<section id="H18AC353EE2184D998D393DA94781DF79" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Commercial Vessel Discharges Reform Act of 2013</short-title></quote>.</text></section> 
<section id="H4C99625B09B8436C8988EC1A46231D80"><enum>2.</enum><header>Discharges incidental to the normal operation of a covered vessel</header> 
<subsection id="H4C185FB59BE74F11AF423C94CEA931E1"><enum>(a)</enum><header>Discharges incidental to the normal operation of a covered vessel</header> 
<paragraph id="H7C56EC52ABA544F890F1151519BAE458"><enum>(1)</enum><header>No permit required</header><text>Section 402 of the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1342">33 U.S.C. 1342</external-xref>) is amended by adding at the end the following:</text> 
<quoted-block id="H34A80C94D2A24D9A88433FE084021077" style="OLC"> 
<subsection id="HEC78F82B50B549E9B04664055BBF4099"><enum>(s)</enum><header>Discharges incidental to the normal operation of a covered vessel</header><text>No permit shall be required under this Act by the Administrator (or a State, in the case of a permit program approved under subsection (b)) for a discharge incidental to the normal operation of a covered vessel (as defined in section 312(p)).</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph> 
<paragraph id="H4F7FB6D96BD74A6789A8C552E699F0DE"><enum>(2)</enum><header>Best management practices for covered vessels</header><text>Section 312 of the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1342">33 U.S.C. 1342</external-xref>) is amended by adding at the end the following:</text>

<subsection id="HF618FDE31F994A26AAE1131910401E13"><enum>(p)</enum><header>Best management practices for covered vessels</header> 
<paragraph id="HF8E3FE47B3BF454D831C52AA69AED2EF"><enum>(1)</enum><header>Definitions</header><text>In this subsection, the following definitions apply:</text> 
<subparagraph id="H94419D5C3343415D90A7884D6C677D2A"><enum>(A)</enum><header>Covered vessel</header><text>The term <term>covered vessel</term> means every description of watercraft, or other artificial contrivance used or capable of being used as a means of transportation on water, that is engaged in commercial service (as defined under <external-xref legal-doc="usc" parsable-cite="usc/46/2101">section 2101</external-xref> of title 46, United States Code), and—</text> 
<clause id="H8A4F7F98C6BE495F80B42E3F8A34177C"><enum>(i)</enum><text>is less than 79 feet in length; or</text></clause> 
<clause id="HA81300CA65DC44C994159D67C4E97A52"><enum>(ii)</enum><text>is a fishing vessel (as defined in <external-xref legal-doc="usc" parsable-cite="usc/46/2101">section 2101</external-xref> of title 46, United States Code), regardless of length of the vessel.</text></clause></subparagraph> 
<subparagraph id="HA86ABA897074434EBF0425876E2267C3" commented="no"><enum>(B)</enum><header>Discharge incidental to the normal operation of a covered vessel</header> 
<clause id="HCB333A5BB27F4A0B82AC93A648DCFE5B" commented="no"><enum>(i)</enum><header>In general</header><text>The term <term>discharge incidental to the normal operation of a covered vessel</term> means—</text> 
<subclause id="HBBF0C065D32C449FBA67CCB7C2A809CB" commented="no"><enum>(I)</enum><text>a discharge into navigable waters from a covered vessel of—</text> 
<item id="H7893A9626D6E4F1B8C4D0C03C4C05322" commented="no"><enum>(aa)</enum> 
<subitem id="HAD000E46362D4F33BEF5AC6180DBAAC1" display-inline="yes-display-inline" commented="no"><enum>(AA)</enum><text>graywater (except graywater referred to in section 312(a)(6)), bilge water, cooling water, oil water separator effluent, anti-fouling hull coating leachate, boiler or economizer blowdown, byproducts from cathodic protection, controllable pitch propeller and thruster hydraulic fluid, distillation and reverse osmosis brine, elevator pit effluent, firemain system effluent, freshwater layup effluent, gas turbine wash water, motor gasoline and compensating effluent, refrigeration and air condensate effluent, seawater pumping biofouling prevention substances, boat engine wet exhaust, sonar dome effluent, exhaust gas scrubber washwater, or stern tube packing gland effluent; or</text></subitem> 
