which was referred to the <committee-name committee-id="HVR00">Committee on Veterans’ Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To provide for advance appropriations for certain information technology accounts of the Department of Veterans Affairs, to include mental health professionals in training programs of the Department, and for other purposes.</official-title></form><legis-body id="HF0BE8A35EB434C75BD82CBF35AAF0C10" style="OLC"><section id="H5E4BA39310074C1B9F1D9CAF656E2A41" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Rural Veterans Mental Health Care Improvement Act</short-title></quote>.</text></section><section id="H715FB7B5A5E749BEBDEA0F172A0ABBA1" section-type="subsequent-section"><enum>2.</enum><header>Advance appropriations for accounts for health-related information technology for the Department of Veterans Affairs</header><subsection id="HAFDDF339B61748E89CBF314F6E4351B2"><enum>(a)</enum><header>Advance appropriations for information technology accounts</header><text><external-xref legal-doc="usc" parsable-cite="usc/38/117">Section 117(c)</external-xref> of title 38, United States Code, is amended by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="H4D45A20C863E41C9ADCDC8294B59DC62" style="OLC"><paragraph id="H14268DE2B8AD4C41A6F51048E9C76238"><enum>(4)</enum><text>Accounts, including subaccounts of the Accounts referred to in paragraphs (1) through (3), providing funds for information technology.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H9047D9FEA5D546E5B5B497CB388AFAA7"><enum>(b)</enum><header>Effective date</header><text>The amendment made by subsection (a) shall take effect on October 1, 2014, and shall apply with respect to fiscal years beginning on or after that date.</text></subsection></section><section id="H593FB5659BB148D8BCA9740A891F8EBF"><enum>3.</enum><header>Inclusion of mental health professionals in the education and training program for health personnel of the Department of Veterans Affairs</header><subsection id="H510627A4AC71498A8AE91D5AB770CDED"><enum>(a)</enum><header>In general</header><text>In carrying out the education and training program required under <external-xref legal-doc="usc" parsable-cite="usc/38/7302">section 7302(a)(1)</external-xref> of title 38, United States Code, the Secretary of Veterans Affairs shall include education and training of marriage and family therapists and licensed professional mental health counselors.</text></subsection><subsection id="H5E2F3E62C38A4B758051035ADB27EE28"><enum>(b)</enum><header>Funding</header><text>The Secretary shall apportion funding for the education and training program equally among the professions included in the program.</text></subsection></section><section id="H8B5F624E43FA425CAF8CF2F444FA23AF"><enum>4.</enum><header>Provision of mental health services for families of certain veterans at facilities of the Department</header><subsection id="H77BB0405E55B45B1B3E050A9BFCBFE10"><enum>(a)</enum><header>Provision of mental health services at Department facilities</header><text>Subsection (e) of section 304 of the Caregivers and Veterans Omnibus Health Services Act of 2010 (<external-xref legal-doc="usc" parsable-cite="usc/38/1712A">38 U.S.C. 1712A</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/111/163">Public Law 111–163</external-xref>) is amended—</text><paragraph id="H7D6A1739C8A64820A674A6E01A547824"><enum>(1)</enum><text display-inline="yes-display-inline">by striking <quote><header-in-text level="subsection" style="OLC">peer outreach and peer support services</header-in-text></quote> and inserting <quote><header-in-text level="subsection" style="OLC">services</header-in-text></quote>; and</text></paragraph><paragraph id="H3201221B8D334FF6895BEBECBE4D8A2C"><enum>(2)</enum><text>by striking <quote>The Secretary shall carry out the services</quote> and inserting “The Secretary shall carry out—</text><quoted-block display-inline="no-display-inline" id="HD66CFBE4FF064E7DA351AE634AA1CFB0" style="OLC"><paragraph id="HA58F705717DA4B3CB8202A4804DA9F83"><enum>(1)</enum><text>the services</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph id="H5B5FB20B09C2427098301E1884B2564B"><enum>(3)</enum><text>by striking the period at the end and inserting <quote>; and</quote>; and</text></paragraph><paragraph id="H5510A9A5BCA342488A64588DBADC1E23"><enum>(4)</enum><text>by adding at the end the following new paragraph:</text><quoted-block display-inline="no-display-inline" id="H71905482CF214B348D85C7485DC9B705" style="OLC"><paragraph id="H4A19536252F34F2AA4F45A9BACD15CB6"><enum>(2)</enum><text>the mental health services required by subsection (a)(2) at or through Department medical centers.