R. 3423</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action><action-date date="20131030">October 30, 2013</action-date><action-desc><sponsor name-id="L000559">Mr. Langevin</sponsor> (for himself, <cosponsor name-id="W000804">Mr. Wittman</cosponsor>, <cosponsor name-id="W000808">Ms. Wilson of Florida</cosponsor>, <cosponsor name-id="M001185">Mr. Sean Patrick Maloney of New York</cosponsor>, <cosponsor name-id="N000147">Ms. Norton</cosponsor>, <cosponsor name-id="B001270">Ms. Bass</cosponsor>, and <cosponsor name-id="G000569">Mr. Grimm</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HWM00">Committee on Ways and Means</committee-name>, and in addition to the Committee on <committee-name committee-id="HIF00">Energy and Commerce</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title>To ensure the safety and well-being of adopted children.</official-title></form><legis-body id="HA06CB6F1F5324B6A9FBF2D696EBDA54A" style="OLC"><section id="HE1EF0DB3719A473CB91D2EC7D2CA3AC8" section-type="section-one"><enum>1.</enum><header>Adoption support services</header><subsection id="HEA543997293645EF9A3B1F5651AA7435"><enum>(a)</enum><header>Ensuring well-Being of adopted children and adoptive families</header><text>Section 421 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/621">42 U.S.C. 621</external-xref>) is amended—</text><paragraph id="H1849E6E96CE743ACA618138F8D1087CC"><enum>(1)</enum><text>in paragraph (4), by striking <quote>and</quote> at the end;</text></paragraph><paragraph id="H177FCBF12A474CA5B698BEAFD9C6D2B5"><enum>(2)</enum><text>by redesignating paragraph (5) as paragraph (6); and</text></paragraph><paragraph id="H96FEC2D2531E4CCF9621A00FFDB540DD"><enum>(3)</enum><text>by inserting after paragraph (4) the following new paragraph:</text><quoted-block id="H00863354302F4C7C9BE684945C42CCCD" style="OLC"><paragraph id="HDBE1A65CA11448D08ABA57628E393548"><enum>(5)</enum><text>ensuring the well-being of adopted children and their adoptive families and promoting efforts to prevent such children from entering the foster care system through the provision of pre- and post-adoptive support services; and</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="HF6DCDE4353614BA18CF0123A965C3493"><enum>(b)</enum><header>Pre- and Post-Adoptive Support Services</header><text>Paragraph (8) of section 431(a) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/629a">42 U.S.C. 629a(a)</external-xref>) is amended to read as follows:</text><quoted-block id="H199D91D075CC4E5E83F66639F0A11929" style="OLC"><paragraph id="H0FDF4BF7FE8044F588EC869A8EBA8076"><enum>(8)</enum><header>Adoption promotion and support services</header><subparagraph id="H1BFD41EB6A514EF9B18AFE6E8C8AF663"><enum>(A)</enum><header>In general</header><text>The term <term>adoption promotion and support services</term> means services and activities designed to encourage more adoptions out of the foster care system and support domestic adoptions and adoptions from other countries, consistent with promoting the best interests of adopted children and their adoptive families. Such services and activities may include pre- and post-adoptive support services, as described in subparagraph (B), that are designed to support adopted children and their adoptive families.</text></subparagraph><subparagraph id="HDCCDBD719F7A4E439A86718DAEE522B2"><enum>(B)</enum><header>Pre- and post-adoptive support services</header><text>The term <term>pre- and post-adoptive support services</term> means the following:</text><clause id="HC03AC422DEE543B5B09483F131086451"><enum>(i)</enum><text>Pre-adoptive support services, which may include—</text><subclause id="HAD5B5C6376D74E0592BFC52F5CE4AC77"><enum>(I)</enum><text>direct services, including training, educational support, counseling, case management, and other services for adoptive parents and families that address caregiver interests and concerns regarding common behavioral issues, such as—</text><item id="H15CB6F3FCD1D44F3B152B49EF35CE0BB"><enum>(aa)</enum><text>issues relating to emotional, behavioral, or developmental health needs;</text></item><item id="H5FF61804A10046109FAF7CD73707C6B1"><enum>(bb)</enum><text>issues relating to attachment, identity, abandonment, cultural differences, grief, and