R. 3447</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action><action-date date="20131112">November 12, 2013</action-date><action-desc><sponsor name-id="B000755">Mr. Brady of Texas</sponsor> introduced the following bill; which was referred to the <committee-name committee-id="HWM00">Committee on Ways and Means</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend title 5, United States Code, to make clear that Federal employees who receive back pay for a period during which they are furloughed due to a lapse in appropriations may not also receive unemployment compensation for the same period.</official-title></form><legis-body id="H4D5CC55EC81F48BFACDD94478CACA1C0" style="OLC"><section id="HB617EE9B54B54938B19D072DF2A3975D" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Furloughed Federal Employee Double Dip Elimination Act</short-title></quote>.</text></section><section id="HC65BB88BF5A14C47A068AE58E4C37881" section-type="subsequent-section"><enum>2.</enum><header>Clarification</header><subsection id="H9C190C1FC2AB45FFB50E21FFD74E6BEA"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/5/8508">Section 8508</external-xref> of title 5, United States Code, is amended—</text><paragraph id="H253C9BBF62A64364AA7515D7D35547FA"><enum>(1)</enum><text>by inserting <quote>(a)</quote> before the first sentence; and</text></paragraph><paragraph id="H29BEE9943CF34C8EA6362686DC50927D"><enum>(2)</enum><text>by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="H4A2FF28CEB9F43B5AC563B067704331A" style="USC"><subsection id="H8C6997CF416B42D2B36FE7A1A84C7379"><enum>(b)</enum><text>The rules and regulations shall include provisions to ensure that, in the case of a Federal employee who receives back pay for a period during which such employee was furloughed due to a lapse in appropriations—</text><paragraph id="HFF6A875D4EF246B58628276D298A5B87"><enum>(1)</enum><text>such back pay shall be treated in the same way as Federal wages attributable to such employee; and</text></paragraph><paragraph id="H70B074C066AF4CA2BC271EDB6E3CD3F1"><enum>(2)</enum><text>the period to which such back pay relates shall be treated in the same way as a period of Federal service attributable to such employee.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H9C97C054175241A2B84D653D974CBCDF"><enum>(b)</enum><header>Effective date</header><text>The amendment made by subsection (a) shall be effective as of September 30, 2013.</text></subsection></section></legis-body></bill>
