R. 3578</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action><action-date date="20131121">November 21, 2013</action-date><action-desc><sponsor name-id="L000554">Mr. LoBiondo</sponsor> (for himself, <cosponsor name-id="L000560">Mr. Larsen of Washington</cosponsor>, <cosponsor name-id="B001275">Mr. Bucshon</cosponsor>, <cosponsor name-id="G000546">Mr. Graves of Missouri</cosponsor>, <cosponsor name-id="L000563">Mr. Lipinski</cosponsor>, and <cosponsor name-id="M001181">Mr. Meehan</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HPW00">Committee on Transportation and Infrastructure</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To ensure that any new or revised requirement providing for the screening, testing, or treatment of an airman or an air traffic controller for a sleep disorder is adopted pursuant to a rulemaking proceeding, and for other purposes.</official-title></form><legis-body id="HB7E451E0FF1D46B2A4934B64BA6524B1" style="OLC"><section id="HB12997594BDD4DDAA0B8FCE7EBA4F285" section-type="section-one"><enum>1.</enum><header>Medical certification requirements for airmen and air traffic controllers relating to sleep disorders</header><subsection id="H0CA6224C007144968336105175BF25F8"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary of Transportation may implement or enforce a requirement providing for the screening, testing, or treatment (including consideration of all possible treatment alternatives) of an airman or an air traffic controller for a sleep disorder only if the requirement is adopted pursuant to a rulemaking proceeding.</text></subsection><subsection id="HA615A82D8E2B40F591D17752CDFD1185"><enum>(b)</enum><header>Applicability</header><text display-inline="yes-display-inline">Subsection (a) shall not apply to a requirement that was in force before November 1, 2013.</text></subsection><subsection id="HAA747AD43A344416AF56B1A8A037C25B"><enum>(c)</enum><header>Definitions</header><text>In this section, the following definitions apply:</text><paragraph id="H9E850A8F50D448728CF14D941731014E"><enum>(1)</enum><header>Airman</header><text display-inline="yes-display-inline">The term <quote>airman</quote> has the meaning given that term in <external-xref legal-doc="usc" parsable-cite="usc/49/40102">section 40102(a)</external-xref> of title 49, United States Code.</text></paragraph><paragraph id="HBADED92C053044838049C061EB8C326E"><enum>(2)</enum><header>Air traffic controller</header><text display-inline="yes-display-inline">The term <quote>air traffic controller</quote> means a civilian employee of the Department of Transportation described in <external-xref legal-doc="usc" parsable-cite="usc/5/2109">section 2109</external-xref> of title 5, United States Code.</text></paragraph><paragraph id="H0182DFD53BB24069ADB0C0AA01995A0F"><enum>(3)</enum><header>Sleep disorder</header><text display-inline="yes-display-inline">The term <quote>sleep disorder</quote> includes obstructive sleep apnea.</text></paragraph></subsection></section></legis-body></bill>
