<official-title>To end the use of body-gripping traps in the National Wildlife Refuge System.</official-title>

<section id="HCF0FC1E263DC49C592242F152F226F2A" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Refuge from Cruel Trapping Act</short-title></quote>.</text></section> 
<section id="H3C1C91D2722B4476A384C555C69B79A7"><enum>2.</enum><header>Possession or use of body-gripping trap prohibited</header><text display-inline="no-display-inline">The National Wildlife Refuge System Administration Act of 1966 (<external-xref legal-doc="usc" parsable-cite="usc/16/668dd">16 U.S.C. 668dd et seq.</external-xref>) is amended by adding at the end the following:</text>

<section id="HD6B3858379974BCFAA10706E0418E1E9"><enum>6.</enum><header>Possession or use of body-gripping trap prohibited</header> 
<subsection id="HC6DFD3684E0A4B9B91548C8F68A17D30"><enum>(a)</enum><header>In general</header><text>No person may possess or use a body-gripping trap in the System.</text></subsection> 
<subsection id="HC86B075E9C62472F86A849B8480CD80F"><enum>(b)</enum><header>Enforcement provisions</header><text>Notwithstanding section 4(f), a person who possesses or uses a body-gripping trap in the System shall be subject to the following:</text> 
<paragraph id="H92380C892D4D4EF8B2B8A9A5BF99C959"><enum>(1)</enum><text>In the case of a first offense, a civil fine of not more than $500 imposed by the Secretary for each body-gripping trap possessed or used.</text></paragraph> 
<paragraph id="H92E1CA94D7DC48FE97EB0FA9C8A0D50E"><enum>(2)</enum><text>In the case of a subsequent offense—</text> 
<subparagraph id="H4A722091F7CE4107A3C68BFD91B7AED8"><enum>(A)</enum><text>a civil fine of not more than $1,000 imposed by the Secretary for each body-gripping trap possessed or used;</text></subparagraph> 
<subparagraph id="H0882A06D7E704E0A8B6DB9E4F88B0C53"><enum>(B)</enum><text>imprisonment for not more than 180 days; or</text></subparagraph> 
<subparagraph id="H85C28222342647D087C11CE42804166D"><enum>(C)</enum><text>both a civil fine and imprisonment in accordance with subparagraphs (A) and (B).</text></subparagraph></paragraph></subsection> 
<subsection id="H9D2F9753223446EFA3462936E49CE4F2"><enum>(c)</enum><header>Forfeiture of body-Gripping trap</header><text>Any body-gripping trap that is possessed or used in violation of this section, and any wildlife captured by the use of such trap, including the pelt or raw fur, shall be subject to forfeiture to the United States in accordance with the provisions of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/46">chapter 46</external-xref> of title 18, United States Code, relating to civil forfeitures.</text></subsection> 
<subsection id="HD43B1A86DE684B65B30B36F0EBD49E37"><enum>(d)</enum><header>Payment of court costs and other associated expenses</header><text>A person found to be in violation of subsection (a) shall pay all court costs associated therewith.</text></subsection> 
<subsection id="HD64B74F30F70418D97F7C5DFBA44030F"><enum>(e)</enum><header>Regulations</header><text>Not later than 120 days after the date of the enactment of this section, the Secretary shall issue any regulations necessary to carry out this section.</text></subsection> 
<subsection id="HCD3B8E53E4C241B8A9EA5F19DBD4AED6"><enum>(f)</enum><header>Definition</header><text>As used in this section, the term <term>body-gripping trap</term>—</text> 
<paragraph id="HA49B5C1F887D4F908D310C2CA7322CE3"><enum>(1)</enum><text>means any device that is intended to kill or capture wildlife by physically restraining any part of the animal;</text></paragraph> 
<paragraph id="HC7437E45D01F4140964DDA4FADF0E85D"><enum>(2)</enum><text>includes any steel-jaw, padded, or other modified leghold trap, kill-type trap, snare trap, or any modified version of any such trap; and</text></paragraph> 
<paragraph id="H404400FE027E44D4808F75A8EAE6EFB1"><enum>(3)</enum><text>does not include any cage or box trap or suitcase-type live beaver trap.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section>
