which was referred to the <committee-name committee-id="HJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Immigration and Nationality Act to promote family unity, and for other purposes.</official-title></form><legis-body id="H88729BE6D9814BCF9CBFAB5737777D3D" style="OLC"><section id="HB61DECC8E4DD4A0E99BEE6352503B84A" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>American Families United Act</short-title></quote>.</text></section><section id="H59E6E10211794C38A794708EF36503F2"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds the following:</text><paragraph id="H24EA464E50C04BDFBCB8787B2E09B29A"><enum>(1)</enum><text display-inline="yes-display-inline">The rights and interests of U.S. citizens should be protected by our Nation’s immigration laws.</text></paragraph><paragraph id="HE68A32430CA04BB889B214B7C3813CB8"><enum>(2)</enum><text>It is the intent of Congress to provide the Attorney General and Secretary of Homeland Security with the limited ability to provide fairness to the spouses, children and parents of American citizens in immigration proceedings on a case-by-case basis.</text></paragraph></section><section id="HB8C1FBB3596A4B55AF0768CF9CF8EB56"><enum>3.</enum><header>Rules of Construction</header><text display-inline="no-display-inline">Nothing in this Act shall be construed—</text><paragraph id="HDCF95153C63743C091CB8A51FB3FE32C"><enum>(1)</enum><text>to provide the Attorney General or the Secretary of Homeland Security with the ability to expand the discretionary authority beyond a case-by-case basis; or</text></paragraph><paragraph id="HB6976283D4BD45899E33A28B14816527"><enum>(2)</enum><text>to provide, confirm or concur legalization or nationalization of persons covered under this Act, it is solely designed to address hardships incurred by a small minority of American families that are adversely affected by inadmissibility and deportation provisions that cause family separation.</text></paragraph></section><section id="HC8AC7691A9C0497984F50BA7133E9143"><enum>4.</enum><header>Waivers of inadmissibility</header><subsection id="HFD41DC6AE64048B4874907ECD006174C"><enum>(a)</enum><header>Aliens who entered as children</header><text display-inline="yes-display-inline">Section 212(a)(9)(B)(iii) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1182">8 U.S.C. 1182(a)(9)(B)(iii)</external-xref>) is amended by adding at the end the following:</text><quoted-block id="HE33FBE43F6D649E6BA62493CC95A066E" style="OLC"><subclause id="HF05AA8DCD94B4BEFB4375F0DEF370E18"><enum>(VI)</enum><header>Aliens who entered as children</header><text>Clause (i) shall not apply to an alien who is the beneficiary of an approved petition under 101(a)(15)(H) and who has earned a baccalaureate or higher degree from a United States institution of higher education (as defined in section 101(a) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1001">20 U.S.C. 1001(a)</external-xref>)), and had not yet reached the age of 16 years at the time of initial entry to the United States.</text></subclause><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H010C5273A4BF479FB311BEDE6BF1298B"><enum>(b)</enum><header>Aliens unlawfully present</header><text display-inline="yes-display-inline">Section 212(a)(9)(B)(v) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1181">8 U.S.C. 1181(a)(9)(B)(v)</external-xref>) is amended—</text><paragraph id="H279F1E3C89AE4B58847438C026E09209"><enum>(1)</enum><text>by striking <quote>spouse or son or daughter</quote> and inserting <quote>spouse, son, daughter, or parent</quote>;</text></paragraph><paragraph id="H4089147677F14E11B8895F2989DF1357"><enum>(2)</enum><text>by striking <quote>extreme</quote>; and</text></paragraph><paragraph id="HAD2E0558E88140569139F616718BB9DA"><enum>(3)</enum><text>by inserting <quote>, child,</quote> after <quote>lawfully resident spouse</quote>.</text></paragraph></subsection><subsection id="H34AD8A8C6AAF4A85A1B5EC0CA003868D"><enum>(c)</enum><header>Previous immigration violations</header><text display-inline="yes-display-inline">Section 212(a)(9)(C)(i) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1182">8 U.S.C. 1182(a)(9)(C)(i)</external-xref>) is amended by adding <quote>, other than an alien described in clause (iii) or (iv) of subparagraph (B),</quote> after <quote>Any alien</quote>.