<section id="H194F59F64CAD4C21A6D8FABA5B2ED80E" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Railway Inspection and Transparency Act</short-title></quote>. </text></section>
<section id="HA1A791C467D844528968484184B33B11"><enum>2.</enum><header>Inspection of railroad facilities</header> 
<subsection id="H274B3C9EC5114245A395FF5ED53E4BC5"><enum>(a)</enum><header>Requirement</header><text display-inline="yes-display-inline">The Federal Railroad Administration shall require each railroad carrier to arrange for an independent inspection by a professional engineer of—</text> 
<paragraph id="HEF9CDF1EF9FE4F04A0B01ABAFDE1AD0D"><enum>(1)</enum><text>all railroad bridges owned or leased by that railroad carrier at least once every 2 years; and</text></paragraph> 
<paragraph id="H09C4B48D21654ACAB893A234A1C35E38"><enum>(2)</enum><text display-inline="yes-display-inline">all railroad signals and switches owned or leased by that railroad carrier at least once every 6 months.</text></paragraph></subsection> 
<subsection id="H5F715AE4D36C4E039BEB1EDA3E01880F"><enum>(b)</enum><header>Documentation</header><text display-inline="yes-display-inline">Each railroad carrier shall provide to the Federal Railroad Administration documentation of the results of inspections carried out under subsection (a). The Federal Railroad Administration shall make such documentation available to the public.</text></subsection> 
<subsection id="HA3A863450494446B8DF5F478DD232971"><enum>(c)</enum><header>Definitions</header><text>In this section:</text> 
<paragraph id="H168DB5FCBAB7413DB69236ACB31F8C37"><enum>(1)</enum><header>Independent inspection</header><text display-inline="yes-display-inline">The term <quote>independent inspection</quote> means an inspection conducted by a professional engineer that is not employed by the railroad carrier or the Federal Railroad Administration.</text></paragraph> 
<paragraph id="H496E367E9C4D4F958BFDD551367F2A98"><enum>(2)</enum><header>Professional engineer</header><text display-inline="yes-display-inline">The term <quote>professional engineer</quote> means an individual who—</text> 
<subparagraph id="H7ACBDD7253254B02A1343230ADBEF646"><enum>(A)</enum><text>is currently registered as a professional engineer or structural engineer by a State, the District of Columbia, or a territory, commonwealth, or possession of the United States; and</text></subparagraph> 
<subparagraph id="HC27E479703B646C79DCB0B6B42B0E75D"><enum>(B)</enum><text>has expertise in railroad operations.</text></subparagraph></paragraph> 
<paragraph id="HAEB628C11B41444E91512F23686E2AC6"><enum>(3)</enum><header>Railroad carrier</header><text>The term <quote>railroad carrier</quote> has the meaning given that term in <external-xref legal-doc="usc" parsable-cite="usc/49/20102">section 20102</external-xref> of title 49, United States Code.</text></paragraph></subsection></section>
