<official-title>To improve the Fair Debt Collection Practices Act by explicitly barring debt collectors from bringing legal action on a debt in which the statute of limitations has expired against any consumer, and for other purposes.</official-title>

<section id="HA601859C9AB94698A2989BE50B7B9C76" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Fair Debt Collection Improvement Act</short-title></quote>.</text></section> 
<section id="H372C6E6DBA484EAD853F5AF8A91BF1B4"><enum>2.</enum><header>Collection of time-barred debt</header> 
<subsection id="H1338A8E7D9A447558613706744BC0CD7"><enum>(a)</enum><header>Legal actions on time-Barred debt</header><text display-inline="yes-display-inline">Section 811 of the Fair Debt Collection Practices Act (<external-xref legal-doc="usc" parsable-cite="usc/15/1692i">15 U.S.C. 1692i</external-xref>) is amended by adding at the end the following:</text> 
<quoted-block display-inline="no-display-inline" id="H36B17326F1AE452B8A7BC3D5E709D8F3" style="OLC"> 
<subsection id="HE2F9CE1BA4D64F6A9238D251570A603C"><enum>(c)</enum><text display-inline="yes-display-inline">A debt collector may not bring, or threaten to bring, legal action against any consumer on a debt in which the statute of limitations has expired.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H94179FCE7AC048EAA98C6091975DAD79"><enum>(b)</enum><header>Communication with consumers with time-Barred debt</header><text>Section 805 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/15/1692c">15 U.S.C. 1692c</external-xref>) is amended—</text> 
<paragraph id="H6318BBB58EFC490FB1DA189CE72B98A0"><enum>(1)</enum><text>by redesignating subsection (d) as subsection (e); and</text></paragraph> 
<paragraph id="HCC21AE797E2540599AB20F7417EF733A"><enum>(2)</enum><text>by inserting after subsection (c) the following:</text>

<subsection id="H06D75A21CF554C2081CE0B7CE3767280"><enum>(d)</enum><header>Communication with consumers with time-Barred debt</header><text display-inline="yes-display-inline">In connection with the collection of debt in which the statute of limitations has expired, a debt collector shall disclose to a consumer the following:</text> 
<paragraph id="HB2F6AC9EB4D245E58AB3A8DFDA788E4B"><enum>(1)</enum><text>The debt has been transferred to the debt collector.</text></paragraph> 
<paragraph id="H1E18438318B14A7BAD583BBF4AC4B9E3"><enum>(2)</enum><text>The creditor no longer holds the debt.</text></paragraph> 
<paragraph id="H91123B4CA4AE409D910D93AE9EF7FE95"><enum>(3)</enum><text display-inline="yes-display-inline">As a result of the expiration of the statute of limitations with respect to such debt, the debt collector may not bring legal action against the consumer to collect such debt.</text></paragraph> 
<paragraph id="H90D741EBF9ED40EBA84ABCF7996C7589"><enum>(4)</enum><text>Any payment by the consumer towards the debt may cause the statute of limitations for such debt to reset.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section>