</text></subsection><subsection id="H174B71BD77CC482482F77B7125E058AD"><enum>(d)</enum><header>False claims</header><paragraph id="H554D8FB16C8749D7A45F850591EA8853"><enum>(1)</enum><header>Inadmissibility</header><subparagraph id="H8CDA1C1A767843008C93C709C21E8025"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Section 212(a)(6)(C) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1182">8 U.S.C. 1182(a)(6)(C)</external-xref>) is amended to read as follows:</text><quoted-block id="H45871620243A4DD9948E1B89F6A16AB0" style="OLC"><subparagraph id="H49AEC3FBD16E46DB90155DBB12B3778F"><enum>(C)</enum><header>Misrepresentation</header><clause id="HC2EF52F32C624D52AF9799531E6199EB"><enum>(i)</enum><header>In general</header><text>Any alien who, by fraud or willfully misrepresenting a material fact, seeks to procure (or within the last 3 years has sought to procure or has procured) a visa, other documentation, or admission into the United States or other benefit provided under this Act is inadmissible.</text></clause><clause id="HB46F4DCCB7294C91BC6BC736F4B216AA"><enum>(ii)</enum><header>Falsely claiming citizenship</header><subclause id="H4EB8E91D702643199057A044B855DB38"><enum>(I)</enum><header>Inadmissibility</header><text>Subject to subclause (II), any alien who knowingly misrepresents himself or herself to be a citizen of the United States for any purpose or benefit under this chapter (including section 274A) or any other Federal or State law is inadmissible.</text></subclause><subclause id="H0A2FA115B7DF41AA804A7DDDDC1E1760"><enum>(II)</enum><header>Special rule</header><text>An alien shall not be inadmissible under this clause if the misrepresentation described in subclause (I) was made by the alien when the alien—</text><item id="H0D35277901D0488FB47076FA810B0713"><enum>(aa)</enum><text>was under 18 years of age; or</text></item><item id="HD2315B624B8D45AA879163F362574E1A"><enum>(bb)</enum><text>otherwise lacked the mental competence to knowingly misrepresent a claim of United States citizenship.</text></item></subclause></clause><clause id="H19B53E6774964954A93C70B11BDDD924"><enum>(iii)</enum><header>Waiver</header><text>The Attorney General or the Secretary of Homeland Security may, in the discretion of the Attorney General or the Secretary, waive the application of clause (i) or (ii)(I) for an alien, regardless whether the alien is within or outside the United States, if the Attorney General or the Secretary find that a determination of inadmissibility to the United States for such alien would—</text><subclause id="H9200FEDCC594467DA16657F8B4BC4BA5"><enum>(I)</enum><text display-inline="yes-display-inline">result in hardship to the alien or to the alien’s parent, spouse, son, or daughter who is a citizen of the United States or an alien lawfully admitted for permanent residence; or</text></subclause><subclause id="H08D28796400341A29E8F2ED492086708"><enum>(II)</enum><text>in the case of a VAWA self-petitioner, result in hardship to the alien or a parent or child of the alien who is a citizen of the United States, an alien lawfully admitted for permanent residence, or a qualified alien (as defined in section 431 of the Personal Responsibility and Work Opportunity Reconciliation Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/8/1641">8 U.S.C. 1641(b)</external-xref>)).</text></subclause><continuation-text continuation-text-level="clause">For purposes of this clause, family separation in and of itself shall be deemed to be a hardship.</continuation-text></clause><clause id="H79364F55FB9E49C1A2DF94FC03DA5A8F"><enum>(iv)</enum><header>Limitation on review</header><text>No court shall have jurisdiction to review a decision or action of the Attorney General or the Secretary regarding a waiver under clause (iii).</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph><subparagraph id="HF3E08E405B8B4595BBA0485794529E63"><enum>(B)</enum><header>Conforming amendment</header><text display-inline="yes-display-inline">Section 212 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1182">8 U.S.C. 1182</external-xref>) is amended by striking subsection (i).</text></subparagraph></paragraph><paragraph id="H23A87C7CA12C45FF9A5DADE0365763C0"><enum>(2)</enum><header>Deportability</header><text display-inline="yes-display-inline">Section 237(a)(3)(D) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1227">8 U.S.C. 1227(a)(3)(D)</external-xref>) is amended to read as follows:</text><quoted-block id="H9D66B06F780E433393F6EBEA3D11B73A" style="OLC"><subparagraph id="H18C8D760391343D9B4F9B4DC9388281B"><enum>(D)</enum><header>Falsely claiming citizenship</header><text>Any alien described in section 212(a)(6)(C)(ii) is deportable.