loss;</text></item><item id="H995A353C77B242CBB9BE1E64326ACDC5"><enum>(cc)</enum><text>issues resulting from birth defects due to fetal alcohol syndrome or any other substance abuse-related developmental disorder;</text></item><item id="H6BD68E14F2CB48CF8ED570F9F821489F"><enum>(dd)</enum><text>the conditions that a child is being adopted from, and how this will influence the child’s emotional and social development; and</text></item><item id="H6B89B033D0864FB58A19C0B31F6AB118"><enum>(ee)</enum><text>adoptive families should receive full disclosure of the child’s background information (non-identifying and identifying when needed or when agreed upon in an open adoption). This information should include but not be limited to information from family, agency, court, school, mental health, and medical files;</text></item></subclause><subclause id="HCB9701C71C54445F9803FB6820307F28"><enum>(II)</enum><text>the provision of educational resources for adoptive parents regarding the geographic, ethnic, and cultural background of the adopted child;</text></subclause><subclause id="HD2D9AC2B86414252A01BA5C2A2C6DE46"><enum>(III)</enum><text>peer-to-peer mentoring and support groups that permit a newly adoptive parent to communicate and learn from more experienced adoptive parents, including programs that enhance communication between adoptive parents with children of similar geographic, ethnic, or cultural backgrounds; and</text></subclause><subclause id="HBE288145E29147FCB901F8C93F4C7F40"><enum>(IV)</enum><text>the provision of informational resources for adoptive parents, including—</text><item id="H2DFE50ADC52B47A98EE8B6141C5854A0"><enum>(aa)</enum><text>resources available through Federal and State agencies, including information regarding benefits for children with a medical condition or a physical, mental, or emotional disability;</text></item><item id="HD1C12F65F12A44919EDF031FD6B875E8"><enum>(bb)</enum><text>newsletters, Web sites, and other informational resources regarding adoption-related services;</text></item><item id="HE7F1BC87C80A4064ACB75C7A8378BF68"><enum>(cc)</enum><text>the establishment of lending libraries containing information and resources for adoptive parents; and</text></item><item id="H084ED576A7E54342B708C1AFFA88A3BF"><enum>(dd)</enum><text>conferences, parent support discussion groups, and seminars that are available to adoptive parents and other relevant stakeholders.</text></item></subclause></clause><clause id="H731DED49662443129DD92DB7C4CC1DA3"><enum>(ii)</enum><text>Post-adoptive support services, which may include—</text><subclause id="HEBE0684FB69047EBAA0391054BBC1753"><enum>(I)</enum><text>continued provision to adoptive parents of pre-adoptive support services described in clause (i);</text></subclause><subclause id="H047CD4204AB443B39465CC28C10A4A1B"><enum>(II)</enum><text>the provision of accessible and reliable respite services for adoptive parents;</text></subclause><subclause id="H13F4A5F378A84D3EBA066D78D1E2FF83"><enum>(III)</enum><text>direct services and counseling for adopted child and family, including, as appropriate—</text><item id="H7FD367E6A5F64A2E9415E549CD93AA07"><enum>(aa)</enum><text>support services for an adopted child with emotional, behavioral, or developmental health needs;</text></item><item id="H5FC9C97011C641DE850CE23978DA3BB2"><enum>(bb)</enum><text>support services that address issues relating to attachment, identity, abandonment, cultural differences, grief, and loss; and</text></item><item id="H36A7247ACCFF4F9ABBEF7DD8FFF04FB4"><enum>(cc)</enum><text>treatment services that are specialized for adopted children, including psychiatric residential services, outpatient mental health services, social skills training, intensive in-home supervision services, recreational therapy, suicide prevention, and substance abuse treatment;</text></item></subclause><subclause id="HD26C1A2506B84B7192B60E35C0D1BFF1"><enum>(IV)</enum><text>peer-to-peer mentoring and support groups that allow adopted children to communicate and socialize with other adopted children, including programs that provide for communication between adopted children from similar geographic, ethnic, or cultural backgrounds; and</text></subclause><subclause id="H13EF9E173E00497E9B1102DE95B3B954"><enum>(V)</enum><text>crisis and family preservation services, including respite care and crisis counseling and a 24-hour emergency hotline for adoptive parents.