which was referred to the <committee-name committee-id="HGO00">Committee on Oversight and Government Reform</committee-name>, and in addition to the Committees on <committee-name committee-id="HIF00">Energy and Commerce</committee-name> and <committee-name committee-id="HHA00">House Administration</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title>To clarify the application of all laws, including the Patient Protection and Affordable Care Act, to the Federal Government and Congress, and for other purposes.</official-title></form><legis-body id="HC33FFABE74BB4421A92A951D1D79D416" style="OLC"><section id="H65A9B82C34C541DD8BB5B06B47C54810" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Fairness in Obamacare Act of 2013</short-title></quote>.</text></section><section id="HC7B520B4F9D7485E809A3A5BB3E2B10A"><enum>2.</enum><header>Application of general laws to Executive Branch and Congress</header><text display-inline="no-display-inline">Congress and the Executive Branch are expressly and equally bound by any Federal law which is intended to be broadly enforced upon the American people.</text></section><section id="H47CD63EEFA9748899F2B47C487164C03"><enum>3.</enum><header>Moving the President, Vice President, and appointed Federal workers into Exchange plans</header><subsection id="HFBCA0C2D8AA242A6A59B5568CDD75275"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 1312(d)(3)(D) of the Patient Protection and Affordable Care Act (<external-xref legal-doc="usc" parsable-cite="usc/42/18032">42 U.S.C. 18032(d)(3)(D)</external-xref>) is amended—</text><paragraph id="HFD533511CE57435DB92DD2E9E5373132"><enum>(1)</enum><text>in the heading, by inserting <quote><header-in-text level="subparagraph" style="OLC">and the President, Vice President, and appointed Federal workers</header-in-text></quote> after <quote><header-in-text level="subparagraph" style="OLC">Members of Congress</header-in-text></quote>;</text></paragraph><paragraph id="HF1F08494798B422E9573920684E20EAD"><enum>(2)</enum><text>in clause (i)—</text><subparagraph id="H29A2CA4352254DB0A782D53CA22E90B8"><enum>(A)</enum><text>by striking <quote>and congressional staff</quote> and inserting <quote>, congressional staff, and the President, the Vice-President, and appointed Federal workers</quote>; and</text></subparagraph><subparagraph id="HAA1BB1105EA74AD6B56B2B688386011D"><enum>(B)</enum><text>by striking <quote>or congressional staff</quote> and inserting <quote>, staff member, President, Vice President, or appointed Federal worker</quote>; and</text></subparagraph></paragraph><paragraph id="H1479FBF863CD4B08A8331FD83D472580"><enum>(3)</enum><text>by adding at the end of clause (ii) the following new subclause:</text><quoted-block display-inline="no-display-inline" id="HFD18C1DA5B784ABAAFD03796BAAF74E8" style="OLC"><subclause id="HF1EB4509589940CDBB496B7968E694BB"><enum>(III)</enum><header>Appointed Federal worker</header><text display-inline="yes-display-inline">The term <term>appointed Federal worker</term> means any individual who—</text><item id="H35728DFB7B334151914319E5472C36F8"><enum>(aa)</enum><text>is employed in a position listed in sections 5312 through 5316 of title 5, United States Code (relating to the Executive Schedule);</text></item><item id="H73188C3477D14E11BBC14C0A0CFBD00F"><enum>(bb)</enum><text>is a limited term appointee, limited emergency appointee, or noncareer appointee in the Senior Executive Service, as defined under paragraphs (5), (6), and (7), respectively, of section 3132(a) of such title; or</text></item><item id="HDB7146A6BBBA4E8B896D6E266BAD9528"><enum>(cc)</enum><text>is employed in a position in the executive branch of the Government of a confidential or policy-determining character under schedule C of subpart C of part 213 of title 5 of the Code of Federal Regulations.</text></item></subclause><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H49E36CBB12C742EE8DB1544E5EFC9E45"><enum>(b)</enum><header>Maintaining current FEHBP coverage of annuitants</header><text>Nothing in the amendments made by subsection (a) shall be construed as affecting the continued coverage of annuitants under health benefits plans under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/89">chapter 89</external-xref> of title 5, United States Code, as in effect as of the date of the enactment of this Act.</text></subsection></section></legis-body></bill>