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H4BEBB7F788F14DCBB52D0BD17627D5F7"><enum>(e)</enum><header>Definition of Conviction</header><paragraph id="H5215C62E4A26442E8A50509933A45517"><enum>(1)</enum><text display-inline="yes-display-inline">Section 101(a)(48) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101(a)(48)</external-xref>) is amended by striking subparagraphs (A) and (B) and inserting the following:</text><quoted-block id="HA071283A300047DFA6B929E11ED58052"><subparagraph id="H8DBDD96D635443C591E9F6912C770194"><enum>(A)</enum><text>The term <quote>conviction</quote> means, with respect to an alien, a final, formal judgment of guilt entered by a court. Where a State or Federal court enters an adjudication or judgment of guilt that has been withheld, deferred, expunged, annulled, invalidated or vacated, or enters an order of probation without entry of judgment, or any similar disposition under State or Federal law such judgment or adjudication shall not be considered a conviction for purposes of this Act.</text></subparagraph><subparagraph id="H82A54DC3B5F74690A9C9F40D81B6FC30"><enum>(B)</enum><text>Any pardon entered by a State or Federal authority shall render the prior conviction null and void for all purposes under this Act.</text></subparagraph><subparagraph id="HD42165C417E545CC8E373632DCDFF19D"><enum>(C)</enum><text>Any reference to a term of imprisonment or a sentence with respect to an offense is deemed to include only the actual period of incarceration or confinement ordered by a court of law. The suspension of the imposition or execution of that imprisonment or sentence in whole or in part shall not be included as a part of the sentence for purposes of this Act.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="H129ECA460BF1456687DFF8087AEA8AA3"><enum>(2)</enum><header>Effective Date and Application</header><text>The amendments made by subsection (a) shall take effect on the date of the enactment of this Act and shall apply to convictions and sentences entered before, on, or after the date of the enactment of this Act.</text></paragraph></subsection></section><section id="H9CF2D5CAD72A4723A7E4682351AF7C18"><enum>5.</enum><header>Discretionary authority with respect to removal, deportation, ineligibility or inadmissibility of citizen and resident immediate family members</header><subsection id="H9522E081494948188E784D01F8A53F12"><enum>(a)</enum><header>Applications for relief from removal</header><text display-inline="yes-display-inline">Section 240(c)(4) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1229a">8 U.S.C. 1229a(c)(4)</external-xref>) is amended by adding at the end the following:</text><quoted-block id="HCE92E2A4607341ED9DD0DCF0B78D94AD" style="OLC"><subparagraph id="H21ECEE4FB2FC4190B013E6E05C2A4E5B"><enum>(D)</enum><header>Judicial discretion</header><text display-inline="yes-display-inline">In the case of an alien subject to removal, deportation, ineligibility or inadmissibility, the immigration judge may exercise discretion to decline to order the alien removable, deportable, ineligible or inadmissible from the United States and terminate proceedings or grant permission to reapply for admission or any application for relief from removal if the judge determines that such removal, deportation, ineligibility or inadmissibility is against the public interest or would result in hardship to the alien’s United States citizen or lawful permanent resident parent, spouse, or child, or the judge determines the alien is prima facie eligible for naturalization except that this subparagraph shall not apply to an alien whom the judge determines—</text><clause id="H27E8362D2BD6426DA26F8D9CF8C445A4"><enum>(i)</enum><text>is inadmissible or deportable under—</text><subclause id="H355867CDC63149139B046E7C73BBBCC8"><enum>(I)</enum><text>subparagraph (B), (C), (D)(ii), (E), (H), or (I) of section 212(a)(2);</text></subclause><subclause id="H7EC37EF3556D41058B85033A6ED26E3E"><enum>(II)</enum><text>section 212(a)(3);</text></subclause><subclause id="H38D77295EA364BFABB15C04F3FBFF104"><enum>(III)</enum><text>subparagraph (A), (C), or (D) of section 212(a)(10); or</text></subclause><subclause id="HEE1CCC8CEB7C47EDB243E0E70921109D"><enum>(IV)</enum><text>paragraph (2)(A)(ii), (2)(A)(v), (2)(F), (4), or (6) of section 237(a); or</text></subclause></clause><clause id="H1714AE92CDAF4FB2BF654FBD00B4DBE4"><enum>(ii)</enum><text>has—</text><subclause id="H44DF208B40704C43B7421FCB15F1ACFB"><enum>(I)</enum><text>engaged in conduct described in paragraph (8) or (9) of section 103 of the Trafficking Victims Protection Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/22/7102">22 U.S.C. 7102</external-xref>); or</text></subclause><subclause id="H1281D853BE244E35861B6DB79909CB89"><enum>(II)</enum><text>a felony conviction described in section 101(a)(43) that would have been classified as an aggravated felony at the time of conviction.