</text></subclause></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="H6A5F900C4B0D4883905E30380E331E8E"><enum>2.</enum><header>Funding for adoption support services</header><text display-inline="no-display-inline">Paragraph (8) of section 473(a) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/673">42 U.S.C. 673(a)</external-xref>) is amended to read as follows:</text><quoted-block id="HEC90784C4F0B4A7E92FEA552D03FD2A4" style="OLC"><paragraph id="H7CDCABD15BAD4CB2BC905498F3DD8019" indent="up1"><enum>(8)</enum><text>With respect to the amount of savings (if any) in State expenditures under this part resulting from the application of paragraph (2)(A)(ii) to all applicable children for a fiscal year, a State shall—</text><subparagraph id="H4D7AFCBE9271436BA07CB83F4B02F393"><enum>(A)</enum><text>spend a significant portion, not less than 20 percent, of such amount to provide pre- and post-adoptive support services (as defined in section 431(a)(8)(B));</text></subparagraph><subparagraph id="H3462C65B643C4D14826ACA0DBEBEC17E"><enum>(B)</enum><text>spend the remainder of such amount to provide to children or families any other services that may be provided under this part or part B; and</text></subparagraph><subparagraph id="H1974D72574D24F918B73A5A10E92F91E"><enum>(C)</enum><text>on an annual basis, submit to the Secretary a report that provides a detailed account of any services that were funded pursuant to this paragraph.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="H8960E71E176C44FEAE5473CEAF52C98A"><enum>3.</enum><header>Federal grant program for post-adoption mental health services</header><text display-inline="no-display-inline">Subpart 3 of part B of title V of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/290bb-3">42 U.S.C. 290bb–3 et seq.</external-xref>) is amended by adding at the end the following:</text><quoted-block id="H847A74BECB73487DA55D2AD408DEF364" style="OLC"><section id="H623EC518459046FDAD6F2ADDF0337D65"><enum>520L.</enum><header>Post-adoption mental health services</header><subsection id="H98FFA94CBF9549749194DBEB234211F6"><enum>(a)</enum><header>In general</header><text>The Secretary, acting through the Administrator, shall award grants or cooperative agreements to eligible entities to—</text><paragraph id="HF4D9CB0BB65747B79FBE9FE075BA83CC"><enum>(1)</enum><text>develop and implement Statewide or tribal post-adoption mental health service programs for all adopted children;</text></paragraph><paragraph id="HB9C7C535FA43414B9157261D36D75220"><enum>(2)</enum><text>support public organization and private nonprofit organizations actively involved in Statewide or tribal post-adoption mental health service programs;</text></paragraph><paragraph id="H24F2B325A29F4C34AA51A5FE4B4E5813"><enum>(3)</enum><text>collect and analyze data on State-sponsored Statewide or tribal post-adoption mental health service programs that can be used to monitor the effectiveness of such services and for research, technical assistance, and policy development;</text></paragraph><paragraph id="H5FD51DB9A97F4D7CB094D11FC113F499"><enum>(4)</enum><text>develop and provide educational and training opportunities concerning the mental health needs of adopted children and their families for use by teachers, social workers, and other community mental health service providers; and</text></paragraph><paragraph id="H2978EF14809A4D3DB25ADA815B329DE9"><enum>(5)</enum><text>develop and provide materials for potential adoptive parents, both for domestic adoptions and adoptions from other countries, describing the possible need for post-adoption mental health services and available resources.