which was referred to the <committee-name committee-id="HBA00">Committee on Financial Services</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To provide exemptions from certain mortgage, servicing, and appraisal requirements for non-profit low-income housing providers, and for other purposes.</official-title></form><legis-body id="H40045977214D48109FC251C1B4E68CF4" style="OLC"><section id="H58D9E69ECE044B04B43C1428FAF0B1CC" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Protecting Habitat Homeownership Act</short-title></quote>.</text></section><section id="H380F4E0DD3A44E269DBD4AEB1561D6AA"><enum>2.</enum><header>Exemptions</header><subsection id="HD1C5AD96C1C74316AEEB12F925FE471A"><enum>(a)</enum><header>Truth in Lending Act</header><text display-inline="yes-display-inline">The Truth in Lending Act (<external-xref legal-doc="usc" parsable-cite="usc/15/1601">15 U.S.C. 1601 et seq.</external-xref>) is amended—</text><paragraph id="H30DD6E324B834F7E809C29361F6E7808"><enum>(1)</enum><text>in section 128(f) (<external-xref legal-doc="usc" parsable-cite="usc/15/1638">15 U.S.C. 1638(f)</external-xref>)—</text><subparagraph id="H30E5E49368B5482CA48D4F77FD005C74"><enum>(A)</enum><text>in paragraph (3)—</text><clause id="H53DCE58625D24EE8879B83E9FE5DECE5"><enum>(i)</enum><text>by striking <quote>apply to any fixed rate</quote> and inserting the following:</text><quoted-block display-inline="yes-display-inline" id="HF1412E777EF34030A51DC34B02F2EDC2" style="OLC"><text>apply to—</text><subparagraph id="HBF4CA354539C471D89D39914990F8BDF"><enum>(A)</enum><text display-inline="yes-display-inline">any fixed rate</text></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></clause><clause id="H6BE78F9D22734F1BBDE82CBDAFB9AF4C"><enum>(ii)</enum><text>by striking the period and inserting <quote>; or</quote>; and</text></clause><clause id="H3860C59F6C9648DE96A5B589144CEDA1"><enum>(iii)</enum><text>by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="H8CDD4838F9C6498C857AB7E3D8117EFF" style="OLC"><subparagraph id="HFED4C620127E4CD6B538FFBD791A1B15"><enum>(B)</enum><text display-inline="yes-display-inline">any residential mortgage loan originated by a non-profit low-income housing provider.</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></clause></subparagraph><subparagraph id="H5D8FD8C82E5F43EB8787176967B56AE4"><enum>(B)</enum><text>by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="HC482395FCC764DEAB40B8E643D0F2C75" style="OLC"><paragraph id="H137043BF280A43BD9F61668E84DC703B"><enum>(4)</enum><header>Non-profit low-income housing provider defined</header><text>For purposes of this subsection, the term <quote>non-profit low-income housing provider</quote> means an organization that—</text><subparagraph id="HC4F9AAE000944C3E98220462B4FE6A68"><enum>(A)</enum><text display-inline="yes-display-inline">is exempt from taxation pursuant to <external-xref legal-doc="usc" parsable-cite="usc/26/501">section 501(c)(3)</external-xref> of the Internal Revenue Code of 1986;</text></subparagraph><subparagraph id="HAEC9B5DB712A41AD85689083373C58FE"><enum>(B)</enum><text display-inline="yes-display-inline">makes residential mortgage loans—</text><clause id="H7A820465C4E744A79EBADA94E25B46A6"><enum>(i)</enum><text>for the purpose of promoting or facilitating homeownership for poor or low-income, disabled, or other disadvantaged persons or families; and</text></clause><clause id="H77B20C187D1545C9A90A4E2A10733096"><enum>(ii)</enum><text>sets interest rates on such loans that—</text><subclause id="H4272400532694F9285DA57A6EDC1D625"><enum>(I)</enum><text>are lower than the bank prime loan rate, as determined under the Federal Reserve Statistical Release of selected interest rates (commonly referred to as the H.15) by the Board of Governors of the Federal Reserve System, for the last day of the most recent weekly release of such rates; or</text></subclause><subclause id="H3A9FB5EE44824E2F92EE1769B268B10E"><enum>(II)</enum><text>are, after adjusting for inflation, no-interest loans or loans with interest rates significantly below the interest rates for loans for purchase of single-family housing generally available in the market;</text></subclause></clause></subparagraph><subparagraph