R. 3425</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action><action-date date="20131030">October 30, 2013</action-date><action-desc><sponsor name-id="L000563">Mr. Lipinski</sponsor> (for himself, <cosponsor name-id="S001191">Ms. Sinema</cosponsor>, <cosponsor name-id="P000608">Mr. Peters of California</cosponsor>, <cosponsor name-id="G000572">Mr. Gallego</cosponsor>, <cosponsor name-id="B001279">Mr. Barber</cosponsor>, <cosponsor name-id="M001191">Mr. Murphy of Florida</cosponsor>, <cosponsor name-id="B001252">Mr. Barrow of Georgia</cosponsor>, <cosponsor name-id="V000132">Mr. Vela</cosponsor>, and <cosponsor name-id="G000573">Mr. Garcia</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HWM00">Committee on Ways and Means</committee-name>, and in addition to the Committee on <committee-name committee-id="HIF00">Energy and Commerce</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Patient Protection and Affordable Care Act to delay the individual health insurance mandate and any penalties for violating the individual mandate until after there is a certification that the healthcare.gov website is fully operational, and for other purposes.</official-title></form><legis-body id="HE607D20791474452A959C18F9989548A" style="OLC"><section id="H0CF96B0D627D41E8984AFD5C78FAC0EE" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Health Care Access Fairness and Penalty Delay Act of 2013</short-title></quote>.</text></section><section id="HD1D7D9CE3C7A41BF9D6DC2320438A174" section-type="subsequent-section"><enum>2.</enum><header>Delay in applying individual health insurance mandate and penalty for violating the mandate before healthcare.gov is certified as being fully operational</header><text display-inline="no-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/26/5000A">Section 5000A</external-xref> of the Internal Revenue Code of 1986 is amended by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="H0DD6DB262C84400AA7E855C5884E43A9" style="OLC"><subsection id="HC3CC10BEE1564B659E470E0873802A11"><enum>(h)</enum><header>Delay in application</header><paragraph id="H01C86D71554B465795E024A2ABFE4D80"><enum>(1)</enum><header>In general</header><text>The provisions of this section shall not apply to an individual for any month that begins earlier than 30 days after the end of the extension of enrollment period provided under paragraph (4). In applying the previous provisions of this section, the Secretary of the Treasury shall adjust the dates in this section accordingly based on the application of this subsection.</text></paragraph><paragraph id="H30746645EDAF4F6C9888FF758C0389F4"><enum>(2)</enum><header>GAO report on progress on making the website fully operational</header><text display-inline="yes-display-inline">Beginning not later than 30 days after the date of the enactment of the <short-title>Health Care Access Fairness and Penalty Delay Act of 2013</short-title> and monthly thereafter (until such time as the Inspector General submits the certification under paragraph (3)), the Comptroller General of the United States shall submit to Congress and to the Inspector General for the Department of Health and Human Services monthly reports on the progress of the healthcare.gov website in becoming fully operational (as defined in paragraph (5)).</text></paragraph><paragraph display-inline="no-display-inline" id="H8C7FD22D0D88463BAACDB7DF07C25BC4"><enum>(3)</enum><header>Inspector General of Health and Human Services certification</header><text>Taking into account the reports submitted under paragraph (2), the Inspector General of the Department of Health and Human Services shall make a determination on whether or not the healthcare.gov website is fully operational and, if so, shall submit to Congress (and post on an appropriate public website) a certification that the healthcare.gov website is fully operational.</text></paragraph><paragraph display-inline="no-display-inline" id="HDD32ADE1A2BB4C089A7D53A8B381BA68"><enum>(4)</enum><header>Extension of initial enrollment period</header><text display-inline="yes-display-inline">The Secretary of Health and Human Services shall take such steps as are necessary to extend the initial enrollment period for individuals in qualified health plans offered through Exchanges under the Patient Protection and Affordable Care Act so that such period does not end earlier than 90 days after the date of the submittal to Congress of the certification under paragraph (3).</text></paragraph><paragraph id="H2BA431BF645045BF9462D5CF37087773"><enum>(5)</enum><header>Fully operational defined</header><text display-inline="yes-display-inline">In this subsection, the term <term>fully operational</term> means, with respect to the healthcare.gov website, that the website is fully functional and operating in a manner consistent with the role envisioned for Exchanges under the Patient Protection and Affordable Care Act (and the amendments made by such Act).</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body></bill>
