R. 3416</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action><action-date date="20131030">October 30, 2013</action-date><action-desc><sponsor name-id="J000174">Mr. Sam Johnson of Texas</sponsor> (for himself and <cosponsor name-id="O000168">Mr. Olson</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HAS00">Committee on Armed Services</committee-name>, and in addition to the Committee on <committee-name committee-id="HGO00">Oversight and Government Reform</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title>To amend titles 5, 10, and 32, United States Code, to require congressional approval before any change may be made to the oaths required for enlistment in the Armed Forces, appointment to an office in the civil service or uniformed services, or appointment as a cadet or midshipman at a military service academy, and for other purposes.</official-title></form><legis-body id="H63D090C11A6E4E459D1D768EAE124B77" style="OLC"><section id="H4696CE47DDDF499996860DDA69FC9246" section-type="section-one"><enum>1.</enum><header>Congressional approval of changes to certain military and civil service oaths</header><subsection id="HECFBAC635D2F40E78DBAF911CB14F124"><enum>(a)</enum><header>Oath of office</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/5/3331">Section 3331</external-xref> of title 5, United States Code, is amended by adding at the end the following new sentence: <quote>The text of the oath required by this section may not be changed except by Act of Congress.</quote>.</text></subsection><subsection id="HAC66F7E5FE8D4DBBA2D1AC5710405353"><enum>(b)</enum><header>Enlistment oath</header><paragraph id="H41453A3709434F89AFA748D1306C35A2"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/10/502">Section 502</external-xref> of title 10, United States Code, is amended by adding at the end the following new subsection:</text><quoted-block display-inline="no-display-inline" id="H4AB674ECF56D4114902C2AA6F0259E31" style="OLC"><subsection id="HC6C14DBD35C64E0DAFF4ADB473C8E815"><enum>(c)</enum><header>Text of oath</header><text display-inline="yes-display-inline">The text of the oath required by this section may not be changed except by Act of Congress.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="H05F2635B3CBB4DAFBDCFBB6DF9445676"><enum>(2)</enum><header>National guard</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/32/304">Section 304</external-xref> of title 32, United States Code, is amended by adding at the end the following new sentence: <quote>The text of the oath required by this section may not be changed except by Act of Congress.</quote>.</text></paragraph></subsection><subsection id="H89F409C774F040069632A948A68DCAA6"><enum>(c)</enum><header>Military service academy oaths</header><paragraph id="H61922C712DB84FD787E41D27805EA004"><enum>(1)</enum><header>United States Military Academy</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/10/4346">Section 4346(d)</external-xref> of title 10, United States Code, is amended by adding at the end the following new sentence: <quote>The text of the oath required by this subsection, and the text of any honor oath required of a cadet, may not be changed except by Act of Congress.</quote>.</text></paragraph><paragraph id="H6D68B01A5C4C48628FB5A881F083AC5D"><enum>(2)</enum><header>United States Naval Academy</header><text>Section 6958(d) of such title is amended by adding at the end the following new sentence: <quote>On and after January 1, 2014, the Secretary may not change the text of the oath required by this subsection, and the text of any honor oath required of a midshipman, without specific authorization in an Act of Congress.</quote>.</text></paragraph><paragraph id="HA8953539CB164B5E909D8EF9B75C4A44"><enum>(3)</enum><header>United States Air Force Academy</header><text display-inline="yes-display-inline">Section 9346(d) of such title is amended by adding at the end the following new sentence: <quote>On and after January 1, 2014, the Secretary may not change the text of the oath required by this subsection, and the text of any honor oath required of a cadet, without specific authorization in an Act of Congress.</quote>.</text></paragraph></subsection></section></legis-body></bill>