</text></subclause><continuation-text continuation-text-level="clause">For purposes of this subparagraph, family separation in and of itself shall be deemed to be a hardship and shall be deemed to be against the public interest.</continuation-text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H27F7DC699DCC4CC590B912BF57D087A0"><enum>(b)</enum><header>Secretary’s discretion</header><text display-inline="yes-display-inline">Section 212 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1182">8 U.S.C. 1182</external-xref>) is amended by adding at the end the following:</text><quoted-block id="HFA007F49018143AE9BEC6863AF89FFA0" style="OLC"><subsection id="HFB0F34ACC13E4778A53F931DA11E2B4B"><enum>(u)</enum><header>Secretary’s discretion</header><text display-inline="yes-display-inline">In the case of an alien who is inadmissible under this section or deportable under section 237 or ineligible under any provision of this Act, the Secretary of Homeland Security may exercise discretion to waive a ground of ineligibility, inadmissibility or deportability or grant permission to reapply for admission or any application for immigration benefits if the Secretary determines that such ineligibility, removal or refusal of admission is against the public interest or would result in hardship, including family separation, to the alien’s United States citizen or permanent resident parent, spouse, or child. For purposes of this subsection, family separation in and of itself shall be deemed to be a hardship and shall be deemed to be against the public interest. This subsection shall not apply to an alien whom the Secretary determines—</text><paragraph id="HEBA29A8D303D462D83CE7B3A787195D4"><enum>(1)</enum><text>is inadmissible or deportable under—</text><subparagraph id="H7669AE2A93024151A474BD3CDF207D92"><enum>(A)</enum><text>subparagraph (B), (C), (D)(ii), (E), (H), or (I) of subsection (a)(2);</text></subparagraph><subparagraph id="H0A09AC55EA7A4FA19161CA97098091D4"><enum>(B)</enum><text>subsection (a)(3);</text></subparagraph><subparagraph id="H7BB9E38A1D8E4EE6807935B56480DB11"><enum>(C)</enum><text>subparagraph (A), (C), or (D) of subsection (a)(10);</text></subparagraph><subparagraph id="HD6D8D16050594F1EB47643E1E2480FBD"><enum>(D)</enum><text>paragraph (2)(A)(ii), (2)(A)(v), (2)(F), or (6) of section 237(a); or</text></subparagraph><subparagraph id="H9F7F865AFE884149B589CC92DEF57384"><enum>(E)</enum><text>section 240(c)(4)(D)(ii)(II); or</text></subparagraph></paragraph><paragraph id="H374E7061DF8C45A4A33779263943B101"><enum>(2)</enum><text>has—</text><subparagraph id="H97E7A6003CED42768BB9FED5F7C23C5C"><enum>(A)</enum><text>engaged in conduct described in paragraph (8) or (9) of section 103 of the Trafficking Victims Protection Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/22/7102">22 U.S.C. 7102</external-xref>);</text></subparagraph><subparagraph id="HD0DF7FB7A14046D0A7C33071DE11E11F"><enum>(B)</enum><text>a felony conviction described in section 101(a)(43) that would have been classified as an aggravated felony at the time of conviction;</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H8A5AC45C21FF4F73A7FB05A28D3A23B3"><enum>(c)</enum><header>Reinstatement of removal orders</header><text display-inline="yes-display-inline">Section 241(a)(5) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1231">8 U.S.C. 1231(a)(5)</external-xref>) is amended by striking the period at the end and inserting <quote>, unless the alien reentered prior to attaining the age of 18 years, or reinstatement of the prior order of removal would not be in the public interest or would result in hardship, including family separation, to the alien’s United States citizen or permanent resident parent, spouse, or child.</quote>.</text></subsection></section></legis-body></bill>
