which was referred to the <committee-name committee-id="HVR00">Committee on Veterans’ Affairs</committee-name>, and in addition to the Committee on <committee-name committee-id="HGO00">Oversight and Government Reform</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title>To amend titles 5 and 38, United States Code, to clarify the veteran status of an individual based on the attendance of the individual at a preparatory school of a service academy, and for other purposes.</official-title></form><legis-body id="H36DD0F7BEE284E04BD0AF7903AE5ADFF" style="OLC"><section id="H2BA4CF424DAB4250958868D5F74332D0" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Support Earned Recognition for Veterans Act</short-title></quote> or the <quote><short-title>SERV Act</short-title></quote>.</text></section><section id="H28654726E09945E58044202852FD9E7F" section-type="subsequent-section"><enum>2.</enum><header>Clarification of veteran status</header><subsection commented="no" id="HDBD57964925B478399B4BF75781C3281"><enum>(a)</enum><header>Clarification of definition of military service</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/38/101">Section 101</external-xref> of title 38, United States Code, is amended—</text><paragraph commented="no" id="H0200650D9A4D4A8995301C11D79A52D4"><enum>(1)</enum><text>in paragraph (21)(D), by inserting after <quote>Naval Academy</quote> the following: <quote>(but, except for purposes of chapter 17 of this title in accordance with section 107(e)(2), does not include any service performed by a student at a preparatory school of a service academy who is not otherwise a member of the Armed Forces)</quote>;</text></paragraph><paragraph id="HD8539E828571471AA8F300F6A008256B"><enum>(2)</enum><text>in paragraph (22), by inserting before the period at the end the following: <quote>or, except for purposes of chapter 17 of this title in accordance with section 107(e)(2), duty performed by a student at a preparatory school of a service academy who is not otherwise a member of the Armed Forces</quote>; and</text></paragraph><paragraph commented="no" id="H12BDD6F61FF04CD7B4D747609C1D5587"><enum>(3)</enum><text>in paragraph (23), by adding after the period at the end the following: <quote>Except for purposes of chapter 17 of this title in accordance with section 107(e)(2), such term does not include duty performed by a student at a preparatory school of a service academy who is not otherwise a member of the Armed Forces.</quote>.</text></paragraph></subsection><subsection id="H51B4247AB78F40BDB2A9903EB1B5C7A1"><enum>(b)</enum><header>Service deemed not To be active service</header><text><external-xref legal-doc="usc" parsable-cite="usc/38/107">Section 107</external-xref> of title 38, United States Code, is amended by adding at the end the following new subsection:</text><quoted-block display-inline="no-display-inline" id="H5DD9CD69836449B899396A1CEF698E83" style="USC"><subsection id="H318B734CC0E340ECA9C6CB35A2F0811E"><enum>(e)</enum><paragraph commented="no" display-inline="yes-display-inline" id="H403A17EC0EAA46569916A896FCB80280"><enum>(1)</enum><text display-inline="yes-display-inline">Except as provided by paragraph (2), duty performed by a student at a preparatory school of a service academy who is not otherwise a member of the Armed Forces shall not be deemed to have been active military, naval, or air service for the purposes of any of the laws administered by the Secretary, regardless of whether the student was injured or disabled as a result of such duty.</text></paragraph><paragraph id="H44B58E7980824D45AB827185652D1A34" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">Chapter 17 of this title shall apply to an individual described in paragraph (1) with respect to furnishing hospital care and medical services solely for an injury or disability incurred by the individual as a result of military training related to future active duty service performed as a student during the course of required training at a preparatory school of a service academy. An individual who receives such care and services under this paragraph may not be treated as a veteran for the purposes of any other provision of law solely by reason of receiving such care and services under this paragraph.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HA1E58DC8E27E4506B05002BE78C03F55"><enum>(c)</enum><header>Small business concerns</header><text><external-xref legal-doc="usc" parsable-cite="usc/38/8127">Section 8127(l)</external-xref> of title 38, United States Code, is amended by adding at the end the following new paragraph:</text><quoted-block display-inline="no-display-inline" id="HDFC4FF89E3054AF5982EC4E4FC9D7204" style="USC"><paragraph id="HCD2416AF45864B80967B1AF1763CC42A"><enum>(3)</enum><text display-inline="yes-display-inline">The term <term>veteran</term>, in accordance with sections 101 and 107 of this title, does not include an individual whose veteran status is based solely on the attendance of the individual as a student at a preparatory school of a service academy, regardless of whether the individual was injured or disabled as a result of duty performed as such a student.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H7404EF7CF9B1424BB55C653455F3FD8C"><enum>(d)</enum><header>Preference eligible</header><text><external-xref legal-doc="usc" parsable-cite="usc/5/2108">Section 2108</external-xref> of title 5, United States Code, is amended—</text><paragraph id="H2BAE7E0E35AB4099B538E28B5C068B0F"><enum>(1)</enum><text>in paragraph (4)(B), by striking <quote>; and</quote> and inserting a semicolon;</text></paragraph><paragraph id="H905D3D74A02C49C58AA517CA3E83C9FB"><enum>(2)</enum><text>in paragraph (5), by striking the period at the end and inserting <quote>; and</quote>; and</text></paragraph><paragraph id="H8B6D250922F1401FA92AA948E065166D"><enum>(3)</enum><text>by adding at the end the following new paragraph:</text><quoted-block display-inline="no-display-inline" id="H35C2DC5A4BBF48A684F38CFB5DF0C47C" style="USC"><paragraph id="H791E103CFEC64E1CADA0907DEAEA9B5E"><enum>(6)</enum><text display-inline="yes-display-inline">an individual whose veteran status is based solely on the attendance of the individual as a student at a preparatory school of a service academy, regardless of whether the individual was injured or disabled as a result of duty performed as such a student, may not be treated as a <quote>veteran</quote>, <quote>disabled veteran</quote>, or <quote>preference eligible</quote>.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section></legis-body></bill>