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H9486572E098044EDB28A40CFA19AC1B5"><enum>(b)</enum><header>Definition of mental health services</header><text>Such section is further amended by striking subsection (f) and inserting the following:</text><quoted-block display-inline="no-display-inline" id="HE3BDD20B61DB4F2AA69CC3838B7BAB0C" style="OLC"><subsection id="H4F99EAE42AC043B88F0B67F73CA34536"><enum>(f)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section:</text><paragraph commented="no" id="HD84756FE77EA4544A4997B05BE6965C6"><enum>(1)</enum><header>Mental health services</header><text display-inline="yes-display-inline">The term <term>mental health services</term> includes outpatient mental healthcare referred to in <external-xref legal-doc="regulation" parsable-cite="cfr/38/17.38">section 17.38(a)(1)(i)</external-xref> of title 38, Code of Federal Regulations (as in effect on the day before the date of enactment of this Act).</text></paragraph><paragraph id="H96AD5E0015A5442C81F3D314D74E56B8"><enum>(2)</enum><header>Vet center</header><text>The term <term>vet center</term> means a center for readjustment counseling and related mental health services for veterans under <external-xref legal-doc="usc" parsable-cite="usc/38/1712A">section 1712A</external-xref> of title 38, United States Code.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="HD51C3402F94C4606904B4947BED24000"><enum>5.</enum><header>Report on provision of telemedicine services</header><subsection id="HDC2CEF230C3843B092BC00EC4CFCF6EE"><enum>(a)</enum><header>In general</header><text>Not later than 120 days after the date of the enactment of this Act, the Secretary of Veterans Affairs shall submit to the Committee on Veterans’ Affairs of the Senate and the Committee on Veterans’ Affairs of the House of Representatives a report on the following:</text><paragraph id="HE1D75FDAADD0473A8B7CAA795B2749EE"><enum>(1)</enum><text>Issues that may be impeding the provision by the Department of Veterans Affairs of telemedicine services for veterans, including the following:</text><subparagraph id="HB76B076084924E208E44434333970318"><enum>(A)</enum><text>Statutory or regulatory restrictions.</text></subparagraph><subparagraph id="H602B9760D2C64AD5A54DBA52444AAF46"><enum>(B)</enum><text>Licensure or credentialing issues for any provider practicing telemedicine with veterans who live in a different State than the provider.</text></subparagraph><subparagraph id="HEE88C1B958D04CAF80ED17C4ECB5926D"><enum>(C)</enum><text>Limited broadband access in rural areas.</text></subparagraph><subparagraph id="H65DA2E096619411EBA6744ED099F639D"><enum>(D)</enum><text>Limited information technology resources or capabilities.</text></subparagraph><subparagraph id="HA7642748F7CB419BB92110F94CA6F8E6"><enum>(E)</enum><text>Long distances veterans must travel to access a facility or clinic with telemedicine capabilities.</text></subparagraph><subparagraph id="H59C0F6D292054254A2DCE08201D72428"><enum>(F)</enum><text>Insufficient liability protection for providers.</text></subparagraph><subparagraph id="HC404AA91418E4A3A91C894540AB7D7E7"><enum>(G)</enum><text>Reimbursement issues faced by providers.</text></subparagraph><subparagraph id="H154B260649B441ACA2A5AE76C425DBD9"><enum>(H)</enum><text>Travel limitations for providers that are unaffiliated with the Department and are participating or seeking to participate in a telemedicine program of the Department.</text></subparagraph></paragraph><paragraph id="HBAD0711437C942579A69F52950D2366D"><enum>(2)</enum><text>Actions taken to address the issues identified in paragraph (1).</text></paragraph><paragraph id="HC3EFDF073D564834A6F7467A0FE0588B"><enum>(3)</enum><text>An update on efforts by the Department to carry out the initiative of teleconsultation for the provision of remote mental health and traumatic brain injury assessments required by <external-xref legal-doc="usc" parsable-cite="usc/38/1709A">section 1709A</external-xref> of title 38, United States Code.</text></paragraph><paragraph id="HFE6C92E854DA4C689F3125A6C89FBB04"><enum>(4)</enum><text>An update on efforts by the Department to offer training opportunities in telemedicine to medical residents, as required by section 108(b) of the Janey Ensminger Act (<external-xref legal-doc="public-law" parsable-cite="pl/112/154">Public Law 112–154</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/38/7406">38 U.S.C. 7406</external-xref> note).</text></paragraph><paragraph id="H32B61D947362479282677C0A569F06A3"><enum>(5)</enum><text>An update on efforts by the Department to, in partnership with primary care providers, install video cameras and instruments to monitor weight, blood pressure, and other vital statistics in the homes of patients.</text></paragraph></subsection><subsection id="HDD7F7CD3D77C4C2EA2153AAFBBE554E5"><enum>(b)</enum><header>Telemedicine defined</header><text>In this section, the term <term>telemedicine</term> means the use by a health care provider of telecommunications to assist in the diagnosis or treatment of a patient’s medical condition.</text></subsection></section></legis-body></bill>
