		<official-title>To amend title I of the Patient Protection and Affordable
		  Care Act to ensure that the coverage offered under multi-State qualified health
		  plans offered in Exchanges is consistent with the Federal abortion funding
		  ban.</official-title>

		<section id="H10C042301AE244118015C0D9E6C68BD3" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Stop Abortion Funding in Multi-state
			 Exchange Plans Act</short-title></quote> or <quote>SAFE Act</quote>.</text>
		</section><section id="H244A84B683524FDEB30838417A95C74D" section-type="subsequent-section"><enum>2.</enum><header>Consistency with
			 Federal abortion funding ban for coverage under multi-State plans in
			 Exchanges</header>
			<subsection id="H1F67AAA50D6B4E0A896F449C078BCD9A"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Paragraph (6) of
			 section 1334(a) of the Patient protection and Affordable Care Act (42 U.S.C.
			 18054(a)(6)) is amended to read as follows:</text>
				<quoted-block display-inline="no-display-inline" id="H1B61C4ADA2EE4C0D81066358031EBCFF" style="OLC">
					<paragraph id="HA2AC7D0FA06D440E807355460550EEB9"><enum>(6)</enum><header>Consistency with
				Federal abortion funding ban</header>
						<subparagraph id="H98FB2A4EA5EC4FCFA31B5064D524CAE1"><enum>(A)</enum><header>In
				general</header><text>In entering into contracts under this subsection, the
				Director shall ensure that no multi-State qualified health plan offered in an
				Exchange provides coverage of abortion.</text>
						</subparagraph><subparagraph id="H25CB3732E70D4DFC87F2CEE3A9530626"><enum>(B)</enum><header>Exception</header><text>The
				limitation established in
				<internal-xref idref="H98FB2A4EA5EC4FCFA31B5064D524CAE1" legis-path="(6)(A)">subparagraph (A)</internal-xref> shall not apply to an
				abortion—</text>
							<clause id="HE25D8CFDD5B74F409AFBBE51977B8B5F"><enum>(i)</enum><text>if
				the pregnancy is the result of an act of rape or incest; or</text>
							</clause><clause id="H8E9DB75112EA4383A6989FC27C18130A"><enum>(ii)</enum><text display-inline="yes-display-inline">in a case where a woman suffers from a
				physical disorder, physical injury, or physical illness that would, as
				certified by a physician, place the woman in danger of death unless an abortion
				is performed, including a life-endangering physical condition caused by or
				arising from the pregnancy
				itself.</text>
							</clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection commented="no" id="HD97B4345F018456D8B221C20D04D01A2"><enum>(b)</enum><header>Preemption</header><text display-inline="yes-display-inline">Section 1303(c) of the Patient Protection
			 and Affordable Care Act (<external-xref legal-doc="usc" parsable-cite="usc/42/18023">42 U.S.C. 18023(c)</external-xref>) is amended—</text>
				<paragraph id="H519D19FB6ABC4E06A669B69C2C29172D"><enum>(1)</enum><text>in paragraph (1),
			 by striking <quote>Nothing in this Act</quote> and inserting <quote>Subject to
			 paragraph (4), nothing in this Act</quote>; and</text>
				</paragraph><paragraph id="HFE143CCA93BA477697B1F27320ECAD26"><enum>(2)</enum><text>by adding at the
			 end the following:</text>
					<quoted-block display-inline="no-display-inline" id="HF71D51A051E94748AC80BEE3830416EC" style="OLC">
						<paragraph commented="no" id="H967FEF4D3C924221A11F6D57BB70E3C5"><enum>(4)</enum><header>Application of
				limitation for multi-State plans</header><text display-inline="yes-display-inline">Paragraph (6) of section 1334(a) shall
				preempt any State law requiring coverage of or funding for abortions with
				respect to the application of such law to multi-State health
				plans.</text>
						</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
