Maloney of New York</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HBA00">Committee on Financial Services</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To permanently extend the Protecting Tenants at Foreclosure Act of 2009 and establish a private right of action to enforce compliance with such Act.</official-title></form><legis-body id="HABC7912B6FE24685B32103D3D66F6F49" style="OLC"><section id="H1E241A01E261482AAA471907FCDEEDE7" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Permanently Protecting Tenants at Foreclosure Act of 2013</short-title></quote>.</text></section><section id="H7E73BB2B0B584473A5FC10F4E9DDB311"><enum>2.</enum><header>Repeal of sunset provision</header><text display-inline="no-display-inline">Section 704 of the Protecting Tenants at Foreclosure Act of 2009 (<external-xref legal-doc="usc" parsable-cite="usc/12/5201">12 U.S.C. 5201</external-xref> note; <external-xref legal-doc="usc" parsable-cite="usc/12/5220">12 U.S.C. 5220</external-xref> note; <external-xref legal-doc="usc" parsable-cite="usc/42/1437f">42 U.S.C. 1437f</external-xref> note) is hereby repealed.</text></section><section id="HF0CA9EACC3054270B263DFCD730ECC5E"><enum>3.</enum><header>Private right of action</header><text display-inline="no-display-inline">The Protecting Tenants at Foreclosure Act of 2009, as amended by section 2 of this Act, is further amended by adding at the end the following new section:</text><quoted-block id="H5F0E02B3447A4142B2BA6DC7549B7D8A" style="OLC"><section id="HD9E93AFDC4614E2FA43561FB0B9BA65E"><enum>704.</enum><header>Private right of action</header><subsection id="H5A47415444494AFBB64573822DA96156"><enum>(a)</enum><header>Right of action</header><text>Any person aggrieved by a violation referred to in subsection (b) may bring a civil action in a court of competent jurisdiction for damages resulting from such violation, and may obtain other appropriate relief, including equitable relief. If the plaintiff prevails in any such action, the court shall award the plaintiff any litigation costs reasonably incurred, together with reasonable attorneys’ fees and reasonable expert witness fees, as determined by the court.</text></subsection><subsection id="H4741018B51314383BBAECCF073CF8719"><enum>(b)</enum><header>Violation</header><text>A violation referred to in this subsection is a violation of—</text><paragraph id="H787457381A3C43C19CCB19D572D62E79"><enum>(1)</enum><text>section 702 of this title; or</text></paragraph><paragraph id="HC616A18BFEF1418EBA7B0C926532EE8B"><enum>(2)</enum><text>the matter in subparagraph (C) or (F) of section 8(o)(7) of the United States Housing Act of 1937 (<external-xref legal-doc="usc" parsable-cite="usc/42/1437f">42 U.S.C. 1437f(o)(7)</external-xref>) that was added by the amendments made by section 703 of this title.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body></bill>