</text></paragraph></subsection><subsection id="H6A780A3191F04F26BEB2F521DBFC02F3"><enum>(b)</enum><header>Eligible entity</header><paragraph id="H767BFE2CA07548EE9E27EA0DC613B006"><enum>(1)</enum><header>Definition</header><text>In this section, the term <term>eligible entity</term> means—</text><subparagraph id="HFA98573BC1B3407C834630C8AF4CBBD0"><enum>(A)</enum><text>a State;</text></subparagraph><subparagraph id="HFCC99B5D0A984248A213747232611083"><enum>(B)</enum><text>a public organization or private nonprofit organization designated by a State to develop or direct the State-sponsored Statewide post-adoption mental health service program under a grant under this section; and</text></subparagraph><subparagraph id="H6BD46C9DA1EF440BA41AFADF47D9DBA8"><enum>(C)</enum><text>a Federally recognized Indian tribe or tribal organization (as defined in the Indian Self-Determination and Education Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/25/450">25 U.S.C. 450 et seq.</external-xref>)) or an urban Indian organization (as defined in the Indian Health Care Improvement Act (<external-xref legal-doc="usc" parsable-cite="usc/25/1601">25 U.S.C. 1601 et seq.</external-xref>)) that is actively involved in the development and continuation of a post-adoption mental health service program.</text></subparagraph></paragraph><paragraph id="HD5A31266ABFA47CBB1585E41644DA524"><enum>(2)</enum><header>Limitation</header><text>In carrying out this section, the Secretary shall ensure that each State is awarded only 1 grant or cooperative agreement under this section. For purposes of the preceding sentence, a State shall be considered to have been awarded a grant or cooperative agreement if the eligible entity involved is the State or an entity designated by the State under paragraph (1)(B). Nothing in this paragraph shall be construed to apply to entities described in paragraph (1)(C).</text></paragraph></subsection><subsection id="H7EBC3B3BC34145CC9668B58109B9AFFB"><enum>(c)</enum><header>Preference</header><text>In providing assistance under a grant or cooperative agreement under this section, the Secretary shall give preference to eligible entities that have demonstrated success in increasing the level of adoption competency among mental health providers, adoption lawyers, social workers, case workers, and adoptive parents.</text></subsection><subsection id="H8CB5DA90D37344808926A8B24C8ABFDD"><enum>(d)</enum><header>Requirement for direct services</header><text>Not less than 85 percent of funds received under a grant or cooperative agreement under this section shall be used to provide direct services, of which not less than 5 percent shall be used for activities authorized under subsection (a)(3).</text></subsection><subsection id="H5BF5D782C56244788DEB8F34E42F1C5A"><enum>(e)</enum><header>Coordination and collaboration</header><paragraph id="H1D0E5371404F4FFE83E73C074519C91E"><enum>(1)</enum><header>In general</header><text>In carrying out this section, the Secretary shall collaborate with relevant Federal agencies and adoption-related working groups to promote interaction between domestic foster care agencies and private adoption agencies in other countries.</text></paragraph><paragraph id="H6DDC163679DD4C078F8935F7B58ECB6D"><enum>(2)</enum><header>Consultation</header><text>In carrying out this section, the Secretary shall consult with—</text><subparagraph id="HC3DFD32EB9E9403082384840C1C2F19B"><enum>(A)</enum><text>State and social service agencies engaged in the placement of children for adoption, domestically or from other countries;</text></subparagraph><subparagraph id="H563DF5F9A5F74B708C5327FDD1AB81DA"><enum>(B)</enum><text>local and national organizations that serve foster and adopted youth;</text></subparagraph><subparagraph id="H84D9B14D3D8A428CBD9FE18FDB1656CF"><enum>(C)</enum><text>health and education specialists who focus on adoption and foster care medicine;</text></subparagraph><subparagraph id="HAE4DFA6711F34FE7AB254930CBE17FC4"><enum>(D)</enum><text>youth who have been in foster care or adopted, domestically or from other countries;</text></subparagraph><subparagraph id="H66BA4E5BCA9C454689A5B325B535E4CE"><enum>(E)</enum><text>families and friends of youth who have been in foster care or adopted, domestically or from other countries; and</text></subparagraph><subparagraph id="H9431093EB3D4476F915A8B0D710D4380"><enum>(F)</enum><text>qualified professionals who possess the specialized knowledge, skills, experience, and relevant attributes needed to serve adopted children and their families.