<official-title>To direct the Architectural and Transportation Barriers Compliance Board to develop accessibility guidelines for electronic instructional materials and related information technologies in institutions of higher education, and for other purposes.</official-title>

<section id="H452520A559124D72BF3F6500302CA8F2" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Technology, Equality and Accessibility in College and Higher Education Act</short-title></quote> or the <quote><short-title>TEACH Act</short-title></quote>.</text></section> 
<section id="HC533703CB0614677882A18664522ECC3" section-type="subsequent-section"><enum>2.</enum><header>Guidelines for accessible electronic instructional materials and related information technologies in institutions of higher education</header> 
<subsection id="HD620B43BBF194946B75F452002A8E8C9"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 18 months after the date of enactment of this Act, the Architectural and Transportation Barriers Compliance Board established pursuant to section 502 of the Rehabilitation Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/29/792">29 U.S.C. 792</external-xref>) (in this Act referred to as the <quote>Access Board</quote>) shall develop guidelines for the accessibility of electronic instructional materials and related information technologies in institutions of higher education. Such guidelines shall—</text> 
<paragraph id="H7F337DD16DC74E3395556CDF536AC4A6"><enum>(1)</enum><text display-inline="yes-display-inline">include performance criteria to ensure that such materials and technologies are accessible to covered blind individuals and covered individuals with a disability; and</text></paragraph> 
<paragraph id="HA82DFC4D4EDB4BB09E438BAF6B596AB1"><enum>(2)</enum><text display-inline="yes-display-inline">be consistent with the standards for technical and functional performance criteria issued pursuant to section 508(a)(2)(A)(ii) of the Rehabilitation Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/29/794d">29 U.S.C. 794d(a)(2)(A)(ii)</external-xref>).</text></paragraph> </subsection> 
<subsection id="H4DA385C005B74CEC94C268749A884835" commented="no"><enum>(b)</enum><header>Harmonization with national and international standards</header><text display-inline="yes-display-inline">The Access Board shall, to the extent practicable, ensure that the guidelines issued under subsection (a) are consistent with national and international accessibility standards for electronic instructional materials and related information technologies.</text></subsection> 
<subsection id="H07699195C07E412782BAA1AC57EFB552"><enum>(c)</enum><header>Review and amendment</header><text display-inline="yes-display-inline">Not later than 3 years after the effective date of the guidelines described in subsection (a), and every 3 years thereafter, the Access Board shall review and, as appropriate, amend such guidelines to reflect technological advances or changes in electronic instructional materials and related information technologies. </text></subsection></section> 
<section id="H2091F39EF66A46E9A19B36108164567A"><enum>3.</enum><header>Safe harbor protections</header><text display-inline="no-display-inline">Institutions of higher education that use electronic instructional materials and related information technologies that comply with the accessibility guidelines described in section 2 shall be deemed to be in compliance with the non-discrimination provisions section 504 of the Rehabilitation Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/29/794">29 U.S.C. 794</external-xref>) and titles II and III of the Americans with Disabilities Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/12131">42 U.S.C. 12131 et seq.</external-xref>, <external-xref legal-doc="usc" parsable-cite="usc/42/12181">42 U.S.C. 12181 et seq.</external-xref>) with respect to the use of such materials or technologies.</text></section> 
<section id="HC001338AAF884A0E8C6E5CDB80EB0005" commented="no"><enum>4.</enum><header>Noncompliant electronic instructional materials and related information technologies</header><text display-inline="no-display-inline">Nothing in this Act shall be construed to require an institution of higher education to use electronic instructional materials or related information technologies that conform to the accessibility guidelines described in section 2 if the institution of higher education provides such materials or technologies, or an accommodation or modification, that would allow covered blind individuals and covered individuals with a disability to receive the educational benefits of such materials or technologies—</text> 
<paragraph id="H3276E0BD6F214591B76BF3E9489B3D67" commented="no"><enum>(1)</enum><text>in an equally effective and equally integrated manner as non-disabled or non-blind students; and</text></paragraph> 
<paragraph id="H1C8D5A4156AA40A6BA015B4ECF355FFC" commented="no"><enum>(2)</enum><text>with substantially equivalent ease of use of such materials or technologies.</text></paragraph></section> 
<section id="H5246CE8BC95A4E5BAB144C7FC47EA497"><enum>5.</enum><header>Authorization of appropriations</header><text display-inline="no-display-inline">There is authorized to be appropriated such sums as may be necessary to carry out section 2 of this Act.</text></section> 
<section id="H1F6D0C56BAE94C429B7BC838B45AA2F7"><enum>6.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act the following definitions apply:</text> 
<paragraph id="HBA0879F952E54DB394846CDB371FA245"><enum>(1)</enum><header>Blind individual</header><text display-inline="yes-display-inline">The term <term>blind individual</term> means an individual whose central visual acuity does not exceed 20/200 in the better eye with correcting lenses or whose visual acuity, if better than 20/200, is accompanied by a limit to the field of vision in the better eye to such a degree that its widest diameter subtends an angle of no greater than 20 degrees.</text></paragraph> 
<paragraph id="HDBD1984A4C234E6B8B63476664FF94D9"><enum>(2)</enum><header>Covered blind individual and covered individual with a disability</header><text display-inline="yes-display-inline">The terms <term>covered blind individual</term> and <term>covered individual with a disability</term> mean a blind individual or an individual with a disability whose blindness or disability limits the ability of such individual to access electronic instructional materials and related information technologies.</text></paragraph> 
<paragraph id="HFF0CBC43E04848A39A1D99FA03D8F7BB"><enum>(3)</enum><header>Disability</header><text display-inline="yes-display-inline">The term <term>disability</term> has the meaning given such term in section 3 of the Americans with Disabilities Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/12102">42 U.S.C. 12102</external-xref>). </text> </paragraph> 
<paragraph id="H53EADF4FC8914BA5B73E901FB3F6A5FE"><enum>(4)</enum><header>Institution of higher education</header><text display-inline="yes-display-inline">The term <term>institution of higher education</term> has the meaning given such term in section 101 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1001">20 U.S.C. 1001</external-xref>).</text></paragraph> 
<paragraph id="H7A807C51DB694E5EB650E7C10F1FB55F"><enum>(5)</enum><header>Electronic instructional material</header><text display-inline="yes-display-inline">The term <term>electronic instructional material</term> means digital curricular content including course-assigned books, journals, articles, and web pages, used by students, faculty, or administrative personnel of an institution of higher education to facilitate the teaching and learning process, including technologies used in distance education as defined in section 103 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1003">20 U.S.C. 1003</external-xref>). </text></paragraph> 
<paragraph id="HE8FC0C08F9DD4DBDB4D15A51C0FD0A28"><enum>(6)</enum><header>Related information technology</header><text display-inline="yes-display-inline">The term <term>related information technology</term>—</text> 
<subparagraph id="HD4A82473C455438B8B1CED4012B19CD0"><enum>(A)</enum><text>means any electronic platform or delivery system used by students, faculty, or administrative personnel of an institution of higher education to access electronic instructional materials; and</text></subparagraph> 
<subparagraph id="HB7D0C710D5284C2E88A66557BD9A6CAD"><enum>(B)</enum><text>includes any hardware, firmware, software, and applications required for the manipulation, annotation, and dissemination of such electronic instructional materials.</text></subparagraph></paragraph></section>
