which was referred to the <committee-name committee-id="HPW00">Committee on Transportation and Infrastructure</committee-name>, and in addition to the Committee on <committee-name committee-id="HII00">Natural Resources</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Water Resources Development Act of 2000 with respect to ecosystem restoration in the lower Columbia River and Tillamook Bay estuaries.</official-title></form><legis-body id="H2ABD8A9893D84A2F9710AFB005C1D02A" style="OLC"><section id="HA4B0776AD6044133A495C476A2888B04" section-type="section-one"><enum>1.</enum><header> Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Fundamentally Improving Salmon Habitat Act</short-title></quote> or the <quote><short-title>FISH Act</short-title></quote>.</text></section><section id="H1A1021E956484B75A13F031DBBFD5FFA"><enum>2.</enum><header>Lower Columbia River and Tillamook Bay ecosystem restoration, Oregon and Washington</header><text display-inline="no-display-inline">Section 536 of the Water Resources Development Act of 2000 (114 Stat. 2661) is amended as follows:</text><paragraph id="H3FF3481B21D5402689BD601A6869DAE3"><enum>(1)</enum><text>By amending subsection (a) to read as follows:</text><quoted-block display-inline="no-display-inline" id="HA07F85C8F87042E3A939753476DE5E5F" style="OLC"><subsection id="HDA7480CEEEFC44F99B0A1FAEDB8C48AA"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary shall, for the lower Columbia River and Tillamook Bay estuaries, Oregon and Washington—</text><paragraph commented="no" id="HC7B58BB8B0734B62BD01CA5BFF0BCA69"><enum>(1)</enum><text>conduct ecosystem restoration projects with total costs of $2,000,000 or greater per project, and studies relating to such projects; and</text></paragraph><paragraph id="H007653FEE0144589AF853427310D3237"><enum>(2)</enum><text display-inline="yes-display-inline">in accordance with an allocation plan submitted under subsection (h)(1), provide grants for ecosystem restoration projects with total costs of less than $2,000,000 per project—</text><subparagraph id="H42963E6C44F04445A5D27235184D4A77"><enum>(A)</enum><text display-inline="yes-display-inline">in the case of projects for the lower Columbia River estuary, except as provided in subparagraph (B), to the Lower Columbia Estuary Partnership;</text></subparagraph><subparagraph commented="no" id="HCD8A37E251D040D1A345342BCD4782E5"><enum>(B)</enum><text>in the case of projects for the lower Columbia River mainstem tributaries in Washington, to the Lower Columbia Fish Recovery Board; and</text></subparagraph><subparagraph id="HEFCA543B77D4413AAC60DB465109D233"><enum>(C)</enum><text>in the case of projects for the Tillamook Bay estuary, to the Tillamook Estuaries Partnership.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="H6A6F8B80DCAB4769993870E3CA6F2B67"><enum>(2)</enum><text>In subsection (b)—</text><subparagraph id="H049391322D064BD883E13AFD0F1E8610"><enum>(A)</enum><text>by amending paragraph (1)(A) to read as follows:</text><quoted-block display-inline="no-display-inline" id="H825C72E07F6A496982A5E3DA1B8F4CB7" style="OLC"><subparagraph commented="no" id="HE24EA6BF89384D74BBDE3442A125CA3E"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">In carrying out, or providing grants for, ecosystem restoration projects for the lower Columbia River estuary under this section, the Secretary shall use as a guide, or ensure such use of—</text><clause id="H126E4E693C984C51958E1442ABC8DA88"><enum>(i)</enum><text display-inline="yes-display-inline">the comprehensive conservation and management plan developed by the Lower Columbia Estuary Partnership under section 320 of the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1330">33 U.S.C. 1330</external-xref>); and</text></clause><clause id="H13952005A15749019FD5113D621C72F9"><enum>(ii)</enum><text display-inline="yes-display-inline">except in the case of projects for the lower Columbia River mainstem tributaries, the lower Columbia River recovery plans developed under, and the Columbia River estuary recovery plan module developed pursuant to, section 4 of the Endangered Species Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1533">16 U.S.C. 1533</external-xref>).