</text></subparagraph></paragraph><paragraph id="HAD14462A6B2347DBB40085E382DFA8C6"><enum>(3)</enum><header>Policy development</header><text>In carrying out this section, the Secretary shall—</text><subparagraph id="HC7F2373C35484A27B70A54300F299A6E"><enum>(A)</enum><text>coordinate and collaborate on policy development with the Administration for Children and Families and other relevant Department of Health and Human Services agencies and adoption-related working groups; and</text></subparagraph><subparagraph id="HD592BFDA3D4441538202DD410367DA86"><enum>(B)</enum><text>consult on policy development at the Federal level with those in the private sector engaged in the recruitment of foster and adoptive parents, the placement of children in foster care and for adoption, and the provision of post-adoption services.</text></subparagraph></paragraph></subsection><subsection id="H336810E458984AC7BA7A6C71FC2B7F97"><enum>(f)</enum><header>Evaluation and report</header><paragraph id="HEFA05AF8D24845BD9FFCB56FFCCD10D1"><enum>(1)</enum><header>Evaluations by eligible entities</header><text>Not later than 18 months after receipt of a grant or cooperative agreement under this section, an eligible entity shall submit to the Secretary the results of an evaluation to be conducted by the entity concerning the effectiveness of the activities carried out under the grant or agreement.</text></paragraph><paragraph id="H60E30751888A4B76A4D688F21FA0BBA1"><enum>(2)</enum><header>Report</header><text>Not later than 2 years after the date of enactment of this section, the Secretary shall submit to the appropriate committees of Congress a report concerning the results of—</text><subparagraph id="H075ED421AB004C6A8C35A7550EE98019"><enum>(A)</enum><text>the evaluations conducted under paragraph (1); and</text></subparagraph><subparagraph id="HFCB3EBEEFCB74BD08889F224DD7709E8"><enum>(B)</enum><text>an evaluation conducted by the Secretary to analyze the effectiveness and efficacy of the activities conducted with grants, collaborations, and consultations under this section.</text></subparagraph></paragraph></subsection><subsection id="H3D28B0262FF44733BE647DCB75EBBBD8"><enum>(g)</enum><header>Definitions</header><text>In this section:</text><paragraph id="H56A2D864074B4E669EA76AFB8345EEDA"><enum>(1)</enum><header>Adopted child</header><text>The term <term>adopted child</term> means an individual who is under 21 years of age and was adopted from foster care, through a private placement agency, or from another country.</text></paragraph><paragraph id="HD70FCBCC8B094EE1AA1D8A4AC8C9A725"><enum>(2)</enum><header>Adoption competency</header><text>The term <term>adoption competency</term> means an understanding of—</text><subparagraph id="H9BF5FCB1D8594B99B36267193082323F"><enum>(A)</enum><text>the nature of adoption as a form of family formation and the different types of adoption;</text></subparagraph><subparagraph id="H75031B83A2DA457E978488DBF9EC4B1E"><enum>(B)</enum><text>relevant emotional and physical issues involved in the adoption process, including issues relating to separation, loss, attachment, abuse, trauma, and neglect;</text></subparagraph><subparagraph id="H369329A45E7C4189BD898C69839E4C97"><enum>(C)</enum><text>common developmental challenges associated with adoption;</text></subparagraph><subparagraph id="H024E1157800A4190881557458A46AD72"><enum>(D)</enum><text>the characteristics and skills that allow for successful adoptive families;</text></subparagraph><subparagraph id="H3F256BA950134274885DDCC5DACE70F6"><enum>(E)</enum><text>proper sensitivity with respect to the different geographic, ethnic, or cultural backgrounds of adopted children and adoptive families; and</text></subparagraph><subparagraph id="H7BC1416691C64489AE2E63C7E4CD86E4"><enum>(F)</enum><text>the necessary skills for effectively advocating on behalf of birth and adoptive families.