<subitem id="H445522C4FD7D4DB38E42FFCCF6C5F617" commented="no" indent="up1"><enum>(BB)</enum><text>any other pollutant associated with the operation of a marine propulsion system, shipboard maneuvering system, habitability system, or installed major equipment, or from a protective, preservative, or absorptive application to the hull of a covered vessel;</text></subitem></item> 
<item id="H2C229F1D81AB45CABF778EB803C467A6" commented="no"><enum>(bb)</enum><text>weather deck runoff, deck wash, aqueous film forming foam effluent, chain locker effluent, non-oily machinery wastewater, underwater ship husbandry effluent, welldeck effluent, or fish hold and fish hold cleaning effluent; or</text></item> 
<item id="HCF04E9E0FE7646A8ABA253F359492F8E" commented="no"><enum>(cc)</enum><text>any effluent from a properly functioning marine engine; or</text></item></subclause> 
<subclause id="H19B97AC2836245138DB201E6162273E1" commented="no"><enum>(II)</enum><text>a discharge of a pollutant into navigable waters in connection with the testing, maintenance, and repair of a system, equipment, or an engine described in item (aa)(BB) or (cc) of subclause (I) whenever the covered vessel is waterborne.</text></subclause></clause> 
<clause id="HA26D561B94724CA38B6D54B9E87C98A1" commented="no"><enum>(ii)</enum><header>Exclusion</header><text>The term <term>discharge incidental to the normal operation of a covered vessel</term> does not include—</text> 
<subclause id="HF88A24CF252848E3AE445333B18188B9" commented="no"><enum>(I)</enum><text>a discharge into navigable waters from a covered vessel of—</text> 
<item id="H7BE6C4D5889645A4AE7C11F628C91F8C" commented="no"><enum>(aa)</enum><text>ballast water;</text></item> 
<item id="H175A53F016054E6D8EB54CBDE84612A6" commented="no"><enum>(bb)</enum><text>rubbish, trash, garbage, incinerator ash, or other such material discharged overboard;</text></item> 
<item id="H4A953BF7C11A4A8A9D1C7DE482668079" commented="no"><enum>(cc)</enum><text>oil or a hazardous substance within the meaning of section 311; or</text></item> 
<item id="HBED9CC2D7D604411890DF08717EA2FC4" commented="no"><enum>(dd)</enum><text>sewage within the meaning of section 312;</text></item></subclause> 
<subclause id="H2DB5667D6AFF47B0A6E74A69045A3C71" commented="no"><enum>(II)</enum><text>an emission of an air pollutant resulting from the operation onboard a covered vessel of a vessel propulsion system, motor driven equipment, or incinerator; or</text></subclause> 
<subclause id="H42C2A868E38D4BDCAC78F09F76037A61" commented="no"><enum>(III)</enum><text>a discharge into navigable waters from a covered vessel when the covered vessel is operating in a capacity other than as a means of transportation on water.</text></subclause></clause></subparagraph></paragraph> 
<paragraph id="HD72DE49F3AD840EEAC3D1214445A188D"><enum>(2)</enum><header>Determination of discharges subject to best management practices</header> 
<subparagraph id="H7B99FD86A2F6403FA0E23C690982DA7F"><enum>(A)</enum><header>Determination</header> 
<clause id="HD72C6082568440B88E386B3B8BAF8EAA"><enum>(i)</enum><header>In general</header><text>The Administrator, in consultation with the Secretary of the department in which the Coast Guard is operating, shall determine the discharges incidental to the normal operation of a covered vessel for which it is reasonable and practicable to develop best management practices to mitigate the adverse impacts of such discharges on the waters of the United States.</text></clause> 
<clause id="H979674BD0D9E4DEE98AFCCA4613AD159"><enum>(ii)</enum><header>Promulgation</header><text>The Administrator shall promulgate the determinations under clause (i) in accordance with <external-xref legal-doc="usc" parsable-cite="usc/5/553">section 553</external-xref> of title 5, United States Code.</text></clause></subparagraph> 
<subparagraph id="HB7A84EEA696244FC9C319CA025D69DC3"><enum>(B)</enum><header>Considerations</header><text>In making a determination under subparagraph (A), the Administrator shall consider—</text> 
<clause id="H9C1333E5340B40B49EC5EEC1AE2045EA"><enum>(i)</enum><text>the nature of the discharge;</text></clause> 
<clause id="H64341B95AED94317811CC0CA62D770E1"><enum>(ii)</enum><text>the environmental effects of the discharge, including characteristics of the receiving waters;</text></clause> 
