which was referred to the <committee-name committee-id="HJU00">Committee on the Judiciary</committee-name>, and in addition to the <committee-name committee-id="">Select Committee on Intelligence (Permanent Select)</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title>To amend title 18, United States Code, to provide increased protections for consumer or subscriber password information, and to amend the Foreign Intelligence Surveillance Act of 1978 to provide that the Director of the Federal Bureau of Investigation may not access password information pursuant to an order under section 501 of that Act, and for other purposes.</official-title></form><legis-body id="HD2C9995258A747FBB3E95ED7751D182E" style="OLC"><section id="HD31FBF5BA15F43E38FAFFA50CAB8C4B6" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Reasonable Expectation of American Privacy Act of 2013</short-title></quote> or the <quote><short-title>REAP Act of 2013</short-title></quote>.</text></section><section id="H5E8F7E2374164D1A9F6C54B91C2D23DC"><enum>2.</enum><header>Increased protections relating to voluntary disclosure of password information</header><text display-inline="no-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/18/2702">Section 2702</external-xref> of title 18, United States Code, is amended—</text><paragraph id="H3856CA56C44346979729E1960C24D847"><enum>(1)</enum><text>in subsection (a)—</text><subparagraph id="HD3ACC945963D455B8C566CB582BC1818"><enum>(A)</enum><text>in the matter preceding paragraph (1), by striking <quote>subsection (b) or (c)</quote> and inserting <quote>subsection (b), (c), or (d)</quote>;</text></subparagraph><subparagraph id="HA3EBA337191549B7B378835380487D1D"><enum>(B)</enum><text>in paragraph (2), by striking <quote>and</quote> at the end;</text></subparagraph><subparagraph id="HB6E06F6F965E41C19B54CD6A9470F174"><enum>(C)</enum><text>in paragraph (3)—</text><clause id="HA42E0B72DF164977BE40D22D90C437AC"><enum>(i)</enum><text>by inserting after <quote>(not including the contents of communications covered by paragraph (1) or (2)</quote> the following: <quote>, or the password information covered by paragraph (4)</quote>; and</text></clause><clause id="H1D70340945454D62A6900FA06E908478"><enum>(ii)</enum><text>by striking the period at the end and inserting <quote>; and</quote>; and</text></clause></subparagraph><subparagraph id="HB86A92B52B2B4E99BA8FB20B97A71DEB"><enum>(D)</enum><text>by inserting after paragraph (3) the following:</text><quoted-block display-inline="no-display-inline" id="HB3CE17D9463D4ABE867190D9E122294E" style="USC"><paragraph id="H96B401A99D124E748605091439967A8E"><enum>(4)</enum><text display-inline="yes-display-inline">a person or entity providing an electronic communication service or a remote computing service to the public shall not knowingly divulge to any person or entity the password information pertaining to a subscriber or customer of such service.</text></paragraph><after-quoted-block>; </after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="H3D4EB9B233A14FBB91415BEECE5A2C1B"><enum>(2)</enum><text>in subsection (c), by inserting after <quote>(not including the contents of communications covered by subsection (a)(1) or (2)</quote> the following: <quote>, or the password information covered by subsection (a)(4)</quote>;</text></paragraph><paragraph id="H78B2756F43184855A2C3552C5A872696"><enum>(3)</enum><text>by redesignating subsection (d) as subsection (e);</text></paragraph><paragraph id="HCB532A110E4A4EDABCA55C3E77049E0D"><enum>(4)</enum><text>by inserting after subsection (c) the following:</text><quoted-block display-inline="no-display-inline" id="HD2FDC154719242E591D5A5D2A50238A5" style="USC"><subsection id="H7E60AEAC5CF548ECB7450F920623360E"><enum>(d)</enum><header>Exceptions for Disclosure of Password Information</header><text display-inline="yes-display-inline">A provider described in subsection (a) may divulge the password information pertaining to a subscriber or customer of such service—</text><paragraph commented="no" id="H5ACE760CEE864F978453F7385C4B65A4"><enum>(1)</enum><text>as otherwise authorized in 2703 of this title;</text></paragraph><paragraph id="H1A2F6EF5547D44308982FA5A83A51E84"><enum>(2)</enum><text>with the lawful consent of the subscriber or customer;</text></paragraph><paragraph id="H051E8424A3F74331806DBB1A48CD8269"><enum>(3)</enum><text>as may be necessarily incident to the rendition of the service or to the protection of the rights or property of the provider of that service;</text></paragraph><paragraph id="H1FB6315BD4CA4126AB97B09D4F0D185E"><enum>(4)</enum><text>to the National Center for Missing and Exploited Children, in connection with a report submitted thereto under section 2258A; or</text></paragraph><paragraph id="HB50A03C6E18A4D5399B62F7094E692DC"><enum>(5)</enum><text>to a governmental entity, if the provider, in good faith, believes that an emergency involving danger of death or serious physical injury to any person requires disclosure without delay of password information relating to the emergency.</text></paragraph></subsection><after-quoted-block>; and </after-quoted-block></quoted-block></paragraph><paragraph id="HEA63BA6F4FDA4AA6BA67B08AE005261B"><enum>(5)</enum><text>in subsection (e), as so redesignated, by inserting after <quote>subsection (b)(8)</quote> each place it appears, the following: <quote>or (d)(5)</quote>.