		  eliminate all federally imposed mandates over the local budget process and
		  financial management of the District of Columbia and the borrowing of money by

		<section id="H6CA8F440A6CE4890AAFDB76242A75891" section-type="section-one"><enum>1.</enum><header>Short Title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>District of Columbia Budget Autonomy
			 Act of 2013</short-title></quote>.</text>
		</section><section id="HD1B3729A514545D68AC1D8B7128A5184"><enum>2.</enum><header>Termination of
			 Federal Mandates Over Local Budget Process and Financial Management of District
			 of Columbia</header>
			<subsection id="H853233AE185C48408321B0C4523BF0B4"><enum>(a)</enum><header>Termination of
			 Mandates</header>
				<paragraph id="HCC543A287D0D45519504C5FD5FE5D61B"><enum>(1)</enum><header>In
			 general</header><text>Part D of title IV of the District of Columbia Home Rule
			 Act (sec. 1–204.41 et seq., D.C. Official Code) is amended by adding at the end
			 the following new subpart:</text>
					<quoted-block display-inline="no-display-inline" id="HC256409647284D69AE6B85E7F7F90CCE" style="traditional">
						<subpart id="HC7EFE67024EC4476BD973B773C623F63"><enum>3</enum><header>Termination of
				Federal Mandates</header>
							<section id="H1A5F5BEA7E9648A987BD06BB9C2973B2"><enum>458.</enum><header>Termination of Federal
		  Mandates</header><subsection commented="no" display-inline="yes-display-inline" id="HF869CBA54DDE43C2A5A00A13FBBDE882"><enum>(a)</enum><header>Budget and Financial
				Management Governed Under District Law</header><text>Effective with respect to
				fiscal year 2014 and each succeeding fiscal year which is not a control
				year—</text>
									<paragraph id="H4D3AF50ECFE44DDD8419933F64BE9ACE"><enum>(1)</enum><text>the provisions of
				subpart 1 and subpart 2 (other than sections 445A, 449, 453(c), and 455) shall
				not apply; and</text>
									</paragraph><paragraph id="HB00F74BE99DE479884C024D42075B754"><enum>(2)</enum><text>the process by
				which the District of Columbia develops and enacts the budget for the District
				government for a fiscal year, and the activities carried out with respect to
				the financial management of the District government for a fiscal year, shall be
				established under such laws as may be enacted by the District (except that
				nothing in this subsection may be construed to permit the District to waive the
				application of any other provision of this Act to such budget or such
				activities for the fiscal year).</text>
									</paragraph></subsection><subsection id="H2F87AB6E0C7B4D088A016D42B031AE94"><enum>(b)</enum><header>Special Rule for
				Determination of Fiscal Year</header><text>Section 441 (relating to the fiscal
				year of the District) shall not apply with respect to fiscal year 2014 or any
				succeeding fiscal year, without regard to whether or not the fiscal year is a
				control year.</text>
								</subsection><subsection id="HB4A9FCEA5D4647F0BD274A566D1B47E7"><enum>(c)</enum><header>No Effect on
				Existing Obligations</header><text>Nothing in this section may be construed to
				relieve the District of Columbia of any contractual or other financial
				obligations incurred by the District under a budget enacted for a fiscal year
				prior to fiscal year 2014.</text>
								</subsection><subsection id="HEC0DB83C5BFF47D49C21858F7CDF4814"><enum>(d)</enum><header>No Effect on
				Other Provisions of Law</header><text display-inline="yes-display-inline">Nothing in this section may be construed to
				waive the application of any provision of this Act with respect to the process
				and activities described in subsection (a)(2) for a fiscal year, other than the
				provisions which do not apply to the fiscal year pursuant to subsection
				(a)(1).</text>
								</subsection></section></subpart><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph><paragraph id="H1D5F01135E41482C8541BFA72D474868"><enum>(2)</enum><header>Clerical
			 Amendment</header><text>The table of contents of such Act is amended by adding
			 at the end of the items relating to part D of title IV the following:</text>