</text></clause></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph><subparagraph id="H94832C021E284101B984BA3E91A3A52F"><enum>(B)</enum><text>in paragraph (1)(B)—</text><clause id="HFDAD40F45CF041749D51BC1FCB86E8F4"><enum>(i)</enum><text>by striking <quote><short-title>The Secretary</short-title></quote> and inserting the following:</text><quoted-block display-inline="no-display-inline" id="HE25857ACD3B340909EB447815FC630D1" style="OLC"><clause id="HF70B66D72EF04475906DEFA934BD6CA7"><enum>(i)</enum><header>Large projects</header><text display-inline="yes-display-inline">The Secretary</text></clause><after-quoted-block>;</after-quoted-block></quoted-block></clause><clause commented="no" id="H8D1C7CFE7B494EEB8C1F51411EE15CD4"><enum>(ii)</enum><text>by striking <quote>and the Forest Service</quote> and inserting <quote>the Forest Service, the Lower Columbia Estuary Partnership, and, as applicable, the Lower Columbia Fish Recovery Board</quote>; and</text></clause><clause id="H0C9B063AFD1F4135BB0CC4FE01575D2B"><enum>(iii)</enum><text>by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="H929097973A6C41EA94CE83C24DBA4576" style="OLC"><clause commented="no" id="HF083F762052E4FF3A2185B92F31FC673"><enum>(ii)</enum><header>Small projects</header><text display-inline="yes-display-inline">The Secretary shall ensure that ecosystem restoration projects for the lower Columbia River estuary carried out by the Lower Columbia Estuary Partnership or the Lower Columbia Fish Recovery Board using grants provided under this section are carried out in consultation with the Governors of the States of Oregon and Washington, as applicable, and the heads of appropriate Indian tribes, the Environmental Protection Agency, the United States Fish and Wildlife Service, the National Marine Fisheries Service, and the Forest Service.</text></clause><after-quoted-block>;</after-quoted-block></quoted-block></clause></subparagraph><subparagraph id="HB5CC2F8E2A9F4760A34C925208B810F5"><enum>(C)</enum><text>by amending paragraph (2)(A) to read as follows:</text><quoted-block display-inline="no-display-inline" id="HA4622D0C5961407CABFBA885E0180A16" style="OLC"><subparagraph id="H6859F2BBD6C148189777B5D36A106BD1"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">In carrying out, or providing grants for, ecosystem restoration projects for the Tillamook Bay estuary under this section, the Secretary shall use as a guide, or ensure such use of, the comprehensive conservation and management plan developed by the Tillamook Estuaries Partnership under section 320 of the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1330">33 U.S.C. 1330</external-xref>).</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph><subparagraph display-inline="no-display-inline" id="H33DE880727784D4CBE7447EC1C1961CC"><enum>(D)</enum><text>in paragraph (2)(B)—</text><clause id="HC161FC4147A84D579988C85155CD3223"><enum>(i)</enum><text>by striking <quote>The Secretary</quote> and inserting the following:</text><quoted-block display-inline="no-display-inline" id="HC1F82CADB02B4E8BBA36F45DADE64AB6" style="OLC"><clause id="H5E94DC7C69724B93836FD2BF751B6DD7"><enum>(i)</enum><header>Large projects</header><text display-inline="yes-display-inline">The Secretary</text></clause><after-quoted-block>;</after-quoted-block></quoted-block></clause><clause id="HAACDAC8706E54379BCD6525F0242B629"><enum>(ii)</enum><text>by striking <quote>and the Forest Service</quote> and inserting <quote>the Forest Service, and the Tillamook Estuaries Partnership</quote>; and</text></clause><clause id="H7493E1FBE23A4FA5B23A214062D01D70"><enum>(iii)</enum><text>by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="H6F97CB671E064F1DB142A869C36AB65A" style="OLC"><clause id="H79EDBF110BD74C86AF1772146CDEC8F5"><enum>(ii)</enum><header>Small projects</header><text display-inline="yes-display-inline">The Secretary shall ensure that ecosystem restoration projects for the Tillamook Bay estuary carried out by the Tillamook Estuaries Partnership using grants provided under this section are carried out in consultation with the Governor of the State of Oregon and the heads of appropriate Indian tribes, the Environmental Protection Agency, the United States Fish and Wildlife Service, the National Marine Fisheries Service, and the Forest Service.</text></clause><after-quoted-block>.</after-quoted-block></quoted-block></clause></subparagraph></paragraph><paragraph id="H10641C1A3E214179915C802336BCF437"><enum>(3)</enum><text>In subsection (c)—</text><subparagraph id="H4B2FD3A2577B470195025ED6A7EB157C"><enum>(A)</enum><text>in paragraph (1)—</text><clause id="H215E2546CF1643609FFD94A253A5A2D9"><enum>(i)</enum><text>by striking <quote>In carrying out</quote> and inserting the following:</text><quoted-block display-inline="no-display-inline" id="H595BAA48076C4341A43599E115AE244E" style="OLC"><subparagraph id="H0EF3DEAE907F4D0CBC5B5023D1D9BB00"><enum>(A)</enum><header>Large projects</header><text display-inline="yes-display-inline">In carrying out</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></clause><clause id="H1C03F93FF4184320855E1A7CDA59E878"><enum>(ii)</enum><text>by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="H4F6E574DCCAE43E298018DE54691DCC7" style="OLC"><subparagraph id="H86DAFFA2A974401A9F5FCD7D22F311A3"><enum>(B)</enum><header>Small projects</header><text display-inline="yes-display-inline">In providing grants to carry out ecosystem restoration projects under this section, the Secretary shall provide funding and technical assistance to each lead entity for activities necessary to protect, monitor, and restore fish and wildlife habitat.