</text></paragraph></section><section id="H2D633A5DC0424DB4B969B5C9B73EBB35"><enum>3.</enum><header>Increased protections relating to required disclosure of customer communications and password information</header><subsection id="H5D4A4BF07AAC45B39B6A99A44DB7DE37"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/18/2703">Section 2703</external-xref> of title 18, United States Code, is amended—</text><paragraph id="H62AEEA6CA28044B4B95A335DA09FD348"><enum>(1)</enum><text>in subsection (a)—</text><subparagraph id="HE592AEF6F2E046F4B07F778B1DAF2982"><enum>(A)</enum><text>in the first sentence, by inserting after <quote>A governmental entity may require the disclosure by a provider of electronic communication service</quote> the following: <quote>or remote computing service</quote>;</text></subparagraph><subparagraph id="H782EC9E77DA14AB697CA9A7F55F4D42E"><enum>(B)</enum><text>by striking <quote>in an electronic communications system for one hundred and eighty days or less</quote>; and</text></subparagraph><subparagraph id="H11B533B261234AFFB5F333DB94653375"><enum>(C)</enum><text>by striking the second sentence;</text></subparagraph></paragraph><paragraph id="H21AB6A25CAB24D2284A0E1D6B5EA8C6B"><enum>(2)</enum><text display-inline="yes-display-inline">by amending subsection (b) to read as follows:</text><quoted-block display-inline="no-display-inline" id="HD7EE1E2885624FF7A3A4CF5DECBC92F0" style="USC"><subsection id="H05CEC776F0C14DE6976ADBA685032F44"><enum>(b)</enum><header>Password information</header><text display-inline="yes-display-inline">A governmental entity may require a provider of electronic communication service or remote computing service to disclose the password information pertaining to a subscriber or customer of such service only pursuant to a warrant issued using the procedures described in the Federal Rules of Criminal Procedure (or in the case of a State court, issued using State warrant procedures) by a court of competent jurisdiction.</text></subsection><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph id="HC3AE0E1632A24D9DB2E5DA59016F33AB"><enum>(3)</enum><text>in subsection (c)(1), by inserting after <quote>(not including the contents of communications</quote> the following: <quote>or the password information pertaining to a subscriber or customer of such service</quote>; and</text></paragraph><paragraph id="HABAFFAA514CC463CAC1357B4EEF97AA8"><enum>(4)</enum><text>in subsection (d), by striking <quote>subsection (b) or (c)</quote> and inserting <quote>subsection (c)</quote>.</text></paragraph></subsection><subsection id="HB709EE3681B74B96B5683C319D0EE5E7"><enum>(b)</enum><header>Conforming amendments</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/121">Chapter 121</external-xref> of title 18, United States Code, is amended—</text><paragraph id="HBEC7DDB5DDC8462AA27BA20CB747BBAD"><enum>(1)</enum><text>in section 2701(c)(3), by striking <quote>, 2704,</quote>;</text></paragraph><paragraph id="HE5FCD5DD7C7C4E799E9907FFFC37AFDB"><enum>(2)</enum><text>by repealing sections 2704 and 2705; and</text></paragraph><paragraph id="H4E42A538BF2A4D6B941CD1F9775CB74A"><enum>(3)</enum><text>in section 2706, by striking <quote>section 2702, 2703, or 2704</quote> and inserting <quote>section 2702 or 2703</quote>.</text></paragraph></subsection></section><section id="H74FA4867B8C7470AAA86B1234B174013"><enum>4.</enum><header>Password information excluded from transactional records available pursuant to a counterintelligence request</header><text display-inline="no-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/18/2709">Section 2709</external-xref> of title 18, United States Code, is amended by inserting after subsection (f), the following:</text><quoted-block display-inline="no-display-inline" id="H8B14DE95C58E48B7B7F4483FBAE4F5F5" style="USC"><subsection id="HEE5632D02C404B20AD552F9AE39E2042"><enum>(g)</enum><header>Password information</header><text display-inline="yes-display-inline">A request made pursuant to subsection (b) for electronic communication transactional records may not include a request for the password information pertaining to a subscriber or customer of a provider of electronic communication service or remote computing service.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="H5D71FCA65AA845D6981C24FFB37FBB1D"><enum>5.</enum><header>Password information excluded from tangible things required to be produced through a FISA court order</header><text display-inline="no-display-inline">Section 501(a)(1) of the Foreign Intelligence Surveillance Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/50/1861">50 U.S.C. 1861(a)(1)</external-xref>) is amended by inserting after <quote>tangible things (including books, records, papers, documents, and other items</quote> the following: <quote>, but not including password information pertaining to a customer or subscriber of a provider of electronic communication service or remote computing service (as such terms are defined in section 2510 and 2711 of title 18, United States Code, respectively)</quote>.</text></section></legis-body></bill>