</text></subparagraph></paragraph><paragraph id="H62A87AD50229432495923EB74D5CBD6A"><enum>(3)</enum><header>Post-adoption mental health services</header><text>The term <term>post-adoption mental health services</term> includes—</text><subparagraph id="H4FAB51A09E9745A186343967EA39DA4A"><enum>(A)</enum><text>adoption competent mental health direct services, including training, educational support, counseling, and other services for adoptive parents and families that address caregiver interests and concerns regarding child behavioral issues that are common among adopted children and children in foster care, including, as appropriate—</text><clause id="H64BD4416F4A64F13889F732B15CAB558"><enum>(i)</enum><text>caring for an adopted child with emotional, behavioral, or developmental health needs; and</text></clause><clause id="H74E823FFB0D34D47A404398FC1C667C2"><enum>(ii)</enum><text>providing for the emotional needs of an adopted child, including issues relating to attachment, identity, abandonment, cultural differences, grief, and loss;</text></clause></subparagraph><subparagraph id="H8BA7A867AC2B45BA841089FB453AFB56"><enum>(B)</enum><text>peer-to-peer mentoring and support groups that permit a newly adoptive parent to communicate and learn from more experienced adoptive parents;</text></subparagraph><subparagraph id="H86790226FF1F429D8F616E5884E80E6F"><enum>(C)</enum><text>the provision of informational resources and available services for adoptive parents;</text></subparagraph><subparagraph id="H34CA897F5BE843D982675BE05330F6D6"><enum>(D)</enum><text>direct services, including counseling, peer-to-peer mentoring and support groups, and other services for adopted children that address common behavioral and adjustment issues, including, as appropriate—</text><clause id="H8DF97180B6984807B71CFBEB98733872"><enum>(i)</enum><text>support services for an adopted child with emotional, behavioral, or developmental health needs;</text></clause><clause id="HBCDE2DE5337840D4B84C2DECAFE086FF"><enum>(ii)</enum><text>support services that address the emotional needs of an adopted child, including issues relating to attachment, identity, abandonment, cultural differences, grief, and loss; and</text></clause><clause id="HAA6F4AF6844F4BB39988D9086413758D"><enum>(iii)</enum><text>treatment services that are specialized for adopted children, including psychiatric residential services, outpatient mental health services, social skills training, intensive in-home supervision services, recreational therapy, suicide prevention, and substance abuse treatment;</text></clause></subparagraph><subparagraph id="HBA79A3B6B3C94BBB8F6F4A9AB1FEF2A2"><enum>(E)</enum><text>peer-to-peer mentoring and support groups that allow adopted children to communicate and socialize with other adopted children; and</text></subparagraph><subparagraph id="H5150832D8F7D45F8A568D24325022610"><enum>(F)</enum><text>crisis intervention and family preservation services.</text></subparagraph></paragraph></subsection><subsection id="H5B5A7BE92CC04354B59FD357C9E07CDB"><enum>(h)</enum><header>Funding for post-Adoption mental health services</header><text>From amounts appropriated to carry out titles III, V, or XIX of the Public Health Service Act for each fiscal year, $20,000,000 shall be used by the Secretary in each such fiscal year to fund services and programs authorized under this section.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="HF9AAF9FE60C543A092426E9B0C80A5A3"><enum>4.</enum><header>Data collection on adoption disruption and dissolution</header><subsection id="H994AA6B350F948B9A0ACFD68122B779F"><enum>(a)</enum><header>In general</header><text>Section 479 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/679">42 U.S.C. 679</external-xref>) is amended by adding at the end the following new subsection:</text><quoted-block id="H90A37F3C915B4F81A6925803CA31326C" style="OLC"><subsection id="H601B1ECCB499438AB0ECF6CE98168FCD"><enum>(d)</enum><paragraph commented="no" display-inline="yes-display-inline" id="H69AD1866C53148B591E8691971F2A71A"><enum>(1)</enum><text>Not later than 12 months after the date of enactment of this subsection, the Secretary shall, as part of the data collection system established under this section, promulgate final regulations providing for the collection and analysis of information regarding children who enter into State custody as a result of the disruption of a placement for adoption or the dissolution of an adoption, which shall require States to collect and report—</text><subparagraph id="HDA0F6AB127CA4E37B364E0441AD47A54" indent="up1"><enum>(A)</enum><text>information on children who are adopted within the United States