			 Congressional Review Period for Budget Acts</header><text>Section 602(c) of
			 such Act (sec. 1–206.02(c), D.C. Official Code) is amended—</text>
				<paragraph id="H9419535AD0E94578BFC169D82E4FCA79"><enum>(1)</enum><text>in the second
			 sentence of paragraph (1), by striking <quote>paragraph (2)</quote> and
			 inserting <quote>paragraphs (2) and (4)</quote>; and</text>
				</paragraph><paragraph id="HD2C237BD7E9044A1AD100ED9AD8F4973"><enum>(2)</enum><text>by adding at the
			 end the following new paragraph:</text>
					<quoted-block id="HDE2EE886DF84441F925B4D5F7AC1DD36">
						<paragraph id="H0B1EB541386548CE8699E32B633D4300" indent="up1"><enum>(4)</enum><text>In the case of any Act adopting the
				annual budget for the District of Columbia government for fiscal year 2014 or
				any succeeding fiscal year which is not a control year, such Act shall take
				effect upon the date prescribed by such
				Act.</text>
						</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection></section><section id="HC77CB553B9F947DEB664D33DCA8712A1"><enum>3.</enum><header>Termination of
			 Federal Mandates Over Borrowing of Money</header>
			<subsection id="HEE7F0EC517BE4FB787F1B94FFE9863A6"><enum>(a)</enum><header>Termination of
			 Mandates</header>
				<paragraph id="H54D7C40B80FD40519EF35A65A16A0D8E"><enum>(1)</enum><header>In
			 general</header><text>Part E of title IV of the District of Columbia Home Rule
			 Act (sec. 1–204.61 et seq., D.C. Official Code) is amended by adding at the end
			 the following new subpart:</text>

						<subpart id="H0379152D08EF4893A0207BAD59932CAE"><enum>6</enum><header>Termination of
				Federal Mandates</header>
							<section id="HFF4EA7C9AE9146D5970BF472B65F2C20"><enum>490A.</enum><header>Termination of Federal
		  Mandates</header><subsection commented="no" display-inline="yes-display-inline" id="H90DD8406D64B4776966EF431ED4FA672"><enum>(a)</enum><header>Borrowing Governed
				Under District Law</header><text>Except as provided in subsection (b),
				effective with respect to fiscal year 2014 and each succeeding fiscal year
				which is not a control year—</text>
									<paragraph id="H89E45CEC995C412994EEB075EF8569C9"><enum>(1)</enum><text>the provisions of
				subparts 1 through 5 shall not apply; and</text>
									</paragraph><paragraph id="HD5B9EA84A16442679D1661AB167F0C55"><enum>(2)</enum><text>the process and
				rules by which the District of Columbia issues bonds or otherwise borrows money
				shall be established under such laws as may be enacted by the District.</text>
									</paragraph></subsection><subsection id="H4021D55E8C564DBE9B5D39519F9C282B"><enum>(b)</enum><header>Exception for
				Certain Provisions</header><text>Subsection (a) does not apply with respect to
				the following sections:</text>
									<paragraph id="H2FFB6841485643A1962B6D1EC67BEB0D"><enum>(1)</enum><text>Section 482
				(relating to the full faith and credit of the District).</text>
									</paragraph><paragraph id="H1347D179E80C4C0CAB37BC438B7BFC4F"><enum>(2)</enum><text>Section 484
				(relating to the nonapplicability of the full faith and credit of the United
				States).</text>
									</paragraph><paragraph id="HEB063E2B617D49A2B130329C946F4C0F"><enum>(3)</enum><text>Section 485
				(relating to the tax treatment of bonds and notes).</text>
									</paragraph><paragraph id="H7A2B223F9C644BD5AE2F777AAF8C1503"><enum>(4)</enum><text>Section 486
				(relating to legal investment in bonds and notes).</text>
									</paragraph><paragraph id="HC023219A1AB54D41AA6B1D303192085A"><enum>(5)</enum><text>Section 487
				(relating to payments for sanitary sewage water works, water pollution
				projects, and waste treatment services).</text>
									</paragraph><paragraph id="H70FE905A930F49D7912E60A97450D9D6"><enum>(6)</enum><text>Section 488
				(relating to payments for reservoirs on the Potomac River).</text>
									</paragraph><paragraph id="H140CF1E555C54B388CCE7555DA0FD003"><enum>(7)</enum><text>Section 489
				(relating to contributions to the Washington Metropolitan Area Transit
				Authority).</text>
									</paragraph></subsection><subsection id="H80E5FA9908D54BF8831851232F370B4B"><enum>(c)</enum><header>Rule of
				Construction</header><text>Nothing in this section may be construed—</text>
									<paragraph id="HFC3F6A2E1B9D4669A95AE11DD34A439F"><enum>(1)</enum><text>to relieve the
				District of Columbia of any obligation incurred with respect to bonds or other
				forms of borrowing issued prior to fiscal year 2014; or</text>
									</paragraph><paragraph id="HB275FCBF07C847BBB3D231D92B7671BD"><enum>(2)</enum><text>to waive the
				application to the District of Columbia of any other Federal law governing the
				borrowing of funds by States or units of local government, including the
				Internal Revenue Code of
				1986.</text>
									</paragraph></subsection></section></subpart><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph><paragraph display-inline="no-display-inline" id="H2F1DB863DE084429A88EB4C3050EC80A"><enum>(2)</enum><header>Clerical
			 amendment</header><text>The table of contents of such Act is amended by adding
			 at the end of the items relating to part E of title IV the following:</text>