</text></subparagraph><after-quoted-block>; </after-quoted-block></quoted-block></clause></subparagraph><subparagraph id="H4150504E2628435886B26838504C304C"><enum>(B)</enum><text>in paragraph (2)—</text><clause id="H01FB4718F1954DD9B798C22A6FEDD418"><enum>(i)</enum><text display-inline="yes-display-inline">in the matter preceding subparagraph (A), by inserting <quote>, or provide grants for,</quote> after <quote>carry out</quote>;</text></clause><clause id="H7D727115125D4DBD8C382E426090253F"><enum>(ii)</enum><text>in subparagraph (A)—</text><subclause id="HACBF46F1CB1A4778BD22975777B90ED0"><enum>(I)</enum><text>by inserting <quote>fish and wildlife habitat,</quote> before <quote>navigation</quote>; and</text></subclause><subclause id="HA25A9BD0E5574D679554377D290B3FD8"><enum>(II)</enum><text>by striking <quote>; or</quote> and inserting a semicolon;</text></subclause></clause><clause id="HBF5366CC9504473ABCCEDDCE308A420E"><enum>(iii)</enum><text display-inline="yes-display-inline">in subparagraph (B), by striking the period at the end and inserting <quote>; or</quote>; and</text></clause><clause id="H127713FFC871454995601A5581B930D2"><enum>(iv)</enum><text>by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="HDEBCDB2B62D94F36AF86DF6E7FBF9A42" style="OLC"><subparagraph id="HFADBD21FB11F430E8F9E3B0A7DEAEF40"><enum>(C)</enum><text display-inline="yes-display-inline">drinking water.</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></clause></subparagraph><subparagraph id="HBF6049D8B9814520B4E70DA73E9BD892"><enum>(C)</enum><text>by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="HB338137A53284BAE8263F6619C6E4E07" style="OLC"><paragraph commented="no" id="H1104436117314ADA9F0DB126084443D0"><enum>(3)</enum><header>Easements</header><text display-inline="yes-display-inline">A project carried out, or for which a grant is provided, under this section may be carried out on private property through the use of an easement.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="HC1F12FBBB4134709873F75B29BD4714C"><enum>(4)</enum><text>By amending subsection (d) to read as follows:</text><quoted-block display-inline="no-display-inline" id="HB321B82B73684425BAD0716FB8F0213C" style="OLC"><subsection id="H804D030B91054DAC8E77B4086AF5A5FD"><enum>(d)</enum><header>Priority</header><text display-inline="yes-display-inline">In determining the priority of projects to be carried out under this section—</text><paragraph id="HE923ECCA9F0340E686A0097D67120C29"><enum>(1)</enum><text>for projects carried out by the Secretary, the Secretary shall consult with the applicable lead entities, and shall consider the recommendations of such entities; and</text></paragraph><paragraph id="H2B6F5A51DCA345DB93D41B6C4293440A"><enum>(2)</enum><text display-inline="yes-display-inline">the lead entities shall follow priorities set in the comprehensive conservation and management plans and the recovery plans and module described in subsection (b), as applicable.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="H45E03D6CBD8B4370947F020F27F1E797"><enum>(5)</enum><text>In subsection (e)—</text><subparagraph id="H89A79CB3C52F4881B71E80E9134A965F"><enum>(A)</enum><text>in paragraph (2)(A)—</text><clause id="HD6B5A16C5437499F87D676357727529F"><enum>(i)</enum><text>by striking <quote>Non-Federal interests</quote> and inserting the following:</text><quoted-block display-inline="no-display-inline" id="H98CA4B3E530149C4B2CC61E41286B5B6" style="OLC"><clause id="HB8DD3374485E4FEF9521D18941F32E32"><enum>(i)</enum><header>Large projects</header><text display-inline="yes-display-inline">Non-Federal interests</text></clause><after-quoted-block>; </after-quoted-block></quoted-block></clause><clause id="HBD0C8E8C69504675B09C5A9E0A0C008A"><enum>(ii)</enum><text>by inserting <quote>by the Secretary</quote> after <quote>carried out</quote>; and</text></clause><clause id="H88DE509CA0E748E299F6E5291AE3DB58"><enum>(iii)</enum><text>by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="H8A30823920A144A0BE391CA1741D30D2" style="OLC"><clause id="H3FECB85CF700452091014D10BF279843"><enum>(ii)</enum><header>Small projects</header><text display-inline="yes-display-inline">The Federal share of the cost of any project carried out using funds from a grant provided to a lead entity under this section—</text><subclause id="H073C774866B245B8BEBB46DF11745149"><enum>(I)</enum><text>shall not exceed 75 percent of the total cost of the project; and</text></subclause><subclause id="HB0C5504D3ED548869440DE2C7499B99D"><enum>(II)</enum><text>shall be made on condition that the non-Federal share of that total cost shall be provided from non-Federal sources.