or from other countries and who enter into State custody as a result of the disruption of a placement for adoption or the dissolution of an adoption, including—</text><clause id="HC61199ADF50948EC8DDDA2B01F406DEF"><enum>(i)</enum><text>the number of children who enter into State custody as a result of—</text><subclause id="HB866FD76058B48BCB9B5FE72681BF05C"><enum>(I)</enum><text>the disruption of placement for adoption; or</text></subclause><subclause id="H42E42A6D5A50461A9E803821089059F3"><enum>(II)</enum><text>the dissolution of an adoption; and</text></subclause></clause><clause id="H3FF3D5AC5EB44E029C250F28A4128064"><enum>(ii)</enum><text>for each child identified under clause (i)—</text><subclause id="H1134E4FDAE27433B862B74FAABD02ABD"><enum>(I)</enum><text>as applicable, the country of birth for any child who was not born in the United States;</text></subclause><subclause id="H6682A130A8B8481CA0EC8D067FF3D6FB"><enum>(II)</enum><text>the length of the adoption placement prior to disruption or dissolution;</text></subclause><subclause id="H27503575FA114446AFB6877932D0D6F9"><enum>(III)</enum><text>the age of the child at the time of the disruption or dissolution;</text></subclause><subclause id="H3C4089A53A744872BD1DF120EBDD381E"><enum>(IV)</enum><text>the reason for the disruption or dissolution; and</text></subclause><subclause id="HD7ECDBDB5A4542C79105DD70FC6F182A"><enum>(V)</enum><text>the agencies who handled the placement for adoption; and</text></subclause></clause></subparagraph><subparagraph id="HCB7C0EA9C20C41F5819AB9346523FEF4" indent="up1"><enum>(B)</enum><text>such other information as determined appropriate by the Secretary.</text></subparagraph></paragraph><paragraph id="H379E113D2F5A4825A40916472E435C01" indent="up1"><enum>(2)</enum><text>The regulations shall require a State that reports the information described in paragraph (1) to use the information—</text><subparagraph id="H1B7C999A783E4F06981C7C8C3895BA15"><enum>(A)</enum><text>to consolidate and expand the collection of information on adoption disruption and dissolution;</text></subparagraph><subparagraph id="H910315F9D0324E97A568F3BD624A278C"><enum>(B)</enum><text>to improve research and data collection systems in order to more accurately determine and measure the rates, outcomes, and causes of adoption disruption and dissolution;</text></subparagraph><subparagraph id="HBCFB7592673F4655862A5F4523C42D9A"><enum>(C)</enum><text>to identify pre- and post-adoptive support services (including services described in section 431(a)(8)(B)) that result in lower rates of disruption and dissolution of adoptions;</text></subparagraph><subparagraph id="HEC291A9CDAD34882A67EBE8913A90744"><enum>(D)</enum><text>to develop an understanding of the relationship between the rate of incidence of adoption disruptions and dissolutions and the support services that are provided to adoptive families in order to identify and develop effective evidence-based strategies, programs, and support services that help to prevent adoption disruption and dissolution; and</text></subparagraph><subparagraph id="H662E4E05E3C04CF6BCFDC8971ECF950A"><enum>(E)</enum><text>to develop and enhance training and educational services regarding strategies for prevention of adoption disruption and dissolution.</text></subparagraph></paragraph><paragraph id="H0DE40CF09C8C477289D603D6692AC4E7" indent="up1"><enum>(3)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="H8019D00E6D694C10BEA7603D27CC1832"><enum>(A)</enum><text>Not later than 6 months after the date of enactment of this subsection, the Secretary shall, subject to subparagraph (B), establish an advisory committee to study methods to effectively collect data regarding disruption and dissolution of adoptions that are not included in the data collection system established under this section, including—</text><clause id="H9392B01610594221AFB177C7C3E41D10" indent="up1"><enum>(i)</enum><text>data on children whose adoptions are disrupted or dissolved but do not enter into State custody as a result of such disruption or dissolution;</text></clause><clause id="H0B584E73172842B784F54F3CFDDE3F2C" indent="up1"><enum>(ii)</enum><text>data on adoption displacements, whereby an adopted child is temporarily placed out of the home of an adoptive parent in order to receive medical, mental health, behavioral, or other forms of treatment; and</text></clause><clause id="HB3BD39C8DC264164B707C5EF34FB35E6" indent="up1"><enum>(iii)</enum><text>such other data as determined appropriate by the Secretary.