5F92CB4E76B96E4F69B5D9C5B9" style="OLC"><toc container-level="quoted-block-container" idref="H4DE2639491394E34A51AD6E8B5634861" lowest-bolded-level="division-lowest-bolded" lowest-level="section" quoted-block="no-quoted-block" regeneration="yes-regeneration"><toc-entry idref="H24034738B6DD41EA97D416CDE6E836C4" level="section">Sec. 9512. Water Infrastructure Investment Trust Fund.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="HF628415DC09C451C8478D4D84FB88FB8"><enum>(b)</enum><header>Voluntary labeling system</header><paragraph id="HE5D5BC25B355464C90671F6338181984"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary of the Treasury, in consultation with the Administrator of the Food and Drug Administration, manufacturers, producers, and importers, shall develop and implement a program under which the Secretary provides a label designed in consultation with manufacturers, producers, and importers suitable for placement on products to inform consumers that the manufacturer, producer, or importer of the product, and other stakeholders, participates in the Water Infrastructure Investment Trust Fund and is contributing to America’s clean water.</text></paragraph><paragraph id="H9505ABBF93004F4894A3F48B9123A1FF"><enum>(2)</enum><header>Fee</header><text>The Secretary shall provide a label for a fee of three cents per unit. Amounts received by the Secretary shall be deposited in the general fund of the Treasury.</text></paragraph></subsection><subsection id="H1BEA7754687040C186038B63A18300A4"><enum>(c)</enum><header>Effective date</header><text>The amendments made by this section shall apply to taxable years beginning after the date of the enactment of this Act.</text></subsection></section><section id="HF25598EE6A364F97A6A0B495F6BE7E7C"><enum>3.</enum><header>Establishment of innovative financing program</header><subsection id="H0434A8CDD58845EBA278A1BAFF255B73"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary of the Treasury shall establish an innovative financing program to make financial assistance available for projects eligible under section 603(c) of the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1383">33 U.S.C. 1383(c)</external-xref>).</text></subsection><subsection id="H52CD5D0C697C48DB92B7310DEA25E145"><enum>(b)</enum><header>Use of TIFIA program as model</header><text>The Secretary shall model the program after the Transportation Infrastructure Finance and Innovation Act of 1998 (TIFIA) program established in <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/23/6">chapter 6</external-xref> of title 23, United States Code.</text></subsection><subsection id="H50D0A59762534E2BABF70527ABF23A19"><enum>(c)</enum><header>Funding</header><text display-inline="yes-display-inline">The Secretary shall carry out this section using funds made available for that purpose out of the Water Infrastructure Investment Trust Fund.</text></subsection></section></legis-body></bill>
