<section id="H7A1ACAC0CC74468B8B9CBDD15CCC5581" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Fallen Firefighters Assistance Tax Clarification Act of 2013</short-title></quote>.</text></section> 
<section id="H2182D5FF1E8044B48F5B1B70765EB3D7"><enum>2.</enum><header>Payments by charitable organizations with respect to certain firefighters treated as exempt payments</header> 
<subsection id="H19AB00E23FA4414DBF510BB1F47343F1"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">For purposes of the Internal Revenue Code of 1986, payments made to—</text> 
<paragraph id="H853E2557D9094DD38CE1DED3A5A54878"><enum>(1)</enum><text>any firefighter who was injured as a result of the ambush of firefighters responding to an emergency on December 24, 2012, in Webster, New York,</text></paragraph> 
<paragraph id="HC7D81B7AA8804ECCA7018A30ED05465F"><enum>(2)</enum><text>the spouse of any firefighter who died as a result of such ambush, or</text></paragraph> 
<paragraph id="H7D6C7349A1C04772A5E4F7B6CC963217"><enum>(3)</enum><text>any dependent (as defined in section 152 of such Code) of any firefighter who died as a result of such ambush,</text></paragraph><continuation-text continuation-text-level="subsection">by an organization described in paragraph (1) or (2) of section 509(a) of such Code shall be treated as related to the purpose or function constituting the basis for such organization’s exemption under section 501 of such Code if such payments are made in good faith using a reasonable and objective formula which is consistently applied.</continuation-text></subsection> 
<subsection id="HC9CBCB42AF1B44388DB2959CA6654644"><enum>(b)</enum><header>Application</header><text>Subsection (a) shall apply only to payments made on or after December 24, 2012, and before the later of—</text> 
<paragraph id="H1434377FBFE14069B0A43F4B21403976"><enum>(1)</enum><text>January 1, 2014, or</text></paragraph> 
<paragraph id="HBC3CE17FAC5E460AB907363C96C707BD"><enum>(2)</enum><text>the date which is 30 days after the date of the enactment of this Act.</text></paragraph></subsection></section>
