R. 3487</legis-num><current-chamber display="yes">IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20131119">November 19, 2013</action-date><action-desc>Received</action-desc></action><legis-type>AN ACT</legis-type><official-title display="yes">To amend the Federal Election Campaign Act to extend through 2018 the authority of the Federal Election Commission to impose civil money penalties on the basis of a schedule of penalties established and published by the Commission, to expand such authority to certain other violations, and for other purposes.</official-title></form><legis-body id="H1CF67C9717AC4FD888F05303B3A5473E" style="OLC"><section id="H31434B85811A471DB6785ECB942203DA" section-type="section-one"><enum>1.</enum><header>Extension of administrative penalty authority of Federal Election Commission through <enum-in-header>2018</enum-in-header></header><text display-inline="no-display-inline">Section 309(a)(4)(C)(iv) of the Federal Election Campaign Act of 1971 (<external-xref legal-doc="usc" parsable-cite="usc/2/437g">2 U.S.C. 437g(a)(4)(C)(iv)</external-xref>) is amended by striking <quote>December 31, 2013</quote> and inserting <quote>December 31, 2018</quote>.</text></section><section id="HF49B920EA09D4E90A4E85238960C5D58" section-type="subsequent-section"><enum>2.</enum><header>Expansion of administrative penalty authority of Federal Election Commission</header><subsection id="HE863859874BC4F46890DDD752E5CAC00"><enum>(a)</enum><header>Application to qualified disclosure requirements</header><text display-inline="yes-display-inline">Section 309(a)(4)(C)(i) of the Federal Election Campaign Act of 1971 (<external-xref legal-doc="usc" parsable-cite="usc/2/437g">2 U.S.C. 437g(a)(4)(C)(i)</external-xref>) is amended by striking <quote>any requirement of section 304(a) of the Act (<external-xref legal-doc="usc" parsable-cite="usc/2/434">2 U.S.C. 434(a)</external-xref>)</quote> and inserting <quote>a qualified disclosure requirement</quote>.</text></subsection><subsection id="H21BD9C7D4BE64990A7081E93B9152172"><enum>(b)</enum><header>Schedule of penalties for each violation</header><text display-inline="yes-display-inline">Section 309(a)(4)(C)(i)(II) of the Federal Election Campaign Act of 1971 (<external-xref legal-doc="usc" parsable-cite="usc/2/437g">2 U.S.C. 437g(a)(4)(C)(i)(II)</external-xref>) is amended by inserting <quote>, for violations of each qualified disclosure requirement, </quote> before <quote>under a schedule of penalties</quote>.</text></subsection><subsection id="H4325F21111724192BDCA1DFB39F58456"><enum>(c)</enum><header>Definition of qualified disclosure requirement</header><text display-inline="yes-display-inline">Section 309(a)(4)(C) of the Federal Election Campaign Act of 1971 (<external-xref legal-doc="usc" parsable-cite="usc/2/437g">2 U.S.C. 437g(a)(4)(C)</external-xref>) is amended—</text><paragraph id="HACD95B746B884384849D2ECC6EB156B2"><enum>(1)</enum><text>by redesignating clause (iv), as amended by section 1, as clause (v); and</text></paragraph><paragraph id="H4DFCF00D756C48C88CEF73469F9BA348"><enum>(2)</enum><text>by inserting after clause (iii) the following new clause:</text><quoted-block display-inline="no-display-inline" id="HB617613ABFED436FAA8967C3C7A3A428" style="traditional"><clause id="H42DB4EFCA7304F32B0419E7EA3947401" indent="up1"><enum>(iv)</enum><text>In this subparagraph, the term <quote>qualified disclosure requirement</quote> means any requirement of—</text><subclause id="H4CEF170EA05B4031A89B433885CC8481"><enum>(I)</enum><text>subsections (a), (c), (e), (f), (g), or (i) of section 304; or</text></subclause><subclause id="H239D26FB7AC647EF85117188559D1FFF"><enum>(II)</enum><text display-inline="yes-display-inline">section 305.</text></subclause></clause><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section><section id="H5F47B4BB40444563BBFB52B940A83E36"><enum>3.</enum><header>Effective date</header><text display-inline="no-display-inline">The amendments made by this Act shall take effect on the earlier of—</text><paragraph id="H5E363445720642BAB024EFD873DFE7F6"><enum>(1)</enum><text>December 31, 2013; or</text></paragraph><paragraph id="H0C633448C725404B8B2464E44F7E0788"><enum>(2)</enum><text>the date of the enactment of this Act.</text></paragraph></section></legis-body><attestation><attestation-group><attestation-date chamber="House" date="20131118">Passed the House of Representatives November 18, 2013.</attestation-date><attestor display="yes">Karen L.
