R. 3502</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action><action-date date="20131114">November 14, 2013</action-date><action-desc><sponsor name-id="S000522">Mr. Smith of New Jersey</sponsor> introduced the following bill; which was referred to the <committee-name committee-id="HJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To encourage States to expand the protections offered to victims of sex offenses who are not in a familiar or dating relationship with the perpetrators of such offenses.</official-title></form><legis-body id="HC910326B67D4403AAF147C4C5C6098E0" style="OLC"><section id="H9C3C1BF79A0B449089E7BDEE79F4877D" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as <quote><short-title>Nicole’s Law of 2013</short-title></quote>.</text></section><section display-inline="no-display-inline" id="H21EFCA8AE8F040C688171481A52B7F22"><enum>2.</enum><header>Protection for victims of sex offenses</header><subsection id="H188A5C8E31294562A26A489627EE2D11"><enum>(a)</enum><header>In General</header><text display-inline="yes-display-inline">For each fiscal year beginning after the expiration of the period specified in <internal-xref idref="HC353BECBD0404909809BD0E3360E2EB6" legis-path="__.(b)(1)">subsection (b)(1)</internal-xref> in which a State receives funds under the subpart referred to in <internal-xref idref="HA477E22ABFCF4251AA99BCC9792A6005" legis-path="__.(b)(2)">subsection (b)(2)</internal-xref>, the State shall have in effect throughout the State laws and policies that ensure that, with respect to criminal cases involving sex offenses (as defined by the State), protections similar to those offered to victims of domestic violence are extended to victims of sex offenses who are not in a familiar or dating relationship with the perpetrators of such offenses. To demonstrate compliance with the preceding sentence, a State shall have in effect laws and policies that—</text><paragraph display-inline="no-display-inline" id="H53372F29CC5C4EC291F5281A2526B424"><enum>(1)</enum><text>expressly authorize judges and courts to issue, as a condition of bail, protection orders that prohibit a defendant charged with a sex offense from having any contact with the victim or with the victim’s friends, co-workers, or relatives;</text></paragraph><paragraph id="H4B9EC3BBBB35461580E8DC6ADC68DAAD"><enum>(2)</enum><text display-inline="yes-display-inline">permit judges and courts, after finding a defendant guilty of a sex offense, to order a continuation of a protection order described in <internal-xref idref="H53372F29CC5C4EC291F5281A2526B424" legis-path="2.(b)(1)">paragraph (1)</internal-xref>, or to otherwise restrict a defendant’s contact with the victim, as a condition of bail, parole, probation, or other supervised release; and</text></paragraph><paragraph id="H66ABBCD5437745729B35A2270F2F309C"><enum>(3)</enum><text>provide judges and courts with the authority to grant or extend a protection order until further order of a judge or court, as an alternative to issuing protection orders that expire on a specific date or upon termination of a sentence or period of supervised release.</text></paragraph></subsection><subsection id="H6ECE685F21D44C2597C5DC4492AB085B"><enum>(b)</enum><header>Compliance and ineligibility</header><paragraph id="HC353BECBD0404909809BD0E3360E2EB6"><enum>(1)</enum><header>Compliance date</header><text>Each State shall have not more than one year from the date of enactment of this Act in which to fully implement this section, except that the Attorney General may grant an additional one year to a State that is making good faith efforts to implement this section.</text></paragraph><paragraph id="HA477E22ABFCF4251AA99BCC9792A6005"><enum>(2)</enum><header>Ineligibility for funds</header><text display-inline="yes-display-inline">For any fiscal year after the expiration of the period specified in <internal-xref idref="HC353BECBD0404909809BD0E3360E2EB6" legis-path="__.(b)(1)">paragraph (1)</internal-xref>, a State that fails to fully implement this section, as determined by the Attorney General, shall not receive 10 percent of the funds that would otherwise be allocated for that fiscal year to the State under subpart 1 of part E of title I of the Omnibus Crime Control and Safe Streets Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/42/3750">42 U.S.C. 3750 et seq.</external-xref>).</text></paragraph></subsection><subsection id="H4322AF07AA0E429FA4FF542EA2687A6B"><enum>(c)</enum><header>Reallocation</header><text display-inline="yes-display-inline">Amounts not allocated under the subpart referred to in <internal-xref idref="HA477E22ABFCF4251AA99BCC9792A6005" legis-path="__.(b)(2)">subsection (b)(2)</internal-xref> to a State for failure to fully implement this section shall be reallocated under that subpart to States that have not failed to fully implement this section.</text></subsection><subsection id="HED5C0977DB8A4A2FA9B84D8345D2B424"><enum>(d)</enum><header>Definition of State</header><text>In this section, The term <term>State</term> includes each of the several States, the District of Columbia, and any commonwealth, territory, or possession of the United States.</text></subsection></section></legis-body></bill>