			 application of federal anti-deficiency act to district of columbia
			 government</header>
			<subsection id="H525E355536874E3A90437BC9D7954649"><enum>(a)</enum><header>Repeal of
			 Provisions Relating to Limitations on Appropriations</header><text display-inline="yes-display-inline">Subchapter III of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/31/13">chapter 13</external-xref> of title 31,
			 United States Code, is amended by striking <quote>or of the District of
			 Columbia government</quote> each place it appears in the following
			 sections:</text>

			 amendments to Home Rule Act relating to changes in Federal role in budget
			 process</header>
			<subsection id="HCC0D60A929254904B8FC5C0D64642EC9"><enum>(a)</enum><header>Federal
			 authority over budget-Making process</header><text>Section 603(a) of the
			 District of Columbia Home Rule Act (sec. 1–206.03, D.C. Official Code) is
			 amended by inserting before the period at the end the following: <quote>for a
			 fiscal year which is a control year</quote>.</text>
			</subsection><subsection id="HAA2919EC7444436186D0555853624011"><enum>(b)</enum><header>Restrictions
			 applicable during control years</header><text>Section 603(d) of such Act (sec.
			 1–206.03(d), D.C. Official Code) is amended to read as follows:</text>
				<quoted-block id="HA33AC6E8CBDB46EA8AC569552BF0D8DD">
					<subsection id="H97FC9C2CCE30464490FF856BBCE63959"><enum>(d)</enum><text>In the case of a
				fiscal year which is a control year, the Council may not approve, and the Mayor
				may not forward to the President, any budget which is not consistent with the
				financial plan and budget established for the fiscal year under subtitle A of
				title II of the District of Columbia Financial Responsibility and Management
				Assistance Act of
				1995.</text>

			 603(f) of such Act (sec. 1–206.03(f), D.C. Official Code) is amended to read as
			 follows:</text>

					<subsection id="HAF4363797C314E9DAE9BE1AD4A44008B"><enum>(f)</enum><text>In this section,
				the term <term>control year</term> has the meaning given such term in section
				305(4) of the District of Columbia Financial Responsibility and Management
				Assistance Act of
				1995.</text>
					</subsection><after-quoted-block>.</after-quoted-block></quoted-block>

			 Date</header><text>The amendments made by this section shall apply with respect

			 amendments relating to Federally authorized adjustments to local
			 appropriations</header>
			<subsection id="H53FD71D6D86D4F3D9EA858F318CFB731"><enum>(a)</enum><header>Authority
			 granted by Federal government To increase spending in case of general fund
			 surplus</header><text display-inline="yes-display-inline">Section 816 of the
			 Financial Services and General Government Appropriations Act, 2009 (sec.
			 47–369.01, D.C. Official Code), is amended by striking <quote>Beginning in
			 fiscal year 2009 and each fiscal year thereafter,</quote> and inserting the
			 following: <quote>With respect to fiscal years 2009 through 2013 and any fiscal
			 year thereafter which is a control year (as defined in section 305(4) of the
			 District of Columbia Financial Responsibility and Management Assistance Act of
			 1995),</quote>.</text>
			</subsection><subsection id="H9EA7562AACFE4ABF8303A24AAF11312A"><enum>(b)</enum><header>Authority
			 granted by Federal government To increase spending in case of increased revenue
			 collections</header><text display-inline="yes-display-inline">Section 817(a) of
			 such Act (sec. 47–369.02(a), D.C. Official Code) is amended by striking
			 <quote>Beginning in fiscal year 2009 and each fiscal year thereafter,</quote>
			 and inserting the following: <quote>With respect to fiscal years 2009 through
			 2013 and any fiscal year thereafter which is a control year (as defined in
			 section 305(4) of the District of Columbia Financial Responsibility and
			 Management Assistance Act of 1995),</quote>.</text>
			</subsection><subsection id="HDAA0163C9DE54394B233743E3F4F8AAA"><enum>(c)</enum><header>Authority
			 granted by Federal government regarding use of Federally Mandated reserve
			 funds</header><text display-inline="yes-display-inline">Section 818 of such Act
			 (sec. 47–369.03, D.C. Official Code) is amended by striking <quote>Beginning in
			 fiscal year 2009 and each fiscal year thereafter,</quote> and inserting the
			 following: <quote>With respect to fiscal years 2009 through 2013 and any fiscal
			 year thereafter which is a control year (as defined in section 305(4) of the
			 District of Columbia Financial Responsibility and Management Assistance Act of
			 1995),</quote>.</text>
