<section id="HE5643AA8E05B4D368A45B1433EA095BE" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Emergency Response Improvement Act</short-title></quote>.</text></section> 
<section id="H22E4CA49DDDE428BB7F929726B436CF2" section-type="subsequent-section"><enum>2.</enum><header>State offices of emergency management</header> 
<subsection id="H20FC70C2B829473C89C7FF5B8DDFB180"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">To be eligible for assistance under the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5121">42 U.S.C. 5121 et seq.</external-xref>) on or after October 1, 2014, the chief executive officer of a State shall be required to maintain a State Office of Emergency Management. </text></subsection> 
<subsection id="H40BA7EAC5CE947D994ACE9792A1698F8"><enum>(b)</enum><header>Duties</header><text display-inline="yes-display-inline">The State Office of Emergency Management referred to in subsection (a)—</text> 
<paragraph id="H6DD27242B55F461282B06A3BBEB7F8C1"><enum>(1)</enum><text>shall coordinate the State response to an emergency; and</text></paragraph> 
<paragraph id="HD9B952BDDA604F10A5134834434D0BA6"><enum>(2)</enum><text>may request Federal assistance with respect to an emergency.</text></paragraph></subsection></section> 
<section id="H041D50466A65407280147A913433137C"><enum>3.</enum><header>Emergency response</header> 
<subsection id="HAC560F49130342E8BB09F8E1BFBD70CC"><enum>(a)</enum><header>Federal incident commander</header><text display-inline="yes-display-inline">If one or more Federal departments or agencies provides assistance to a State in response to an emergency, the President shall designate an individual from one such department or agency to serve as the Federal incident commander for that emergency.</text></subsection> 
<subsection id="H5B38EFFC968F4E98A377D5790E375B18"><enum>(b)</enum><header>Functions</header><text>As soon as practicable after designation under subsection (a), a Federal incident commander shall—</text> 
<paragraph id="H86DB0EC6E7F44300A246CBC63B3110F1"><enum>(1)</enum><text>meet with representatives of Federal, State, and local entities involved in the response to the emergency; and</text></paragraph> 
<paragraph id="H6C538162218049CDB1642E22DBB61A54"><enum>(2)</enum><text>assist such representatives in—</text> 
<subparagraph id="H0FC16D214B7141E29FAE478F7815F128"><enum>(A)</enum><text>creating a plan to respond to the emergency that specifies the responsibilities of each entity involved in the response; </text></subparagraph> 
<subparagraph id="H521922F20A6E436983100C324A569444"><enum>(B)</enum><text>designating an individual to lead the response; and</text></subparagraph> 
<subparagraph id="H58EDD786FE2A4E9783785AC3C3E1CDCD"><enum>(C)</enum><text>drafting and executing a memorandum of understanding with respect to the plan described in subparagraph (A) that describes the responsibilities of each entity involved in the response.</text></subparagraph></paragraph> </subsection> 
<subsection id="H2D3C4B0D718B4188AC6267BB79FBD571"><enum>(c)</enum><header>Failure To agree</header><text display-inline="yes-display-inline">In the absence of a memorandum of understanding described in subsection (b)(2)(C), the Federal incident commander shall report to the President or the President’s designee and recommend if, and to what extent, the relevant Federal departments or agencies should be involved in the response to the emergency.</text></subsection></section> 
<section id="H4683EBC144D74B1385C7EDC1250DF120"><enum>4.</enum><header>Effect</header><text display-inline="no-display-inline">Nothing in this Act shall be construed to limit, expand, or change any authority granted to a Federal, State, or local entity to respond to an emergency under Federal, State, or local law.</text></section> 
<section id="HBB306CD42B7648D0974F885BC9EF4798"><enum>5.</enum><header>Definitions</header> 
<subsection id="H9AB567BAA11F47EDA1C018291F6232E2"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">In this Act, the terms <term>emergency</term>, <term>Indian tribal government</term>, and <term>State</term> have the meanings given such terms in section 102 of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5122">42 U.S.C. 5122</external-xref>).</text></subsection> 
<subsection id="H0F4DB977CB0C4BF5B84061886D41650C"><enum>(b)</enum><header>Treatment of Indian tribal governments</header><text>For the purposes of this Act, any reference to <quote>State</quote> shall be treated as a reference also to <quote>Indian tribal government</quote>. </text></subsection></section>