</text></clause></subparagraph><subparagraph id="H6CEA715BC0684E0E82A1297CC879C5A7" indent="up1"><enum>(B)</enum><text>The membership and organization of the advisory committee described in subparagraph (A) shall be determined by the Secretary and shall include—</text><clause id="H29565E94428D43A393829F61B7E74928"><enum>(i)</enum><text>State and child welfare agencies that are engaged in the placement of children for adoption domestically or from other countries;</text></clause><clause id="HAD3DC97235154ED5BD2C06DCBFC2B47C"><enum>(ii)</enum><text>local and national organizations that serve adopted children and children in foster care; and</text></clause><clause id="H19DDB44484684F74A57DBB384C6D24B4"><enum>(iii)</enum><text>members of State and local judiciary and court staff.</text></clause></subparagraph><subparagraph id="HF37F05A1630145BAA18F908D05080071" indent="up1"><enum>(C)</enum><text>Not later than 12 months after establishment of the advisory committee described in subparagraph (A), the Secretary shall submit to the appropriate committees of Congress a report containing recommendations of the advisory committee for improvement of the data collection system established under this section.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HA44DC0B2F113413A93B81E72163AFF9F"><enum>(b)</enum><header>Annual report</header><text>Section 479A of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/679b">42 U.S.C. 679b</external-xref>) is amended—</text><paragraph id="HF96F22BE89EB41BE880A949ECA07B85F"><enum>(1)</enum><text>in paragraph (5), by striking <quote>and</quote> after the semicolon;</text></paragraph><paragraph id="H0ED192A053A0432C801BEA9517D85DDD"><enum>(2)</enum><text>in paragraph (6), by striking the period at the end and inserting <quote>; and</quote>; and</text></paragraph><paragraph id="H9F7A0D0535724CAE87EA6C44FD031A3A"><enum>(3)</enum><text>by adding at the end the following new paragraph:</text><quoted-block id="H8CE089D2E6254CFD8A198411358DB0C9" style="OLC"><paragraph id="HD4D5F6F5BD4C4C4CA30D65C2424D69B1"><enum>(7)</enum><text>include in the report submitted pursuant to paragraph (5) for fiscal year 2013 or any succeeding fiscal year, national and State-by-State data on the numbers and rates of disruptions and dissolutions of adoptions, as collected pursuant to section 479(d)(1).</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section><section id="HE1AE2F1EBB0142E8993343390AA1A0BD"><enum>5.</enum><header>GAO report</header><text display-inline="no-display-inline">Within 1 year after the date of the enactment of this Act, the Comptroller General of the United States shall submit to the Congress a written report on—</text><paragraph id="HB248EE729CCE4AE190950A324050C735"><enum>(1)</enum><text display-inline="yes-display-inline">how children are advertised online for adoption, the number of children so advertised, what happens to children so advertised, the reasons why children are so advertised, and the resources available to the government to combat the advertising;</text></paragraph><paragraph id="HCD71FC6427714031A834B316293641DD"><enum>(2)</enum><text>how home studies of prospective parents vary, depending on whether the adoption is private, domestic, or international;</text></paragraph><paragraph id="H0B00BD3C059C4FA09AF3112C652BD348"><enum>(3)</enum><text>how the type and amount of pre-adoptive training prospective parents receive varies;</text></paragraph><paragraph id="HA53F97751B584A808A0D6476480D9670"><enum>(4)</enum><text>the availability of quality support for families to meet the post-adoption emotional and behavioral challenges faced by children; and</text></paragraph><paragraph id="H01B04776D3D64C24A335077015F926CB"><enum>(5)</enum><text>the reasons for adoption disruptions and dissolutions, and for the sending of adopted children to live with new families without notice to the appropriate authorities.</text></paragraph></section></legis-body></bill>
