R. 3432</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action><action-date date="20131030">October 30, 2013</action-date><action-desc><sponsor name-id="P000588">Mr. Pearce</sponsor> introduced the following bill; which was referred to the <committee-name committee-id="HAG00">Committee on Agriculture</committee-name>, and in addition to the Committee on <committee-name committee-id="HII00">Natural Resources</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title>To expedite the planning and implementation of salvage timber sales as part of Forest Service and Department of the Interior restoration and rehabilitation activities for lands within the Gila and Lincoln National Forests and for Bureau of Land Management lands in New Mexico adversely impacted by the 2012 and 2013 fire seasons, and for other purposes.</official-title></form><legis-body id="H1CEA82C614284561903AAEE6AE0A65CF" style="OLC"><section id="H181694740AB54A73B0FE1BDC1E15CB86" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>New Mexico Wildland Fire Emergency Salvage Act of 2013</short-title></quote>.</text></section><section id="H786B07000E394A92AE578E9F82FA8A9C"><enum>2.</enum><header>Expedited salvage timber sales in response to the Silver, Little Bear, and Whitewater-Baldy Complex Fires in New Mexico</header><subsection id="HB2BEB9C1824D42468F5FEE8E08B192E9"><enum>(a)</enum><header>Salvage timber sales required</header><text>As part of the restoration and rehabilitation activities undertaken on lands within the Gila National Forest and Lincoln National Forest and on Bureau of Land Management lands adversely impacted by the 2012 Little Bear and Whitewater-Baldy Complex Fires and the 2013 Silver Fire in New Mexico, the Secretary of Agriculture, with respect to the affected National Forest System lands, and the Secretary of the Interior, with respect to affected Bureau of Land Management lands, shall promptly plan and implement salvage timber sales of dead, damaged, or downed timber resulting from those wildfires.</text></subsection><subsection id="HC953C2ABAED643BB9CC62CAEC5E5121B"><enum>(b)</enum><header>Legal sufficiency</header><text>Due to the extraordinary severity of the wildfires referred to in subsection (a), salvage timber sales conducted under such subsection shall proceed immediately and to completion notwithstanding any other provision of law, including the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321 et seq.</external-xref>), section 14 of the National Forest Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/16/472a">16 U.S.C. 472a</external-xref>), the Forest and Rangeland Renewable Resources Planning Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/16/1600">16 U.S.C. 1600 et seq.</external-xref>), the Federal Land Policy and Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1701">43 U.S.C. 1701 et seq.</external-xref>), and laws related to the management of timber on the lands covered by such subsection.</text></subsection><subsection id="HC40B6B805E794D9493963FB6C504926A"><enum>(c)</enum><header>Administrative and judicial review</header><text>Salvage timber sales conducted under subsection (a) shall not be subject to—</text><paragraph id="H057E3AF3124443ED920C33A58A486132"><enum>(1)</enum><text>administrative review, including, in the case of the Forest Service, the notice, comment, and appeal requirements of section 322 of the Department of the Interior and Related Agencies Appropriations Act, 1993 (<external-xref legal-doc="public-law" parsable-cite="pl/102/381">Public Law 102–381</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/16/1612">16 U.S.C. 1612</external-xref> note); or</text></paragraph><paragraph id="HF3F33CDD2F384E4892CD6A88CE0B2CEC"><enum>(2)</enum><text>judicial review in any court of the United States.</text></paragraph></subsection><subsection id="H26E45793FD4042C0B63C8B92E67F5A76"><enum>(d)</enum><header>Limitation; rule of construction</header><text display-inline="yes-display-inline">Nothing in this section shall be construed in a manner that would affect the land management plan applicable to any area designated as a component of the National Wilderness Preservation System under section 3 of the Wilderness Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1132">16 U.S.C. 1132</external-xref>) and containing lands covered by subsection (a).</text></subsection></section></legis-body></bill>