id="H04BB289F4E564997BF87437E3A1F2C78"><enum>(C)</enum><text display-inline="yes-display-inline">except as described under subparagraph (B), does not engage in the business of a loan originator or mortgage broker;</text></subparagraph><subparagraph id="H127FBA6AAEBA42D0A40A406CA2992F10"><enum>(D)</enum><text display-inline="yes-display-inline">conducts its activities in a manner that serves public or charitable purposes;</text></subparagraph><subparagraph id="H25EE0CFA278D4E529582BBE35C1471F9"><enum>(E)</enum><text>receives funding and revenue and charges fees in a manner that does not incentivize the organization or its employees to act other than in the best interests of its clients;</text></subparagraph><subparagraph id="H5253E3953C724A3E93C83DA6BC69DF68"><enum>(F)</enum><text>compensates employees in a manner that does not incentivize employees to act other than in the best interests of its clients; and</text></subparagraph><subparagraph id="H11D4F520486C4216A5B5CA892DFAE0DB"><enum>(G)</enum><text>meets such other requirements as the Bureau determines appropriate.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="H714BD13332F149D4987B10A887F9E403"><enum>(2)</enum><text display-inline="yes-display-inline">in section 129C(a) (<external-xref legal-doc="usc" parsable-cite="usc/15/1639c">15 U.S.C. 1639c(a)</external-xref>), by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="H6E704E3B870D416EB5B1EF1B1A1F2F74" style="OLC"><paragraph id="H52A7A777AC3947819C99332C378FBFA8"><enum>(10)</enum><header>Exemption for non-profit low-income housing providers</header><text display-inline="yes-display-inline">This subsection shall not apply to a residential mortgage loan made by a non-profit low-income housing provider (as such term is defined under section 128(f)(4)).</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph id="HC355AD88CA364E9C90F0CC6CDB631041"><enum>(3)</enum><text display-inline="yes-display-inline">in section 129E (<external-xref legal-doc="usc" parsable-cite="usc/15/1638e">15 U.S.C. 1638e</external-xref>), by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="H5ACC29CB6C584EFF8B831BBAD8D3A6D7" style="OLC"><subsection id="H6AB54F4DCE97493FA30F91672DF9E1F1"><enum>(l)</enum><header>Exemption for non-Profit low-Income housing providers</header><text display-inline="yes-display-inline">This section shall not apply to a residential mortgage loan made by a non-profit low-income housing provider (as such term is defined under section 128(f)(4)), or any services provided with respect to such a mortgage loan.</text></subsection><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="H1873D51ABFFB4974996E78C1223D7923"><enum>(4)</enum><text display-inline="yes-display-inline">in section 129H (<external-xref legal-doc="usc" parsable-cite="usc/15/1638h">15 U.S.C. 1638h</external-xref>), by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="H55895C4EBF074108B119F2ACF6EE6CEE" style="OLC"><subsection id="H506E783F6AAC450697783C21CBDBD991"><enum>(g)</enum><header>Exemption for non-Profit low-Income housing providers</header><text display-inline="yes-display-inline">This section shall not apply to a residential mortgage loan made by a non-profit low-income housing provider (as such term is defined under section 128(f)(4)).</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="HC4A324C7A62E4DCC921093D4478F93C9"><enum>(b)</enum><header>Real Estate Settlement Procedures Act of 1974</header><text display-inline="yes-display-inline">Section 6(k) of the Real Estate Settlement Procedures Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/12/2605">12 U.S.C. 2605(k)</external-xref>) is amended by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="HE8841B7B38E142BEA0B24D3F9DBBAFB8" style="OLC"><paragraph id="HB53945ED7553474BAC22758EC6EB3768"><enum>(3)</enum><header>Exemption for non-profit low-income housing providers</header><text display-inline="yes-display-inline">This subsection and subsections (l) and (m) shall not apply to the servicing of a residential mortgage loan made by a non-profit low-income housing provider (as such term is defined under section 128(f)(4) of the Truth in Lending Act).</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section></legis-body></bill>