<clause id="H2522348D1E3246C181EF9724D7C02DEF"><enum>(iii)</enum><text>the effectiveness of the best management practice in reducing adverse impacts of the discharge on water quality;</text></clause> 
<clause id="HACCB779D9DD041D88FB30FE062D4DFF0"><enum>(iv)</enum><text>the practicability of developing and using a best management practice;</text></clause> 
<clause id="HB8B2FC59980D49A59D5AFF666F5E7F87"><enum>(v)</enum><text>the effect that the use of a best management practice would have on the operation, operational capability, or safety of the vessel;</text></clause> 
<clause id="H606CDD46766D43D28B2AC2034B4C763F"><enum>(vi)</enum><text>applicable Federal and State law;</text></clause> 
<clause id="H4C7B938AA946444DB89A06E85EC1AF6D"><enum>(vii)</enum><text>applicable international standards; and</text></clause> 
<clause id="H5D3D46FC78A04827AB301DD8EC83F182"><enum>(viii)</enum><text>the economic costs of the use of the best management practice.</text></clause></subparagraph> 
<subparagraph id="H1E788DCB392A4D2597E84DF7E29F9F9B"><enum>(C)</enum><header>Timing</header><text>The Administrator shall—</text> 
<clause id="HC15EDB242A334EBD8C7B2592F7526EC9"><enum>(i)</enum><text>make initial determinations under subparagraph (A) not later than 1 year after the date of enactment of this subsection; and</text></clause> 
<clause id="H4B13D3A608904C0C9C74C785F194CCA6"><enum>(ii)</enum><text>every 5 years thereafter—</text> 
<subclause id="HD4F3F1BC935C4CA79C00B5B0CA7A49A7"><enum>(I)</enum><text>review the determinations; and</text></subclause> 
<subclause id="H9C5275BCABD1404A9D033A342EE630E9"><enum>(II)</enum><text>if necessary, revise the determinations based on any new information available to the Administrator.</text></subclause></clause></subparagraph></paragraph> 
<paragraph id="HD65FEEE9D6DD41AC8E8F8731F789BDDB"><enum>(3)</enum><header>Regulations for the use of best management practices</header> 
<subparagraph id="H42B19476A4EB4226A9AC6EC28A602469"><enum>(A)</enum><header>In general</header><text>The Secretary of the department in which the Coast Guard is operating, in consultation with the Administrator, shall promulgate regulations on the use of best management practices for discharges incidental to the normal operation of a covered vessel that the Administrator determines are reasonable and practicable to develop under paragraph (2).</text></subparagraph> 
<subparagraph id="H23013057D8784900AFE7833D8E29352D"><enum>(B)</enum><header>Regulations</header> 
<clause id="H3FFA01B53621430BB0AD8628CB225319"><enum>(i)</enum><header>In general</header><text>The Secretary shall promulgate the regulations under this paragraph as soon as practicable after the Administrator makes determinations pursuant to paragraph (2).</text></clause> 
<clause id="HBBEF8C908326434EA53941BAB23FC4D7"><enum>(ii)</enum><header>Considerations</header><text>In promulgating regulations under this paragraph, the Secretary may—</text> 
<subclause id="HCA34C951ABA5448AB3C865B09F959D84"><enum>(I)</enum><text>distinguish among classes, types, and sizes of vessels;</text></subclause> 
<subclause id="HEFC2CF2ED89C42F9BBEDA781B1B4E70D"><enum>(II)</enum><text>distinguish between new and existing vessels; and</text></subclause> 
<subclause id="HC8334BE333B04C71AA4ABE06500709D0"><enum>(III)</enum><text>provide for a waiver of the applicability of the standards as necessary or appropriate to a particular class, type, age, or size of vessel.</text></subclause></clause></subparagraph></paragraph> 
<paragraph id="H810B86324A59496AA150EE503B1D9F0E"><enum>(4)</enum><header>Effect of other laws</header><text>This subsection shall not affect the application of section 311 to a covered vessel.</text></paragraph> 
<paragraph id="H65CB8659D1D24088987395A0EB043704"><enum>(5)</enum><header>Prohibition relating to covered vessels</header><text>After the effective date of the regulations promulgated by the Secretary of the department in which the Coast Guard is operating under paragraph (3), the owner or operator of a covered vessel shall neither operate in, nor discharge any discharge incidental to the normal operation of the vessel into, navigable waters, if the owner or operator of the vessel is not using any applicable best management practice meeting standards established under this subsection.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section>