</text></subclause></clause><after-quoted-block>; and</after-quoted-block></quoted-block></clause></subparagraph><subparagraph id="HE77A4F43A4D847BAB7724290E908521F"><enum>(B)</enum><text>in paragraphs (3) and (4), by inserting <quote>by the Secretary, or using funds provided,</quote> after <quote>carried out</quote> each place it appears.</text></subparagraph></paragraph><paragraph id="HC5A7CFE95F4B4D788F3394CAD225E9E3"><enum>(6)</enum><text>By redesignating subsections (f) and (g) as subsections (g) and (h), respectively, and inserting after subsection (e) the following:</text><quoted-block display-inline="no-display-inline" id="HFF6A2D733F51479E8233AC01F0539384" style="OLC"><subsection commented="no" id="HF57D5CF677E8430BADE2036A3FF637FB"><enum>(f)</enum><header>Annual allocations</header><paragraph commented="no" id="HB5989B3709244F179B80737A2136B3BD"><enum>(1)</enum><header>Allocation plans</header><text>For each fiscal year, the lead entities shall jointly submit to the Secretary a plan to allocate among the lead entities funding available for the fiscal year under subsection (h)(2)(B).</text></paragraph><paragraph commented="no" id="HE796184C838C45F68F8B6601AA7894A2"><enum>(2)</enum><header>Reports</header><text>Each lead entity shall report annually to the Secretary on the use of funds provided to the entity by a grant under this section.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="HCEB8E9B580D147889657B9205DCDCC67"><enum>(7)</enum><text>In subsection (g) (as redesignated by paragraph (6))—</text><subparagraph id="HC4D14525AC1C4B9FA887C72EB59059E2"><enum>(A)</enum><text>by redesignating paragraphs (1) and (2) as paragraphs (2) and (4), respectively;</text></subparagraph><subparagraph id="HC169943F6FCF45D0924B507FA2C4A1F6"><enum>(B)</enum><text>by inserting before paragraph (2) (as so redesignated) the following:</text><quoted-block display-inline="no-display-inline" id="HA83EB55B3CA24D3681F005FCEA6033A7" style="OLC"><paragraph id="H0E5AD914188D410AB160A1257100BDF3"><enum>(1)</enum><header>Lead entity</header><text>The term <term>lead entity</term> means the Lower Columbia Estuary Partnership, the Tillamook Estuaries Partnership, or the Lower Columbia Fish Recovery Board.</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph><subparagraph id="HACF445ED6A944728AF4D0285B8D6EC2F"><enum>(C)</enum><text>by inserting after paragraph (2) (as so redesignated) the following:</text><quoted-block display-inline="no-display-inline" id="H5F78C59C46914E8194351726623B1D39" style="OLC"><paragraph id="H3D6F2673D7364DE89052CA371D2E6635"><enum>(3)</enum><header>Lower Columbia River mainstem tributaries</header><text>The term <term>lower Columbia River mainstem tributaries</term> means those mainstem tributaries, exclusive of sub-tributaries, of the Columbia River west of Bonneville Dam.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="H5FF692443F7E436EBE563505796AC328"><enum>(8)</enum><text>In subsection (h) (as redesignated by paragraph (6))—</text><subparagraph id="HE17A0BCA73494C418E4FCF79AD44C431"><enum>(A)</enum><text>by striking <quote>There is authorized</quote> and inserting the following:</text><quoted-block display-inline="no-display-inline" id="H4DEC4623F6E1451E882E904791721245" style="OLC"><paragraph id="HC3F95E4DBD764CE1B1EB65CE452D564F"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">There is authorized</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph><subparagraph id="H97732F1DA0DE4338AC6D63F0FBB57448"><enum>(B)</enum><text>by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="H7E223A766CC24F51BE45D1EEE8EAC055" style="OLC"><paragraph commented="no" id="H27F2C68891244B86A6430D957612A6EA"><enum>(2)</enum><header>Project funding ratio</header><text display-inline="yes-display-inline">Of the funds appropriated under this subsection for each fiscal year, beginning on the date of enactment of this paragraph, the Secretary shall use—</text><subparagraph commented="no" id="H2F019D3C74574D5EB5D12B961159916E"><enum>(A)</enum><text>75 percent for activities described in subsection (a)(1); and</text></subparagraph><subparagraph commented="no" id="H00804E161BCC4D8097CDD4ACE6BC1E25"><enum>(B)</enum><text>25 percent for activities described in subsection (a)(2).</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></section></legis-body></bill>
